Board of Adjustment Staff Report Case No. WA-9418 REQUEST Page 2 The applicant is requesting a 26.5 square foot variance to the maximum area allowed for a freestanding sign. This request is to allow an existing freestanding sign to be moved from it's present location to a new location. In March of 1980 a sign permit was submitted and approved fora 130 square foot freestanding sign. This approval was based on the existing Sign Code allowing a total of 138.75 square feet based on the following: 4,050 square foot building 75 square feet of signage for the first 1,500 square feet of building area an additional square foot of signage for each additional 40 square feet. Currently the Sign Code allows a maximum freestanding sign area of 103.5 square feet based on the following: 6,750 square foot building 100 square feet of signage for the first 5,000 square feet of building area an additional square foot of signage for each additional 500 square feet. Section 26-408: allows nonconforming sign to remain provided that the sign is not rebuilt, enlarged, relocated, extended or reconstructed. Therefore to allow the sign to be moved approval of a variance is required. II. FINDINGS OF FACT Can the properly in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by the regulations for the district in which it is located? It can be assumed that the property can yield a reasonable return in use if permitted to be used only under the conditions allowed by the regulations of the current Sign Code. All other businesses must conform to the same sign area restrictions and it would seem that this site is not unique; and 2. Is the plight of the owner due to unique circumstances? Circumstances should not be considered unique as many signs were rendered nonconforming with the adoption of the new Sign Code and as the code did not require immediate removal of nonconforming sign it does require nonconforming signs to be brought into conformance the exceptions are not met; and 3. If the variation were granted, would it after the essential character of the locality? Are there any particular physical surroundings, shape or topographical conditions of the property involved that would result in a particular hardship? There are no particular physical surroundings, shape or topographical conditions of the property that would result in a hardship; and 5. Are the conditions upon which the petition for a variation is based be applicable, generally, to the other property within the same zoning classification? The conditions upon which the petition is based would be applicable to other properties within the same zoning classification as there are no unique circumstances nor hardships that separate this site from any other; and 6. Is the purpose of the variation based exclusively upon a desire to make more money out of the property? The purpose of this variance is based exclusively upon the desire to make more money as a larger sign would attract more attention and hopefully more clients; and 7. lias the alleged difficulty or hardship been created by any person presently having an interest in the property? No hardship has been created by any person presently having an interest in the property; and 8. Will the granting of the variation be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located? The granting of this variance will not be injurious to other property or improvements in the neighborhood; and g. Will the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety and substantially diminish or impair property values within the neighborhood? Circumstances could be considered unique because the property is a through-lot which requires 30 foot setbacks from both the rear and front property lines. 2. The granting of this variance will not alter the essential character of the neighborhood as four residents on Jay Street have non-conforming setbacks. 3. The neighboring structure directly to the north is aligned west of the proposed carport. 4. Several neighbors have written statements in favor of the improvement. WITH THE FOLLOWING CONDITION: 1. Case No. WA-94-18: An application by Gordon Sign Company for approval of a 26.5 square foot variance to the total area allowed for a £ree-standing sign. The request is to allow the relocation of an existing non-conforming free- standing sign for property located at 4300 Wadsworth Boulevard. Greg Moberg presented the staff report. All pertinent documents were entered into record, which Chairman JUNKER accepted. Board Member ECHELMEYER questioned if the owner of the Gemini Restaurant should be the applicant and be present, and Mr. Moberg answered anybody can make application, and in this case Gordon Sign Company is the applicant. Board Member HOVLAND asked if there are any regulations regarding setbacks in the sign code, and Mr. Moberg answered the setback in this request has not changed; this is only a sign area variance. Board Member Hovland thought the original sign was setback further, and Mr. Moberg said if the original sign was setback further it could be placed as a condition to set the new sign further back also. Board Member ECHELMEYER commented it is the same basic sign and will have the same framework and same height. WHEAT RIDGE BOARD OF ADJIISTMENT MINOTES OF MEETING: December 8, 1994 Page 5 Board Member ABBOTT wanted to know if the lettering on the bottom of the proposed sign was figured in the square footage, and Mr. Moberg answered yes. It was noted there is 10' from the ground to the bottom of the sign. No further questions were asked of staff. Fred Page, Gordon Sign Company, 2930 W. 9th Avenue, Denver, CO, was sworn in. Board Member ECHELMEYER wanted to know why .the sign is being moved, and Mr. Page replied because the property to the north planted trees years ago, and they have grown so much the sign cannot be seen. By moving it across the parking lot, there will be better visibility when coming from the north. They have talked to the owners of the north property and they are not really too willing to cut down the trees, they will; but Mr. Page does not feel that will be necessary. The trees do enhance the northern property and the applicant does not want to do damage to that. Mr. Page said everything will remain the same as the present sign. Board Member HOVLAND questioned if there is anything on the bottom of the sign that could be eliminated so it could be in conformance, and Mr. Page said the 'wording on the bottom does have something to do with the restaurant so they do aot want that eliminated. Regarding the setback, Mr. Page said the proposed sign has been located back towards the building as far as possible without getting in to the restaurant's patio. Photos were entered into record, labeled Exhibit 'A'. Consensus was the sign will be placed in a much better location. No further questions were asked. Motion was made by Board Member ABBOTT that Case No. WA-94- 19, be APPROVED for the following reasons: 1. The proposed location would be an improvement over the previous location. 2. Trees have grown up on the north significantly blocking the view of the sign from the north. 3. The sign may not be moved into a complying setback because of the locatioa of the building. Board Member ROSSILLON offered an amendment eliminating #3 above and inserting the following: WHEAT RIDGS BOARD OF ADJIISTMSNT MINIITSS OF MSETING: December 8, 1994 Page 6 3. The relocated sign must meet all current sign code requirements. Board Member ROSSYLLON suggested to change all wording to read "legal non-conforming sign". Motion was seconded by Board Member ROSSILLON. Motion carried 6-0. Resolution attached. C. Case No. WA-94-19: An application by Gordon Sign Company for approval of variances to Section 26-409(9) and Section 26-410(0)(2) to allow a roof sign and to allow a wall sign on a wall that does not front upon a public street. Said property is located at 9930 W. 49th Avenue. Greg Moberg presented the staff report. All pertinent documents were entered into record, which Chairman JUNKER accepted. Board Member ROSSYLLON asked if there are currently three signs on the property, and Mr. Moberg answered yes, they have three legal signs. Board Member ABBOTT questioned if they were asking for an additional wall sign on the east above the entrance, and Mr. Moberg replied yes, they are replacing as illegal sign that had not received a variance. Board Member ECHELMEYER said the diagram submitted does not indicate where the Y-70 identification sign sets in relation to the building. Mr. Moberg answered it shows the sign to be on the west side of the building towards the corner. Board Member ECHELMEYER asked if .the property could have two signs on the same side of the building, and Mr. Moberg replied yes. Free-standing and wall signs are figured completely separate ammd it does not matter which side of the building they are on. Board Member WALKER asked at this point if we are addressing the neon request also and Mr. Moberg answered yes. Board Member HOVLAND questioned the sign at Motel 6 being a roof sign, and Mr. Moberg replied technically it is not a roof sign because the roof is not peaked. A roof sign can be 3 feet above a flat roof. The motel also has right-of- way all around the property so that is why they have the neon. Furr's Cafeteria also has neon but it is all under the eaves.
