Dear Mr. Benallo:
This letter is in regard to your request for a two-lot consolidation plat for property located
at 6088 W. 39th Place. 1 have reviewed your second submittal and have concluded that all
the outstanding comments generated by the Community Development Department have
been met. Please find attached comments from our Public Works Department.
After review ofthe City's subdivision regulations, it has been determined that this
application can be approved administratively. A fee of$500 was paid which is in excess of
the fees for an administrative plat consolidation. You can either request a reimbursement
of $200 or apply the overage to variance fees required for new construction. Because the
consolidation plat can be approved administratively, the Planning Commission certificate
can be removed.
Once all changes have been made, a mylar copy of the consolidation plat must be generated
for recordation with the Jefferson County Clerk and Recorder. The mylar must be signed
and sealed by the surveyor of record and the property owner. The property owner's
signature must be notarized. The Community Development Department will gather all of
the City signatures prior to recording. There is an $11 per page fee for recording.
I have looked at your revised house expansion plans and have the following comments. The
required setbacks for the main structure or an addition to the main structure are 30' from the
front property line (south side), 30' from the side property line due to the abutting ofIngalls
Court (west side) and 30' from the rear property line due to the abutting ofW. 39th Place. The
house expansion plan presented shows a rear setback (north side) of 19'. The other setbacks
shown are 15' from Ingalls Court (west side) and 15' from 39th Avenue (south side). Therefore,
three setback variances would be required to accommodate the proposed lot layout.
An amendment to the variance process was recently completed allowing variances of 50% or
less, as an administrative approval. This means the Community Development Director is
empowered to decide upon applications for variances for 50% or less without the requirement of
a public hearing if no objections are filed by surrounding property owners. Therefore, staff can

grant an administrative variance for up to 15' without the need for 11 hearing. See attached
variance process guide.

I have completed the second review of the above referenced documents for the proposed development
located at 6088 West 39th Place received on September 19, 2007, and I have the following comments:
Surveying Comments
1. All previous comments have been addressed. The plat will be approvable and ready for Mylar@
upon completion of the two minor modifications mentioned below:
a. The distance of356.51 shown from the radius at Harlan Street to the True Point of
Beginning, needs to be moved above the line as indicated on the redlined Plat (and the
little arrows adjusted to also reflect this).
b. The distance from the section line to the True Point of Beginning needs to be clearly
identified as shown on the redlined Plat (per City Code).
Upon completion of these two items the Plat will be ready for Mylar @.

This letter is in regard to your request for a two-lot consolidation plat for property located
at 6088 W. 39th Place. I have reviewed your submittal and have the following comments:
1. ModifY the title to have a unique name to read (as an example):
"Benallo Subdivision
A consolidation plat of Lot 7, Harlan Court
The west IIz and the east........."
2. Modify the surveyor's certificate to reflect the name change as per above.
3. Add a case history box with the following case number: MS-07-03.
4. Add a note about the existing zoning which is R-3.
5. Add a total lot area in square feet for the consolidated parcel.
6. Add the city's standard easement language. See attached.
The following are other items of concern relating to the platting application:
1. The land use application and plat document represents the land as being owned by
Gerald M. Benallo. The deed submitted for the east half of Lot 7 lists Michael J. and
Elizabeth Benallo as owners. Please clarify.
2. No proof of ownership was provided for the west half of Lot 7. This is required for
the file.
Attached are referrals received from other city departments and outside agencies regarding the
plat document.
Xcel Energy: See attached letter from John Keller dated July 16, 2007.
Wheat Ridge Police Department: See attached email from Paul Balafas dated July 8,
2007.
Wheat Ridge Public Works: See attached letter from Dave Brossman dated July 10, 2007.
I have also looked at your preliminary house expansion plans and have the following comments.
The required setbacks for the main structure or an addition to the main structure are 30' from the

house expansion plan presented shows a rear setback (north side) of29'. The other setbacks
shown are 10' from Ingalls Court (west side) and 15' from 39th Avenue (south side).
The proposed northern setback which is substandard by l' can be built in this configuration if the
existing northem structure setback is at 29' without need for a variance. This can only occur if
you are matching a substandard setback on that side. Both the proposed setbacks on the south
and west will require variances.
An amendment to the variance process was recently completed allowing variances of 50% or
less, as an administrative approval. This means the Community Development Director is
empowered to decide upon applications for variances for 50% or less without the requirement of
a public hearing if no objections are filed by surrounding property owners. Therefore, staff can
grant an administrative variance for up to 15' without the need for a hearing. As proposed on
the submitted site plan, an administrative variance could be sought for the south side but the
proposed setback on the west would require a public hearing in front of the Board of Adjustment.
Staff would recommend you evaluate whether the western setback could be increased to 15' thus
qualifYing this setback to be approved administratively. See attached variance process guide.
In addition, no more than 40% of the lot can be covered with building. Inadequate information
was submitted to perform this analysis.
This concludes the summary of comments. Please address each of these comments by revising
the drawings accordingly. For clarification on any of these issues, please feel free to contact any
