G ~/ ~ °~-~_ 03- ~ ~ • Cpl., P tOPERATIN6 PROCEDURES TIMB AT COMMISSARY --- One hour, half-hour in the morning, half- hour at closing. Morning half-hour --- Pre-loading of all supplies and dairy products onto cart, initial wipe down of all serving surfaces, filling of fresh water tanks. Closing half-hour --- Transfer of all dairy products to the commissary refrigerator, disposal of wastewater, disposal of excess fresh water, sanitizing of fresh water tank(s), waste water tank, cart, Espresso machine, ~ tools, equipment; and steaming pitchers. DAILY ACTIVITIES --- Pie-loading of the cart at the commissary, transfer of cart to location, plug into power source and warm up Espresso machine, aet up all condiments, baked goods, cash register, tools, and other items necessary to open for business. One final wipe down of all surfaces with wipe-cloths rinsed in a bleach bucket containing one gallon of clean water mixed with one cap-full of bleach. DURING BUSINESS HOURS, Espresso drinks made and sold, food items sold, surfaces continually sanitized with wipe-cloths from bleach bucket. As wipe-cloths become soiled, they will be replaced and the soiled cloths held in plastic bags. Certain tools will be sanitized at the commissary and will be held in plastic bags until the end of the day. Fresh water tanks shall be filled at the commissary as business volume dictates. The waste water tank shall be emptied at the commissary as business volume dictates. At closing, the cart shall be pushed back to the commissary and all dairy products transferred to the commissary refrigerator, and all closing procedures at the commissary completed. TUP-94-2 I. REQUEST Page 2 The applicant is requesting a Temporary Use Permit to allow a drive-thru espresso business. The parcel is zoned Commercial-One and is approximately 2.14 acres in area. The site is currently being used by a variety of commercial uses. A 4,550 square foot "Color Tile." business is located on the northeastern portion of the parcel. A 2,600 square foot attorney's offices is located on the northwestern portion of the parcel and a "Putt Putt Golf" business is situated on the south half of the parcel. There are 110 striped parking spaces (it is difficult to ascertain how many parking spaces are legal relative to size and isle width) and landscaping is at a minimum. Due to the types of uses and the size of buildings the site is required 104 spaces. The applicant would like to locate his business just west and center of the landscaped area east of the Putt Putt Golf Course. This location would in affect remove ail the parking west of the landscaping, approximately 8 spaces. Three curb-cuts access the entire site. One located at both the north and south property line and one located in the middle of the site. The espresso business would utilize the southern two curb-cuts for traffic circulation. Vehicles would enter using the middle curb-cut, order and exit using the south curb-cut. Vehicle stacking would be confined to a minimum as there is only enough room for 2 cars, one ordering and one waiting. I2. CRITERIA Staff has the following comments regarding the criteria to evaluate an application for a Temporary Use Permit: 1. Will this request have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood of the proposed use. Because of the proposed location, Staff is concerned that the reduction of parking and the location and substandard amount of vehicular stacking that is proposed, this request could have a detrimental effect upon the general welfare, safety and convenience of persons working and patrons using the proposed and existing uses; and 2. Will this request adversely affect the adequate light and air, or cause significant air, water or noise pollution, or cause .drainage problems for the general area. TUP-94-2 Page 3 This request will not adversely affect the adequate supply of light and air, nor cause significant air, water or noise pollution, nor cause drainage problems for the general area; and 3. will this 'request result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. If is felt that because the proposed use will reduce parking below the minimum requirement and substandard stacking area could cause vehicles to be stacked out onto Wadsworth Boulevard or across the middle curb-cut. In any case this request could result in undue traffic congestion or traffic hazards, unsafe parking and internal traffic conflicts to the detriment of persons whether on or off the site; and 4. Will this request be appropriately .designed, including setbacks, heights, parking bulk, buffering, screening and landscaping, so as to be in harmony and compatible with character of the surrounding areas and neighborhood, especially with adjacent properties. Because the site has existed for years-parking, buffering; screening and landscaping has not been addressed nor any additional proposed. However