Item 2 was introduced by Mr. Womble, who read the Executive Summary. Mr. Crane presented the staff report. The applicants for the Special Use Permit, Howard Schiffman, Exec Director of Griffith Centers for Children and Karen Yarberry, Executive Director of Jefferson Hills and Co- owner of Healing Homes for Children, were present and spoke to Council on the matters of granting this Special Use Permit. The following interested citizens were present and spoke on this item: Marcus Nunez, DorothyArcher, Ray Pepe, Ellen Warp, Linda Briones, and Moreen Wallner. Their concerns and issues expressed regarding the issuance of this Special Use Permit included, but were not limited to: the presence of this group home brings threats to the neighborhood of peddling, theft, and surprise visits to area homes; some residents report having seen periods of time lacking any supervision of the residents of this home; it is recommended that the permitting stay at the current four residents for a trial period; the owners of the home have not cared for the conditions of the front yard of the home; there is usually only one staff caring for the residents, which is not enough for six older, male children; previous residents have trespassed onto next door neighbor's yard; neighbors are concerned about the severity of the residents' past violations and the threats to their children of sexual assault or drugs; residents in the area are concerned that the process to grant this permit does not require neighborhood approval and question why residents aren't notified outside of 600-foot radius of the home; Council asked the applicants questions regarding the age and severity of the offenses of the residents, the nature and policies of supervision, specifics on the purported violations of privacy previous residents have made against neighbors, and the qualifications of the staff in the home. Mayor DiTullio called for a break at 8:07pm, to resume at 8:12pm. Mayor DiTullio closed the public hearing. Motion by Mr. Womble to deny Case No. SUP-07 -07 for the reason that the special use does not meet all the requirements outlined in Section 26-114 (D) of the Code of Laws; seconded by Mrs. Sang. Location Map Subject Parcel I. REQUEST The property in question is located at 7055 W. 33'd Avenue. The applicant is requesting a special use permit to allow for a group facility (Exhibit I, Request). The applicant has received the appropriate permissions from the current property owner to pursue this application. II. CASE ANALYSIS The property is 9,235 square feet in size (approximately 0.21 acres), and currently contains an existing residential structure. Group homes are subject to minimum lot size requirements and shall require a special use permit. The Code of Laws states that there shall be at least 1,500 square feet oflot area for each child housed in the group home. Typically, the SUP process starts as an administrative review, complete with a ten-day public notice period. If any objections are received during this ten-day period, the application is forwarded to City Council. The ten-day posting period was held for this application, and the City did receive letters of objection (Exhibit 2 and 3, Letters of Objection). These objections were deemed relevant, so the application has been forwarded to City Council for review. Additionally, the Code of Laws requires a neighborhood meeting prior to submittal of an application for a special use permit. A neighborhood meeting was held on July 25, 2007. There were several neighbors and interested parties in attendance at this meeting. A meeting synopsis has been attached as Exhibit 4. III. EXISTING CONDITIONS The property currently contains a 2,548 square foot residential structure. The structure was purchased by the Jefferson County Housing Corporation in 1996, and has subsequently been used as a variety of residential programs since. The Code of Laws dictates that a residential group home shall have 1,500 square feet oflot area for each child that resides in the structure. The property is 9,235 square feet in size; therefore if the special use permit is approved, up to six children may reside in the structure. The property is required to have two parking spaces. This requirement is currently being met. IV. AGENCY REFERRALS The proposal was referred to all ofthe necessary outside agencies. All responding agencies stated that service could be provided to the property. The property does not need any additional upgrades to increase the capacity by two children. V. SPECIAL USE PERMIT REVIEW Staff has the following comments regarding the criteria used to evaluate a special use permit request: Per the Code of Laws Sec. 26-114 CD) before a special use permit is approved, the applicant shall show, and the community development director or city council shall find, the proposed special use: 1. Will not have a detrimental effect upon the general health, welfare, safety aud convenience of persons residing or working in the neighborhood of the proposed use. The proposed use should not have a detrimental effect on the general health, safety or welfare of persons in the neighborhood. The applicant has indicated that this facility is to be used as a transitional residence used to assimilate children in the latter stages of counseling back to their respective family environments. City Council SUP-07-07/Healing Homes 2 2. Will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics of the proposed use. The proposed residential group home facility should not contribute to blight in the neighborhood. The property currently contains an existing residential structure. The applicant is not proposing any upgrades to the existing facility, as the facility will accommodate their needs. 