PLEASE SEE THE ATTACHED IMPROVEMENT LOCATION CERTIFICATE FOR DRAWING. THE REASON I HAD THE AWNING COVER ATTACHED TO THE GARAGE IS TO KEEP THE LARGE TREES LOCATED ON THE ADJACENT PROPERTY LINE FROM DROPPING SAP AND LIMBS BREAKING OFF AND CAUSING DAMAGE TO MY PROPERTY AND BELONGIN~S._ THE TREES ARE IN VERY CLOSE PROXIMITY TO MY PROPERTY AND THE LIMBS AND BRANCHES OVERHANG 20 TO 30 FEET INTO MY PROPERTY. THESE ARE VERY LARGE AND WEAK TREES. OVER THE YEARS LARGE BRANCHES HAVE BROKEN AND CAUSED DAMAGE TO MY BELONGINGS. ALSO HAIL DAMAGE HAS BEEN A CONCERN. GRANTING THE VARIANCE WOULD NOT ALTER THE ESSENTIAL CHARACTERISTICS OF THE LOCALITY. THERE ARE OTHER AWNINGS OR CAR PORTS LOCATED ON-OTHER PROPERTIES IN THE NEIGHBORHOOD. IT WOULD PRESENT A EXTREME HARDSHIP AND CONSIDERABLE EXPENSE DUE TO THE FACT THAT OVER THE YEARS WE HAVE INCURRED SEVERAL DAMAGES CAUSED BY THE TREES. I HAVE SPENT C-ONSIDEAABLE AMOUNTS OF MY PERSONAL FUNDS TO TRY TO KEEP THE TREES TRIMMED„ BECAUSE THE OWNER OF THE TREES WILL NOT ASSUME RESPONSIBILITY FOR THE UPKEEP AND MAINTENANCE OF HIS TREES. OTHER PROPERTIES IN THE NEIGHBORHOOD HAVE THE SAME CONDITIONS DUE TO THE LARGE NUMBER OF VERY LARGE OLD TREES. THE PURPOSE OF THE VARIANCE IS FOR THE COVER TO PROTECT MY PROPERTY, VEHICLES AND PERSONAL BELONGINGS THERE IS NO PERSON OR PROPERTY WITHIN THE AREA, THAT COULD BE ADVERSELY AFFECTED BY THE AWNING. THE COVER WILL NOT AFFECT THE AIR OR LIGHT TO THE ADJACENT PROPERTY. IT_WILL NOT INCREASE CONGESTION IN PUBLIC STREETS OR INCUR A FIRE DANGER, OR DIMINISH THE PROPERTY VALUE IN THE NEIGHBORHOOD. - RE: VARIANCE REQUEST FOR FREE STANDING BARN IT-WOULD BE A HARDSHIP TO MOVE THIS STORAGE UNIT. IT WOULD LTMIT OUR ACCESS FOR ENTRANCE AND EXIT AS WELL AS, PARKING IN OUR DRIVEWAY. TO THE EAST OF THE BUILDING THERE IS A VACANT LOT AND THE SETBACK IS WITHIN 10% OF THE ALLOWED 5 FEET. THE NORTH SIDE IS OPEN SPACE WITH NO STRUCTURE FOR OVER 200 FEET. THE CLOSEST PROPERTY FENCE IS 30 FEET AWAY. THIS IS A UTILITY SHED, WELL MAINTAINED AND PAINTED. THE SHAPE-AND DESIGN ARE AESTHETICALLY PLEASING AND IN KEEPING WITH THE NATURE OF THE NEIGHBORHOOD. THE BARN IS USED TO STORE-THE LAWNMOWER, SNOW BLOWER, YARD IMPLEMENTS AND ITEMS THAT WOULD LOOK .UNSIGHTLY IN LEFT OUTSIDE. BECAUSE OF THE LARGE SIZE OF THE PROPERTY, THE MAINTENANCE EQUIPMENT IS ALSO LARGE AND NEEDS TO BE STORED IN ADEQUATE STORAGE SPACE. SITE The property is approximately 21,780 square feet in area and contains approximately 5,464 square foot in building coverage. Existing buildings include a single-family dwelling (3,348 square feet), attached garage (900 square feet) and awning (600 square feet) and a detached barn (400 square feet) and shed (216. square feet). The detached barn and attached awning are the structures that are subject to this request. No building permits were submitted or approved for either of these structures. 222. FINDINGS OF FACT No variance shall be granted unless the Board of Adjustment finds based on evidence that: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by the regulations for the district in which it is located. The property .is and has been used as a single-family residential property for many years at the current setback. It is reasonable to assume that i£ the site is permitted to be used only under the conditions allowed by the regulations for the district in which it is located the property can yield a reasonable return in use; and 2. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? As no building permit was applied for nor approved the alleged difficulty or hardship has been created by the applicant; and 8. Will the granting of the variation be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located. The granting of this variance would not be detrimental or injurious to public welfare or injurious to other property or improvements in the neighborhood in which the property is located as the proposed residence does not encroach into the sight triangle created by Harlan Street and West 36th Place; and 9., Will the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety