BOARD OF ADJUSTMENT STAFF REPORT CASE N0. WA-95-28 I. REQUEST This request is for the approval of a variance to allow a 2 yard dumpster on a residential single family lot as long as it is needed. The applicant has requested this dumpster for the purpose of disposing of household trash generated by a-large eight (8) member household. The dumpster was brought to code enforcement's attention through a complaint. The owner was issued a Notice of Violation of the dumpster. ordinance. The applicant has requested a variance to allow it to remain on the property. II. EXISTING ORDINANCES Pursuant to Section 2b-30-(R) bf the Wheat Ridge Municipal Code, One and Two family dwellings and accessory uses, except for temporary construction purposes, shall not be permitted to --- maintain large trash dumpsters one (1) cubic yard or larger, as such dumpsters are of size and type normally associated with commercial uses. III. CRITERIA 1. Can the property in question yield a reasonable return in use,. service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located. Yes, the property is currently being used as a single family residence. 2. Is the plight of the owner due to unique circumstances.- Possibly, a family with two adults and 6 children residing in one household is somewhat unusual for todays standards. 3. If the variance were granted, would it alter the essential character of the locality. Staff feels this request could alter the essential character of the locality if the variance were granted and the staff recommendations are not followed, as such dumpsters are of the size and type normally associated with commercial uses not residential/single family neighborhoods. Would the particular physical surrounding, shape or typographical condition of_the specific property involved result in a particular hardship upon the owner, as distinguished from a mere inconvenience, if the strict letter of_the regulations were carried out. No, the property is of normal character for the neighborhood. 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to the other property within the same zoning classification. Yes, staff has other property owners waiting for such a variance to be approved so they ,will have a good basis and precedent to request approval of their dumpster. 6. Is the purpose of the variation based exclusively upon a desire to make money out of the property. No, there is no economic motivation for this request. 7: Has the alleged 'difficulty or hardship been created by any person presently having an interest in the property. No 8. Would the granting of the variation be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located. No, however it may set a precedent. 9. would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood. No, however it could negatively affect the residential character of the neighborhood. BOARD OF ADJUSTMENT STAFF REPORT CASE NO. WA-95-28 IV. RECOMMENDATIONS If the requested variance is approved, staff recommends the following: 1. The dumpster must be-place behind the front setback of the home. 2. The dumpster must be enclosed by a six(6) foot decorative wall or fence so as to be screen from view from all adjacent properties. 3. The dumpster must be maintained in a clean, safe and healthy manner. 4. The dumpster must be emptied on a regular or weekly basis. 5. Said property is zoned Residential-Three and is located at 3870 Oak Street. Susan E11is presented the staff report. All pertinent documents were entered into record, which Chairman JUNKER accepted_ Board Member ECHELMEYER asked when looking at the slides, where is the dumpster going to be placed and what is there now, and Ms. Ellis replied the car is where the dumpster will be placed and it will have to be ..moved in order for the dumpster to be placed there. The driveway will hold five vehicles. Chairman JUNKER asked if the City has ever allowed dumpsters in the residential area, and Ms. Ellis replied only the one that was granted a variance at the last hearing ._ It was for a different purpose but they had to meet the same requirements, and no, this is not typical. Very few people have dumpsters unless it is for construction purposes, it is just something that the City does not allow. Board Member ECHELMEYER mentioned a dumpster on 41st Avenue, and Ms. Ellis said she believed that is for an apartment building and that is dealt with differently. We are in the process of requiring everyone to enclose their dumpsters and have cited approximately 150 people already. It is just a matter of getting to everyone. Board Member HOWARD asked for a clarification on the ordinance, Section 26-30(R). Ms. E11is read the ordinance and a discussion followed saying they could not have a dumpster less than one-cubic yard or larger. The trash companies have come out with-'trash containers under one cubic yard that have the'appear_ance of a residential trash container and that would be an option for the applicant. Ms. Ellis passed around a notice from.