Walter, Chairman Foothills Bank 4975 Kipling Street P.O.Box 228 Wheat Ridge, Colorado 80034-5138 LETTER OF UNDERSTANDING Re: Improvement requirements for the temporary Bank occupancy to remain in effect as further development occurs within the Bluegrass Development. bear Mr. Walter: As we discussed in our meeting on Mazch 17, there are several requirements which must occur for the temporazy use of the existing bank building to continue while the remainder of the Bluegrass Site is developed. Future traffic generated by further development requires that all public improvements along both property frontages be constructed in conformance with the approved plans on file with the City. The exception will be the sidewalk along 50's to allow for the return lane of the drive thru banking lane as shown in Exhibit A which is attached and part of this letter. More specifically, the requirements as we discussed aze listed below. SEE ATTACHED EXHIBIT A Landscape the west end of the lot adjacent to Street "A" along with the other site improvements shown in the attached Exhibit A. Construct curb and gutter, sidewalk, asphalt, and striping improvements along both frontages per the approved plans on file with the City with the exception of the sidewalk along 50'" Avenue to allow for the drive thru banking lane. Note: If the field staked radius for the drive thru is not sufficient for alI traffic, a temporary sign shall be placed at the drive thru lane advising drivers of long wheelbase vehicles to use the right drive up lane. Construct the turn island at the intersection with all curbing, patterned concrete, and ramps. No direct vehicular cross access will be allowed to the property directly south of the Bank at the southeast comer of the property. This access would aggravate a left turn access problem from northbound Kipling Street into the site. Any plan amendments which he may require shall be submitted to the City for approval and approved by the Ciry prior to any construction. ' The improvements listed above must be complete and in place prior to the issuance of a Building Permit for any new structure on the development site. Please note that the reference to allowing 40 feet to be constructed on SOs' has been stricken from the exhibit. This is due to information wIuch I received from Mr. Kannapinn regazding the turning movement for long wheelbase vehicles noted above. Please provide the exact address for the project. Historic Drainage System 1. Please provide further, numerically ,based discussion in this section. with respect to the historical values of the initial _a and major storm frequencies-for the respective historical basins analyzed. Box 638 Wheat Ridge, CO 800346038 Dr. Sean, Thank you for the referral on Blue Grass Terrace (case no. MS-96-6/PBG-96-1 ). As you may be aware, the City of Arvada, the State of Colorado, and the City of Wheat Ridge have been working on a plan for the Ridge Home area. This area is within that plan. As a part of this plan there are common streets and other improvements which connect through and serve both jurisdictions. In order to properly facilitate the construction of these improvements certain costs have been proposed to be shared. Currently the State Land Board is fine tuning the engineering estimates made by the plan consultants, RNL. When this is completed, we will need to meet with Wheat Ridge and State staff to go over possible alternative for cost sharing of the improvements. Phil Cortese of our city managers office and Jane McVey of our economic development staff have been coordinating this plan. Following are comments received from the appropriate city agencies: Transportation Division Comments 1. The left turn signal is to be moved from W. 49th to 50th Ave. with a full turning movement at W. 50th Ave. The turning radii must be able to accommodate Coors trucks. 2. Who is paying for the construction of W. 50th, and W. 49th and what portions of the street are being constructed? 3. It would be desirable to coordinate our landscape designs for the street frontages. Development/Drainage Engineer Comments 4. More information should be provided regarding the improvements proposed along P.O. 60X 8101 • $101 RALSTON ROAD • ARVADA, COLORADO • 80001-$101 W. 50th Avenue. The Columbine Study prepared by the Urban Drainage and Flood Control District in cooperation with the cities of Arvada and Wheat Ridge, show that a box culvert and open channel improvements are necessary within the W. 50th Avenue alignment. These improvements should be constructed in conjunction with the construction of W. 50th Avenue. 