and substantially diminish or impair property values within the neighborhood. CONCLUSIONS AND RECOMMENDATIONS Based on the preceding "Findings of Fact", staff has reached the following conclusions: 1. Circumstances could be considered unique as the zoning of this property does not fit with the use of the site nor the surrounding area. In addition the surrounding zoning classifications allow for side yard setbacks of less than 15'; and 2. The granting of this variance would probably not alter the essential character of the local neighborhood as the surrounding zonings allows for side yard setbacks of less than 15' and it seems that the Agricultural-One zoned properties to the south of the subject site have side yard setbacks of less than 15'; and 3. Due to the uniqueness of this request the conditions upon which this petition for variances are based, would not be applicable to other property within the same zoning classification; and 4. The purpose of this variance is not based exclusively upon the desire to make money; and 5. PUBLIC FORUM (This is the time for anyone to speak on any subject not appearing on the agenda.) No one came forward to speak. 4. PUBLIC HEARING A. Case No. WA-94-11: An application by Paul McSheehy for approval of a 10' variance to the required 15' side yard setback to allow an existing awning to remain, and a 12' variance to the required 15' side yard setback and a .5' variance to the required 5' rear yard setback to allow an existing barn to remain. Said property is zoned Agricultural-One and is located at 4360 Jellison Street. Greg Moberg presented the staff report. All pertinent documents were entered into record, which Chairman ROSSILLON accepted. Board Member HOWARD asked staff to clarify what buildings are included in the variance and what shed is 400 square feet, and Mr. Moberg .replied the barn/structure is 400 square feet with the awning being 600 square feet. Member HOWARD asked Mr. Moberg to point out where the attached awning is and Mr. Moberg pointed out all structures and reminded the Board there arc two Structures ~in t8is" variance request. Board Member HOVLAND asked why this was not considered for a re-zoning, and Mr. Moberg said that is an option for the applicant i£ these variances are not approved. However, the 3' setback on the north side of the barn and the 4.5 setback on the east side would not be allowed and the shed would have to be removed. Certain zonings would allow the awning to remain. Board Member ABBOTT asked what property line is in dispute and Mr. Moberg answered the east property line. Mr. Moberg suggested because the property line is in question, he would recommend to place in the motion a stipulation that if the property line would change due to court action the shed would have to be moved back. t. WHEAT RIDGE BOARD OF ADJ[TSTMENT Page 3 MINQTES OF MEETING: September 22, 1994 Board Member HOWARD asked what the awning is made of and Mr. Moberg said the applicant refers to it as an awning, but it is actually a carport made of wood. No permits were issued for the shed or awning. Board Member ABBOTT asked if there. was a permit pulled for the garage, and Mr. Moberg replied yes. No further questions were asked of staff. Ken Fellman, attorney for the applicant, 3773 Cherry Creek North Drive, Ste. 900, Denver, CO, was sworn in. Mr. Fellman said it is clear there were no permits issued for this work, but Mr. McSheehy did hire a contractor to do the work and thought he had obtained all permits necessary.