At its meeting of August 2, 2007, Planning Commission APPROVED Case No. MS-07-02, a
request for approval of a 2-1ot minor subdivision plat for property zoned Residential-Two and
located at 3661 Miller Street for the following reasons:
1. All requirements of the Subdivision Regulations have been met.
2. All required utility easements are being provided.
3. Adequate infrastructure will be constructed with the development to serve the
proposed use.
Enclosed is a draft copy of the minutes stating the Commission's decision. A blacklinephotographic
mylar of the plat with original signatures needs to be submitted for recording with Jefferson County
within 60 days of final action. Enclosed are Jefferson County's recordation requirements.
The fees for recording with Jefferson County are $11 per page. Please submit payment along with
the mylar.

Mr. Knobbe appeared as the surveyor for the property. In response to a question
from Commissioner REINHART, Mr. Nobbe stated that the south building is
approximately 5 Y2 to 6 feet from the southern property line and does not lie

Mr. Burns expressed his opposition to construction of a duplex. He has lived in
his home since 1958 and the area has always been considered a single family area.
Dale Brothers returned to the podium. He stated that he may have been wrong
about the percentage of duplexes in the area, however, there are many duplexes in
the area. He stated that the three sewer lines coming from the existing house were
scoped and no issues were found. He stated he would provide a copy of the report
if necessary. He stated that the garage on the west portion of the lot would be
removed. Both outbuildings would be removed. He stated his belief that the
proposed duplex would not detract from property values 0 xisting homes in the

regulations for special waivers.
Commissioner BRINKMAN asked the reason for the regulation that set cul-de-
sac length at 500 feet. Ms. Reckert replied that she was not sure of the reasons,
but it has been in the subdivision regulations since 1972 and probably relates to
connectivity and emergency access.

All notification and posting requirements have been met; therefore, there is jurisdiction to hear
this case.
I. CASE ANALYSIS
The applicant (owner) is requesting approval of a two-lot subdivision plat. The property is
currently zoned Residential Two (R-2), and contains a single-family structure and associated
outbuildings. The applicant wishes to subdivide the property and create two lots. The R-2 zone
district allows single- and two-family residential structures (depending on lot size) and accessory
buildings. The property is 24,840 square feet in size.
Lot 1 - Existinl!: Structure
There is an existing single-family structure located on Lot 1 that will remain. The existing
outbuildings will be removed. The R-2 zone district development standards were used to
examine conformance with lot coverage and setbacks in relation to the newly created lot line.
The subdivision plat will create a new side yard property line on lot 1, and the existing primary
structure must meet minimum side yard setbacks from this property line. A main structure in the
R-2 zone district must have a minimum side yard setback of at least 5 feet, with a combined side
yard total setback of 15 feet. The existing house will be approximately 15 feet from the newly
created side yard (northern) property line.
The R-2 zone district allows a maximum of 40% ofthe lot to be covered by structures. Given a
lot size of 10,620 square feet, a maximum of 4,248 square feet of lot coverage is allowed. The
existing structure has a footprint of approximately 1,549 square feet, giving a total lot coverage
of 14.58% on the newly created Lot 1.
Any new structure constructed on Lot 2 must meet the applicable setback and lot coverage
standards. The newly created Lot 2 is large enough for a two family dwelling in the R-2 zone
district.
II. SUBDIVISION PLAT
The plat will subdivide the property into two lots (Exhibit 1, Plat). Each lot will have direct
frontage on Miller Street. When subdividing a parcel into multiple parcels, each newly created
parcel should meet the district standards for minimum lot size and width. The minimum size and
width of an R-210t is based upon type of residential structure located on the lot. A single family
structure in the R-2 zone district requires minimum lot size of at least 9,000 square feet and a
minimum lot width of at least 75 feet. A two-family structure in the R-2 zone district requires
minimum lot size of at least 12,500 square feet and a minimum lot width of at least 100 feet.
Lot 1 will be 10,620 square feet in size, with a lot width of75 feet. The existing single family
structure will remain on this lot. Lot 2 will be 14,221 square feet in size and 100.41 feet in width.
This lot will be large enough for a two-family structure to be constructed.
Al!:encv Referral
All responding agencies have indicated that they can serve the property, and the applicant will
bear the cost of upgrading any service to the property. Typical utility easements are being
established around the perimeter of each lot.
The Subdivision Regulations require that parkland dedication is required for any residential
subdivision. Typically, this takes the form of a fee in lieu ofland dedication. This fee will be
collected at time of building permit submittal.
Additionally, the need for either the installation of or escrow for curb, gutter and sidewalk will
be examined at time of building permit submittal.
III. STAFF CONCLUSION & RECOMMENDED MOTION (S):
Because this is a two-lot minor subdivision, Planning Commission is the fmal deciding authority.
Staff concludes that the proposed subdivision meets all of the requirements of Article IV of the
Code of Laws. Therefore, staff recommends APPROVAL of the subdivision plat.

