Planning Division Staff Report Case No. MS-97-2/Daddis Page 2 I. REQUEST The applicant requests approval of a two-lot minor subdivision on property located at 4445 Parfet and 11050 West 45th Avenue. The property in question contains 1.34 acres and is "L-shaped" with frontages on both Parfet Street and West 45th Avenue. The purpose of the subdivision is for the sale and construction of a single family residence on the 45th Avenue parcel (Lot 1). At the time of this writing, there are no specific plans for development on the Parfet Street parcel (Lot 2). II. SUBDIVISION DESIGN The property is split-zoned with Residential-Two zoning on the northern portion and Residential-Three zoning on the south. Lot 2 (southern lot) is totally encompassed with R-3 zoning where Lot 1 (northern lot) has R-2 zoning on the northern 150 feet, with the southern 65 feet zoned R-3. Staff has indicated the location of the zoning boundary line in red pen on the plat. All minimum requirements of the R-2 and R-3 zone district have been met. Based on lot width restrictions, only a single family residence can be built on Lot 1. There is a 75 foot wide Public Service Company easement which traverses the property restricting development on both lots. No permanent structures can be built within this easement, however, it can be used for driveways and landscaping with ornamental-sized trees. The prospective purchaser of Lot 1 is aware of the encumbrance on the property and has been designing the house layout accordingly. A 10 foot right-of--way dedication will occur for West 45th Avenue. No additional right-of--way is required for Parfet Street. Existing mature trees have been located on the plat. A note should be added that these trees cannot be removed unless indirect conflict with a building envelope. Despite legal description problems which need to be corrected prior to review by City Council, all requirements of the Subdivision Regulations have been met. III. AGENCY REFERRALS Public Works will require a final drainage report prior to the issuance of a building permit for the house. Street construction plans will be required for any requested improvements along West 45th Avenue plus fmancial guarantees for the improvements. There aze legal description problems with the plat which must be corrected prior to City Council review. Fruitdale Sanitation District has main lines in Parfet and Pierson Streets. If the property is used for development other than a single family residence, additional mainlines and hydrants may be required. STAFF CONCLUSIONS AND RECOMMENDATIONS Staff has concluded that a subdivision must occur in order for the 45th Avenue pazcel to become a marketable and developable lot. Staff further concludes that all minimums of the R-2 and R-3 zone district regulations have been met and that aside from legal description problems, all requirements of the Subdivision Regulations have been met. For these reasons, a recommendation of approval is given with the following conditions: 1. Legal description problems be corrected before review by City Council. 2. A note be added to the plat requiring that no existing, mature trees be removed unless in direct conflict with a building envelope. V. Planning Division Staff Report Page 2 Case No. MS-97-2/Daddis I. REQUEST The applicant requests approval of a two-lot minor subdivision on property located at 4445 Parfet and 11050 West 45th Avenue. The property in question contains 1.34 acres and is "L-shaped" with frontages on both Parfet Street and West 45th Avenue. Please refer to Exhibit `A' which is the plat version being reviewed by City Council. The purpose of the subdivision is for the sale and construction of a single family residence on the 45th Avenue parcel (Lot 1). At the time of this writing, there are no specific plans for development on the Parfet Street parcel (Lot 2). This case was originally scheduled for the September 22 and has been continued twice because of survey problems. II. SUBDIVISION DESIGN The property is split-zoned with Residential-Two zoning on the northern portion and Residential-Three zoning on the south. Lot 2 (southern lot) is totally encompassed with R-3 zoning and Lot 1 (northern lot) has R-2 zoning. Staff would note that the plat being reviewed is somewhat different than that presented to Planning Commission. Included under Exhibit `B' is the version approved by Planning Commission which shows Lot 1 substantially larger (north to south dimension) with split-zoning (R-2 on the north & R-3 on the south). Appazently this was a mistake on the part of the surveyor which has been corrected. From a practical stand point, Exhibit `A', makes more sense as it allows the lot line to follow the zone line and lets lot 2 be regulazly shaped, thus more developable. All minimum requirements of the R-2 and R-3 zone district have been met. Based on lot width and size restrictions, only a single family residence can be built on Lot 1. There is a 75 foot wide Public Service Company easement which traverses the property resiricting development on both lots. No permanent structures can be built within this easement, however, it can be used for driveways and landscaping with ornamental-sized trees. The