Public Service Company of Colorado (PSCo) has reviewed the development plans for 6000 W
32ntl Ave./Harlan St.. To ensure that adequate utility easements are available within this
development, PSCo requests that the following dedication language, or plat note, be placed on
the preliminary and final plats for the subdivision:
Eight-foot (!t) wide utilify easements are hereby granted on private
property adjacent to the front and rear lot lines of each lot in the
subdivision or platted area. These easements are dedicafed for the
installation, maintenance, and replacemenf of electric, gas, television
cable, and felecommunications facilities. Utilifies shall also be permitted
within any access easements and private streets in the subdivision.
Permanent strucfures and water meters shall not be permitted within said
utility easements.
PSCo also requests that these utility easements be depicted graphically on the preliminary and
final plats. While these easements should accommodate the majority of utilities to be installed
in the subdivision, some additional easements may be required as planning and building
progresses.
As a safety precaution, PSCo would like to remind the developer to call the Utility Notification
Center, at 1-800-922-1987, to have all utilities located prior to construction. If PSCo has
existing gas or electric distribution facilities in this area, the developer should contact PSCo's
Engineering Department at (303) 425-3867, regarding the use or relocation of these facilities.

I have reviewed your request for approval of a two-lot minor
subdivision and have the following comments:_
1. Centerline of Harlan Street must be shown.
2. Case history box with case number (MS-96-7) must be added_
3. Owners address and phone number must be added.
4. Signature block for the holder of the deed of trust. should
be expanded as follows: "Holder of deed of trust hereby
releases claim to areas dedicated to public use."
5. Existing structures must be shown with dashed lines.
6. Street addresses must be added.
7. Non-exclusive utility easements must be added as follows:
five feet along side lot lines and ten feet -along rights-of-
way.
8. A five-foot right-of-way dedication along Harlan with the
language on the plat as being "hereby dedicated!'.

I have scheduled a public hearing in front of Planning Commission

The applicant requests approval of a two-lot minor subdivision for property located at 6000 West 32nd
Avenue and 3175 Harlan Street.
II. SUBDMSION DESIGN
The property is zoned R-2 and has two single-family residences on it. The purpose of the application is
to create a separate parcel for the home to the south.
Right-of-way is being dedicated for Harlan Street (5~ and a 15 foot corner radius. Tract °A' needs to be
designated as being "hereby dedicated for right-of-way purposes".
No zoning violations have been created with the new common property line. All requirements of the
Subdivision Regulations have been met.
III. AGENCY REFERRALS
All agencies are already serving the property and have no problems with the plat document.
Public Works is requiring 5 feet of right-of-way for Harlan Street and a YS-foot corner radius. They have
approved the plat.
N. STAFF CONCLUSIONS AND RECOMAAENDATIONS
Staff concludes that a subdivision is required to create separate parcels for the property. Staff further
concludes that all outside agencies are servicing the property and that all requirements of the
Subdivision Regulations have been met. For these reasons, a recommendation of approval is given with
the following condition:
1. Tract 'A' be shown as being "hereby dedicated for right-of-way purposes".

Meredith Reckert presented the staff report, which included
slides. Entered and accepted into the record were the Zoning
Ordinance, Subdivision Regulations, case file and packet
materials.
Commission had no questions at that time for Staff.
Lawrence Gill, 6000 West 32nd Avenue was sworn in. Mr. Gill
stated he was requesting the subdivision so that he could deed to
his daughter the second residence on the property.
Fleix Poletto, 5925 W 32nd Avenue was sworn in. Mr. Poletto
stated he represented the Sons of Italy Lodge at 5925 West 32nd
Avenue and wanted to know if a two-lot minor subdivision would
include another residence.
Chairperson LANGDON stated no, it would not.

Meredith Reckert presented the staff report. Entered and
accepted into the record were. the Comprehensive Plan, Zoning
Ordinance, Subdivision Regulations, case file, packet materials
and exhibits.
Commissioner ECKHARDT asked if all the proposed land uses had
already been approved?
Ms. Reckert answered yes, that was true.
Commissioner ECKHARDT was concerned that the architectural
rendering of the duplex showed exit/entrance onto West 32nd
Avenue.
Ms. Reckert stated staff would not recommend any additional curb
cuts onto West 32nd Avenue. She added for that lot the only
access should be to Zinnia Court.
Commissioner CERVENY asked Ms. Reckert what date the land uses
had been approved on this parcel?
Ms. Reckert answered that the original annexation occurred in
1974.
Chairperson LANGDON asked Ms. Reckert for a list of the items
requiring correction.
Ms. Reckert stated the list was extensive. She added that rather
than itemizing everything, she had laid out the general items in
the staff report, but under conditions of approval, she had noted

The applicant requests approval of a two-lot minor subdivision for property located at 6000 West 32nd
Avenue and 3175 Harlan Street.
II. SUBDNISION DESIGN
The property is zoned R-2 and has two single-family residences on it. The purpose of the application is
to create a separate parcel for the home to the south.
Right-of-way is being dedicated for Harlan Street (5~ and a 15 foot corner radius. Tract 'A' needs to be
designated as being "hereby dedicated for right-ot-way purposes".
No zoning violations have been created with the new common property line. All requirements of the
Subdivision Regulations have been met.
111. AGENCY REFERRALS
All agencies are already serving 4he property and have no problems with the plat document.
Public Works is requiring 5 feet of right-of-way for Harlan Street and a 15-foot corner radius. They have
approved the plat.
N. PLANNING COMMISSION
A public hearing in front Planning Commission was held on August 15, 1996. A recommendation of
approval was made whh the following condition:
Tract 'A' be shown as being "hereby dedicated for right-of-way purposes".
V STAFF CONCLUSIONS AND RECOMMENDATIONS
Staff concludes that a subdivision is required to create separate parcels for 4he property. Staff further
concludes that all outside agencies are servicing the property and that all requirements of the
Subdivision Regulations have been met. For these reasons, a recommendation of approval is given with
the following condition:
1. Tract 'A' be shown as being "hereby dedicated for right-of--way purposes".

Glen Gidley was sworn in by the Mayor and presented the staff report.
Motion by Mrs Fields that Case No MS -96 -7, a request for a two -lot minor subdivision at
6000 West 32nd Avenue /3175 Harlan Street, be approved for the following reasons 1 A
subdivision is required to create two parcels 2 All requirements of the Subdivision
Regulations have been met. With the following condition 1 Tract A be shown as being
hereby dedicated for right -of -way purposes ", seconded by Mr DiTullio
Motion by Mr DiTullio to amend the motion that the dedication only include a 15 ft corner
radius and the 5 ft dedication on Harlan Street be eliminated, seconded by Mrs. Shaver
Mr DiTullio called for the question, carried 5 -3 with Councilmembers Eafanti, Dalbec, and
Slier voting no
Motion on amendment carried 6 -2 with Mr Slier and Mr Solano voting no
Original Motion as amended carried 7 -1 with Mr Siler voting no