3. Will not adversely affect the adequate light and air, nor cause significant air, water or noise pollution. The proposed group home facility should not affect the adequate light and air, nor cause significant air pollution. The structure s currently in existence and the applicant is not proposing any changes to the structure which would affect light or air, not cause pollution. 4. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. The request will not result in undue traffic congestion in the area. All of the City's parking requirements have been met. This type of facility should not generate traffic beyond what is normally acceptable in a residential neighborhood. 5. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. The structure is already in existence, so this criterion does not apply. It should be noted that if the property owner or operator of the facility wishes to install a permanent trash receptacle or playground equipment, these areas must be screened appropriately. 6. Will not overburden the capacities of the existing streets, utilities, parks, schools and other public facilities and services. The proposed use will not overburden the capacities of existing streets, utilities, parks, schools or other public facilities and services. All of the necessary agencies for public facilities and utilities were notified of this request the responding agencies stated that service can be provided to the property. 7. History of compliance by the applicant with Code requirements and prior conditions, if auy, regarding the subject property. The applicant has no history of compliance or noncompliance with the City of Wheat Ridge code requirements. 8. Ability of the applicant or any permitted snccessor-in-interest to continuously meet the conditions of the proposed permit. If conditions of an approved special use permit are violated, City Council has the authority to revoke the special use permit. 9. Other factors relevant to the specific application. There are no other relevant factors. VI. STAFF CONCLUSIONS AND RECOMMENDATIONS City Council SUP-07-07/Healing Homes 3 Staff concludes that the proposed residential group home facility will not have a negative impact on the traffic or circulation in the vicinity. The use of the property as a group home should not severely impact the neighborhood. Therefore, staff recommends APPROVAL of Case No. SUP-07 -07. City Council shall decide if the special use request is a personal grant of the owner/applicant or a grant to the property which may be inherited. Staff recommends that the special use permit be a grant to the applicant, and that any subsequent group home on this property by someone other than the applicant shall require a special use permit. VII. RECOMMENDED MOTIONS Option A: "I move to approve Case No. SUP-07 -07, a request for approval of a special use permit to allow for a residential group home facility located at 7055 W. 33'd Avenue, for the following reasons: I. This would allow a residential group home for children in an R-2 zone district. Healing Homes for Children has been operating a foster home for youth in the home since Aprill, 2007. Healing Homes for Children is co-owned by Griffith Centers for Children and Jefferson Hills. It was organized in response to Jefferson County Department of Human Services need for step-down, transition placement for youth. Both co-owners are longstanding companies with strong relationships in Jefferson County and the community. Both companies are not for profit, 50lc3s and are nationally accredited by the Council of Accreditation, (COA). The house is owned by Jefferson County Housing Authority, who supports the project. We have completed the preliminary steps of having the pre-application meeting on April 12,2007 and the community meeting on July 25,2007. Prior to the formal community meeting, we hosted 2 open houses at the home for neighbors to visit and ask questions. The property is currently zoned Residential Two (R-2). The zone district allows single- and two-family dwellings, as well as a few more quasi-residential uses. One such allowed quasi-residential use is a foster care home. A foster care home is defined as a home which cares for not more than 4 adolescents. The property currently operates as a foster home. The applicant has submitted a request to allow a group home. The R-2 zone district allows a group home only by special use permit. If the special use permit were granted, the property can only support up to six children due to its size. The application was submitted on 30 July 2007 and is currently being reviewed by staff. The Code requires that all special use permit requests begin with an administrative review and a ten-day public notice period. The ten- day public notice period started yesterday and runs through Wednesday. August 15th During this period, any affected party may comment on the application. Any legitimate objection to the application will cause the case to be heard by the City Council. One of your questions was in reference to the parking at the property. The Code of Laws states that when on- street parking is available. only 2 parking spaces are required on the property. I am confident that the property meets the minimum required parking counts for this specific use. In response to your questions regarding a petition to the County which would eliminate any type of program at the property, I am afraid I do not