Dear Steve:
The Colorado gapart•.mnnt of Transportation has reviewed thi::
proposal and offers the following:
1. Section 2.13 of the State Highway Access Cvde (conformance of
suhclivisions) iG applicable. This proposed resubdivision would
apparently create twv lots which would have no public street access
except on State_ Highway 72. After June 21, 1979, no person or
persons may submit an applivation for the subdivision of property
abutting a state highway to a Local aut}lority unless the
,t~bdi.vision plan or plat provides that all lots and parcels created
by tho subdivision will have access to Y.ha state highway system in
conformance with the state Highway Access Code. Direct access from
the subdivision to the highway shall be permitted only if the
access approach meets the requirements of this code. Depending
upon the asSi.gnad access category, direct highway access may be
permitted to individual lots or parcels created by a subdivision.
2. Private direct access to the state highway shall be permitted
only when the property in question has no other reasonable access
to the general street system, and no more than one access shall be
provided to an individual parcel or contiguous parcels under the
same ownership.
3. The record copy of permanent easement (E 118) acquired in t}tc
year of 1971 (see now attached right--of-way plan sheet) does not
9.ndicate the purpose of this easement. However, the right-of-way
plan sheet indicates it was purchased for irrigati°ROU1tdYnotebe
and, planting trees within this 10.00 foot wide trip
permitted.

4. The proposed plan appears to show two accesses to Ward Road
(State Highway 72). Accesses spaced less than 350.00 feet ap~T•t
are not allowed under urban design requirements. However, meeting
spacing criteria does not guarantee granting of access to the state
highway. No information has been included wittl tflis review packet
about volume of traffic generated, capacity, impacts, turn radii,
sight. distance or geometry. Does this improvement warrant a
signal? Based on materials included, the Department will not
approve this plan. '
5. The written paragraph (under right hand corner) states under
the name and style of Wyatt Business Park, however tha name at top
of drawing says Wyatt Business Park Filing No. 2, which is it? Thy
1/4 section line in Ward Road should be shown on drawing with
"ties" to the south 1/4 corner of Section 17. The 10.00 foot wide
highway easement should include recording information. The basis'
of bearings. statement should describe the monuments found at the
south 1/4 corner of Saction 17 and also the center of Section 1'l.
6. Access to this site will have to be designed and constructed in
strict conformance with the State Highway ACCe5S Code.
7. Roadway widening may be required for speed changes lams, let.'t
turn lanes, and wilt include curb, gutter, sidewalk, storm sewer
system and highway signing and striping.
8. Any work within the state highway right-of-way will require a
permit from this office at 5640 East Atlantic Place, llCnvc+. r„

This letter ,is to inform you that the final drainage study for
the above referenced project has been reviewed and approved for
construction. Per our meeting of October 25, 1994 the following
items are to be submitted as soon as possible: 1) State approved
construction plans for Ward Road. 2) Approved access permit from
the state. 3) Re-plat reflecting those corrections forwarded to
you by Mr. Chuck Braden. Also, please be aware of the following
items regarding the construction of the project:
1. The proposed drainage facilities shall be constructed and
approved by the City of Wheat Ridge prior to issuance of the
Temporary Certificate of Occupancy.
2. Erosion control for the project shall be placed in conformance
with the approved drainage/erosion control plans and shall be

3. All drainage .improvements shall be constructed in conformance
with the approved final drainage report and plans.
4. It will be the responsibility of the contractor for the
project to repair any damage to the existing public
improvements on Ward Road as a result of related construction
traffic in the area. Also the contractor will be responsible
for maintaining Ward Road on a regular basis such that it is
free of .construction debris and tracking from construction
traffic accessing the site.
5. Upon completion of the drainage improvements, the engineer
shall provide to the City of Wheat Ridge a letter of
certification stating that the various improvements, as
defined in the drainage report and plan, have been accurately

surveyed to confirm that their construction is in accordance
with these documents. The certification letter shall be
written and stamped by the engineer who prepared the drainage
report, and shall be submitted for review and approval by the

Storm water detention/retention 'area(s):
When storm water detention/retention area(s) are required the fol-
lowing language shall appear on the face of the plats
The storm water detention/retention areas} shown hereon
shall be constructed and maintained by the owners, heirs,
successors, and assigns. In the event that said construc-
tion and maintenance is not performed by said owner, the
City of Wheat Ridge shall have the right to enter such
area(s) and perform the necessary work, the cost of which,
said owner, heirs, successors, and assigns agrees to pay
upon billing. No building or structure will be con-
structed in the detention/retention area(s) and no
changes or alterations affecting the hydraulic character-

