This letter is in regard to your request for modification of a special use permit allowing a vehicle
sales lot on property located at 4949 Marshall Street. Case No. SUP-07-09 was approved to allow
vehicle sales display on certain locations on your property.
On August 8, 2008, the city received a request from you to amend the locations of the permitted
vehicle display. Please be advised that your SUP approval has been modified to allow vehicle
sales within an existing access easement located along the northern property line with the
following conditions:
1. Five vehicle display spaces have been approved at the location shown on attached
Exhibit 1.
2. For the display to occur, a valid agreement with the persons owning the easement
(Thomas and Isabel Abbott) must be in effect. If the agreement becomes null and
void, parking in this area must cease.
3. The amended special use approval shall be a grant of use to the current tenant
(Allen Martinez) and cannot be inherited, transferred or assigned.

SUBJECT: Case No. SUP-07-09/Clear Creek Collision
Case No. SUP-07-09 was a request to allow a vehicle sales lot on property zoned C-1 located at
4949 Marshall Street. Existing on the property is a heavy automotive repair facility. The case
was approved administratively in August of 2007 for the following reasons:
1. This request for an administrative special use meets all applicable conditions as required
by Section 26-114 of the City of Wheat Ridge Code of Laws.
2. Staff has not received written comments in opposition to this request from the noticed
property owners.
3. The building and land is currently being used for automotive repair which is more
intensive than vehicle sales and rental.
4. There is no change in site conditions so the special use will not impact adjacent
properties or endanger the general health, safety welfare and convenience of persons residing or
working in the neighborhood.
5. Adequate parking is provided on site.
With the following conditions:
1. The special use shall be a grant of use to the current tenant (Allen Martinez) and cannot
be inherited, transferred or assigned.
2. The property must be utilized in conformance with Exhibit 1.
3. Vehicle display cannot occur in the area which is encumbered by a 50' wide
ingress/egress easement running along the northern side of the property.
Attached is exhibit A which defines where vehicles for sale were to be located.
The applicant has requested an amendment to his approval to allow five parking display spaces
along the north side of his property. This area is encumbered with a 50' wide ingress-egress
easement for access to the property directly to the west which has no direct street frontage. The
easement belongs to Tom Abbott who runs his landscape business from the property to which the
easement allows access.
Mr. Abbott has agreed to the modification and has provided his terms for the parking attached as
Exhibit 2.
It is my opinion that modification of the approval to allow five vehicle display spaces along the
north property line of the repair facility does not further impact the area. Attached is the original
staff report.
Please advise me as to your thoughts about the SUP modification.

Per our conversation on the phone, Mr. Abbott and I have come to a written
agreement. Mr. Abbott is permitting Clear Creek Auto Sales Inc to park cars
in the easement. We have only parked cars in the easement during business
hours; we move the cars behind the fence everyday and would continue to
do so. We would also ask for a modification to submit this agreement,
between Mr. Thomas L and Isabel I Abbott and Allen Martinez and Bruce
Carpenter, into the city of Wheat Ridge records and allow Clear Creek
Collision Center to use the easement per the agreement. Thank you in

AGREEMENT
Between the Followine Parties:

