BOARD OF ADJQSTMENT STAFF REPORT CASE NO. WA-95-1/ PAGE 2 REQD'EST This request is for approval of an interpretation of the Wheat Ridge Zoning Ordinance's definition of a roof sign. The owner of the property has erected a sign located on the roof at 4892 Marshall Street. The applicant has stated that the sign is located oa the roof, however the sign is not attached to the roof. The applicant states that the sign is being supported by two poles placed through the top of the roof and anchored to the floor inside of the building. (See Exhibit A) The sign was brought to Code Enforcement's attention by a complaint. After investigating, it was found that the applicant did not obtain a building permit to erect the sign. A warning notice was issued citing Sections 26-406: Sign permit required and 26-409(9): Roof signs are prohibited. After receiving the warning notice the applicant applied for a building permit, permit was denied because staff concludes that the sign is a roof sign and thus prohibited. The applicant has appealed that decision to the Board of Adjustment. Relating to the building permit, the applicant has submitted a drawing showing the structuring of the sign. According to the building department, this sign cannot be approved as constructed. The building department would require the applicant to submit an engineering study to confim that the structure (building, roof and sign) would adequately hold the loads imposed oa it. (See Exhibit 8) II. ZONING INTERPRETATION The Zoning Ordinance's definition of a roof sign found in Section 26-402 is "A sign erected, constructed and maintained above the eaves and attached to the roof of the building. Roof signs are specifically prohibited." The Zoning Ordinance's definition of a free standing sign found is Section 26-402 is "A sign that is permanent and self- supporting, being nondependent on support from a building or other structure, including signs placed upon fences or nonsupporting walls. BOARD OF ADJUSTMENT STAFF REPORT CASE NO. WA-95-1/ PAGE 3 III. STAFF'S CONCLIISION It is staff's opinion that the sign in question is attached to and being supported by the roof. Even if the poles supporting the sign. go through the roof, the poles must be sealed to the roof to prevent leakage. All pertinent documents were entered into record, which Chairman JUNKER accepted. Boazd Member HOWARD wanted to know if the opening on the right is a gazage door opening, and.Ms. Ellis answered yes, and upon showing the slides again said there is a window directly underneath the sign and a door to the right of that. The garage door is actually in the center of the building. Board Member HOWARD asked what kind of sign is above the door,;and Ms. Ellis answered it is an illegal wall sign. Boazd Member ROSSILLON asked if the sign in question is in compliance as faz as the size, and Ms. Ellis replied yes, however, staff feels it is a roof sign because it is attached to the roof. Boazd Member HOWARD said the property is allowed to have some kind of a sign so what size would that be legally, and Ms. Reckert answered it would be based on the squaze footage of the building, but generally they would be allowed to have a 35 squaze foot, double faced, free standing sign, and they might even be allowed to go lazger than that. They are also allowed wall signs_based on the lineaz footage of the building. Boazd Member WALKER asked if the taller structure to the right is part of the applicant's building, and Ms. Ellis answered no. No further questions were asked of staff. Mr. Bartels said he thought that his secretary had pulled the permit for this sign. When he called and talked to an inspector he was told the sign would be okay. The sign is supported by 4 x 4 - 1/4 inch steel poles. They were originally going to mount the poles on the outside of the building but because their building sets directly on the property line, they felt it was more appropriate to put them on the inside of the building. The sign has been up for seven months and they have not had any problems with it at all. Mr. Bartels added the sign is more supported by the cinderblock wall than by the roof, and be wants an interpretation as to whether this is a roof sign or a pole sign. Boazd Member WALKER asked on their penetration through the roof, is that just a hole in the roof with tar around it or is there an actual roof jack coming up through , and Mr. Bartels answered they fabricated a soddered cap that goes up the parapet and brought down to the decking and roughed in with tar and gravel. Boazd Member ABBOTT feels the City has a weak azgument that the roof actually supports the sign and the flashing does not support the sign. The intent of the code in prohibiting roof signs