In connection with the application for Greenway Minor
Subdivision, a variance will be needed due to the rear setback
requirement on the existing house. The enclosed porch is located
within the setback but the foundation of the house is beyond this
setback at a distance of 16.8 ft. The porch is not a heated living
area and only provides access to the cellar and a convenient
location for a freezer and washer/dryer.
Midwest Builders plans to erect 3 homes on the
remaining sites and they have no objection to this variance and
feel that it would in no way harm or deter from their overall plans
of development. The existing house will be undergo extensive
remodeling after the completion of the subdivision, along with the
garage being demolished and or removed. The home is in good
structural condition and has had many updates in electrical,
plumbing and heating over the years, providing many more years of
useful live. _
We hope that a variance will be granted and the porch
remain attached to the home. We feel that this would not be
detrimental to the public or other property owners in the
neighborhood, impair property values or endanger public safety.

35-14501. When power of attorney not affected by disability. (1) Whenever a principal designates another his attorney-in-fact or agent by a power
of attorney in writing and the writing contains the words "This power of attorney shah not be affected by disabiht of the principalY or "This power of
attorney shall become effecnve upon the disabhit of ttre principal:' or similar words showing the intent of the principal that the authority conferred shall
6e exercisable nmwithstanding his disabiliTy, the authority of the attorney-ia-fact or agent is exercisable by him as provided in the power oa behalf of the
principal notwi0rs[anding later disability or incapacity of the principal at law or later uncertainty as to whether the principal is dead or alive. The
authority of the attorney-ia-fact or agent to act on behalf of the principal shall be set forth in the power and may relate to any act, power, duty, right, or
obligation which the principal has or after acquires relating to the principal or any matter, transaction, or property, real or personal, tangible or intangible,
including but not limited to the power to consent to or approve on behalf of the principal any medical or other professional care, counsel, treatment, or
service of or io the principal by a licensed or certified professional person or institution engaged in the practice of, or providing, a healing art. The
attorney-in-fact or agent, however, is subject to the same limitations imposed upon courtappointed guazdians contained in section IS-14312(1)(a).
Additionahg the principal may expressly empower his attorney-in-fact or agent to renounce and disclaim interests and powers, to make gifts, in trust or
otherwise, and to release and exercise powers of appointment. All acts done by the attorney-in-fact or agent pursuant to the power during any period of
disabiliTy or incompetence or uncertainty as [o whether the principal is dead or alive have the same effect and inure [o the benefit of and bind the principal
or his heirs, devisees, and personal representatives as if the principal were alive, competent, and not disabled. If a guardian or conservator thereafter is
appointed for the principal, the attorney-in-fact or agent, during the continuance of the appointment, shall consult with the guardian on matters concera-
ingthe principal's personal care or account to the conservator on matters concerning the principal's financial affairs. The conservator has the same power
the principal would have had if he were not disabled or incompetent to revoke, suspend, or terminate all or any part of the power of attorney or agency as
it relates to 5nancial matters. Subject to any limitation or restriction ofthe guardian's powers or duties set forth in the order of appointment and endorsed
on the letters of guardianship, a guardian has the same power ro revoke, suspend, or terminate aU or any part of the power of attorney or agency as it
relates to matters concerning the principal's personal cam that the principal would have had if the principal were not disabled or incompetent.
(2) An adrdavit, executed by the attorney-in-fact or agent, stating that he did not have, at the time of doing an aM pursuant to the power of attorney,
actual knowledge of the termination of the power of attorney by death is, in the absence of fraud, conclusive proof of the nonterminatioa of the power at
that time. If the exeroise of the power requires execution and delivery of any instrument which is recordable, the affidavit when authenticated for record is