have any insight to the process. As I understand it, the property is owned by the non- profit organization Jeff CO Housing Corporation, and not Jefferson County. As a result. I am not certain of the County's role in forcing the Housing Corporation to sell the property. Additionally. the City cannot force any property owner to sell or vacate the property. This would be no different from the County or City asking a private landowner to move or sell his property: it simply is not a function of municipal government. The City does have the authority to not grant the special use permit which would prevent the property from housing six adolescents. However. the zone district allows a foster care home as a use by right and the City cannot cause that legal use to cease. Finally, I should inform you that contact with your elected officials should be avoided while the case is in process. The application is quasi-judicial in nature; meaning that City Council (and potentially the Mayor) may vote on the application. Any contact with the elected officials may jeopardize their involvement at the public hearing. Simply, all contact should occur at the public hearing so that all members of Council and members of the public will have the benefit of hearing your comments. I live next door to this property at 7I 15 W. 33rd Ave. and was in attendance for most of the meeting on July 25th. I, along with other neighbors, expressed concern for the latest program to be allowed to reside in this County-owned property; the program is Healing Homes for Children. The meeting was to gather input as to whether the Healing Homes for Children should be allowed to increase the number of teenage juvenile delinquent (or otherwise "troubled") male youth residing at this residence from four boys to six boys. My concerns are; the safety and well-being of my own three children (ages 11, 11, and 13 - all girls). I am a single, working parent and have paid for a Nanny to supervise my children in my home for the past eight years, while I worked. I have started cutting back the hours of Nanny care for my children, as they are now coming to an appropriate age, to be unsupervised for short periods of t ime, while I work. I am extremely concerned with a program for troubled, teenage boys, to exist next door to my children. At the meeting, I was questioned as to my specific concerns; they are the possibility ofharrassment (verbal and sexual) to my children. It is analogous to placing a den offox (es) next door to a chicken coop. Additionally, I am concerned if one of the boys has a mental/emotional/physical breakdown in this home and cannot be controlled by the young (usually 23- 25 year old) female Supervisor. I do not see how one young, and usually female counselor could possibly control SIX troubled, teenage boys if a crisis situation would arise. Other concerns are the amount of traffic and cars that are always coming and going from this residence. Frequently, the parked cars have spanned the entire front of the property on 33rd, the front of my property, and across the st reel. Is there legally enough parking for a public program of this size? I have resided at 7I 15 W. 33rd Ave. since the fall of 1995, when the property directly to the east (7055 W. 33rd Ave.) was still a privately owned, single-family residence. In 1996, the County purchased this property, without any consultation with the neighbors or (as I was told) without any notification to the City of Wheat Ridge. Since this time, numerous County programs have been allowed to reside at this location, ALL of which have failed. Let me briefly list the programs which I have seen come and go from this residence: I.) Original program was a Respite Home for disabled/handicapped children. Please note that this residence was at the time of purchase, a four-bedroom, single family home (all bedrooms located on the second floor), with a enclosed, hot tub solarium room in between the main house and the garage. This configuration was totally inappropriate to handle any type of disabled/handicapped children. Extensive, Jefferson County funded modifications (totaling more than $60,000 of public funds) have been spent on this residence. 2.) Numerous foster-type home programs have also resided at this location. One of the last programs was providing a respite home for troubled kids. A place were their parents, or legal guardians could drop off their troubled kids for a few days (or week), and get a publically-funded vacation from them. This group of kids were allowed to engage in unsupervised, outdoor activities, which were frequently punctuated with extremely foul-language. On several occasions, my children could and would not play outdoors, because they were offended by the loud, foul-language used by these kids. 08/07/2007 Page 3 of3 I attended the first public hearing for the handicapped/disabled child respite program held in April/May (? exact month) of 1996 to express my concern about this property. My main issues were the impact of County-owned property on my property valuation, and more importantly, the safety of my children. Since this time, I have remained a reasonable and helpful neighbor to all the programs which have been existed and failed, at this residence. On several occasions, young children (charges of the County-run program) have come into my home to play with my own children. I have always been non- discriminatory to innocent children, in regards to their etlmic, financial, physical,or religious orientations/status. I have shared and educated my own beliefs with my children, in