has to do a lot more with the visual aspect than it does how it is supported. Board Member ABBOTT asked Ms. Reckert what the intent is of the City in prohibiting roof signs and if the appellant was to have placed these poles outside the building and up against the wall, kind of like a billboazd, would this still be a roof sign or pole sign. Ms. Reckert said then that would be a free standing sign, not depending on any building or stricture. The intent behind the prohibition of roof signs is aesthetics and also there is some concern with safety (wind and snow load, etc). Discussion followed on building department requirements. Susan Ellis said part of the interpretation here is not only that the sign is attached to the roof, but under the defimition of a roof sign is also erected, constructed and maintained above the eaves. Ms. Reckert added that staff has concluded this is a roof sign. Board Member HOWARD asked the applicant when he decided to advertise the business why was the sign put in this location instead of a free standing sign out in front of the building, and Mr. Bartels said one reason is their parking and also when he called down to the City they said the sign has to face your address which is on Mazshall Street. Mr. Bariunek continued saying on the curve it becomes Mazshall Street and if they placed the sign the way the building is angled they would not be directly facing Marshall Street, but more toward the corner . Another reason is because It can be secured better right next to the building, not at all relying on the roof. The roof is not supporting any part of that sign at all. Mr. Bartels is not quite cleaz on the definition of a roof sign, the poles were the whole_intent of getting the sign up,in the air and supported freely. WHEAT RIDGE BOARD OF ADJUSTMENT MINUTES OF MEETING: February 23, 1995 Page 4 Ms. Reckert wanted to make it known that any interpretation is applied City wide. In most of the commercial zones, there is a height limitation of 50 feet so that is another reason for roof signs not being allowed. Boazd Member WALKER asked the applicant to clarify if he said putting the poles on the outside of the building would be encroaching on the property line, and Mr. Bartels answered yes, if they placed the sign on the outside of the building they would not be facing Marshall Street and they would be on the adjacent property. Board Member HOWARD asked if roof Signs aze legal or illegal, and Ms. Reckert replied illegal. Any sign that is on the roof of a building is illegal. Board Member ABBOTT said the problem the Boazd has is it is hard to consider an interpretation being City wide, but the alternative would be to have come in and ask for a variance for an illegal roof sign. That allows the Board a lot more flexibility to consider hardships such as property line. Boazd Member ABBOTT asked why did staff decide to go for an interpretation instead of a variance of an illegal roof sign,. and Ms. Ellis said staff did not direct the applicant which way to go, all options are explained, but the applicant would have to decide on which option to choose. Steve Bartunek, part owner of the business, 6050 W. 83rd Place, Arvada, CO, was sworn in. Mr. Bartunek said there were several plans discussed when this sign was being designed. They could not put the sign any further to the left because the property line is the actual edge of their building,. They lined the sign up so it can be serviced and maintained without getting on the roof at all and Mr. Bartunek showed how the top of the sign lined up with the face of the building. The applicants had an engineer friend do the calculations and helped design the sign and he assured them there should be no problems. The sign is so close_to the face of the building it is not above the roof, but above the pazapet and hangs out over the front of the pazapet on the right hand side. You can actually stand on the parapet and service the sign. They shifted the sign to the right to keep the sign on their property and still face the street frontage. Mr. Bartunek said they have spent both a great deal of money and a great deal of time. He said he also assumed the permit was pulled by the office. Mr. Bartunek said the only stress from the sign poles is on the floor which is 12 inches of concrete. Board Member WALKER questioned Exhibit 'A' showing the poles right up to the roof line, and Mr. Baztunek said the drawing he has is much more correct Ms. Ellis said the Building department is more concerned with the windload and snowload than the Zoning department and they would require the applicant to submit an engineering study to confirm that the structure would adequately hold the load imposed WHEAT RIDGE BOARD OF