15-14-502. Other powers of attorney not reroked ondl notice of death or disability. (I) The death, disability, or incompetence of any principal who
has executed a power of attorney in writing other than a power as described by section 15-14501, does not revoke or terminate the agency as to the
attorney-in-fact' agent, or other person who, without actual knowledge of the death, disability, or incompetence of the principal, acts in good Faith under
the power of attorney or agency. Any action so taken, unless otherwise invalid or unenforceable, binds the prncipal and his heirs, devisees, and personal
representatives.
(2) An affidavit, executed by the attorney-in-fact or agent, stating that he did not have, at the time of doing an act pursuant to the power of attorney,
actual knowledge of the revocation or termination of the power of attorney by death, disabiliTy, or incompetence is, in the absence of fraud, conclusive
proof of the nonrevocadon or nontermination of the power at that time. If the exercise of the power requires execution and delivery of any instrument
which is recordable, the affidavit when authenticated for record is likewise recordable.
(4) All powers of attorney executed for real estate and other purposes, pursuant to law, shall be deemed valid until revoked as provided in the terms of
the power of attorney or as provided by law.

SCHOOL DISTRICT PLANNING COMMENTS:
Wheat Ridge Senior is currently using ten temporary classrooms.
Based upon projections from this development and subdivisions in
this area which have been approved or are pending approval, current
school capacities at Wheat Ridge Senior are inadequate to serve the
anticipated student population from this proposal. However, the
recent passage of the Bond Issue on October 6, 1992, will provide a
building renovation/upgrade at Wilmore-Davis Elementary and Wheat
Ridge Senior and various improvement projects at all three schools
at a cost of $9,560,932 for this area.

SUBJECT: MS-94-2, Parker/7800 West 38th Avenue
The Public Works Department has reviewed the site plan for the
above referenced project and has the following comments:
1. We will need a drainage report.
2. We will need construction drawings which reflect the removal
and replacement of the existing curb, gutter and walk on the
Allison Street frontage to ADA standards, i.e. walk is
required to be a minimum of 4 feet wide. Also, any roadway
improvements as a result of the above mentioned work or to
meet City standards will need to be .addressed in the plans
requested.
3. The driveway location for lot 1 shall be located on Allison j
Street. No access can be allowed on W. 38th Avenue. The I '~~
driveway location on Allison should be as far south from t~
intersection of 38th Avenue as possible, and at least 25 f,et_
from the south property line of Lot 1.
4. The plat has been reviewed, and the resulting comments
(see attached list) are in the process of being corrected
by the consultant in coordination with the respective City
representatives.

Please be advised of the present status regarding the above
referenced project as a result of a recent telephone conversation
with the respective developer.
1. The developer was not receptive to removing the existing curb,
gutter and sidewalk .and replacing it to ADA standards as I had
requested in my memo dated May 18th. Specifically, ADA
requires a minimum 4 foot wide sidewalk. The existing walk is
approximately 3.3 feet__wide. Staff agrees that the ADA
requirement width should be complied with, and that any
variance to this requirement should be a policy issue resolved
by the developer through City Council.

been decided to allow the existing curb, gutter, and walk to
remain. The primary reason for this decision is that no new
improvements are being proposed for the project which will
require the developer to work within City right-of-way.

1. Trees mostly on the east and southeast side that are coming way
over our fence .and lying directly on the power lines and need to be
trimmed way back.
2. Trees mostly on the east and southeast side are coming over and