The owner, his successors or assigns grants limited rights and privilege
of access to, and free movement through those areas indicated as "Cross

and guests of the owners, and shall furthermore grant access to, and
free movement through said easements to those entering said easements

In regard to the plat. submitted for Wyatt Business Park, Staff
has the following comments in addition to .those of my letter
dated .November 2, 1994:
• The temporary drainage easement needs to be shown with the
following language: "Temporary drainage easement to expire
upon construction of building on rear of Lot ~ after
approval of a revised drainage study".
• Joint curb cut with the language relating to cross access
(attached).
• Need clarification from CDOT as to what they will require.
They probably cannot respond until they receive an access
permit application. _ --
• Major legal description problems
• Show existing improvements (at least on another s~eet)

Based on the ambiguity in regard to the requirements for Ward.

RE: Building Permit for 4.940 Ward Road,
Wyatt Business Park
Dear Mr. Wyatt,
The City recently issued a permit for the construction of a new
building at the above location. The plans show a proposed access
to Ward Road. Ward Road is a State Highway and is owned and
maintained by the Colorado Department of Transportation (COOT). As
a result, the State and the City require approval of an access
permit. All of the design elements of the proposed access and the
street improvements of Ward Road must meet the State Highway Access
Code. In this access/street improvement plan, an accel-decel lane

Since the access permit process is a lengthy one, I suggest you
have your engineer contact Rudy Blea of Colorado Department of
Transportation at 757-9901 as soon as possible to work on approval
of the proposed access/street improvement plan. As soon as you
satisfy all of the COOT design requirements, please submit an
access application to me so I may process it and forward it to the
State for final approval.
Please note that the City will not issue the Certificate of
occupancy for the new building until the access permit is approved
by the City and State and the Ward Road improvements are built.

Please let this correspondence serve as a memorandum of agreement

1. The area in front (west) of the proposed building may have
to be redesigned based on comments from CDOT and their
requirements for. issuance of an access permit.
2. A ten-foot-wide landscaped buffer will be required along
Ward Road. If the ten-foot highway easement cannot be used
for landscaping and/or trees, the ten-foot-wide buffer will
have to be shifted easterly.
3. The landscaping at the southwest corner of the lot must be
increased in size to compensate for displaced landscaping at
the rear of the building.
4. The sidewalk running along the south side of the building
can remain as shown.
5. Striped parking stalls will not be required on the east side
of the building as there is currently adequate parking shown
on the west and south sides of the structure. If CDOT
requires an additional ROW dedication, the parking and drive
area along Ward Road may not be functional. In that case,
the parking will be required on the east side.
6. The curb cut shown on Lot 2 is for emergency access only and

SUBJECT: Wyatt Business Park, 4940 Ward Road State Highway Access Permit
Bob Goebel and I met with Rudy Blea of CDOT and Mr. Wyatt, his engineer and architect,
regarding the above subject. The following are the comments generated from the meeting:
o The amount of right-of--way dedication required will be dictated by providing adequate
room for the accel-decel lane, curb, gutter, sidewalk, highway signage and any utility
feature that may be placed behind the sidewalk.
o With the discussion of the future subdivision of this property (that is to become two
sepazate pazcels) in mind, CDOT suggested that a traffic impact study be done for the
entire site. Currently, these proposed access points are too close to each other and do not
meet the code. In the traffic study, the south access will beproposed as aright-in-right-
out access and the north access will be a full movement access. The perimeter of lot 2
will be constructed with a physical feature which prevents traffic from lot 1 entering the
site. The concern from Mr. Wyatt and his associates is that lot 2 probably won't generate
that much traffic to impact Ward Road. The study needs to prove this. The CDOT will
approve or deny the proposal based on the outcome of the study. That is, if the study
shows the traffic generated from both the existing and the proposed site will not be
detrimental to Ward Road, the State may approve it.
o The current alley way locates at the east side of the property will have to be vacated or
access onto Ward Road will be denied. The only way to keep the alley is to construct a
physical barrier along the property frontage to prevent traffic from entering/exiting with
the exception of providing some sort of breakaway structure for emergency equipment.
If the City feels strongly about maintaining this ally way for fire access then this
requirement should be pursue.

