This notice is intended to inform you of the process involved in land use development applications. Prior to application for rezoning or special use permit, the developer is responsible for holding an informal neighborhood meeting. The purpose of the meeting is to provide the opportunity for citizens to become aware of a proposed development in their neighborhood and to allow the developer to respond to citizen concerns in the design of their project. All residents within 600 feet are required to be notified of the meeting. A staff planner will attend the and regulations and the process will remain impartial regarding meeting to discuss City policy involved, however, the planner viability of the project. Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be entered as testimony, it is the public hearings in front of Planning Commission and City Council where decisions are rendered. REQUEST The applicant requests approval of a three-lot minor subdivision at 4630 - 50 Kipling Street. II. SUBDIVISIO~d DESIGN The property is zoned Agricultural-One with a 40-foot-wide strip of land zoned R-2 on the very eastern edge. The applicant is proposing the subdivision so that the northern two lots can be legally sold. These lots are subject to a rezoning request pursuant to Case No. WZ-94-4. A 15-foot right-of-way dedication is proposed for Kipling Street which is consistent with the recommendation from Public Works. A 50-foot-wide joint access to Kipling is shown for Lots 1 and 3 which will allow a joint curb cut.- Cross-access easements are being shown throughout the subdivision to allow circulation between properties. The specific location of the easements cannot be specified until the properties develop, however, the intent has been met by language included on the plat. A similar cross-access note should be shown on the southern property line of Lot 3 to allow access with the property to the south (Lot 1, Block 1 of Chado Subdivision). All other requirements of the Subdivision Regulations have been met. III. AGENCY REFERRALS All responding agencies can provide sex~zice to the subdivision. Colorado Department of Transportation has no objections to the joint access on Kipling, however a 50-foot-wide curb cut would require a variance. Roadway widening will be required. Consolidated Mutual requires that each separate structure needing a water tap have direct frontage to a district main line (i.e., Kipling Street). If and when a building permit is requested for the development of Lot 2, all of the district requirements will have to be met. Public Works will require a 15-foot right-of-way dedication for Kipling Street. Improvements including an accel/decel lane and curb, gutter and sidewalk will be required on the frontages of Lots 1 and 3 when Lot 1 develops. A drainage report will be required. There are problems with the legal description which are being worked on by the applicant's engineer. Planning Commission Staff Report Page 3 Case No. WZ-94-3/Ketelsen IV. RECOMMENDATION/CONCLUSION Staff concludes that the subdivision must occur prior to the sale of Lots 1 and 2. Staff further concludes that all requirements of the Subdivision Regulations have been, met. For these reasons, a recommendation of Approval is given with the following conditions: 1. Any legal description problems be corrected. 2. The ability for cross-access be indicated along the southern property line of Lot 3. V. He requested that this case be heard following Cases MS-94-3 and WZ-94-2. Mr. Gidley requested the addition of an item under New Business, discussion of a special meeting in June. Commissioner LANGDON moved to approve the order o£ the agenda for the meeting of June 2, 1994 as amended. Commissioner-JOHNSON seconded the motion. Motion carried 5-0. 5. APPROVAL OF MINUTES Commissioner ECKHARDT noted that on page 3, the sentence before. item 10 reads, "Commissioner CERVENY the effects" This sentence should read "Commissioner CERVENY summarized the effects of this proposed bill". With that correction Commissioner ECKHARDT moved for approval of the minutes for the study session of May 19, 1994 as corrected. Commissioner JOHNSON seconded the motion. Motion carried 3-O, with Commissioners CRUMPTON and JOHNSON abstaining. 6. No one came forward nor signed the roster to speak on this item. 7. PUBLIC HEARING 2. Case No MS-94-3• An .application by James R. Chado for. approval of a three-lot minor subdivision on property zoned Agricultural-One and Residential-Two located at. 4630-50 Kipling Street. Keredith Reckert presented the staff report. Entered and accepted into the record were the Subdivision Regulations, Zoning ordinance, exhibits, case file and packet materials. commissioner RASPLICKA asked where drainage from the property would go. Ms. Reckert stated the engineer for the. project could best answer that question. At this time, time was taken to explain to individuals in the audience the location of the proposed subdivision. Planning Commission Minutes Page 3 June 2, 1994 Chris Porter, attorney for the applicant, 4465 Kipling, was sworn in. Mr. Porter stated that the problem with the legal description had been resolved. He added that all water would be contained on the property, utilizing five dry wells. Roger Venables, ADG Engineering, 770 West Hampden, was sworn in. Mr. Venables gxplained the drainage plan for containing water on the property in question. Commissioner ECKHARDT asked about possible pollution of -the aquifer or shallow wells in the area. Mr. Venables answered that because it is a retention system, the surface soils will act as a filter to remove contaminants from the drainage water. He noted that the area not graveled would be used only for storage purposes. All vehicle fluids-would be properly contained, he added. Sally Jo Button, 4585 Independence Street was sworn in. Ms. Button stated she was a new resident of Wheat Ridge and added she has more questions than comments. Her concerns were building height and water contamination. Mr. Gidley explained that the case now before the Planning Commission was a request for subdivision, which is division of land for the purpose of development or resale. He elaborated. Mary Oswald, 4615 Independence Street was sworn in. Ms. Oswald stated the main source of water on her property was a well. She added she had received notification of the public hearing. Her concerns were impact on Pennington Elementary, traffic increase, ,,,,, property value ._ Ms. Oswald felt.th~s development was being "jammed down their throats". Commissioner JOHNSON asked Ms. Oswald what she would like built on the proposed development -site. Ms. Oswald stated "nothing" and suggested the land be left as open space. Ms. Oswald voiced concern about pollution of her well water. Ms. Reckert informed those present about the rules of notification. Chairperson RASPLICKA stated that Ms. Oswald would get additional information when the rezoning case is'consdered.