prospective purchaser of Lot I is aware of the encumbrance on the property and has been designing the house layout accordingly. A 10 foot right-of--way dedication will occur for West 45th Avenue. No additional right-of--way is required for Parfet Street. Existing mature trees have been located on the plat. A note should be added that these trees cannot be removed unless in direct conflict with a building envelope. Lot sizes should be designated in squaze footage, rather than acreage. All requirements of the Subdivision Regulations have not been met as there aze still outstanding legal description problems. Please refer to Exhibit `C'. There is also an 8' property line discrepancy with the property owner to the east at 4499 Parfet. Staff has met with the owner, Pete Synko, to discuss the situation and offer solutions. To our knowledge, the Planning Division Staff Report Case No. MS-97-2/Daddis Page 3 surveyor has not contacted Mr. Synko to try and resolve the situation. III. AGENCY REFERRALS Public Works has reviewed and approved a final drainage report. Street construction plans will be required for any requested improvements along West 45th Avenue plus financial guazantees for the improvements. There are legal description problems with the plat which have not been addressed by the surveyor. Fruitdale Sanitation District has main lines in Parfet and Pierson Streets. The northern lot may have some difficulty reaching a main. Valley Water District has main lines in Pazfet and 45th Avenue. If the property is used for development other than a single family residence, additional mainlines and hydrants may be required. Arvada Fire Protection District has no objections to the construction of one single family residence. IV. Planning Commission Action Planning Commission reviewed this request at a public hearing on August 7, 1997. A recommendation for approval was made for the following reasons: 1. A subdivision must occur in order for the 45th Avenue parcel to become a mazketable and developable lot. 2. All minimum requirements of R-2 and R-3 zone districts regulations have been met. 3. All requirements of the subdivision regulations have been met. With the following conditions: 1. Legal description problems be corrected before review by City Council. 2. A note be added to the plan requiring that no existing mature trees be removed unless in direct conflict with a building envelope. Staff would note that the legal description problems have not been corrected forcing Staff to give a denial recommendation. V. STAFF CONCLUSIONS AND RECOMMENDATIONS Staff has concluded that a subdivision must occur in order for the 45th Avenue parcel to become a Planning Division Staff Report Page 4 Case No. MS-97-2/Daddis marketable and developable lot. Staff fiirther concludes that all minimums of the R-2 and R-3 zone district regulations have been met. However legal description has .not been corrected, therefore, the requirements of the Subdivision Regulations have not been met. There is also a property line discrepancy that has not been addressed by the surveyor. For these reasons, a recommendation of denial is given for case No. MS-97-2. If City Council intends on approving this case, staff recommends the following conditions be imposed: 1. Legal description problems be corrected prior to recordation. 2. A note be added to the plat requiring that no existing, mature trees be removed unless in direct conflict with a building envelope. 3. The lot be shown in square footage rather than acreage. VI. RECOMMENDED MOTIONS Option A: "I move that Case No. MS-97-2, a request for approval of a two-lot minor subdivision for R-2 and R-3 zoned property located at 4445 Parfet and 11050 W. 45th Avenue, be Denied for the following reasons: 1. Said property is located at 4445 Parfet and 11050 West 45th Avenue, City of Wheat Ridge, Council of Jefferson, State of Colorado. Ms. Reckert presented an overview of this case. She reviewed overheads and slides with the Commission and entered into the record the Comp Plan, zoning ordinance, subdivision regulations, case file and packet materials/exhibits. Property was posted, published, and thirteen certified mailings to adjacent property owners. Ms. Reckert discussed the "L" shaped lot and stated that only a single family residence could be built on this parcel. Staff is requesting a ten foot r-o-w dedication along 45th Avenue with no addition r-o-w for Parfet Street. She said that one of the conditions of approval was to place a note on the plat regarding the removal of the trees. There are minor legal description problems that will need to be corrected. All agencies contacted can serve the property, however, Public Works will require a final drainage report before a building permit is issued for the northern lot and a review of street construction plans. Staff is recommending approval with two conditions; the legal description problems be corrected and that a note be added to the plat that requires all of the large trees not be removed unless the aze in duect conflict with the building. General discussion took place regarding the R-2 line, drainage, land dedication, public access, sidewalk requirements, the high tension wires, easements