Re: Case No. WA-95-35
Case No. WA-95-35 is a request fora 6' lot width variance to the 60' lot width requirement
and a 210 square foot lot area variance to the 7,500 square foot lot area requirement to
allow a single family dwelling on a substandard parcel located at 3711 High Court, for
which the applicant is proposing to move an existing house from another location. Neither
variances exceed 10% of the minimum or maximum, and may be heard administratively.
As per Section 26 D.2.a, certified notification was sent to all adjacent property owners, and
a public notice was posted on said property, both of which were processed without any
reply or objection. Because of this, the request was administratively processed without the
need of a public hearing.
FINDINGS OF FACT
1. Can the property in question yield a reasonable return in use, service or income if permitted
to be used only under the conditions allowed by the regulations for the district in which it
is located?
No. The property exists with substandard lot widths and lot area, bofh of which need to
be complied with prior to the issuance of a building permit, unless a variance is attained.
2. Is the plight of the owner due to unique circumstances?
No. There are several substandard lots located throughout the city of Wheat Ridge.
3. If the variation were granted, would it alter the essential character of the locality?
No. In fact, staff believes the development of this vacant parcel will alleviate the past
weed problem and the potential for fire hazard.
4. Are there any particular physical surroundings, shape or topographical conditions of the
property involved that would result in a particular hardship?
No. The applicant created his own hardship by subdividing his original standard-parcel
to two separate substandard-parcels.
5. Are the conditions upon which the petition for a variation is based be applicable, generally,
to the other property within the same zoning classification?
Yes. There are other residents with substandard parcels throughout the city of Wheat
Ridge, which may be approved for variances as well.
6. Is the purpose of the variation based exclusively upon a desire to make more money out of
the property?
Yes. The applicant is hoping to move asingle-family dwelling on the vacant parcel and
place the lot on a selling market.
7. Has the alleged difficulty or hardship been created by any person presently having an
interest in the property?
No. The applicant is the only person presently having an interest in the property, and the
hardship was self imposed.
8. Will the granting of the variation be detrimental to the public welfare or injurious to other
property or improvements in the neighborhood in which the property is located?
No. The granting of this variance will not be injurious to other property or improvements
in the neighborhood.
9. Will the proposed variation impair the adequate supply of light and air to adjacent property
or substantially increase the. congestion in the public streets or increase the danger of fire
or endanger the public safety and substantially diminish or impair property values within the
neighborhood?
No. The granting of this variance will not impair the adequate supply of light and air to
adjacent property or substantially increase the congestion in the public streets or increase
the danger of fire or endanger the public safety and substantially diminish or impair
property values within the neighborhood.
CONCLUSIONS
Staff finds that:
1. The variance does not exceed 10% of the minimum or maximum standard.
2. The "Findings of Fact" as set forth in subsection 26.D.2.c. support the request.
3. All adjacent property owners have been notified of the request at least 10 days prior to the
rendering of this decision and no one has registered concerns during the 10 day_period.
4. The development of asingle-family dwelling on this vacant property will alleviate the future-
problems of weed violations and the potential of fire hazards the weeds pose.
staff concludes that all conditions and requirements of this request have beer, met in regards to
Section 26.D.2. Minor Variance or Waivers, therefore, a recommendation of APPROVAL is given
for Case No. WA-95-35 with the following conditions:
1. All development and use regulations per Section 26-16 (setbacks, etc.) must be met during
placement_of the dwelling structure.

variance to the 60' lot width requirement and a 240 square foot lot area variance to the
7 500 square foot lot area requirement for a property located at 3711 Hi h Court.
The applicant is requesting an administrative variance review which allows no more than
a ten percent (10%) variance to be granted by the Zoning Administrator without need for