hopes that they too will never judge a person by their appearance/financial status/regilious beliefs...etc. and that upstanding moral ethics, proper education and speech, were the defining characteristic of a person. Throughout the years, I have been a supporting neighbor but have contacted the Jefferson County Housing Authority/Manager, Henry Weinardt (spelling?) on a few occasions with concerns over the appearance of the property, especially the upkeep ofthe lawn (which no longer exists on the west side of the property), the offensive language used by the unsupervised charges within the programs, and most recently, when the County removed a cedar, split-rail fence dividing our properties; never replacing it. A portion of this fence was in disrepair (mainly due to abuse from the children in the previous programs) but this fence was in fine condition in the comer which wrapped around my property (and was located ON MY property) in the front, SE comer. The county removed my fence without my permission, and Henry W. (Jeffco Housing Authority) requested that I split the cost of replacement with the County. When a perfectly fine section of fence is removed from MY property without my permission, I do not feel obliged to finance the replacement. As far as the other issues, especially, the foul-language, they have been resolved simply by attrition/failure of EACH, and EVERY program ,allowed to reside in this residence. In fact, over the past couple of years, this house has remained empty for the majority of time. In closing, I do not recommend granting a Special Use Permit to increase the number of troubled, teenage boys from four to six in this program. The only resolution I can endorse is pentioning the County to sell this residence back as a private, single family home. Can you provide me with the details of how I can proceed with this petition to the County? Do I have to compose a document proposing public sale of this property and obtain signatures? The existing structure would remain, and would not be significantly changed. Issues discussed: There were a number of interested parties and neighbors in attendance. Questions arose about the number of and the typical age of children in the house. There were many questions about the property ownership, and questions regarding how many total houses the Jefferson County Housing Corporation owns in the City. One comment was made that it seems many more of these facilities are present on the east side of town. There were a few questions about the staffing levels, and the typical type of staff member. There was some discussion regarding previous programs on this property which have failed, and the impact they had on the neighborhood. One neighbor was concerned about safety in the neighborhood. One attendee stated that they never knew this was a foster care home, and it blended well with the neighborhood. There were some questions regarding the type of programs that the children went through, and that it might be a good opportunity for the kids to help around the neighborhood with chores. EXHIBIT 4 A few attendees questioned the number of staff present - typically a 30unger female staff person is present. There were questions regarding the special use - if it could be revoked after a trial period, or if conditions worsened. The meeting concluded with the remaining attendees agreeing that it would be acceptable to allow this use, and if any problems arose, City Council could revoke the special use permit. I live next door to this property at 7115 W. 33rd Ave. and was in attendance for most of the meeting on July 25th. I, along with other neighbors, expressed concern for the latest program to be allowed to reside in this County-owned property; the program is Healing Homes for Children. The meeting was to gather input as to whether the Healing Homes for Children should be allowed to increase the number of teenage juvenile delinquent (or otherwise "troubled") male youth residing at this residence from four boys to six boys. My concerns are; the safety and well-being of my own three children (ages 11, 11, and 13 - all girls). I am a single, working parent and have paid for a Nanny to supervise my children in my home for the past eight years, while I worked. I have started cutting back the hours of Nanny care for my children, as they are now coming to an appropriate age, to be unsupervised for short periods of t ime, while I work. I am extremely concerned with a program for troubled, teenage boys, to exist next door to my children. At the meeting, I was questioned as to my specific concerns; they are the possibility ofharrassment (verbal and sexual) to my children. It is analogous to placing a den of fox (es) next door to a chicken coop. Additionally, I am concerned if one ofthe boys has a mental/emotional/physical breakdown in this home and cannot be controlled by the young (usually 23- 25 year old) female Supervisor. I do not see how one young, and usually female counselor could possibly control SIX troubled, teenage boys if a crisis situation would arise. Other concerns are the amount of traffic and cars that are always coming and going from this residence. Frequently, the parked cars have spanned the entire front of the property on 33rd, the front of my property, and across the st reet. Is there legally enough parking for a public program of this size? I have resided at 7115 W. 33rd Ave. since the fall of 1995, when the property directly to the east (7055 W. 33rd Ave.) was still a privately owned, single-family residence. In 1996, the County purchased this