EDARC Commissioners present were: JOE DREW, TOM SLATTERY, MOE KELLER, NORMAN BURKEPILE, JANE LONGO, JERRY ROACH, DAN LaPLANTE (arr. 4:20 pm), and Ex-officio member TONY FLASCO. Commissioner Michael Scarafiotti was absent. Also present were Attorney Jim Windholz, Ron Myles, Ann Pitinga and LaVonne Youngblood. Commissioner Drew asked for remedy of the 3 or 4 dead trees in the Wheat Ridge Town Center Park; the dumping of shingles at the rear of the former Handy Dan store; and mosquitoes breeding there. Executive Director Ann Pitinga will contact Code Enforcement and City Forester for assistance. Commissioner Burkepile circulated photographs of a Farmers Market in St. Paul, Minnesota, and described an apparently very successful and long lasting enterprise. Discussion ensued regarding the feasibility of considering such an operation in the Wheat Ridge Town Center, and suggestions were offered by the Commissioners for alternative uses, such as a flea market, possibility of bus service to the area from the Denver metro area, etc. Executive Director Ann Pitinga will obtain information for Chairman Drew from the current management of the Farmers Market in the Park 'N Shop area on Thursdays. ., MOTION by Commissioner KELLER, seconded by Commissioner LONGO, to adjourn the meeting. (5:00 p.m.) LaVonne Youngblood Recording Secretary EDARC RESOLUTION 92-5 Series of 1992 TITLE: RESOLUTION AUTHORIZING SUBMISSION OF PROPOSED DRAFT OF LIST OF PROJECTS TO BE INCLUDED IN THE URBAN RENEWAL PLAN TO PLANNING COMMISSION AND CITY COUNCIL WHEREAS, Wheat Ridge Economic Development and Revitalization Commission entered into an Intergovernmental Agreement with the City of Wheat Ridge dated July 15, 1992; and WHEREAS, pursuant to said Agreement, a list of projects and project elements, were to be jointly developed and contained within and authorized by the approved Urban Renewal Plan, upon which tax increment and other funds in the possession of EDARC may be expended, which elements might include, without limitation and without guarantee or expectancy that the following might be ultimately agreed upon, construction of acceleration/deceleration lanes as called for in the approved plan, possible purchase of identified properties within the approved Urban Renewal Area; NOW, THEREFORE, BE IT RESOLVED that the attached draft of Primary Project Activities be forwarded to Planning Commission and to City Council pursuant to the Intergovernmental Agreement dated July 15, 1992, subject to City Council approval, disapproval, or amendment of the Urban Renewal Plan. State law requires that Planning Commission review the Urban Renewal Plan and all subsequent amendments and make a finding that such Urban Renewal Plan (or amendments in this case) is in conformance with the Comprehensive Plan. The proposed revisions are indicated by :_--.- ---==2h (delete) or underlined (add). In summary, the modifications are as follows: 1. The boundary of the Urban Renewal District is being revised to exclude the residential properties along Upham Street. 2. Various sections are being revised to provide that the Wheat Ridge City Council must approve all expenditures of Urban Renewal funds. 3. Repetitive language regarding Goals and Objectives has been deleted. 4. There are several changes that place a greater emphasis on private sector/public sector participation in rehabilitation efforts. 5. The existing Wheat Ridge Town Center Master Plan is replaced by the proposed amended Plan. CONCLUSION Staff concludes that the Wheat Ridge Town Center Urban Renewal Plan does conform with the Wheat Ridge Comprehensive Plan, as proposed for amendment in Case WPA-92-1. We also request that a copy of these proposed activities be submitted to the Planning Commission for its information. Thank you for your consideration. c: City Administrator City Attorney (Via Fax) PROJECT ACTIVITIES The project activities shall be to participate and assist in the new development, redevelopment or rehabilitation of the Wheat Ridge Town Center, which by way of illustration but not by limitation may include the following: 1. Assist or,cooperate with a developer, redeveloper or rehabilitator in the completion of a development in the Wheat Ridge Town Center; and/or 2. Acquire by lease, negotiated agreement or exercise of the power of eminent domain the right to fee simple interest, or any other interest in real property and personal property; and/or 3. Assist qualified businesses, tenants and occupants with moving and other relocation expenses associated with redevelopment or rehabilitation in the project area. These benefits shall be defined more explicitly by a Relocation Handbook which shall be adopted by EDARC pursuant to the urban renewal plan; and/or - 4. Complete site preparation of proposed redevelopment projects within the redevelopment area which may include but not be limited to, demolition and clearance of buildings, structures, pavement and all other types of improvements, and relocation or provision of public and other utilities; and/or 5. Provision of public improvements and facilities which may include but not be limited to traffic control devices, street and traffic access improvements, curbs and gutters, drives, sidewalks, parks and perimeter landscaping drainage and signage. The acquisition of necessary public right-of-way to satisfy the classification of Wadsworth Boulevard as a "Major Regional Arterial", and the construction of transportation improvements related thereto may ;also be included in such projects; and/or 6. Provide financial assistance in the design and construction of private development, redevelopment or •~_ rehabilitation projects which may include ,grants, services-in-kind or loans; and/or 7. Assist in the overall beautification of the Wheat Ridge Town Center, which may include various improvements and landscaping. These items may be commenced, as needed to cooperate with and assist a selected (re)developer. If within three (3) years (September, 1995) or when there is not a (re)developer in actual discussion with the Authority or demonstrating good faith interest in or concerning the (re)development of all or any portion of the Wheat Ridge Town Center, whichever date is earliest, the Authority and City Council jointly shall determine the specific priorities of these project activities and shall commence construction thereof; subject however, to considerations of financial feasibility, practical usefulness, market feasibility and contributions or assistance to the community needs and public well- being.