*aon't be pushed down.
3. Trees mostly on the east and southeast side are coming way over
into our yard and are starting to destroy our beautiful, tall blue
spruce trees and need to be trimmed way back.
4. There is a lot of dead wood, especially on the east side. We
hone that when this dead wood is removed that it is removed very
carefully both for our sake and for the sake of the workman who
does it because the wood is full of ticks. I spend $165.00 every
year to get our yard_sprayed so that the ticks won't come over and
get on our dogs and get in our house, which has happened in the
past before I started the spraying program.
5. We request that the aspen trees on the southwest side try to be
saved. They are offshoots of aspen trees wktich we brought from the
mot+.ntains when the new road was built up by Georgetown and the
state encouraged people to go up and get the trees and replant
them. The original trees were on our property but spread to the
adjacent lot. It would be wonderful if they could be saved.
5. There was a half-hearted effort to trim some of the tail weeds
in the lot, but they were left long along the fenceline and in the
back of the lot. Those weeds are another breeding ground for the
ticks.
7. When building as well as now there is great concern about dead
wood and lumber being around because the people from the union hall
across the fence do a lot of partying and throw their lit cigarette
butts across the fence. If the lumber is near the fence it will
catch on fire. We had that happen to onr grass a couple of years
ago. So encourage the workmen to put the lumber not too close to
the fenceline.
8. We are concerned about the placement of the stakes at the
property line. Our survey shows that we have five to ten inches
outside the fenceline which is our property. The stakes in the
front and the back don't seem to be in line. The front stake is
too far to the south. We believe that in both the front and the
back the property line has been mismarked by Mr. Patterson's survey
crew. We suggest that the builders check with our surveying
company before proceeding with the building of the house.

Dear Adjacent Property Owner:
I£ you have received this notice, you reside or own property
adjacent to a property involved in a land use case being
processed by the City of Wheat Ridge.
This notice is intended to inform you of the process involved in
land use development applications.
Prior to application for rezoning or special use permit, the
developer is responsible for holding an informal neighborhood
meeting. The purpose of the meeting is to provide the
opportunity for citizens to become aware of a proposed
development in their neighborhood and to allow the developer to
respond to citizen concerns in the design of their project. All
residents within 600 feet are required to be notified of the
meeting.
A staff planner will attend the meeting to discuss City policy
and regulations and the process involved, however, the planner
will remain impartial regarding viability of the project.
Keep in mind that this is not a public hearing. Although a
synopsis of the meeting will be entered as testimony, it is the
public hearings in front of Planning Commission and City Council
where decisions are rendered.- If you want input in the decision-
making process, it is imperative that you attend the public
hearings.
The public hearings you-will be attending are quasi-judicial in
nature. Please do not contact your Planning Commissioners or
Council people to discuss the merits of a case prior to the
public hearing. It could jeopardize your representatives'
ability to hear the case.
If you are an adjacent property, you may have the right to file a
"legal protest" against the application. The result of this
filing is that it requires a 3/4 majority of City Council to
approve a request.

I. REQUEST

The applicant requests approval of a four-lot minor subdivision at
7800 West 38th Avenue. Two motions are necessary due to the
involvement of a variance.
II.
This property is located at the southeast corner of West 38th Avenue
and Allison Street. The property contains one single-family residence
and has a zoning designation of Residential-Two. The applicant
proposes splitting the existing lot into four lots while keeping the
existing single-family residence on Lot I.
Minimum lot standards for single-family dwellings in the R-2 zone are
9,000 square feet in lot area and 75 feet of lot width with the
exception that corner lots must be 80 feet wide.
Lot 1 (northern lot) would be 12,084 square feet in area with 86.5
feet of width. Lot 2 (immediately south of Lot 1) would be 10,511
square feet in size. Lot 3 (immediately south of Lot 2) would be
10,517 square feet in size. Lot 4 (southern lot) would be 10,524
square feet with 75 feet of width. None of the lots is large enough
to allow for duplex construction as the minimum requirement for a
duplex lot is 12,500 square feet.
Minimum side yard setbacks £or single-family dwellings in the R-2 zone
are five feet and minimum rear yard setbacks are ten feet. The plat
depicts an existing single-family dwelling on Lot 1 containing
southern porch and steps that lay six feet one inch from the proposed
southern boundary of Lot 1. The variance will be measured from the
southern wall of the porch, eight feet six inches from the rear lot
line, rather than the steps, thus the variance will actually be of one
foot six inches.
The porch on the southern side of the single-family dwelling serves to
enclose steps to the cellar. The porch contains screens for windows
and is not considered "livable" space. .Please refer to Section IV in
regard to the variance.
An existing garage on Lot 2 will be demolished.
In accordance with the recommendation from Public Works, the driveway
location for Lot 1 shall be located on Allison Street. No access
should be allowed on West 38th Avenue. The driveway location on
Allison should be as far south from the intersection of West 38th
Avenue as possible. A note indicating such shall be added to the
plat.
Selected mature trees on the property will be saved as long as they do
not prevent the construction of a single-family dwelling by falling
within the dwellings proposed footprint. A note stating this should
be added to the plat.