5. Also, we request a copy of the utility plan and drainage plan for this development. Transportation Division Comments 6. The first access on W. 50th Ave., west of Kipling St., should be restricted to right- in, right-out only. 7. An acceleration lane will be required along the west side of Kipling St. south of W. 50th Ave. 8. A left turn lane into W. 50th Ave. from Kipling St. will need to be provided. 9. Amore detailed diagram, showing the lane configuration for the intersection of W. 50th Ave and Kipling St., should be submitted for review. 10. A left turn pocket should be provided for Street B. All-weather fire dept. access roadways, minimum of 20 feet of unobstructed width, capable of supporting-the imposed loads of fire apparatus need to be provided prior to above grade construction.-. UFC 41 10.204(a),(b). 3. The island at the S.W. corner of building 4 needs to__be reduced to allow proper turning radius for fire apparatus. UFC 91 1D.204(c). 4. Fire lanes will need to be posted, "IQo Parking Fire Lane" with signs that meet City of Wheat Ridge Standards. UFC 91 1D.20fi. 5. A new 12" and 8" water mainline extension will be needed to service the project. 2. New service lines and water taps will be required to service each of the separate commercial buildings. 3. A water line extension easement on W. 50th Avenue must be obtained by the owner from the State Land Board that meets the Valley Water District and Denver Water Requirements. 4. The water line extension easement from W. 49th Avenue to W. 50th Avenue through the property must be provided to Valley Water District that meets District and Denver Water Department requirements. 5. The area shown as Tract C on the Blue Grass proposed plat to be vacated by the City of Wheat Ridge has existing water lines, gas, telephone and sewer lines in place. Proper wording must be placed in the document to assure the water line easement is in place for repairs and maintenance of the water line. Also, it should state that no construction activity should take place on Tract C that would effect the structural integrity of the water line. The Valley Water District has met with Leroy Tobler and Jenny Shrader of Contra Engineering regarding these requirements. I have also attached a copy of the area in Tract C from with City of Wheat Ridge Special Improvement District plan 1987-1, page 28 that shows existing water lines in the Tract C area highlighted in blue. MS-96-8/WSP-96-y/WV-96-3 DESCRIPTION OF REQUEST Page 2 This is a proposal to develop asix-acre, Commercial-One (C-1) zoned property located in the IGpling Activity Center into amulti-building, unified commercial center. In order to develop in the manner desired by the applicant, there are several different approvals necessary by the City as follows: 1. Site plan with a Master Sign Plan (IA/SP-96-1) 2. Street Vacation (WV-96-3) 3. Subdivision (MS-96~) II. SffE PLAN (WSP-96-11 The general site plan provides for four new buildings, and an existing cell tower, each located on a new lot to be created by the subdivision discussed under Section IV. The site plan presumes that the excess street right-of-way described under Section III is vacated. The plan provides for access from an internal private drive system and from West 49th Avenue, Kipling and a new West 50th Avenue. The uses proposed are: Lot 1- Retail or gas station (minor site plan modification required for gas station Lot 2 -Fast food Lot 3 -Sit-down restaurant Lot 4 -Bank and office building Lot 5 -Cell tower (existing) The applicant has voluntarily excluded auto sales and service, however staff would also request that sales, service and rental of RVs and boats be excluded, and any other use that requires outside storage, display or operations be excluded. We would also recommend billboard signs be excluded. All C-1 district requirements are met for each lot and each use. The Site Plan includes a signage schedule that qualifies as a Master Sign Plan under Wheat Ridge Code Section 26-411. Each building will have wall signage which complies with the Code. Each lot will have a monument sign (free standing sign under seven feet). There are two "tall signs" which are 50 feet high free-standing signs also proposed oriented to the I-70 traffic. 