property, without any consultation with the neighbors or (as I was told) without any notification to the City of Wheat Ridge. Since this time, numerous County programs have been allowed to reside at this location, ALL of which have failed. Let me briefly list the programs which I have seen come and go from this residence: I.) Original program was a Respite Home for disabled/handicapped children. Please note that this residence was at the time of purchase, a four-bedroom, single family home (all bedrooms located on the second floor), with a enclosed, hot tub solarium room in between the main house and the garage. This configuration was totally inappropriate to handle any type of disabled/handicapped children. Extensive, Jefferson County funded modifications (totaling more than $60,000 of public funds) have been spent on this residence. 2.) Numerous foster-type home programs have also resided at this location. One of the last programs 08/06/2007 Page 2 of3 was providing a respite home for troubled kids. A place were their parents, or legal guardians could drop off their troubled kids for a few days (or week), and get a publically-funded vacation from them. This group of kids were allowed to engage in unsupervised, outdoor activities, which were frequently punctuated with extremely foul-language. On several occasions, my children could and would not play outdoors, because they were offended by the loud, foul-language used by these kids. I attended the first public hearing for the handicapped/disabled child respite program held in April/May (? exact month) of 1996 to express my concern about this property. My main issues were the impact of County-owned property on my property valuation, and more importantly,the safety of my children. Since this time, I have remained a reasonable and helpful neighbor to all the programs which have been existed and failed, at this residence. On several occasions, young children (charges of the County-run program) have come into my home to play with my own children. I have always been non- discriminatory to innocent children, in regards to their ethnic, financial, physical,or religious orientations/status. I have shared and educated my own beliefs with my children, in hopes that they too will never judge a person by their appearance/financial status/regilious beliefs...etc. and that upstanding moral ethics, proper education and speech, were the defining characteristic of a person. Throughout the years, 1 have been a supporting neighbor but have contacted the Jefferson County Housing Authority/Manager, Henry Weinardt (spelling?) on a few occasions with concerns over the appearance of the property, especially the upkeep ofthe lawn (which no longer exists on the west side of the property), the offensive language used by the unsupervised charges within the programs, and most recently, when the County removed a cedar, split-rail fence dividing our properties; never replacing it. A portion of this fence was in disrepair (mainly due to abuse from the children in the previous programs) but this fence was in fine condition in the corner which wrapped around my property (and was located ON MY property) in the front, SE corner. The county removed my fence without my permission, and Henry W. (Jeffco Housing Authority) requested that I split the cost ofreplacement with the County. When a perfectly fine section of fence is removed from MY property without my pennission, I do not feel obliged to finance the replacement. As far as the other issues, especially, the foul-language, they have been resolved simply by attrition/failure of EACH, and EVERY program ,allowed to reside in this residence. In fact, over the past couple of years, this house has remained empty for the majority of time. In closing, I do not recommend granting a Special Use Permit to increase the number of troubled, teenage boys from four to six in this program. The only resolution I can endorse is pentioning the County to sell this residence back as a private, single family home. Can you provide me with the details of how I can proceed with this petition to the County? Do 1 have to compose a document proposing public sale of this property and obtain signatures? How many signatures are required to have this addressed by the City of Wheat Ridge and Jefferson County. I appreciate your attention to this matter and greatly anticipate your response. Practicing life skills with family, staff, and others while attending school in the area while working to return the youth fully back home and to the community is the object of the group home. Staff receives significant training from both organizations as well as the county, to foster positive relationships with the youth as they continue learning life skills to be successful in the community. The entrance will be modified to comply with the American Disabilities Act (ADA), as approved by the City of Wheat Ridge Community Development Department standards. Healing Homes for Children, co-owned by Jefferson Hills and Griffith Centers for Children, was organized in response to Jefferson County Department of Social Services need for a transition for youth moving from an out of home placement. While Healing Homes for Children is a new company, its 2 owners are longstanding companies with strong relationships in Jefferson County and the community. Jefferson Hills, a wholly owned subsidiary of Jefferson Center for Mental Health, provides staff secure residential care to 70 adolescents at its 6th and Simms facility in Lakewood, and another 86 adolescents at its facility at 1-225 and Mississippi