TUP-97-3, a request to allow the sales of• package liquor on a property zoned Plazmed Commercial Development, which currently does not allow such a use. As previously stated, the applicant, Keith Blanchard, has applied for a minor Temporary Use Permit (TUP), or as stated in the Wheat Ridge Code of Laws, a One (1) month Temporary Use Pernut, to allow the sales of package liquor at 4550 Wadsworth Boulevard, unit #F. Approval of this TUP will allow the applicant to operate his business for one (1) month. The property, located at 4550 Wadsworth Boulevard, is zone Planned Commercial Development (PCD). Under the regulations established in the PCD (WZ-77-13, Consolidated Industries, Incorporated Wadsworth Plaza), there are specific uses, described within the development, which are specifically not permitted. Package liquor stores is a use which is specifically prohibited within the PCD. According to section 26-22(B)(30)(ffj, of the Wheat Ridge Code of Laws, package liquor stores are generally prohibited by right, unless otherwise specified in a Planned Commercial Development. Concurrently, the applicant has applied to the Boazd of Adjustment, to allow for a one (1) year Temporary Use Permit; for the same property. During which time, the applicant will also be applying for an amendment to the Planned Commercial Development. Approval of the one (1) year TUP will allow the applicant to operate his business until there is a decision on the application for PCD amendment, heazd before the City Council. FINDINGS OF FACT: When heazing and deciding requests for temporary permits, the zoning administrator shall base their decision in consideration of the following findings of fact: 1, Will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood of the proposed use; The property, for which the use is requested, is a commercial center, which would generally support package liquor sales. Approval of this use will not have a detrimental effect on the surrounding neighbors have ontacted the Plnazm ng Department pposing the sales of package e liquor at that location. 2, Will not adversely affect the adequate light and air, nor cause significant air, water or noise pollution, or cause drainage problems for the general area; Because the request is for a use to be allowed in a specific district, there will not be any construction proposed for this use. T represent my mother who owns the home at 7445 w 45th P1, which is the second home East of the shopping area. We do not feel that this use is a good one for the neighborhood. With the problems that liquor stores can bring to an area. We also feel that the shopping area is too small to allow for any more deliveries by semi tractor trailer trucks, as was witnessed when a beer delivery truck was completely across 45th place trying to back up to the store to make a delivery. A liquor store is not allowed, as you know, under the zoning; and for the city to allow this, I feel is illegal. Twenty years ago when T represented my in-Saws in ehofsuse,of this property, the neighbors did not want this typ Tt was certainly not the intention of the sellers or the buyers at that time to dump this use on the neighborhood. T feel that thfs should be the case at this time also. We feel that the city Council should not have waived the neighborhood survey, which is the normal procedure when a liquor store relocates.
