NOTICE OF PUBLIC NEARING
Notice is hereby given of a public hearing to be held before the Wheat Ridge
Board of Adjustment on December 8, 1994, at 7:30 p.m., at 7500 West 29th
Avenue, Wheat Ridge, Colorado. All interested citizens are invited to speak
at the public hearing or submit written comments. The following petitions
shall be heard:
Case No. WA-94-16: An application by Herbert Daniels, Sr., for approval
of a four and one-half foot variance to the minimum required sideyard
setback of five feet and a sixteen foot variance to the minimum required
30 foot rear yard setback. The request is to allow a carport to be
located 6 inches from the north property line and 14 feet from the east
property line for property zoned Residential One-C. The property is
located at 3950 Kendall Street and is legally described as follows:
Lot 3, Swanson's Subdivision
County of Jefferson, State of Colorado
2. Case No. WA-94-18: An application by Gordon Sign Company for approval
of a 26.5 square foot variance to the total area allowed for a free-
standing sign. The request is to allow the relocation of an existing
non-conforming freestanding sign. Said property is located at 4300
Wadsworth Boulevard and is legally described as follows:
The west one-half of the northwest quarter of the southeast
quarter of Section 23, Township 3 South, Range 69 West, except the
north 35 feet thereof as described in Book 723 at page 158 and
except portion described in Book 1187 at Page 448. County of
Jefferson, State of Colorado.
3. Case No. WA-94-19: An application by Gordon Sign Company for approval
of variances to Section 26-409(9) and Section 26-412(0)(2) to allow a
roof sign and to allow a wall sign on a wall that does not front upon a
public street. Said property is located at 9930 W. 49th Avenue and is
legally described as follows:
Lot 1, TOGETHER WITH ingress-egress and parking easement lying
within Lot 2 as contained in Ingress-Egress and Parking Easement

The applicant is requesting variances to both the required side and rear yard setbacks to
allow the construction of a detached carport. A 4.5 foot variance to the required 5 foot
side yard setback and a 16 foot to the required 30 foot rear yard setback is needed to
allow the carport to be placed .5 foot from the north property line and 14 feet from the
east property line.
The subject site is located at 3950 Kendall Street, is approximately 8,730 square feet in
area, contains a 1,422.9 square foot residence with an attached garage. The parcel is a
through lot that is fronted by Kendall Street to the west and backs onto Jay Street to the
east. Because of Jay Street the required rear yard setback for the carport is 30 feet.
FINDINGS OF FACT
Can the property in question yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by the regulations for the district
in which it is located?
It can be assumed that the properly can yield a reasonable return in use if permitted to
be used only under the conditions allowed by the regulations as the residence has
existed and will remain on this property regardless of the required 30 foot rear yard
setback; and
2. Is the plight of the owner due to unique circumstances?
Circumstances could be considered unique as the property is a through lot which
requires 30 foot setbacks from both the rear and front property lines; and
3. If the variation were granted, would it alter the essential character of the locality?
The granting of this variance would not alter the essential character of the local
neighborhood as of the 6 residences that are adjacent to Jay Street, 4 currently have
nonconforming setbacks. These setbacks range from 10 feet for a garage at 3900
Kendall Street and 10 feet for the residences at 3920 and 3990 Jay Street to 18 feet for a
garage at 3860 Kendall Street; and
4. Are there any particular physical surroundings, shape or topographical conditions o4 the
property involved that would result in a particular hardship?
There are no particular physical surroundings, shape or topographical conditions of the
property that would result in a hardship; and
5. Are the conditions upon which the petition for a variation is based be applicable,
generally, to the other property within the same zoning classification?
The conditions upon which the petition is based would not be applicable to other

properties within the same zoning classification; and
6. Is the purpose of the variation based exclusively upon a desire to make more money out
of the property?
The purpose of this variance is not based exclusively upon the desire to make more

interest in the property?
No hardship has been created by any person presently having an interest in the
property; and
8., Will the granting of the variation be detrimental to the public welfare or injurious to other
property or improvements in the neighborhood in which the property is located?
The granting of this variance will not be injurious to other property or improvements in
the neighborhood; and
9. Will the proposed variation impair the adequate supply of light and air to adjacent
property or substantially increase the congestion in the public streets or increase. the
danger of fire or endanger the public safety and substantially diminish or impair property
values within the neighborhood?
The granting of this variance will not impair the adequate supply of light to the front yard
of the property directly to the north of the subject site.

Motion was made Board Member ROSSILLON, seconded by Board
Member ABBOTT that the agenda be approved as printed.
Motion carried 6-0.
3. PUBLIC FORUM (This is the time for anyone to speak on any
subject not appearing on the agenda.)
No one came forward to speak.
4. PUBLIC HEARING
A. Case No. WA-94-16: An application by Herbert Daniels, Sr.,
for approval-of a 4 1/2 foot variance to the minimum
required,sideyard setback of 5 feet and a 16 foot variance
to the minimum required 30 foot rear yard setback. The
request is to allow a carport to be located 6 inches from
the north property line and 14 feet from the east property
line for property zoned Residential One-C and located at
3950 Kendall Street.
Greg Moberg, presented the staff report. All pertinent
documents were entered into record, which Chairman JUNKER
accepted.
Board Member ABBOTT questioned why in this case were the
conditions upon which this petition based not applicable
to other properties within the same zoning classifications,
and Mr. Moberg replied it is based on the fact that this is
a through-lot and there is already existing setback
encroachments.
Board Member ECHELMEYER asked Mr. Moberg to describe a
carport and will this just be a shelter-roof, and Mr. Moberg
answered per our ordinance a carport is dealt with exactly
the same as a garage. The applicant has indicated he wants
to build a carport with no side walls, however enclosing the
sides would be acceptable as far as our code goes.
Board Member ABBOTT asked if the 14 feet from Jay Street to
the carport is from the City's right-of-way, and Mr. Moberg
answered yes.
Board Member ROSSILLON asked if there is a sidewalk in front
of this property, and it was determined there is none. Mr.
Moberg said in this instance these are all rear yards and
the street is very short.
No further questions were asked of staff.