111. VACATION fWV~6-3) The portion of West 49th Avenue requested to be vacated (Tract B) begins approximately 140 feet west of the northwest comer of West 49th Avenue and Kipling Street and extends approximately 185 feet southwest, and then 705 feet northwest to the terminus 290 feet from the beginning. This excess right- of-way is a result of the realignment of I-70 Front Road North in 1988. Tract B has street frontage on the southeast and southwest (West 49th Avenue) creating frontage on both sides. No construction or development except for drives and parking will be allowed on Tract B. Landscaping and approved landscaping features (i.e., detention ponds) are permitted but written approval from the various utility companies (water, sewer, PSCo. etc.) Is required before landscaping begins. A maintenance easement must remain for the existing water line (per Valley Water District). Landscaping and landscaping features are subject to removal should maintenance occur. Planning Division Staff Report Case Nos. MS-96.6/WSP-961/WV-96-3 N. SUBDNISION PLAT (AIS~96-6) Page 3 Currently, the property exists as five separate parcels measured cumulatively as 6.22 acres. The proposed subdivision will plat the property into five new lots. It will also create private access easements for Streets A & B, will provide an alternate access from Kipling Street between Lots 2 and 4 which will be used only if Amoco agrees to joint access. There also is a small dedication for Kipling Street. West 50th Avenue is proposed north o4 this subdivision on State land board property, however the developer of this subdivision is responsible for street construction of the south half, plus Kipling Street improvements. The plat does not provide for specific construction and maintenance responsibilities for the private access easements and the improvements therein. Such provisions need to be incorporated on the plat or provided by separate document to be recorded with this plat. V. AGENCY REFERRALS Wheat Ridge Public Works will require the following: final drainage study, construction drawings for West 50th Avenue, dumping and landfill permit and a traffic impact study. Also the legal description needs correction and additional right-of-way is needed at the northeast corner of Lot 7 to accommodate the turn lane. Arvada Fire District is requiring the installation of water lines and fire hydrants, with written approval of all locations by the Valley Water District and Fire Marshall's office. Sprinklers will need to be installed in the four-story office building. Valley Water District will require a 72 inch and 8 inch water main line. Water taps are required for each new building. Water line extension easements are required for both West 50th Avenue and West 49th Avenue from the State land Board. VI. PLANNING COMMISSION ACTION AND CONDI710NS: Planning Commission reviewed this request at a public hearing held on June 20, 1996. In regard to the right-of-way vacation, a recommendation for APPROVAL was made for the following reasons: Tract B is not needed for public use. Regarding the five-lot subdivision, a recommendation for APPROVAL was made with the following conditions: 7. Proposed curb cut, on Kipling between proposed lot 1 and lot 2, to be eliminated. 2. Establish the joint access between lot 2 and Amoco. 3. Provide for a landscape buffer between proposed Street B and the property to the west. Regarding the site plan and master sign plan, a recommendation for APPROVAL was made with the following conditions: 1. Revise note #2 to read as follows: "auto, RV, boat, camper sales, service or rental, or any other use that requires outside storage, display, or operations shall be excluded as a permitted use. 2. No billboard signs may be permitted. 3. Current RV storage use may be allowed on site, except upon full build out of site plan. Planning Division Staff Report Case Nos. Applicant did note that the shared access between Lot 2 and the existing Amoco is contingent upon approval from Amoco Corporation. At the time this report was written, there has not been an agreement regarding the shared access. VII. STAFF CONCLUSIONS AND RECOMMENDATIONS RE: WV-96-3: Staff recommends approval of the street vacation request as this right-of-way is unneeded for public access purposes. Utility easements will remain in place. RE: MS-96-6: Staff. recommends approval, subject to Agency Referral comments and subject to common access easements and drive construction and maintenance provision being added and provided to the City Attorney for approval prior to recording. RE: WSP-96-y: Staff recommends approval of the Site Plan and Master Sign Plan subject to the following: A. He explained that B.G.T. He introduced Jerry Kannapan, designer of their site plan; Jenny Shrader, their engineer; John Felton, representing Burger King; and Bob Murray from the Amoco Station. He explained their plans for the site and answered questions. Glen Gidley was sworn in and presented the staff report. The following speakers were sworn in by the Mayor: Ramona Reed, M.D., owns business just north of the development. She is concerned about drainage and doesn't want her parking lot to become a retaining pond. John Fetton, representing Burger King, gave reasons for the necessesity of following the site plan in regards to