Aside from minor legal description problems, all requirements o£ the
Subdivision Regulations have been met.
II2. AGENCY REFERRALS
All agencies are providing service to the property.
Public Works is requiring a drainage plan and compliance with American
Disabilities Act (ADA) standards. For instance, ADA compliance may
require removal of the curb, gutter and sidewalk along Allison Street
and widening the sidewalk to four feet. The driveway access to Lot 1
will be from Allison Street and located as far from West 38th Avenue
as possible.
Parks and Recreation Commission will require a cash contribution of
S75 for each of the three proposed lots.
IV. VARIANCE
As mentioned in Section II, the applicant is requesting a 1.5 foot
rear setback variance to the required ten foot rear yard setback.
Staff has the following comments regarding criteria to support a
variance:
Variances must be considered separately from the other cases and
requires a greater-than-majority vote based upon Wheat Ridge Code o£
Laws Section 2-53(s). and Section 26-6(D)(2).
1. Can the property in question yield a reasonable return in
use, service or income if permitted to be used only under the
conditions allowed by regulation for the district in which it is
located?
Yes, however if the variance is not granted, the subdivision would be
faced with realignment into fewer lots to allow space for the rear
yard setback of Lot 1.
2. Is the plight of the owner due to unique circumstances?
No, there are no unique circumstances.
3. If the variation was granted, would it alter the essential
character of the locality?
The character of the area would not be affected as there are numerous
setback encroachments in the area.

4. Would the particular physical surrounding, shape or
topographical condition of the specific property involved result
in a particular hardship (upon the owner) as distinguished from a
mere inconvenience, if the strict letter of the regulations were
carried out?
It could be an economic hardship if sale of the four lots does not
occur or is incomplete.
5, Would the conditions upon which the petition for a variation
is based be applicable, generally, to the other property within
the same zoning classification?
There are numerous substandard rear setbacks within the City of Wheat
Ridge.
6. Is the purpose of the variation based exclusively upon a
desire to make money out of the property?
Yes, the request is economically motivated.
7. Has the alleged difficulty or hardship been created by any
person presently having an interest in the property?
Yes, there were no rear yard setback encroachments before the proposed
property subdivision.
8. Would the granting of the variations be detrimental to the
public welfare or injurious to other property or improvements in
the neighborhood in which the property is located?
Granting of the variance will not be detrimental to the public welfare
or injurious to neighboring properties.
9. Would the proposed variation impair the adequate supply of
light and air to adjacent property or substantially increase the
congestion in the public streets or increase the danger of fire or
endanger the public safety or substantially diminish or impair
property values within the neighborhood?
No, the granting of the variance would not affect the supply of light
and air, increase street congestion, increase fire danger or
negatively affect property values.
Although circumstances are not unique and there is no physical
hardship, Staff concludes that granting of the variance would not harm
the health, safety and welfare of the neighborhood. This is a minimal
request which is almost in the realm of administrative approval.
Since there are existing setback encroachments in the area and
approval will_not negatively affect the character of the neighborhood,
Staff recommends approval of the rear setback variance.

IV. STAFF CONCLUSIONS AND RECOMMENDATIONS __
Staff concludes that there will be minimal impact to the area if the
variance is granted. Staff further concludes that all minimums for
single-family development in an R-2 zone have been met and all
requirements of the Subdivision Regulations have been met. For these
reasons, a recommendation for approval is given for Case No. MS-94-2
as presented with the 1.5 foot rear setback variance with the
following conditions:
1. Legal description problems be corrected;
2. A note be added to the plat in regard to
trees; and
3. A note be added tc the plat disallowing
