I. REQUEST
Case No. SUP-07-06 is an application by Laura DeGroat requesting approval of an
administrative special use permit to allow a dog kennel/doggie daycare on PID zoned property located at 8175
W. 48th Ave. The PID does not have a list of specific uses so all uses allowed in an industrial zone district are
permitted on the property.
Pursuant to Ordinance No. 1291, the Community Development Director has the ability to decide upon
applications for administrative special use approval, without requirements for a public hearing, provided the
following conditions have been met:
1. A completed application package has been submitted and fee paid.
2. The Community Development Department has notified adjacent property owners by letter and
the site has been posted for at least ten (10) days.
3. No written objections have been received in such ten day period.
4. The Community Development Director concludes that the criteria for approval, as set fourth
below, are substantially complied with and support the request.
The Community Development Director can impose conditions or stipulations upon the approval, which may
include physical design, operational, and maintenance considerations to ensure compliance with the criteria for
review.
The Community Development Director shall also decide the following:
1. Whether the SUP runs with the land in perpetuity
2. Whether the SUP is personal to the applicant and mayor may not be inherited; and/or,
3. Whether the SUP is granted only for a defined period, after which time the special use shall expire
unless renewed subject to all of the requirements of this section.
II. PROPERTY DESCRIPTION
The property is .27 acres in size. There is one existing building on the site. It is a single story, concrete brick
building. The building has an approximate footprint of 3,000 square feet. The rest of the site is paved for areas
of parking and storing of materials related to the use of the property. There is a small landscape buffer with
trees to screen the building along W. 48th Ave and a chain link fence with barbed wire surrounds the entire
property. The northern end of the property is the wall for the exit ramp off ofI-70 onto Wadsworth.
A large section of the paved area will be removed and replaced with peat gravel to help filter animal waste out
of the water when the area is washed. The rocked areas will be the outdoor play areas for the dogs. Some of
the chain link fencing will be removed and replaced with 6 foot privacy fencing to screen the outdoor play areas
from the surrounding neighborhood. A 50 foot freestanding sign will erected on the site and the interior of the
building will also receive renovations to meet the needs of the business.
III. SPECIAL USE PERMIT CRITERIA
The Community Development Director shall base their decision in consideration of the extent to which the
applicant demonstrates the following criteria have been met:
1. The special use will not have a detrimental effect upon the general health, welfare, safety
and convenience of persons residing or working in the neighborhood.

The property will not affect the health, welfare, safety, or convenience of any person working or
residing in the area. The surrounding uses are industrial in nature and are more intense in their
uses then the proposed use. There also is a minimal number of residences in the area, none of
which should be affected by this use.
2. The special use will not create of contribute to blight in the neighborhood by virtue of
physical or operational characteristics.
The property has been vacant for an extended amount of time and has been unmaintained during
that period. The applicants will be improving the property from its current state. The
establishment of a viable business should be a benefit to the neighborhood and will not
contribute to blight.
3. The special use will not create adverse impacts greater than allowed under existing zoning
for the property.
There will be no adverse impacts greater then what is allowed for the zoning. There should be
no impact light to the adjacent properties. The air and water should not be affected if the
requirements for buffering are complied with and maintained. With proximity to 1-70 there
should be little concern for increased noise pollution.
4. The special use will not result in undue traffic congestion or traffic hazards, or unsafe
parking, loading, service or internal traffic conflicts to the detriment of persons whether on
or offthe site.
The use will not create undue traffic congestion or hazards. The applicants have secured enough
space to be able to accommodate the required parking.
5. The property is appropriately designed, including setbacks, heights, parking, bulk,
buffering, screening and landscaping, so as to be in harmony and compatible with the
character of the surrounding areas and neighborhood, especially with adjacent properties.
The adjacent properties should experience minimal impact from the proposed special use. The
outdoor dog areas will be screened with privacy fencing and landscaping. Buffering will also be
provided to help filter water that is used to wash the outdoor areas. Parking requirements have
been met. The business is compatible with the surrounding uses and neighborhood.
6. The special use will not over burden the capacities of the existing streets, utilities, parks,
schools, and other public facilities and services.
Parks, schools and other public facilities will not be utilized. Streets have the ability to handle
the increased capacity oftraffic that will be generated by this use. Other utility agencies are
already serving the property as there is an existing building already on site and should see no
increase in usage.
7. There is a history of compliance by the applicant and/or property owner with Code
requirements and prior conditions, if any, regarding the subject property.
There is no history of code violations on the property.