Burger King and to allow the proposed curb cut. Bob Murray, proprietor of Amoco Station, had concerns about traffic problems if he has to share a curb cut. John Eatwetl, Architect for Burger King, stated that the best location for a curb cut is the one they are requesting. Jerry Kannapan, designer of the site plan, was present to answer questions. He stated that this is a quality, community-friendly development. Jenny Shrader, civil engineer for the project, was present to answer questions. SfTE PLAN IWSP-96-1) The general site plan provides for four new buildings, and an existing cell tower, each located on a new lot to be created by the subdivision discussed under Section IV. The site plan presumes that the excess street right-of-way described under Section III is vacated. The plan provides for access from an internal private drive system and from West 49th Avenue, Kipling and a new West 50th Avenue. The uses proposed are: Lot 1- Retail or gas station (minor site plan modification required for gas station Lot 2 -Fast food Lot 3 -Sit-down restaurant Lot 4 -Bank and office building Lot 5 -Cell tower (existing) The applicant has voluntarily excluded auto sales and service, however staff would also request that sales, service and rental of RVs and boats be excluded, and any other use that requires outside storage, display or operations be excluded. We would also recommend billboard signs be excluded. All C-1 district requirements are met for each lot and each use. The Site Plan includes a signage schedule that qualifies as a Master Sign Pian under Wheat Ridge Code Section 26411. Each building will have wall signage which complies with the Code. Each lot will have a monument sign (free standing sign under seven feet). There are two "tall signs" which are 50 feet high free-standing signs also proposed oriented to the I-70 traffic. III. VACATION (WVti963) The portion of West 49th Avenue requested to be vacated (Tract B) begins approximately 140 feet west of the northwest corner of West 49th Avenue and Kipling Street and extends approximately 185 feet southwest, and 4hen 105 feet northwest to the terminus 290 feet from the beginning. This excess right- of-way is a result of the realignment of I-70 Front Road North in 1988. Tract B has street frontage on the southeast and southwest (West 49th Avenue) creating frontage on both sides. No construction or development except for drives and parking will be allowed on Tract B. Landscaping and approved landscaping features (i.e., detention ponds) are permitted but written approval from the various utility companies (water, sewer, PSCo. etc.) is required before landscaping begins. A maintenance easement must remain for the existing water line (per Valley Water District). Landscaping and landscaping features are subject to removal should maintenance occur. The proposed subdivision will plat the property Into five new lots. h will also create private access easements for Streets A & B, will provide an alternate access from Kipiing Street between Lots 2 and 4 which will be used only if Amoco agrees to joint access. There also is a small dedication for Kipiing Street. West 50th Avenue is proposed north of this subdivision on State land board property, however the developer of this subdivision is responsible for street construction of the south half, plus Kipiing Street improvements. The plat does not provide for specific construction and maintenance responsibilities for the private access easements and the improvements therein. Such provisions need to be incorporated on the plat or provided by separate document to be recorded with this plat. V. AGENCY REFERRALS WheaR Ridge Public Worfu: will require the following: final drainage study, construction drawings for West 50th Avenue, dumping and landfill permit and a traffic impact study. Also the legal description needs correction and additional right-of-way is needed at the northeast corner of Lot 1 to accommodate the turn lane. Arvada Rrc District is requiring the installation of water lines and fire hydrants, with written approval of all locations by the Valley Water District and Fire Marshall's office. Sprinklers will need to be installed in the four-story office building. Valley Water District will require a 12 inch and 8 inch water main line. Water taps are required for each new building. Water line extension easements are required for both West 50th Avenue and West 49th Avenue from the State land Board. VI. PLANNING COMMISSION ACTION AND CONDfIIONS: Planning Commission reviewed this request at a public hearing held on June 20, 1996. In regard to the right-of-way vacation, a recommendation for APPROVAL was made for the following reason: Tract B is not needed for public use. Regarding the five-lot subdivision, a recommendation for APPROVAL was made with the tollowing conditions: 1. Proposed curb cut, on Kipiing between proposed lot 1 and lot 2, to be eliminated. 