I. REQUEST
The applicant requests approval of a two-lot minor subdivision for property located at 4940 Ward Road.
An official development plan was approved in 7951. See attached Exhibit 'A'. There is an existing house
on the property which has been converted into a retail sales facility. The structure designated as
"building one" is currently under construction.
A 15-foot right-of-way vacation needs to occur for Ward Road.
The ability for cross-access between Lots 1 and 2 has been provided by a note. A temporary drainage
easement has also been provided, however, the reservation language needs to be revised to have the
owner responsible for maintenance instead of the City.
In addition to the drainage easement language, there are numerous mistakes and changes that need to
occur to the document prior to review by City Council. Although Staff is recommending approval, this
case will not be scheduled for City Council public hearing until all changes requested by Staff have been
reviewed and approved.
As part of this application, the owner is requesting that a 15-foot-wide alley easement running along the
eastern property line be vacated. Although there is no connection with the property to the south, there is
a connection from West 49th Place south through the property to the north. For this reason, Staff
recommends this portion of the request be Denied.
11. AGENCY REFERRALS
Public Works is requesting a 15-foot right-of-way dedication and construction of an acel/decel lane in
front of both lots. There are numerous problems with the legal description.
Colorado Department of Highways is requesting a 15-foot right-of-way dedication for Ward Road.

4. APPROVE THE ORDER OF THE AGENDA
Commissioner LANGDON requested the addition of an item under New
Business, "Quasi-judicial Matters". Commissioners ECKHARDT and
Chairperson RASPLICKA wished to discuss under New Business the
Public Works Advisory Committee's meeting of November 3, 1994.
With those additions, Commissioner CERVENY moved to approve the
agenda-for the meeting of December 1, 1994 .as amended.
Commissioner LANGDON seconded the motion. Motion carried 6-0.
5. APPROVAL OF MINDTES
Commissioner ECKHARDT moved to approve the minutes for the
meeting of November 3, 1994 as printed. Commissioner OWENS
seconded the motion.., Motion carried 6-0.
Commissioner ECKHARDT pointed out several-.typographical errors
and a missing word at the top of page two of the minutes for the
meeting of November 17, 1994. In addition, ,Commissioner
WILLIAMS' name had inadvertently been left off the list of those
members attending. With those corrections, Commissioner WILLIAMS
moved to approve .the minutes for the meeting of November 17,
1994. Commissioner OWENS seconded the motion. Motion carried-
6-0. '
6. PIIBLIC FORIIM (This is the time for anyone_to speak on any
subject not appearing under Item 7 of~the Public Hearing
section of the agenda.)_
No one had signed the roster, nor came forward at that time to
speak.
7. PIIBLIC HEARING
1. Case No. MS-94-4: An-application by B. A. Wyatt for
approval of a two-lot minor subdivision for property
zoned Planned Commercial Development at 4940 Ward Road.
Mr. Gidley presented the staff- report. Entered into the record
and. accepted by the Chairperson were the Comprehensive Plan,
Zoning Ordinance, Subdivision Regulations, case file, packet
materials, exhibits and slides.
Chairperson RASPLICKA asked about the "changes that need to be
made" on the plat staff was referring to.
Mr. Gidley explained that language. on the plat needed minor
revision.

Commissioner CERVENY asked what impact the request for increased
dedication would have on parking requirements on the site.
Mr. Gidley explained the requirements. He added that according
to the-plan submitted, the dedication requirements of the
Colorado State Highway may encroach into the improvements, such
as the parking lot. Additionally, a ten-foot-wide landscaping
buffer is required. .Thus, .the parking lot may have to be
relocated-to the rear of the.building or possibly sidewalk could
be eliminated from the plan.
Commissioner CERVENY noted that on the final development plan
parking was indicated_on-the. ..east side of the building.
Mr. Gidley stated that originally, only parking in front was
planned. He noted options available. The City would be willing
to work with the applicant. °The State is not flexible, however,
in their requirements.
Alan Ojala, 6425 West 52nd Avenue, was sworn in. He requested
that Commission allow flexibility in determination of the
decision regarding the 15-foot alley easement. The other pending
issues would be resolved with the State Highway Department, he
stated. He elaborated.
Commissioner ECKHARDT asked what the rear yard setback was on the
parcel.-__
Mr. Gidley stated there are no specific requirements, however, it
should be related to a similar zone district., In this case, he
felt a C-1 or C-2 zone district would be appropriate. The
minimum would be a 10-foot setback from the rear property line.
Commissioner ECKHARDT explained he thought the setback might be
15-feet and that if it was, the alley easement would not be an
issue.
Mr. Oja].a pointed out the location of .the eas-ement and stated
that he saw no point in the easement requirement. He elaborated.
Chairperson RASPLICKA asked if City requirements would be met if
the adjacent property owner, would submit a letter of agreement.
Mr. Gidley answered the concern is that the Arvada Fire District
can gain access to all parts of the building in case of fire.
Discussion followed. _
Mr. Gidley pointed out another factor to, consider regarding the
15-foot easement is keeping solid waste management vehicles off
Ward Road. Developments such as the one proposed, especially