ADJUSTMENT MINUTES OF MEETING: February 23, 1995 Page 5 on it. The Zoning department does say they want an approved building permit. Ms. Ellis said as far as the sign being completely independent of the roof asked Mr. Bartunek why he and he replied that is not the roof but rather an independent wall, not even part of the roof. That is about the strongest support you will find on that property attached the sign to a solid brick block wall with poured concrete through the cinderblocks. The engineer suggested it be constructed that way_and nothing would happen with 120 miles an hour wind. It is also bolted with bolts and lead anchors drilled into 12 inch concrete slabs, and the concrete in the floor is well set up. Board Member ROSSILLON said he has a problem with this because it does not meet the requirements of the free-standing sign. The support from the parapet wall is what keeps the sign from falling over and once that was done, it was no longer a free- standing sign. Ms. Ellis said there is confusion as to how the sign had to be placed as far as parallel with the street frontage.. The sign can be perpendicular to the building, but it has to be erected on the front portion of the building. , Board Member ROSSILLON said this is a situation that should never have happened, and Ms. Ellis agreed, saying if they had pulled a permit to be reviewed it would not have, but unfortunately that did not occur before the sign went up. Mr. Bartunek said there has been a communication problem. They would like to go ahead and get a letter from the engineer and submit it to the Building department, .maybe ask for a vaziance and somehow meet in the middle for sort of agreement. He said this will cost them a lot of money to redo all of this. They thought they were doing this right and did not think there was a problem at all. Ms. Reckert added there is a hesitation for approval because it is applicable on a City wide basis, but perhaps if the applicant would change this request to a variance to allow a roof sign and continue and approach the Board with that. Boazd Member ROSSILLON said the way it stands right now, he would vote it a roof sign, but feels they are putting the applicant in a situation that will cost him a lot. Board Member ABBOTT said he would like to make a motion as to whether they think this interpretation is and if the, determination goes against the appellant then someone could make a motion to heaz this again under a different approach next month, and the appellant would not have to pay a double fee. Boazd Member ABBOTT said he would like to make a motion as to whether this criteria outlined here tonight is significant as to interpreting the code. Discussion followed. Mr. Bartunek said he did want to push very hazd to prove this sign is not on the roof. WHEAT RIDGE BOARD OF ADJUSTMENT MINUTES OF MEETING: February 23, 1995 Page 6 Boazd Member WALKER questioned if 35 square feet sign is legal, and Ms. Reckert said she has not measured the building. The present sign is a little over 70 square feet. Mr. Bartunek thought the building is about 7-8 thousand square feet. Ms. Reckert added she doubted if this building is that large, but for a seven thousand squaze foot building, they could start at 100 square feet of signage and she thinks they are okay as faz as size goes. Chairman JCTNKER informed the applicant that he would have to have four positive votes in order for this to pass. Motion was made by Board Member ABBOTT that Case No. WA-95-1, an application by B and B Heating, is interpreted as follows: It is the decision of the Boazd that the sign in question, as to intent of the ordinance, is a roof sign for the following reasons: 1. The sign is constructed, erected and maintained above the eaves. 2. The sign does not appear to meet the definition of a free standing sign as it is dependant upon the structure for support at the floor and pazapet. 3. Engineering arguments presented may not logically be applied City wide and enforcement of this ordinance. 4. The appellants' hardships and rationale were not persuasive enough in logic or general enough in body and context as to be applicable in scope or easily enforceable by the City as to allow an interpretation of language. applicable to all structures and occupancies within the City. Motion was seconded by Board Member HOWARD. Motion carried 5-0. Resolution attached. Chairman 7UNKER informed the applicant he could re-apply for a variance and then all hardships could be taken into consideration on that specific sign.. Board Member ROSSILLON moved the applicant be allowed to re-apply for a variance for the sign and permitted to do so without the usual fee. Motion was seconded by Board Member WALKER and carried 5-0.
