enclosed please find Waivers from the following utilities relative to the vacation of the easements
from the R & R Auto Body Minor Subdivision Plat:
1. Qwest Corporation
2. Fruitable Sanitation District
3. Xcel Energy Corporation
4. Comcase; and
5. Valley Water.
Please advise if you need anything further so that we can complete the Plat Amendment
process.

Qwest Corporation does hereby grant Permission for the Vacation and removal of the
Plated Utility easements as described on the attached Exhibit "A" of the subdivision
known as Rand R Autobody FIg #1 (also known as 10805 West 44th Ave.) with the
following conditions. Any and all Qwest Utilities that may be found in conflict in the
future and are located within the described easement will be relocated at the expense of
the properties owners.

Dear Mr. Keller:
This firm represents the Romero family, the owners of the above teal propE:Ity. . rn
2006, our clients applied to the City of Wheat Ridge for a lot line adjustment on their property,
stemming from 1he fact that they believed that their property extended some thirty feet to the
north past the recorded boundat)' line, based upon the location of a fence which had been in
exist= fo~ decades previously.
The City of Wheat Ridge approved the lot line adjustment in or abou:t June, 2006.
However, and unbeknownst to the own.ers, the City erroneously treated the application as an
application for a minor subdivision and not as a simple lot line adjustmenl Accordingly, the
final plat which got recorded SbOWli a. lO-foot utility easemej;lt Oll, the north and south ends of tbe
property and as-foot utiliiy easement on the east side. As ytIU probably are aware, there was no
specific grant of an easement to you along the east and IlDrth boundmY lines prior to Juile, '2006,
and these n.ew easements are not necessary- for you to supply yow utility to the property. The
Colorado Utility N otificati,on Center has inspected the property and did not find any of Xcel
EJ:iergy's lines within the Sl:ell to be vacated.
We are enclosing a copy of the Minor Subdivision Plat for YOte( review and
consideration.
All panies have now recognized the wistake that was made. However, the City of
Wheat Ridge is requiring, as part of its approval of an amended p1at, that you authorize the
removal or vacation of the easement. Please indicate your agreement to the il<llIle by executing a
copy of this letter and returning the same to us as soon as possible. Please do not hesitate to

Dear Mr. Moore:
This firm represents the Romero family, the owners of the above real property. In
2006, our clients applied to the City of Wheat Ridge for a lot line adjustment on their property,
stemming from the fact that they believed that their property extended some thirty feet to the
north past the recorded boundary line, based upon the location of a fence which had been in
existence for decades previously.
The City of Wheat Ridge approved the lot line adjustment in or about June, 2006.
However, and unbeknownst to the owners, the City erroneously treated the application as an
application for a minor subdivision and not as a simple lot line adjustment. Accordingly, the
fmal plat which got recorded shows a 10- foot utility easement on the north and south ends of the
property and a 5-foot utility easement on the east side. As you probably are aware, there was no
specific grant of an easement to you along the east and north boundary lines prior to June, 2006,
and these new easements are not necessary for you to supply your utility to the property. The
Colorado Utility Notification Center has inspected the property and did not fmd any of
Comcast's lines within the area to be vacated.
We are enclosing a copy of the Minor Subdivision Plat for your review and
consideration.
All parties have now recognized the mistake that was made. However, the City of
Wheat Ridge is requiring, as part of its approval of an amended plat, that you authorize the
removal or vacation ofthe easement. Please indicate your agreement to the same by executing a
copy of this letter and returning the same to us as soon as possible. Please do not hesitate to
contact us should you have any questions or comments. Our clients agree that, should any of
your lines subsequently be discovered in the vacated easement area, they will pay to relocate such
lines.

Dear Mr. Strauss:
I have completed the second review of the plat amendment for the property located at 10805 W. 44th
Avenue, and I have the following comments:
I. General:
A. I have included referral comments from all responding agencies. If you have any questions
regarding these referral comments, please direct them to the agency which generated said
comment.
B. I have included red-lined plans for clarification of comments.
C. Your client is requesting that certain utility easements be vacated. Please submit corresponding
affirmation from each utility company which allows the removal of theses easements. Utility
providers such as water and sanitation districts, Xcel Energy, Qwest Communications,
Comcast, etc. should be contacted and should provide written authorization to vacate these
easements.
2. Plat Review:

Dear Mr. Strauss:
I have completed the initial review of the plat amendment for the property located at 10805 W. 44th
Avenue, and I have the following comments:
1. General:
A. I have included referral comments from all responding agencies. If you have any questions
regarding these referral comments, please direct them to the agency which generated said
comment.
B. I have included red-lined plans for clarification of comments.
C. Your client is requesting that certain utility easements be vacated. Please submit corresponding
affirmation from each utility company which allows the removal of theses easements. Utility
providers such as water and sanitation districts, Xcel Energy, Qwest Communications,
Comcast, etc. should be contacted and should provide written authorization to vacate these
easements.
2. Plat Review:
A. Please show the easements which are to be vacated with a note 'easement hereby vacated by
this plat'.
B. Please add the following the case history box: "LLA-06-02, MS-07-01".
C. Please add a note # 6 under General Notes which describes the purpose of this plat amendment.
D. Please remove the note on the graphical portion ofthe plat which refers to the previous removal
of the lot line. This line was removed with the plat correction from 2006.
Please make the following corrections and resubmit for review. The Community Development
Department will require 15 full sized (24" x 36") copies and one reduced (11" x 17") copy of the plat for
the resubmittal.

Avenue received on March 30, 2007, and I have the following comments:
Surveying Comments
1. Need to include the Case History number in the Case History box: MS-07-01.
2. Show all the easements to be vacated, and include a statement "EASEMENTS HEREBY V ACA TED BY
TillS PLAT".
3. Be advised that prior to approval of any utility easement vacations, written approval of said vacation shall
be obtained from all utility companies and a copy of the approvals forwarded to the Case Manager in the

In reference to Case #M5-07 -0 I Romero Plat Amendment, Valley Water District has
reviewed the inquiry and offers the following comments:
1. The subject property is currently served by a well. If future development of the
property is planned, please contact the District as the below listed items win apply.
Valley Water District can provide water service to your proposed development subject to
Valley Water District rules and regulations.
2. Valley Water District is supplied water through a distributors contract with the
Denver Water Department and must follow Denver Water operating rules and
regulations. The District must also follow all Denver Water mandates with regard to
drought and conservation that may be imposed.
3. Additional water main lines, fire hydrants and fire sprink1er lines may be needed
to serve the property that meet Arvada Fire Protection District requirements which will
be at owner's expense.
4. Each separate building would require a separate water tap_ Please contact the
District regarding domestic water service prior to construction.
5. The owner will be required to provide a recorded plat of the project to the Valley
Water District.
6. The owner will need to provide necessary easements for water service that meet
Denver Water requirements. If additional mainlines are needed, a looped water main at
two connection points to the Valley Water District distribution system will be required.