To Whom It May Comm:
Thomas L. and Isabel I. Abbott, in consideration of good will, grant the following:
The cement owners of the Clear Creek Collision Center may park cars for sale within the north easternmost side of
this legally described access easement, where closest to Marshall St, and as actually demarcated by the first 5
parkthg spots as currently indicted by diagonal pavement stripiog.
Under-the Following Conditions and Stipulations:
1. Term ofthe Agreement Two Years from this date. August 7, 2008 to August 7, 2010.
2. Agreement is Not Transferable by the current owners of Clear Creek Collision Center to any other person
or entity.
3. The Agreement may be revoked, at any time, for cause.
4. In deference that the described parking is not illegal under the Wheat Ridge Code of laws
5. Vehicles parked must be in driveable condition, and positioned for easy relocation.
6. Vehicles must be moved by Clear Creek Collision on short notice if requested by the Abbott's or their
agent
7. 24 hour clear-driveway truck access must be maintained at all times, without the moving of vehicles; for
Excel Energy, CBS Outdoor, or any other tenant of 4909 Marshall SL Also for emergency access, such as
fire department and police. The current locked chainimk gate is accepted, with the understanding that each
property wr71 be allowed to, provide their own padlock fnrrequired secure access.
8. The granting of this Agreement in noway is intended to provide avenue far the granting or gaining of any
long-tam legal property right, or elaim to such right; to Clear Creek Collision Center or the owner of the
overlying property known as 4949 Marshall SL Wheat Ridge, CO 80033. Given, and with recognition of,
the past, errant and on-going encroachments and activities occUrIng within the physical boundaries of
this access easement which occurs across the property known as 4949 Marshall St; the boundaries and
stipulations ofthe referenced underlying legal easement shall be considered and understood to remain
unchanged and unaffhoted.

On the fall of 2007, you were granted a special use permit to allow the sale and rental of vehicles
on property located at 4949 Marshall. The specific conditions of approval were the following:
1. The special use shall be a grant of use to the current tenant (Allen Martinez) and cannot be
inherited, transferred or assigned.
2. The property must be utilized in conformance with Exhibit 1.
3. Vehicle display cannot occur in the area which is encumbered by a 50' wide ingress/egress
easement running along the northern side of the property.
It has come to the City's attention that the property is being used in violation of the approved conditions
including parking vehicles for sale in the city right-of-way for Marshall Street and the display of vehicles
in the 50' wide access easement which runs along north property line in the 50' wide access easement. A
violation of any of the conditions of approval could result in the SUP being revoked.
Please see attached excerpt from the zoning and development code
F. Enforcement All conditions and stipulations imposed by the community development
director or city council shall be maintained during the entire term of the special use. If at any
time the stipulations or conditions are not adhered to or are found to have been materially
altered in scope, application or design, the director of community development shall investigate
and, if appropriate, initiate revocation proceedings which shall include the following:
1. Notice of violation following procedures as set forth, in sections 26-1005 or 26-1006 of this
Code.
2. Upon a finding of noncompliance after the prescribed correction date, the community
development director shall schedule a revocation hearing before the city council. The purpose
of the revocation hearing shall be for the city council to hear evidence concerning the nature
and extent of the alleged noncompliance with the conditions of the special use permit The
council shall have the power, upon good cause being shown, to cancel or revoke the previously
issued special use permit, to require certain corrective measures to be taken, and/or to direct the
city's agents to enter upon the premises and take corrective measures required by the city
council, and to modify the conditions which apply to the special use permit.
You are also in violation of Section 13-43 below.

Sec. 13-43. Removal and impoundment.
(a) Whenever any police officer or community services officer finds a motor vehicle, attended
or unattended, standing upon any portion of a street or highway right-of-way or other public
place in such a manner as to constitute an obstruction to traffic or proper highway
maintenance, or the construction of any public improvement, or threatens public safety, such
officer is authorized to cause the motor vehicle to be moved forthwith to eliminate any such
obstruction, and neither the officer nor anyone acting under his direction shall be liable for any
damage to such motor vehicle occasioned by such removal.
Please contact me at your within ten days of receipt of this letter to discuss compliance with the
original conditions of approval. Disregard of this letter may result in a summons to City of Wheat
Ridge Municipal Court.

All notification and posting requirements have been met; therefore, there is jurisdiction to make a
determination regarding this request.
I. REQUEST
The applicants request approval of a special use permit to allow a vehicle rental and sales facility on
property located at 4949 Marshall Street and zoned Connnercial-One.
Section 26-204 (zone district use schedule) of the Zoning and Development code requires that
automobile and truck sales and rental in the C-I zone district receive special use approvals.
The applicant is applying for a special use permit in order to sell and rent cars from the address above.
The majority of sales will be internet based but a physical location is needed for the business. The
vehicles that are on site would also be sold to walk-in customers. The vehicles will be displayed on
the lot during business hours then moved to a fenced area after hours. A car rental component will be
supplemental to the body shop service that will allow for customers who are having vehicles worked
on to be able to rent a car at this location.
The property is located on Marshall just north of the curve from W. 48th Avenue. There is an existing
structure on the property with a 7200 s.f. footprint. A special use permit was granted pursuant to Case
No. SUP-82-5 to allow heavy automotive repair. No additional site improvements are proposed.