8. The application is in substantial compliance with the applicable standards set forth in the
Architectural and Site Design Manual.
The Architectural and Site Design Manual applies to all new buildings, those undergoing major
renovations, and those with large expansions in commercial, industrial, and multi-family zone
districts that are located within "Architectural Overlay Areas" ofthe City. This property does not fall
in one of the Architectural Overly Areas and is also not undergoing major exterior renovations. The
Architectural and Site Design Manual guidelines will not be applicable to this property.
IV. NEIGHBORHOOD METING
A meeting for neighborhood input was held on July 17' 2007. The only attendees were the applicants and the
owner of the property.
V. AGENCY REFERRAL
All affected service agencies were contacted regarding the ability to serve the property. specific referral
responses follow.
Colorado Department of Transportation: No comments or objections.
Jefferson County Health Department: Suggested addressing how the applicant will minimize the odors
coming from the outdoor areas. Jeffco Health responds to complaints regarding strong odors and uses the
Colorado Air Quality Control Commission Odor Emission Regulation No.2 for any enforcement action
necessary. They also recommend that the project be designed to minimize noise that may create a nuisance to
neighboring uses.
Urban Drainage and Flood Control: No objections to the project as long as any improvements to the building
do not result in "substantial improvement."
City of Wheat Ridge Police Department: All dog kennels within the city limits are required to obtain a City
Kennel License (city ordinance 4-34) and must also meet the standards and guidelines of the Colorado
Department of Agriculture.
City of Wheat Ridge Public Works Department: Will need to see the location of the outdoor areas for dogs
on a site plan and the relative location of the asphalt removal and peat gravel cover. A vegetative buffer is
required to act as a filter for water running off the site. The location and dimensions of the vegetative buffer
will need to be indicated on the site plan, as well. A list of the specific plants used for the vegetative buffer will
be required. Grass would be the optimum buffer to act as the filter.
VI. STAFF RECOMMENDATIONS/FINDINGS OF FACT
Staffrecommends APPROVAL of Case No. 07-06/Rover Retreat, a request to allow a dog kennel/doggie
daycare on PID zoned property located at 8175 W. 48th Ave. with the following fmdings offact:
1. This request for an administrative Special Use meets all applicable conditions as required by
Section 26-144 of the City of Wheat Ridge Code of Laws.
2. Staff has not received written comments in opposition to this request from the adjacent property
and business owners.
3. There will be no detrimental effect on health, safety, welfare, or convenience to the public in the
area.

4. There will be no impact on the light nor will it increase the noise pollution on the adjacent
property owners.
5. Proper steps are being taken to mitigate potential air and water pollutants.
6. There has been a history of compliance of the property with the provisions of the Zoning and
Development Code.
With the following conditions:
I. The use of the property shall remain in compliance with the submitted application materials and
site plan, including the vegetative buffer areas.
2. Dogs shall not be kept or kenneled outdoors over night.
3. The special use shall be a grant to the applicant and carmot be inherited by another user.
4. A waste management plan shall be implemented for the purpose of keeping the outdoor areas
clean, sanitary, and from becoming odorous.