and permitted building azea. Chairperson Williams swore in the following citizens wishing to speak on this case: Diane Whitfield, 1584 Myrtle Street, Brighton. Ms. Whitfield is the applicant representative. She said she felt that the best use of this property is for a single family residence. John Kellow, 4740 Pazfet. Mr. Kellow inquired of the City Attorney and Commission what the penalties were for improperly posting public hearing signs. Ms. Reckert attempted to explain the posting requirements to him but he did not let her answer. He stated that the dates and signs were incorrect. He also stated that the signs were not up for 15 days which Ms. Reckert denounced as incorrect. Mr. Kellow went into posting details that he felt were improper. In addition, Mr. Kellow elaborated on his displeasure about building on this property and suggested that attention, be paid to the high tension lines and pointed out that Public Service Company was not in attendance to discuss that issue. He additionally stated that he did not like the necessary position the house would have to be built. Ms. Reckert stated that this public hearing was strictly the deternunation of a subdivision not a design issue. Mr.Synko stated he does not believe that there is enough room to build a house. He was also concerned about what affects building a house on this property would have on his well water. He believes the lot is too small and wanted to know where the lot designation pins were located. He also stated he enjoys all of the wildlife that lives on the lot and prefers not to have anything built close to his property. He would also like the owners to find the property line pins and was advised that the owners would be taking care of mazking the property lines. Bill Hall, representative of ReMax West, 5440 Ward Road, Arvada. He stated that he hoped he could settle some fears of the neighborhood. He said that the future owner was under contract and that they have been in contact with P.S.C. and stakes have been placed across the azea that cannot be built under. The future owner is under contract with a modulaz home that meets all requirements. The home will not have a basement and would not affect any azea wells and further that there would be minimal dirt movement as well. We still do not agree with the mathematical location of the subdivision. It falls 3 feet north of our right of way line. The owner of the property adjacent to lot 1 was very concerned about the location of the pins set by you and asked us what he should do about it. We suggested that he talk to you. Since that conversation, I have sent my survey crew out to traverse the area and tie down the corners that you set and some of the surrounding fences and features in the azea. This is not something we do on a regular basis. The pins that we found on the north line of lot 1, based on our control, were 3 feet south of our right of way line. We could not find some of the corners that were shown on your plat as set by you. The pin set at the north east corner of lot 1 is 8 feet east of the west fence line of the adjacent property. The pin set at the north west corner is approximately the same distance away from the fence to the west. We are aware that there are problems surveying in this area and the legal descriptions don't always fit what is actually on the ground. CITY COUNCIL MINUTES October 27, 1997 Page -2- Mrs. Worth explained that she and her husband own a house that abuts this property; she would have a legal protest in a zoning Motion by Mrs Dalbec to allow Mrs Worth to abstain from voting on this item, seconded by Mr Solano, carried 5 -2 with Mr Siler and Mr DiTullio voting no and Mrs Worth abstaining Motion by Mr Siler that Case No MS -97 -2, a request for approval of a two -lot minor subdivision for R -2 and R -3 zoned property located at 4445 Parfet and 11050 West 45th Avenue, be denied for the following reasons 1 The legal description has not been corrected. 2 There is a property line discrepancy which has not been addressed by the surveyor; seconded by Mrs Shaver Diana Whitfield, real estate broker representing Toula Daddis, owner of the property, was sworn in by the Mayor She asked for approval subject to overcoming the conflict between the two surveyors Meredith Reckert presented the staff report. Motion carried 7 -0 with Mrs Worth abstaining Item 2. Council Bill 46 - An Ordinance repealing Section 2 -27 of the Wheat Ridge Code of Laws Council Bill 46 was introduced on second reading by Mrs Worth, who also read the title, Ordinance No 1099 was assigned by the Clerk. Bob Middaugh was sworn in by the Mayor and asked that the Sales and Use Tax administration be taken from the Treasurer's Office and put under a full time staff person. Motion by Mrs. Worth that Council Bill 46 (Ordinance 1099) be approved; seconded by Mrs Dalbec, carried 8 -0 DECISIONS RESOLUTIONS, AND MOTIONS Item 3. Teller Street Neighborhood Traffic Management program project. Item 3 was introduced by Mr DiTullio, title and summary read by the Clerk. Sandra Collins, 3415 Teller Street, asked Council to accept the conceptual plan presented by City staff as a viable application for traffic calming on Teller Street.
