This is to inform you that Case No. TUP-97-6 is a request for
a Temporary Use Permit to allow a construction trailer for 30 days
for property located at 4800 Tabor Street
The applicant is requesting an administrative variance review
which allows no more than a ten percent (10%) variance to be
granted by the Zoning Administrator without need for a public
hearing. Prior to the rendering of a decision, all adjacent
property owners are required to be notified of the request by
certified letter.

Re: Case No. TUP-97-6 / Skarphol Construction Group
Case no. TUP-97-6, an application for approval of a 30 day temporary use permit to allow
a construction trailer at 4800 Tabor Street. As per Section 26.D.2.a.,the request was
administratively processed without the need of a public hearing. No written or verbal
complaints were recorded.
FINDINGS OF FACT

No. Approval of this request will not have a detrimental effect upon the general, health safety and
convenience of persons residing in the neighborhood as the trailer will be located within the
property lines of private property and is intended to be used for on-site meetings.

noise pollution, or cause drainage problems for the general area;
No. Because the request is for the placement of a temporary construction trailer, and there will not
be any major modifications to the property, there should not be any adverse affect on the adequate
light and air, nor any increase in air, water and noise pollution.

4. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering,
screening and landscaping, so as to be in harmony and compatible with character of the
surrounding areas and neighborhood, especially with adjacent properties.
Because the request is for a 30 day temporary use, staff will not require any temporary landscaping.
I-lowever, staff will ensure that adequate setbacks are maintained so the trailer will not be
detrimental to the public's welfare.
5. Will not overburden the capacities of the existing streets, utilities, parks, schools, and
other public facilities and services.
No. The temporary use permit will overburden the capacities of the existing streets, utilities, parks,
schools and other public facilities as the temporary construction trailer is for on-site meetings. This
structure will not be used as for sleeping quarters at any time.
CONCLUSIONS
Staff finds that:
The Temporary Use Permit will only be for 30 days, the maximum time for a minor
Temporary Use Permit; and
2. The "Findings of Fact" as set forth in subsection 26.D.2.c. support the request; and
3. AI I adjacent property owners have been notified of the, request at least 10 days prior to the
rendering of this decision and only one property owner has registered concerns during the
10 day period; and
4. The request will not be a detriment to the neighborhood nor result in an endangerment to
the public's welfare
staff concludes that all conditions and requirements of this request have been met in regards to
Section 26.D.2. Minor Variance or Waivers, therefore, a recommendation of APPROVAL is given
for Case No. WA-97-26.