I have completed the first review of the Special Use Permit for the Rover Retreat doggie day car
located at 8175 W. 48th Avenue received on July 19,2007 for the, and have the following comment:
1. The proposed development does not sufficiently increase the use nor is the existing property
being modified to the extent which would trigger additional or modified public improvements.
2. However, Public Works has concerns with respect to the treatment of animal waste to be
produced by the proposed use. Please see the attached Memo from Bill LaRow, Stormwater
Coordinator for the Public Works requirements.

I have reviewed the proposed business plan dated July 18, 2007 for the above project.
Before giving approval I have the following requirements:
. I need to see on the map where the dogs will be allowed to roam and the relative
location of the asphalt removal and the peat gravel cover.
. Need to see on the plans the location of the vegetative buffer and its approximate
dimensions (width).
. Need to know what specific vegetation that will be used for the vegetative buffer,
optimum vegetation would be grass. The vegetative buffer will be acting as filter
for any water coming off the property.

This is a written request for a Special Use permit for the property located at 8175 W. 48th
Ave. The property is currently zoned P.I.D.
The purpose for this request is to allow a doggy day care to open on this property.
We have met all requirements that the planning department requested after our Pre-
Application meeting, including moving our free-standing sign, reconfiguring fencing and
parking, and have addressed all concerns made by Stormwater Management.
Please see the enclosed business plan which will explain more about our business.
Thank You for your consideration. It is our hope that you will allow us the chance to
start a new relationship, along with our business, within the city of Wheat Ridge.

To: Wheat Ridge Community Development Department:
After reviewing the feedback from our pre-application meeting, the following changes
will be implemented so that Rover Retreat Wheat Ridge will meet all requirements:
1. The free-standing sign will be moved from the N.W. comer of the building to
a location between the garage door and the front door. This will allow for the
30 foot setback requirement as the sign will be located 35 ft. from the 1-70
right~f-way and more than 35 ft. from 48th. Ave. The sign will remain a
height of 50 feet, with a maximum signage square footage of 64 square feet.
2. A six foot privacy fence will be installed on the west, south lIIld eastern areas
of the building. We will not have privacy fencing between the southern
building fayade and the 48th Ave. right-of-way. The existing six foot chain
link fence and gates will remain.
3. The COncern stated by Storrnwater Management Program will be addressed as
follows: The asphalt will be removed from aU "play" areas and pea gravel
will be layered on top of the dirt. A border of organic matter (dirt, shrubs and
ground cover) will be placed outside the fenced area as a barrier from possible
leaks from pollutants. As an additional precaution against contaminants and
odors, the entire play area will be sprayed weekly (or as often as needed) with
a non-toxic chemical compound that is proven to kill E.Coli, Salmonella,
Distemper, Rabies and other viruses, fungi, bacteria, and microorg9tJi!mls.
This system is called the Wysiwash.
4. Parking will consist of 4 spaces on the west side of the building, one of which
will be a handicapped space. These spaces will have ample room for cars to
back out on the property and drive forward to exit onto 48th. Ave. The east
side of the building will have 3 spaces and cars can back out onto the shared
Wheatridge Industrial Park: access and drive forward onto 48th. Ave. This
access is shared by all the business in the Industrial Park: including 8175 W.

. The Water and Sanitation District must provide a proof of services letter for the
proposed development.
. Landscaping plans should include appropriate water conservation measures.
. A fugitive dust permit is not required for the development of this site. However, the
developer must use sufficient control measures to minimize any dust emissions during
demolition, land clearing and construction activities.
. This Department recommends that this project employ runoff reduction practices as well
as include an infiltration best management practice for any water quality capture volume
requirement of the Storm Drainage Design and Technical Criteria Manual. Structures such as
a sand filter, porous landscape detention or constructed wetland structures are less
likely to provide mosquito breeding habitat. This would assist in protecting water quality
and controlling diseases such as West Nile Virus.
. State licenses are required for pet animal boarding facilities and similar uses. All
requirements of the Pet Animal Care and Facilities Act, under the Colorado Department of
Agriculture, must be complied with. Contact the Animal Industry Division at 700 Kipling
Street. Suite 4000, Lakewood, Colorado 80215-5894, Phone: (303) 239-4161 for application
requirements.
. The applicant must address how they will minimize odors coming from the proposed dog
kennel. This Department responds to complaints regarding strong odors and uses the
Colorado Air Quality Control Commission Odor Emission Regulation Number Two for any
enforcement action necessary.
. This Department recommends that this project be designed to minimize noise that may
create a nuisance to neighboring uses.