Dear Mr. Nobbe:
I have completed my initial review of the subdivision plat submitted for 3661 Miller Street, and I
have the following comments:
1. General:
A. I have included all referral comments received for your review. Please direct any
questions regarding these comments to the appropriate agency which generated said
comment.
B. I have included all redlined comments to provide clarity of the written comments.
C. After all required corrections have been made; a public hearing will be scheduled
before the Planning Commission. Prior to the hearing, the applicant will be required
to post public hearing signs on the property (created by City staff). The applicant
will be required to maintain the public hearing sign a full fifteen days prior to the
hearing, and ensure the sign is visible at all times.
D. The Code of Laws dictates that for all residential subdivisions, a fee in lieu of
parkland dedication is required. This fee is based on size of subdivision, value of
subdivision and number of new dwelling units created. This fee should be paid at the
time of issuance of building pennit.
E. You should be aware that a public improvement escrow will be required for public
improvements not installed along Miller Street. This escrow will be collected prior
to issuance of the certificate of occupancy for the new structure. Upon submittal of
the building permit for the new structure on the northern lot, civil construction
drawings and an engineer's cost estimate for the public improvements must be
in1cuded.
2. Subdivision Plat:
A. Please remove the reference to singular ownership in line 1 of the Dedication
statement (We, Sandra L. Althen and Janeth...).
B. Please correct the typographical error in line 11 of the Legal Description
(S89012'55"W).
C. Please clarify the relationship between Ms. Althen and Ms. Bricham and Mr. Lewis.
This relationship should be clearly identified on the plat. Additionally, please submit

something in writing, such as a power of attorney, which explains this relationship.
D. Please add the following case numbers to the Case History box: MS-07-02.
E. Please correct the spelling of "Commission" in the Planning Commission

G. Please show all unplatted lots as being 'unplatted'.
Please make all of the required corrections prior to the next submittal. A Planning Commission
hearing has been set for Thursday, August 2, 2007. The hearing will begin at 7 p.m. in the City

This will acknowledge receipt of your correspondence dated June 8, 2007 regarding the
above referenced property.
Please be advised that the above referenced property is in an area served by The
Consolidated Mutual Water Company by virtue of a Distributor's Contract with Denver
Water. Domestic water service may be provided to this property subject to compliance
with the Company's rules, regulations and requirements for such service as well as the
water tap allocation policies as established by Denver Water.
Our records indicate that the property addressed as 3661 Miller Street is currently

Dear Mr. Crane:
Reference is made to your request regarding proposed
development/subdivide the existing property into two
single-family residential lots at 3661 Miller Street.
The referenced site is in the boundary of the Westridge
Sanitation District. At this date, there is an extremely
shallow sanitary sewer facility of the District near by to
this proposed development; however, at south side of lot
No.1 there is a deeper sanitary sewer main. Please refer
to the attached sewer record drawings.
This new development can not be served by gravity and it
may require a sanitary sewer service easement and perhaps a
lift station.
The District requires that a new application for a sewer
service connection be completed by the property
owner/applicant and returned to the Westridge Sanitation
District for proposed residence. The applicant is subject
to compliance with all applicable District rules and
regulations.
The District will continue to serve the existing residence
at 3661 Miller S.treet, subject to compliance w.ith all
applicable District rules and regulations.

Surveying Comments
1. Need to show the Case History: MS-7-02.
2. Per Section 26-412 of the Municipal Code of Laws, the Legal Description shall include a metes
and bounds description with section tie( s) on the current City Datum to a section or a Y. section
corner. Along those same lines, the following is to be included on the plat:
a. The Basis of Bearing statement needs to be revised using a city-based bearing.
b. Show the Point of Commencement (shall be either a section or a Y. section comer).
c. Show the True Point of Beginning.
3. Please modify all Lot and subdivision boundary line to be on city-based bearings.
4. Revise the names ofthe owners to the Co-Conservators for the Dale K. Lewis estate. Be sure to
show the owner(s) as being exactly what is recorded at the County Clerk and Recorder's Office
or the plat will be rejected by the County. You may need to consult with the attorney for the Dale

I have attached the review comments and all referral comments received to date regarding the minor subdivision
at 3661 Miller Street. I have sent also sent copies to the surveyor, Richard Nobbe. When we last met, you asked
about building permit fees for the development of the newly created lot. I offer the following information:
Building permit fees are based on the following:
. duplex with 2,400 total square feet (1 ,200 per side)
. 600 square foot garage for each unit
. 600 square feet of porch area
With a finished basement, the permit would be $15,288.85.
With an unfinished basement, the permit would be $10,346.37.
Keep in mind there would also be a parkland dedication fee of approximately $1,000-$1.500 and a public works
review fee of approximately $150.
I have detailed all resubmittal and public hearing deadlines on my review. Please let me know if you have any