- Karen Buchanan, 4575 Independence Street was sworn in. Ms. Buchanan stated she grows much of her_family's food and her concern was that sewage would not be properly handled. Planning Commission Minutes June 2, 1994 Chairperson RASPLICKA stated the developer planned, to be connected to the sewer. Page 4 Ms. Buchanan was concerned that she would no longer be able to see the mountains from her home. She was fearful that gangs might be drawn to the area. Commissioner JOHNSON requested that Mr. Gidley explain further to those present what the proposed development involves. Mr. Gidley did so. He added that the City of Wheat Ridge adopted a Comprehensive Plan in 1976 that encourages a commercial activity center at the proposed development site. He elaborated. Ms. Oswald asked what it would take to rezone the area left A-1? Mr. Gidley explained the same process the applicant is going through presently would be required. He elaborated. Ms. Button asked if the ,residents on independence Street could do anything to prevent-this development, since commercial-type development is recommended by the Comprehensive Plan. Chairperson RASPLICKA doubted the Comprehensive Plan would be changed, but urged the citizens present to be informed of changes going on in their neighborhood and'not to be afraid to ask questions. He elaborated. Mr. Gidley mentioned the Citizen Awareness Program newsletters announcing meetings that will be held at neighborhood schools to keep the citizens involved and aware of changes being made. Thee-meetings-would be a good time to voice any concerns, he added. Ms. Button reiterated her concern about the Comprehensive Plan designating commercial zoning along Kipling and that area residents could not change that £rom happening. Chairperson RASPLICKA stated that his best guess was that the . commercial zoning would happen along Kipling, because it was not appropriate for 'residential development. Ms. Button stated there were other alternatives. Commissioner ECKHARDT.stated it is indicated by the., Comp Plan that properties along Kipling from 44th to I-70 should be developed as a commercial. node and it is likely the properties will develop that way. However, the properties are not all zoned for commercial development at this time and plans do change. Both Planning Commission and City Council make changes to the Comp Plan. REQUEST Page 2 The applicant requests approval of a three-lot minor subdivision at 4630 - 50 Kipling Street. II. SUBDIVISION DESIGN The property is zoned Agricultural-One with a 40-foot-wide strip of land zoned R-2 on the very eastern edge. The applicant is proposing the subdivision so that the northern two lots can be legally sold. These lots are subject to a rezoning request pursuant to Case No. WZ-94-4. A 15-foot right-of-way dedication is proposed for Kipling Street which is consistent with the recommendation from Public Works. A 50-foot-wide joint access to Kipling is shown for Lots 1 and 3 which will allow a joint curb cut. Cross-access easements are being shown throughout the subdivision to allow circulation between properties. The specific location of the easements cannot be specified until the properties develop, however, the intent has been met by language included on the plat. A similar cross-access note should be shown on the southern property line of Lot 3 to allow access with the property to the south (Lot 1, Block 1 of Chado Subdivision). All other requirements of the Subdivision Regulations have been met. III. AGENCY REFERRALS All responding agencies can provide service to the subdivision. Colorado Department of Transportation has no objections to the joint access on Kipling, however a 50-foot-wide curb cut would require a variance. Roadway widening will be required. Consolidated Mutual requires that each separate structure needing a water tap have direct frontage to a district main line (i.e., Kipling Street). If and when a building permit is requested for the development of Lot 2, all of the district requirements will have to be met. Public Works will require a 15-foot right-of-way dedication for Kipling Street. Improvements including an accel/decel lane and curb, gutter and sidewalk will be required on the frontages of, Lots 1 and 3 when Lot 1 develops. A drainage report will be required. PLANNING COMMISSION ACTION _ Planning Commission reviewed this request at a public hearing held on June 2, 1993. A recommendation of Approval was made for the following reasons: 1. The subdivision must occur prior to the sale of Lots 1 and 2; and 2. All requirements of the Subdivision Regulations have been met. With the following conditions: 1. Any legal problems be corrected; and 2. The ability for cross-access be indicated along the southern property line of Lot 3. V. RECOMMENDATION/CON LUSION Staff concludes that the subdivision must occur prior to the sale of Lots 1 and 2. Staff further concludes that all requirements of the Subdivision Regulations have been met. For these reasons, a recommendation of Approval is given with the following conditions: 1. Any legal description problems be corrected. 2. The ability for cross-access be indicated along the southern property line of Lot 3. VI.