in Aurora. Jefferson Hills has been providing residential services for almost 15 years. Griffith Centers for Children has provided quality services to youth for over 70 years. Its continuum of care includes residential services at 3 locations (Larkspur, Colorado Springs, and Grand Junction) totaling 130 youth. Griffith Centers for Children also provides an extensive community based network, including 4 group homes, 40 foster homes, and a variety offamily based outpatient services assisting 1,000 families in preserving youth in the home. Jefferson Hills and Griffith Centers for Children have a long history of partnering together on a number of successful projects, including sharing staff. Both organizations are not for profits (501c3) and are nationally accredited by the Council of Accreditation (COA). In their residential programs, both Jefferson Hills and Griffith Centers for Children provide mental health services, regular and special education programs, routine and emergency medical services, recreation services, pre-vocational programs, and experientialleaming experiences. As the result, we have numerous relationships with these entities in the community as we transition our residents back to their homes. Specifically, we have an excellent relationship with Jefferson High School and Wheat Ridge Middle School for these youth. The group home program priority is safety of youth, staff, and the community, and uses principles of experiential therapy and learning to allow the youth an opportunity to practice life skills as they re-integrate into the community setting. We provide for close communication with the home school for education success. Family services are intended to maximize the returning of the youth to his family. Our targeted length of stay is 3-6 months. The group home is staffed by 24/7, awake, direct care workers, meeting the same standards as required by the State of Colorado for foster/group home care, as well as the rigorous standards set by Griffith Centers for Children and Jefferson Hills. It is our belief that Healing Homes for Children provides an excellent model of continued support in a less structured setting for Jefferson County youth. The home on the site is already operating as a foster home and is able to accommodate four children. The home will under go a major interior renovation in order to accommodate up to 8 adolescent males and a 24 hour staff of several employees. The staff and home will meet all standards required by the State of Colorado for a group home. The home is intended for short stays by the adolescents as they transition from state and county agencies back to home life. Stays are intended to be 3-6 months as they practice life skills with family, staff, and others while attending school in the area. . Will a neighborhood meeting need to be held prior to application submittal? A neighborhood meeting will be required for a Special Use Permit. Planning comments: The parcel on which the action is being requested is zoned Commercial Residential Two, R-2. This district was established to provide high quality, safe, quiet, and stable low to moderate-density residential neighborhoods and to prohibit activities of any nature which are incompatible with the residential character. R-2 zoning districts do permit residential group homes for children by way of a special use permit. The existing home is currently located in a well established neighborhood where the zoning is primarily R-2 with small pocket of R-3 zoning across the street. The surrounding homes consist of single and two family dwelling units. . The applicants own the home and currently use it as a foster home for children. At this time, they have two children in foster care at the home with the ability to accommodate up to 4 children. The home is currently underutilized and will undergo renovations in order to be able to accommodate up to 8 children in order to be fiscally viable. The home will also have a 24 hour live-in staff. By remodeling the existing structure the applicants hope to have as little impact on the neighborhood as possible and to keep the building within character of the surrounding homes. The home opened several months ago with little impact on the neighborhood, as one of the goals is to have the neighbors feel as if there is no group home there. The home will receive children primarily from Jefferson County but will occasionally get children from other agencies. The kids who come to the home tend to have family in the area who are involved in aiding their return back home. The children will also attend local schools and the staff are involved with their teachers and administrators to make sure that they staying on track. Residential group homes for children require 2 spaces per home if on street parking is available or 4 if on-street parking is not available, plus 1 spot per eight beds. Three off- street parking spots will be required for this home since on-street parking is available and the home may have up to eight children. The driveway may need to be widened to meet this requirement since the garage is being removed and parking in tandem cannot count towards this requirement. Before the drive is widened, all permits pertaining to the widening must be approved. During the remodel, all the common areas of the home must be renovated to comply with the American Disabilities Act (ADA). This includes, but is not limited too, making the entrance to the home at grade, if it is not already, providing wider doorways and halls, and having the bathroom on main floor meet all standards. If