The site is in the 100-year floodplain of Clear Creek as defined in a recently completed Flood Hazard
Area Delineation (FHAD) study. However, it is not in the 100-year floodplain on the effective Flood
Insurance Rate Map (FIRM). We are encouraging local governments affected by the new FHAD to be
cognizant of both the FHAD and FIRM and recognize that eventually the FIRM will be modified by
the FHAD. Consequently, the more restrictive floodplain should be used.
This appears to be a new use for an existing building. As long as any improvements to the building do
not result in "substantial Improvements" the proposal can be allowed to proceed.
We recommend you work with the city's floodplain manager, and also inform the applicants of the
situation,

I received a copy of this case from Sgt. Balafas regarding the doggie daycare/kennel
application for8175 W. 48th Ave.
All dog kennels located within the city limits of Wheat Ridge are required by City Ordinance 4-
34 to obtain a City Kennel License. In addition, the kennel is required to meet the standards
and operating guidelines of the Colorado Department of Agricuture,
I've included a copy of the Wheat Ridge Ordinance in this e-mail for your review...
Sec. 4-34, Kennel licenses,
(a) No person, group of persons or business entity shall own, keep or harbor more than three (3) dogs
or four (4) cats of more than six (6) months of age or engage in the commercial business of breeding,
buying, selling, trading, training or boarding cats or dogs without having obtained a kennel license from
the chief of police.
(b) Kennel licenses must be renewed every year between January I and March 1. No kennel license
shall be issued until a recommendation of approval has been obtained from the animal welfare and
control commission.
( c) The yearly license fee for kennels shall be as established by the commission by resolution.
(d) This section shall not apply to and will not be construed to require a kennel license for a licensed
veterinarian to operate an animal hospitaL
(e) This section shall not apply to and will not be construed to require a kennel license for any pet shop
which sells animals ofless than six (6) months of age.
Any person or business applying for or holding a keunellicense must be currently licensed by the State
of Colorado. Pursuant to the Pet Animal Care and Facilities Act, C.R.S. 99 35-80-101--35-80-117,
The issuance of a new kennel license shall be based on the following minimum requirements:
Application for a new kennel license or for transfer of an existing license shall be made to and a
recommendation of approval obtained from the commission. The application shall include a detailed
description of the property to be licensed.
The commission may require a public hearing before a new kennel license is recommended for approval.
The hearing shall be posted and published in the same manner as in section 26-6.
The animal welfare and control commission shall have the authority to conduct a hearing to consider
whether to recommend that the chief of police grant a variance to subsection (a) above as to the number
of animals permitted and the commission shall inform the chief of police of its decision.
The recommendation of the commission shall be forwarded to the chief of police, who shall act to
approve, approve with conditions, or deny the application within thirty (30) days of the commission's
recommendation,
The chief of police may promulgate rules and regulations to establish minimum standards for the care
and treatment of animals at any facility licensed under this section, after review and approval by the
animal welfare and control commission.

Community service officers or any agent of the chief of police have the authority to inspect any licensed
facility under this section during normal posted business hours,
Violations of any of this section may be brought before the animal welfare and control commission for
review, and a hearing may be initiated by the commission for suspension, revocation or nonrenewal of
the kennel license. The animal welfare and control commission may recommend, and the chief of police
may revoke, suspend or not renew a license for failure to comply with any ofthe requirements of this
section. No such action may be taken without prior notice to the licensee and an opportunity for the
licensee to present evidence and testify. No decision by the chief of police under this section shall bind,
alter, or affect a subsequent decision on a subsequent application, either for a new kennel license or for
renewal of an existing license. Nothing in this section shall affect the independent authority of
appropriate city officials to take action with respect to vicious animals, threats to public safety, or the
enforcement of any other provision of this Code of Laws.