when they front on state highways, ought to have interior -
circulation alternatives which allows for circulation between
businesses.
Mr. Oiala reiterated his belief that the alley easement was not
needed. He stressed that circulation for the. site would not
change whether an alley exists or not..
Commissioner CERVENY asked Mr. Ojala what his relationship to the -
case was.
Mr.. Ojala stated he was Mr. Wyatt's representative, architect and
general contractor. __
Commissioner LANGDON asked for Clarification of_existing alley
easement.
Mr. Gidley stated that there is an existing 15-foot alley
easement and a 10-fo_ot setback requirement.
Commissioner LANGDON was wondering why the five feet was so
important.
Mr. Ojala stated the issue was not five-feet or even 15-.feet...
The issue is why is the alley easement needed. He explained
further. Since the alley easement serves no purpose, he wanted
it vacated.-
Commissioner LANGDON asked if this case would go before City
Council.
Mr. Gidley stated it would be .forwarded to Council, because of
the dedication for Ward Road. He added that it was possible the
matter could be resolved prior to Council hearing the case.
Chairman RASPLICKA asked Mr. Gidley if he thought the problem
could be worked .out.
Mr. Gidley stated it was possible. He explained..
Commissioner ECKHARDT stated he could understand the need for an
easement for circulation to properties to the north and south and
to West 49th Place. The Fire Department had a legitimate
concern for adequate access. The only reason why the easement
would be useful was if the property to the south desired access
to West 49th Place in the future. It would_also provide an
outlet for employees. Otherwise, he saw no reason for the
easement. He thought additional room might be desirable for
turnaround for-the loading docks. He added that taxes would be
paid by the owner if the property was an easement or not.

Mr. Gidley_s recollection was that originally_in 1980 or 1981,
the easement was required in case the development-was extended to
the-south to the Decal's property. He explained further.
' There were_no further questions for Mr.-Ojala.
Commissioner OWENS moved to ..forward Case. NO. MS-94-4 to City
Council.
Commissioner ECKHARDT asked if Commissioner OWENS intended to
make a recommendation to Council to approve the case or deny it.
Commissioner OWENS stated he was not making a recommendation for
either.
Motion died for lack of second.
Commissioner ECKHARDT moved that Case No. MS-94-4 be approved
with the following provisions:
1. The 15-foot right-of-way be dedicated for Ward Road; and
2. The 15-foot-wide alley easement on the east side of the
property remain on the plat; and
3. The minor errors noted by staff be made to the plat. before
it goes to City Council.
Commissioner CERVENY seconded the motion_ He-;suggested ,that a
friendly amendment be added to the motion that necessity for the:
15-foot-wide alley easement be left up to staff, providing the
applicant gains approval of the Arvada Eire. Protection District.
Council could make the final-decision if staff and-applicant are
unable to reach agreement.
Commissioner ECKHARDT stated he would agree with Commissioner
CERVENY's friendly amendment.
Commissioner ECKHARDT clarified the motion as follows:
1. The 15-foot right-of-way be dedicated-for Ward Road.
2. The -l5-foot-wide alley easement along the east side of the
property be required unless Arvada Fire District and
planning Staff agree that it is not necessary:-