the upper level bedrooms will house handicap children a lift will be required, as well as making all areas of the second level accessible for them as well. The Chief Building Official will confirm all details pertaining to these issues and other issues such as ingress and egress. City of Wheat Ridge code requires a minimum lot area of one thousand five hundred (1,500) square feet for each child residing at the home. In order to accommodate 8 children this lot would need to be a minimum of 12,000 square feet. According to the Jefferson County Assessor, the lot on which this home occupies is approximately 9,235 square feet. As a result, only 6 children would be allowed to reside in the home. No variance can be requested for this requirement. Variances can only be requested for site development requirements such as landscaping, setbacks, and building height. The special use permit (SUP) process has two options. The first process requiring submission of a site plan is used more for applications on vacant land that is being developed. The second option, request for special use without a site plan, is more suited to the needs to the applicant as all existing site improvements are currently in place The first step in the process began with the pre-application meeting in which the applicants met with staff to talk about initial concerns, answer questions the applicants may have had, and inform the applicants the processes that they are required to go through. The second step required by the community development department will be to conduct a neighborhood meeting. For this meeting, the applicants must inform all property owners about the meeting, via mail or hand delivery, within a 600 foot radius of the property in which the action is being taken. The community development department will supply the applicant with a list of the all property owners in the radius. The meeting should be coordinated with the assigned staff member at a fee of $100. A sample of this letter is found in the pre-application meeting packet and can be used as a template. However, changes to the letter should be made to suit the applicant, including the letterhead. The meeting will be led by the applicants and should inform those who attend what is being proposed. After the neighborhood meeting is held, the applicant may submit their application for a special use permit. Upon submittal, the assigned staff will review and comment on the project. The project will simultaneously be referred to other departments and utility companies for their comments. The staff planner will inform the applicant if further changes need to be made based on comments of others or their own, or if they meet all requirements. When all requirements are met, the applicant will be required to post a sign on the property for ten days informing citizens of the action being proposed. Normally, if no legitimate objections were received regarding the action on the property the Special Use Permit could be approved administratively. If legitimate objections are received via mail or phone from anyone, the Special Use Permit will have to be heard before the Planning Commission. A date will be set for the hearing and will be open to the public. At the meeting the case planner will present evidence to support their recommendation of approval, approval with conditions, or denial. The public will also be allowed to give testimony in support of or against the request for the Special Use Permit. The Planning Commission will listen to all the testimony given and make a final decision of approval, approval with conditions, or denial for the Special Use Permit. We are opening the home as a foster home under a Child Placement Agency state license, with up to 4 adolescent boys on April 3, 2007. The boys are being referred by Jefferson County Department of Social Services. Weare requesting group home status, which would allow the home to have up to 8 children and/or youth. Healing Homes for Children, co-owned by Griffith Centers for Children and Jefferson Hills, was organized in response to Jefferson County Department of Human Services need for step-down from out of home placement. While Healing Homes for Children is a new company, its 2 owners are longstanding companies with strong relationships in Jefferson County and the community. Jefferson Hills, a wholly owned subsidiary of Jefferson Center for Mental Health, provides staff secure residential care to 70 adolescents at its 6th and Simms facility in Lakewood, and another 86 adolescents at its facility at 1-225 and Mississippi in Aurora. Jefferson Hills has been providing residential services since 1993. Griffith Centers for Children has provided quality services to youth for over 70 years. Its continuum of care includes residential services at 4 locations (Larkspur, Colorado Springs, Rifle, Grand Junction) as well as an extensive community based network, including a group home in Colorado Springs, foster homes, and a variety of family based outpatient interventions. Both agencies are not for profits (50Ic3s) and are nationally accredited by the Council of Accreditation (COA). The group home program priority is safety of youth, staff, and the community, and uses principles of experiential therapy and learning to allow the youth an opportunity to practice life skills as they re-integrate into the community setting. We will ensure close communication with the home school for education success. We will provide family services with the intent ofretuming the youth to his/her family. Our targeted length of stay is 3-6 months.