To; Wheat Ridge Community Development Department:
After reviewing the feedback from our pre-application meeting, the following changes
will be implemented so that Rover Retreat Wheat Ridge will meet all requirements:
1. The free-standing sign will be moved from the N. W. comer of the building to
a location between the garage door and the front door. This will allow for the
30 foot setback requirement as the sign will be located 35 ft. from the 1-70
right-of-way and more than 35 ft. from 48th. Ave. The sign will remain a
height of 50 feet, with a maximum signage square footage of 64 square feet.
2. A six foot privacy fence will be installed on the west, south and eastern areas
of the building. We will not have privacy fencing between the southern
building ~ade and the 48th Ave. right-of-way. The existing six foot chain
link fence and gates will remain.
3. The concern stated by Stormwater Management Program will be addressed as
follows: The asphalt will be removed from all "play" areas and pea gravel
will be layered on top of the dirt. A border of organic matter (dirt, shrubs and
ground cover) will be placed outside the fenced area as a barrier from possible
leaks from pollutants. As an additional precaution against contaminants and
odors, the entire play area will be sprayed weekly (or as often as needed) with
a non-toxic chemical compound that is proven to kill E.Coli, Salmonella,
Distemper, Rabies and other viroses, fungi, bacteria, and microorganisms.
This system is called the Wysiwash.
4. Parking will consist of 4 spaces on the west side of the building, one of which
will be a handicapped space. These spaces will have ample room for cars to
back out on the property and drive forward to exit onto 48lh. Ave. The east
side of the building will have 3 spaces and cars can back out onto the shared
Wheatridge Industrial Park access and drive forward onto 48lh. Ave. This
access is shared by all the business in the Industrial Park including 8175 W.

The ratio for people to dogs will be 1110-15
The number of dogs scheduled to be at Rover Retreat Wheat Ridge will determine
how many employees will be working at a given time. There will be at least one
owner or manager on duty during business hours.
Total projected payroll is to be determined by the number of dogs in day care and
boarding and will be set, initially on a weekly basis, followed by a monthly basis
as business increases.
Financial Plan
For initial startup costs and to cover the first few months of business, liquid
assets, in the form of saving accounts at First Bank of Colorado will be used. The
current available funds are $90,000.00. Personal, secured loans in the amount of

Ruver Retreat Wheat Ridge is proposing a Special Use Permit on property located at 8175 W, 48 Ave. in
the Wheat Ridge Industrial Park. A neighborhood meeting will be held on Tuesday, July 17 2007 at 6 pm
in the second Floor glass conference room in the Wheat Ridge Municipal Building at 7,500 W. 29 Ave.
The purpose of dto request is to allow a dog day care to move into this location. 7011ing on this property is
Planned Industrial Development.

Rover Retreat is an established doggie day care facility in Gulden and is looking to expand into the Wheat
Ridge area. Through working with the city of Wheat Ridge, our next step in bringing this business to the
areas to hold an informal neighborhood meeting. As it is necessary for this type of business, at this
location to have a Special Use Permit, we are required to notify all property owners and residents within
600 feet and invite them to this neighborhood meeting. This meeting will allow us to explain our business
to you and to answer your questions and concerns.
A staff planner will attend the meeting to discuss City policies and regulations and the process involved,
however, the Planner will remain impartial regarding viability of the project,
Keep in mind that this is not it public hearing. Although a synopsis of the meeting will be entered as
testimony, it Is the public hearings in front of the Planning Commission and City Council where decisions