-the applicant with signatures from immediate neighbors,- approximately 10, that have no objections.. It was noted there were 'no protests registered however,-this came to Code Enforcement's attention from a complaint. ~''-~, No further questions were answered. The applicant, David Wilson, 3870 Oak Street,-was sworn in. Mr. Wilson said the reason he needs this .variance is because he has a large family and accumulates a lot of trash, plus he lives right off of the greenbelt and is always cleaning . up the trash 4-5_times a week after the raccoons and foxes have made a mess. He checked with the trash company about the smaller trash containers (one cubic yard or less) and he would have to have about 6 of them because he has 15-20 bags of trash per week. His neighbors would like him to have the dumpster also because it keeps the neighborhood cleaner without trash strung all over. Mr. Wilson said he called and to have 5-b of the smaller trash containers would run about $100 a month, and the dumpster now is only $42 a month. He is injured and on disability so he has a limited budget. He said he grew up in this house and feels it is a nice neighborhood and wants it to stay that way. Board Member ECHELMEYER asked if the applicant was going to enclose the dumpster with a fence, and Mr. Wilson said yes, however it will take him about 45 days to build due to his disability. He has most of the materials bought but he has been waiting to get the building permit to see what happens with the meeting tonight. He wants to box the section entirely first because he has dogs, but later on his intention is to put a 6 foot fence around the whole thing. WSEAT RIDGE BOARD OF ADJUSTMENT MINUTES OF MEETING: September 28, 1995 Page 11 Board Member ECHELMEYER wanted to know if he .could put the dumpster back further before the fence is finished, and Mr._ Wilson said .yes, that would be no-problem, he could even put it in the garage until the fence is done_ .The dumpster is where its at because he did not_want to place it right up against somebody's house. Mr. Wilson has only had the dumpster about a month. Board Member WALKER asked what method does the trash company use to empty the dumpster, and Mr. Wilson replied just a normal trash truck with a special hook-up to lift the dumpster. They pick up the trash between noon and 2:.00, so it does not disturb anyone. Board Member.HOVLAND asked if the applicant has to wheel the. dumpster out to the street, and Mr. Wilson answered yes. Board Member HOWARD asked if the applicant had considered any alternatives, and Mr. Wilson replied he did try and call about the 'less than one-cubic yard' dumpsters and again they only hold about,3 bags of trash, and he has 15-20 every week regardless. Board Member ABBOTT questioned if the applicant's neighbor is on the list submitted, and Mr. Wilson replied yes, he is the neighbor that offered to help build the fence. No further questions were. asked. Motion was made by Board Member ABBOTT, that Case No. WA-95- 28, an application by David Wilson, be DENIED for the following reasons: - 1. The City was made aware of this violation by a complaint. 2. The property is surrounded on all adjacent sides by residential uses therefore the effects of noise and neighborhood disturbance would be considerable, the dumpster wil l be located within approximately 10-15' of the adjacent residential single family home-and this would seem unreasonable and against the intent of the ordinance. 3. The hardship indicated is not sufficiently unique as to avoid the in tent of .the ordinance... _ 4. The .proposed location would create a significant problems of access by the trash truck or by rolling the dumpster to the curb in the winter. Motion was by Board Member ECHELMEYER. Board Member ABBOTT said he agreed, but it would be a matter of breaking the load up into small pieces and taking them through the snow down the driveway. Board Member ABBOTT. continued saying he would not want to be the one wheeling the large dumpster down the driveway to the curb with the volume that the applicant is indicating. Board Member ABBOTT commented in the picture it looks. like the driveway is on a hill and not really level, and Mr. Wilson said it is not that bad, just slightly tapered. No further questions were asked.- Motion was made by Board Member ABBOTT, that Case No. WA-95- 28, an application by David Wilson, be DENIED for the following reasons: 1. The City was made aware of this violation by a complaint. 2. The property is surrounded on all adjacent sides by residential uses therefore the effects of noise and neighborhood disturbance would be considerable, the dumpster will be located within. approximately 10-15' of the adjacent residential single family home and this would seem unreasonable and against the intent of the . ordinance. 3.