the required front yard setback for this property is 50 feet and the applicant has proposed only 10 feet; and 5. Will this request over burden the capacities of the existing streets, utilities, parks, schools, and other public facilities and services._~_. Because the property is already zoned commercial, this use will not overburden the capacities of the existing streets, utilities, parks, schools, and other public facilities and services. III. CONCLUSION AND RECOMMENDATION Based on conclusions derived from "Findings of Fact", staff has the following comments: 1. Because of the proposed location, Staff is concerned that the reduction of parking and the location and substandard amount of vehicular stacking that is proposed, this request could have a detrimental effect upon the general welfare, safety and convenience of persons working and patrons using the proposed and existing uses; and BOARD OF ADJUSTMENT STAFF REPORT CASE NO. TUP-94-2 Page 4 2. it is felt that because the proposed use will reduce parking below the minimum requirement and substandard stacking area could cause vehicles to be stacked out onto Wadsworth Boulevard or across the middle curb-cut. In any case this request could result in undue traffic congestion or traffic hazards, unsafe parking and internal traffic conflicts to the detriment of persons whether on or off the site; and 3. The required front yard setback for this property is 50 feet and the applicant has proposed only 10 feet; and Therefore, staff would recommend that Case No. TUP-94-2 be DENIED. Greg Moberg presented the staff report. All pertinent documents were entered into record which Chairman ROSSILLON accepted. Board Member ECHELMEYER asked if tY.is ownership of the espresso was tied in any way with Putt-Putt, and Mr. Moberg answered no. Board Member ECHELMEYER wanted to know who owns the property that borders Wadsworth where the landscaping is and do they plan to leave the landscaping there, and Mr. Moberg replied the landscaping will be left. This property is owned by Norwood and they have a very long term lease. There is actually another ownership underneath and that is Mr. Graul. Norwood, however has the rights to do whatever they want with, the property. The three sites 'are 'run by-three businesses and lease .the ground from Norwood. Board Member HOWARD asked what is the front yard setback on a commercial lot because it seems every use on Wadsworth has a different setback, and Mr. Moberg answered 50 feet. Mr. Moberg stated after reading the staff report, the applicant decided to move the building further back. You might want to approve the use permit with the condition that it has to be 50 foot setback with a survey showing such. Board Member HOWARD asked if there is a accel-decel lane on Wadsworth in front where the driveways are located, and Mr. Moberg replied no, they just come right out on Wadsworth. No further questions were asked of staff. l WHEAT RIDGE BOARD OF ADJUSTMENT MINUTES OF MEETING: May 26, 1994 Page 17 The applicant, John Colip, 1415-Agape Way, Lafayette, CO, was sworn in. The building will be custom built and be 10` by 8'. The new location will at most eliminate 4 parking spaces. The potential problem of stacking will be significantly addressed by the new placement of providing that 90 feet and which if there is no objection, we can stripe with lanes indicating the directional flow of traffic. Chairman ROSSILLON asked it the entrance be from the north, and Mr. Colip replied the dotted line takes us 90 feet away from the building eliminating the stacking problem. The 90 feet provides room for optimisticly five cars to be waiting with 3 feet between bumpers and still would not exceed past the cut. Frank Mason, 7091 So. Lamar Street, Littleton, CO, was sworn in. Mr. Mason added their proposed distance from the curb to the espresso cart is 54, feet. There-is enough room for five stacked cars, but it will be a miracle if that ever happens. Originally they were not aware they had to have 50 feet from the curb, but now there is more. Mr. Colip added they will not be there after a year, they will be looking at a permanent location when they come back. They picked this site because they feel it is a great temporary location but are actively looking for a permanent location. They will do anything the Board requires because they want to do a first class. job. Board Member ECHELMEYER wanted to know if they would tear the cart down at the end of the ye~.r, and Mr. Colip answered no, however the next one they do will be a permanent location on a slab. Board Member ECHELMEYER wanted to know if they had worked up a performance statement which would indicate how many cars are needed an hour to make this thing profitable, and Mr. Colip replied yes, if they can do 10 cars an hour they can make this work. Our hours of operation would be from 6:00 a.m. to 6:00 p.m. Board