2. Sean McCartney advised Commission that Case No. MS -96 -6 was a request for a five -lot subdivision, not a four -lot subdivision as indicated. He added that the 30 -foot required setback had been met and therefore, a variance would not be necessary. He added that the owner would -be responsible for street maintenance, but streets would be accessible to the public. Commissioner THOMPSON asked if the City had a preference relative to ingress /egress? Mr. Gidley stated that the City's preference would be the shared ingress /egress with Amoco. He elaborated. Commissioner THOMPSON asked if the proposed gas station would have access only from the shared access, until West 50th Avenue is developed? Mr. Gidley stated the south two lanes of 50th Avenue-would be constructed along with the first building to Street 'A'. Street 'A' will be constructed to at least to the south edge of Burger King. Commissioner-THOMPSON asked if with additional traffic coming into the area, a straight configuration might be preferable, rather than the loop design as shown? Mr. Gidley stated it was once straight, however, the City relocated the frontage road made. the frontage. road the priority movement, instead of West 49th Avenue. At that time 49th became a "T" intersection, which is preferred to an "A intersection. Mr. Oman stated that he- had.spoken to Bob - .Murray, owner and -the officials at Amoco, although he had received nothing official from them, they are quite concerned about the future of the intersection at West 49th Avenue. Mr. Oman stated he would prefer to have the road between Lots 1 and 2. Burger King is in agreement also. Mr. Gidley stated that the Cities of Wheat Ridge and Arvada have concerns regarding the intersection design of Kipling and .1 -70. He elaborated. Commissioner RASPLICKA noted that the Colorado Department of Transportation had no concerns with the request. Mr. Gidley stated it was not included in their roadway system. He added that highway ownership does not go north at 49th Avenue. Discussion followed. . Commissioner THOMPSON asked if you closed 49th Avenue, wouldn't that adversely affect the visibility of the proposed restaurant? Mr. Gidley answered no. Commissioner THOMPSON suggested that no left hand turns be allowed but not close it. Further discussion followed. Mr. Oman .stated_that some type of movement is appropriate for the corner, right -in, right -out would be minimum. Dr. Ramona Reed 12497 West 69th Avenue, was sworn in. Dr. Reed stated that her office is located at 10185 West 49th Avenue and she was concerned about increased noise and traffic. She -was hopeful that a sound barrier could be constructed. Mr. Robert Murray 8335 Kathryn Way, Denver was sworn in. He stated he was representing Amoco. Mr. Murray stated his major concern was with traffic flow in the area. Mr. Murray added that he as well as others in the area need access. He explained further. Dr. Reed stated that the large trucks travel down the Frontage Road to Miller Street and then to 49th Avenue to gain access to George T. Sanders Company. Otherwise, the traffic consists of only small trucks and passenger cars. Jerry R. Kannapinn, 4910 Fox Street, Denver, was sworn in. Mr. Kannapinn stated he was the architect /designer on the project. He was present to answer questions, however, he had rough • sketches showing pallet of materials, etc. He spoke briefly about dealing with sound. . Jenny Schrader 8795 Ralston Road, Arvada, was sworn in. She introduced herself as the engineer on the project. She offered to answer questions. Commissioner ECKHARDT stated he had some real concerns with the proposal, and felt the additional curb cut on Kipling Street was unnecessary. He was concerned about existing traffic problems and the need for a development of this type in the area. He elaborated. She is concerned about drainage and doesn't want her parking lot to become a retaining pond John Felton, representing Burger King, gave reasons for the necessesity of following the site plan in regards to Burger King and to allow the proposed curb cut. Bob Murray, proprietor of Amoco Station, had concerns about traffic problems if he has to share a curb cut. John Eatwell, Architect for Burger King, stated that the best location for a curb cut is the one they are requesting. Jerry Kannapan, designer of the site plan, was present to answer questions He stated that this is a quality, community - friendly development. Jenny Shrader, civil engineer for the project, was present to answer questions.