The applicant, Herbert Daniels, Sr., 3950 Kendall Street,
was sworn in.
Board Member ROSSILLON was concerned with the one setback
being so close to the property on the north side, and Mr.
Daniels said he needs the space to park his pick-up and car
along side of the trailer.
Board Member ROSSILLON questioned if the carport could be'
moved more south and Mr. Daniels said he also. has a Sth-
wheel trailer to be parked there and he cannot extend south
without getting in the way of something else.
Board Member ABBOTT added he shares the concern of having to
push the property line so tightly on the north and said one
of the reasons for setbacks is to keep the neighbors wall
from being so close to a fence. Mr. Daniels said this
carport will have no walls, so basically all he wants is
four posts and a roof. He assured the Board the carport
will not be converted into a garage.
Board Member ECHELMEYER wanted to know on the 18' x 20' size
carport, where would the 18 feet begin, and Mr. Daniels said
it would be back 10-12 feet to the west and right at the end
of the concrete slab.
Board member ECHELMEYER asked how high will the roof be, and
Mr. Daniels replied 10 feet from the concrete and added, the
roof will be flat.
Board Member ABBOTT commented the neighbor's house is set
back and faces Jay Street, so it is not aligned directly
with the proposed carport.
Board Member HOVLAND,stated his concerns with the setback
even though he understands there .are too many vehicles to
come further south with the carport. Mr. Daniels said he
also has a greenhouse that will line up with the carport.
Mr. Moberg said after scaling this off it appears the
structure on the property to the north will be approximately
10 feet west of where the carport will be placed.
No further questions were asked.
Chairman JUNKER announced there is six members present
therefore, five affirmative votes will, be needed for any
variance to pass.

Motion was made by Board Member ABBOTT, that Case No. WA-94-
16, an application by Herbert Daniels, Sr., be APPROVED for
the following reasons:
1. Circumstances could be considered unique because the
property is a through-lot which requires 30 foot
setbacks from both the rear and front property lines.
2. The granting of this variance will not alter the
essential character of the neighborhood as four
residents on Jay Street have non-conforming setbacks.
3. The neighboring structure directly to the north is
aligned west of the proposed carport.
4. Several neighbors have written statements in favor of
the improvement.
WITH THE FOLLOWING CONDITION:
1. The sides of this structure may not be enclosed.
Motion was seconded by Board Member ROSSILLON. Motion
carried 6-0. Resolution attached.
B. Case No. WA-94-18: An application by Gordon Sign Company
for approval of a 26.5 square foot variariae to the total
area allowed for a free-standing sign. The request is to
allow the relocation of an existing non-conforming free-
standing sign for property located at 4300 Wadsworth
Boulevard.
Greg Moberg presented the staff report. All pertinent
documents were entered into record, which Chairman JUNKER
accepted.
Board Member ECHELMEYER questioned if the owner of the
Gemini Restaurant should be the applicant and be present,
and Mr. Moberg answered anybody can make application, and in
this case Gordon Sign Company is the applicant.
Board Member HOVLAND asked if there are any regulations
regarding setbacks in the sign code, and Mr. Moberg
answered the setback in this request has not changed; this
is only a sign area variance.
Board Member Hovland thought the original sign was setback
further, and Mr. Moberg said if the original sign was
setback further it could be placed as a condition to set the
new sign further back also.
Board Member ECHELMEYER commented it is the same basic sign
and will have the same framework .and same height.

Adjustment, do hereby certify that the following Resolution was
duly adopted in the City of Wheat Ridge, County of Jefferson,
State of Colorado, on the 8th day of December 1994.

ROSSILLON the following Resolution was stated.
WSEREAS, the applicant was denied permission by an Administrative
Officer; and
WHEREAS, Board of Adjustment Application, Case No. WA-94-16
is an appeal to this Board from the decision of an Administrative
Officer; and
91SSREAS, the property has been posted the required 15 days by law
and there WERE NO protests registered against it; and
~PSERSAS, the relief applied for MAY be granted without detriment
to the public welfare and without substantially impairing the
intent and purpose of the regulations governing the City of Wheat
Ridge.
NOW, '~'a*;ARFORS, 8E IT RESOLVED that Board of Adjustment
Application Case No. WA-94-16 be and hereby is APPROVED
TYPE OF VARIANCH: A 4 1/2' to the minimum side yard setback and ,a
16' to the minimum rear yard setback.
PDRPOSH: To allow a carport to be located 6".from the north
property line and 14' from the east property line.
FOR THE FOLLOWING REASONS:
1. Circumstances could 'be considered unique because the property
is a through-lot which requires 30' setbacks from both the
rear and front property lines.
2. The granting of this variance will not alter the essential
character of the neighborhood as four residents oa Jay Street
have non-conforming setbacks.
3. The neighboring structure directly to the north is aligned
west of the proposed carport.
4. Several neighbors have written statements in favor of the
improvement.
