Dear Glen;
As the property owner of 3880 Pierson Street, Wheat Ridge I am
filing a formal protest of administrative variances that are
proposed for 3860 Pierson Street.
While I am objecting to the variance requested for the north and
the south .side of the property, after executing an agreement with
the property owner on site development issues I will withdraw my
objection to the variance requested for the south side.

In an agreement dated May 30, 1995, I have resolved site
development issues with the owner of 3860 Pierson Street. In our
agreement we have stipulated to an acceptable setback for the
proposed structure and a drainage plan that will direcft flows from
the roof drains and surface drainage to the west and to the south.
In exchange for the site considerations I have agreed to drop my
objection to the administrative variance requested for the south
side of 3860 Pierson Street.

This is to inform you that Case No. WA-95-18 is a request for an
Administrative Approval for a 3 foot and a 1 foot sideyard variance
for a property located at 3860 Pierson Street.
The applicant is requesting an adminstrative variance review which
allows no mre than a ten percent (10%) variance to be granted by
the Zoning Administrator without need for a public hearing. Prior
to the rendering of a decision, all adjacent property owners are
required to be notified of the request by certified letter.

RE: Findings & Conclusions
DATE: June 2, 1995-
FINDINGS•
1. Joel Palmer has applied for side yard setback variances as
follows:
A. North Side yard - 14 feet where 15 feet is required,
resulting in a one foot variance
B. South ide yard - 27 feet where 30 feet is required,
resulting in a three foot variance
2. Posting and letter notification has properly occurred.
3. The adjacent property owner to the north has submitted a
protest to part of the "A" variance request, but has
negotiated an agreement relating to the part "B" variance
request and is therefore not protesting the part "B"
variance. No other protests have been received.
CONCLUSIONS:
1. The-part "A" variance cannot be issued administratively
pursuant to Wheat Ridge Code Sec. 26-6(D)(2)(a) because a
protest has been filed. The applicant concedes this
variance request and will not appeal to the Board of
Adjustment.
2. The part "B" variance can be, and is, approved because the
requirements for minor variances pursuant to Sec. 26-
6(D)(2)(a) have been met.