Dear Adjacent Property Owner:
If you have received this notice, you reside or own property
adjacent to a property involved in a land use case being
processed by the City of Wheat Ridge.
This notice is intended to inform you of the process involved in
land use development applications.
Prior to application for rezoning or special use permit, the
developer is. responsible for holding an informal neighborhood,
meeting. The purpose of the meeting is to provide the
opportunity for citizens to become aware of a proposed
development in their neighborhood and to allow the developer to
respond to citizen concerns in the design of their project. -All
residents within 600 feet are required to be notified of the
meeting.
A staff planner will attend the meeting to discuss City policy
and regulations and the process involved, however, the planner
will remain impartial regarding viability of the project.
Keep in mind that this is not a public hearing. Although a
synopsis of the meeting will be entered as testimony, it is the
public hearings in front of Planning Commission and City Council
where decisions are rendered. If you want input in the decision-
making process, it is imperative that you attend the public
hearings.
The public hearings you will be attending are quasi-judicial in
nature. Please do not contact your Planning Commissioners or
Council people to discuss the merits of a case prior to the
public hearing. It could jeopardize your representatives'
ability'to hear the case.
If you are an adjacent property, you may have the right to-file a
"legal protest" against the application. The result of this
filing is that it requires a 3/4 majority of City Council to
approve a request.

The applicant requests approval of a two-lot minor subdivision for property located at 4940 Ward Road.
An official development plan was approved in 1981. See attached Exhibit 'A'. There is an existing house
on the property which has been converted into a retail sales facility. The structure designated as
"building one" is currently under construction.
Typically, a 45-foot half-section is required for arterial streets such as Ward Road. This would require a
15-foot right-of-way dedication. However, since all improvements can fit within a 40.foot half-section,
only ten feet of right-of-way will be required. The plat should be corrected to show only aten-foot
dedication.
The ability for cross-access between Lots 1 and 2 has been provided by a note. A temporary drainage
easement has also been provided.
As part of this application, the owner is requesting that a 15-foot-wide alley easement running along the
eastern property line be vacated. Although there is no connection with the property to the south, there is
a connection from West 49th Place south through 4he property to 4he north. For this reason, Staff
recommends that a small portion at the north end of the property be retained so vehicles can enter the
property. The rest can be vacated.
II. AGENCY REFERRALS
Publ-~c Works is requesting a 10-foot right-of-way dedication and construction of an acel(decel lane in
front of both lots. Problems with the legal description have been corrected.
Colorado Department of Highways is requesting a 10.foot right-of-way dedication for Ward Road.
Arvada Fire District can serve and supports the alley vacation as long as they can get onto the property.
III. PLANNING COMMISSION ACTION
Planning Commission reviewed this case at a public hearing held on December 1, 1994. A
recommendation of Approval was made with the following conditions:
1. The 75-foot right-of-way be dedicated for Ward Road; and
2. The 15-foot-wide alley easement on the east side of the property remain on the plat; and
3. The minor errors noted by staff be made to the plat before it goes to City Council.
Items 2 and 3 have been resolved. Only ten feet of additional right-of-way is needed for Ward Road.
N. STAFF RECOMMENDATION
Staff concludes that in general, the requirements for a subdivision have been met. For this reason, a
recommendation of approval is being given with the condition that the dedication for Ward Road be
shown as ten feet rather than 15 feet.

A recommendation of Approval is given for the request for vacation of the alley easement as long as 30
feet is retained at the north end. This 30-foot strip needs to be shown.

Item 4. Application by B.A. Wyatt for approval of a two-lot minor subdivision for
property zoned Planned Commercial Development at 4940 Ward Road.
(Case No. MS-94-4)
Mrs. Worth introduced Case No. MS-94-4; Mr. Gidley was swom in by the Mayor and
presented the staff report.
Allan Oiala applicant, was swom in by the Mayor; gave history on the alley; and asked for
approval of subdivision and alley vacation.
John Sillison, 12300 W. 49th Place, was sworn in by the Mayor; he does not consider this an
alley, but only emergency access. There will be problems if vehicles are starting to go
through that alley.
Motion by Mrs. Worth that Case No. MS-94-4, a request for approval of a two-lot minor
subdivision for property located at 4940 Ward Road, be approved with the following
condition: 1. The right-of-way dedication for Ward Road be shown as ten foot; seconded
by Mr. Edwards; carried 6-0.
Motion by Mrs. Worth that the request for vacation of a 15-foot wide alley easement on
property located at 4940 Ward Road, by Denied for the following reasons: That alleyway
needs to be kept open for fire easement and should not be built on. The plats and the
buildings have been built as an industrial area and the vacating of the alleyway would not be
conducive to the safety of the people that work and live in that area; seconded by Mr.
Edwards; carried 5-1 with Mrs. Behm voting no.