- This is not negligence on the applicant's part. The shed and carport were not put in at the same time. Mr. Fellman said they did speak to some of the neighbors and then entered into record, labeled Exhibit 'A', a letter stating no objection from one of the adjacent neighbors. Mr. Fellman agrees since there is some boundary dispute, the motion should state they are requesting to leave the structure 5 feet from the property line. If the courts decide the property belongs to the Pierces,. then Mr. McSheehy would have to move the structure. Also entered into record were photos of the property, labeled Exhibit 'B'. The reason for the carport is the neighbors showed no interest in trimming their trees that overhang onto the applicant's property. Without the awning, any kind of snow like we had a few nights ago would have caused Mr. McSheehy untold vehicle damage (Mr. McSheehy has antique " ~ automobiles). Mr. Fellman discussed the nine criteria in ' the staff report and added he feels the character of the neighborhood will not be changed by permitting this structure. Mr. McSheehy acknowledges he'is responsible for the building permits and the purpose of being here tonight is to come in after the fact and seek approval so he can be in compliance with the Wheat Ridge code. No questions were asked of Mr. Fellman. The applicant, Paul McSheehy, 4360 Jellison Street, was sworn in. Mr. McSheehy said he needs the awning to protect his boat and antique automobiles. It has cost him about $800 in the past to trim the trees and the awning has saved him money over the long run. The barn itself was put in for storage and has been there for a considerable amount of time. WHEAT RIDGE BOARD OF ADJIISTMENT MINIITES OF MEETING: September 22, 1994 Page 4 Board Member HOWARD questioned if there are two sheds on the property, and Mr. McSheehy answered yes. Mr. Gidley commented that the applicant has a home occupation of a carpet cleaning business and questioned Mr. McSheehy as to how many vehicles and employees he has. Mr. McSheehy replied he has 3 vehicles and the only employees he has working for him are his brother and sister. Home occupations were further discussed. Board Member ABBOTT asked staff if a building permit can still be issued, and Mr. Moberg answered yes, a building permit has to be obtained before a Certificate of Occupancy can be issued. No further questions were asked of the applicant. Shelly Pierce, 14354 W. 44th Avenue, was sworn in. Mr. and Ms. Pierce own the adjacent property at 9800 W. 43rd Avenue and are currently building a new home on the site, which is east of Mr. McSheehy's property. Ms. Pierce hopes the request gets denied and feels the main use of this property is commercial, stating the applicant does not even reside there. They feel since the applicant is using this property for commercial purposes it should be zoned commercial or at least he should have to maintain the setbacks. The hardship has been created by Mr. McSheehy by direct result of not obeying the rules that are set for our community. Obtaining a building permit would have eliminated the problem entirely. Their dealings with Mr. McSheehy appears that he' thinks he is above the law and does what is best for himself ._ Ms.~Pierce continued saying they have recently began construction on their home and Mr. McSheehy has put out an extra effort to make sure they are building in accordance with the regulations and the Pierces feel he should be held responsible for abiding by them as well. They feel they have the right to request the enforcement of the designated setbacks because the building involved with the rear property line will be directly outside their kitchen window and they believe it will impair the supply of light and air and pose a higher fire risk to their building. Board Member ABBOTT wanted to know if their main concern is the shed or the carport. The shed is more of a problem because it will be right out side of .their kitchen window. Entered into record was a photo of the foundation of their new home labeled Exhibit 'C'. Mr. Fellman spoke again saying it is true the applicant does not reside at the address, however his sister does. If the applicant is made to move the shed 12' west he. does not see how that could make much of a difference, but it would pose a substantial hardship for Mr. McSheehy because it would eliminate the turning radius .for the trucks. It would also take away his storage, thus putting more heavy equipment outdoors. No further questions were asked. Board Member ABBOTT suggested this resolution be in two parts.