Member ECHELMEYER asked what current problems do you see once all five stalls and they start to spill back out and will that present a problem on Wadsworth. Mr. Co1ip said the other side of the building will be a service window for walk-ups and the service is fast. Seldom do you see much backup. Chairman ROSSILLON commented the parking will be eliminated on the east side and that eliminates some danger. Mr. Colip said there are certainly adequate parking spaces available for using the adjacent businesses. WHEAT RIDGE BOARD OF ADJUSTMENT MINUTES OF MEETING: May 26, 1994 Board Member HOVLAND questioned what will building after the year, and Mr. Colip sa be moved off and on site. The only thing the building is the 220 power, everything Page 18 happen to the Ld the building can that hooks up to is self contained. Board Member HOWARD said the traffic flow will be between the building and the Putt-Putt fence which is the ordering and serving window for the driver's side o£ the vehicle. Is there any type of service on the east side of the building, and Mr. Colip said that will be a walk-up window, no car traffic. Board Member HOWARD stated he would like to eliminate the possibility of car traffic on that side and Mr. Colip said they will address that problem. Mr. Moberg added even for fast food the City only requires room for six cars to be stacked for fast food, so you can assume they don't expect any more than six. The applicant has 90 feet which would take care of five vehicles very easily. Board Member ECHELMEYER asked staff ..what is to prevent people coming in from the south curb cut cutting diagonally across Wadsworth, and Mr. Moberg said the only reason cars would come that way is to get service out of that eastern window. Board Member ECHELMEYER questioned if there is sufficient lighting so the cuts would not be a hazard or can the City put lighting in. Mr. Moberg answered the City does not require lighting on curb cuts, so it would be to the applicant's best interest if that 9.s lit up. They would have to meet commercial lighting standards, but the curb- .. cuts are pretty much-the same through out the City, so there should not be any problems. Board Member HOVLAND asked if there was a median at that point, and Mr. Moberg answered no. There is a turn lane at that point so they would not be prohibiting any traffic going north bound, but the main draw would be traffic going south on Wadsworth. Mr. Colip said that is why they are looking at a more permanent site to get north and south, bound traffic. Mr. Mason said he feels-it is to difficult for north bound traffic to cross over and the site has to be a convenience to people. Board Member HOWARD said he would venture to say more people make left turns off of Wadsworth at that location than one can imagine. Discussion followed. WHEAT RIDGE BOARD OF ADJUSTMENT ''MINUTES OF MEETING: May 26, 1994 Page 19 Board Member HOVLAND asked staff what is the reason for the Temporary Use Permit, and Mr. Moberg said the need is to allow more than one main structure on the property. The applicant could go through a Planned Building Group, but at that point in time the we would require the entire site be brought up to code.in_terms of,iandscaping and anything else that is non-conforming. This Temporary Use Permit allows the applicant to place a building on a piece of property where he could not do it by right without a major expense. However, the Board can require any of the code under a Temporary Use Permit, so it basically allows the applicant to find out if there is a market on this in the area so he can find a permanent site at a later date. Board Member HOWARD asked the applicant if this was his first location anywhere on Wadsworth, and Mr. Colip replied yes. Board Member HOWARD asked what time frame are we looking at, and Mr. Colip said 30-45 days, because they still have to go through the health department. Motion was made by Board Member CLARK, that Case No. TUP-94- 2, an application by John D. Colip, be approved for the following reasons: 1. The Board finds that based upon all evidence presented and based upon the Board's conclusions relative to the five specific questions to justify the Temporary Use Permit, the evidence and facts in this case do support the granting of this request. 2. The proposed. location has been moved to accommodate the setback requirements. 3. The use will not be detrimental to the minimum parking requirements, and the subsequer,i: automobile stacking area will prevent congestion upon Wadsworth Boulevard. Board Member HOWARD suggested placing the following condition on this request: 1. The Temporary Use Permit will be for one year. Chairman ROSSILLON offered the following amendments: 2. The lot be striped to insure there .will be room for the stacking of six automobiles. 3. If the east window is used it will be barricaded for pedestrian use only.