The northern 50' of the property is encumbered with an ingress/egress easement for the property to the
west. (Exhibit 2, survey)
The area surrounding the proposed site is largely industrial with some uses being more intensive
(commercial contractors' storage yards) than others (plumbing fixtures sales and installation). There
already is a body shop on site which is considered to be more intensive in use then automobile sales
and rental. The Clear Creek greenbelt and open space area abuts the property to the north.
Pursuant to Section 26-114 (special uses), the Connnunity Development Director has the ability to
decide upon applications for administrative special use approval, without requirement for a public
hearing, provided the following conditions are met:
I. A completed application package has been submitted and fee paid.
2. The Connnunity Development Department has notified adjacent property owners by letter
notice and the site has been posted for at least ten (10) days,
3. No written objections have been received in such ten-day period;
4. The Connnunity Development Director concludes that the criteria for approval, as set forth
below, are substantially complied with and support the request.
The Connnunity Development Director can impose conditions or stipulations upon the approval,
which may include physical design, operational, and maintenance considerations to ensure compliance
with the criteria for review.
The Connnunity Development Director shall also decide the following:

I. Whether the SUP runs with the land in perpetuity; or,
2. Whether the SUP is personal to the applicant and mayor may not be inherited; and lor,
3. Whether the SUP is granted only for a defined period, after which time the special use
shall expire unless renewed subject to all ofthe requirements of this section.
II. AGENCY REFERRALS
Wheat Ridge Fire Protection District: No response.
Wheat Ridge Water District: No response.
Wheat Ridge Sanitation District: No response.
Public Works: A trip generation study will not be required based on the characteristics of the
proposed business operation.
III. SPECIAL USE PERMIT CRITERIA
For an administrative approval, the connnunity development director shall base the decision in
consideration of the extent to which the applicant demonstrates the following criteria have been met:
1. The special use will not have a detrimental effect upon the general health, welfare, safety
and convenience of persons residing or working in the neighborhood.
The property in question has been previously utilized for automotive use. No changes to the site
conditions are proposed. There should be no detrimental impact to the property owner to the west if
the ingress/egress easement is kept clear of vehicles.
2. The special use will not create or contribute to blight in the neighborhood by virtue of
physical or operational characteristics.
There should be no blight issues associated with the additional display vehicles given the industrial
nature of the area. The property is already being used for heavy automotive repair which is considered
more intensive than auto sales and rental.
3. The special use will not adversely affect the adequate light and air, nor cause significant
air, water or noise pollution.
The site conditions are not changing, therefore, there should be no impact on light, air, or water to
adjacent properties. There should be no concern for increased noise, air or water pollution in light of
the surrounding connnercial and industrial uses in the innnediate area.
4. The special use will not result in undue traffic congestion or traffic hazards, or unsafe
parking, loading, service or internal traffic conflicts to the detriment of persons whether on or
off the site.

Parking can be acconnnodated on site for the vehicle sales, rentals, and body shop. There is room for
the parking of20-25 vehicles in the building alone. The outdoor parking, storage, and display areas
are all paved and have enough area to meet parking requirements.
Public Works has concluded that there will be minimal traffic impact based on the proposed operation
ofthe business.
5. The property is appropriately designed, including setbacks, heights, parking, bulk,
buffering, screening and landscaping, so as to be in harmony and compatible with the character
of the surrounding areas and neighborhood, especially with adjacent properties.
Adjacent properties are connnercial and industrial in nature and will experience minimal impact from
the proposed vehicle display. No changes to the property are proposed.
6. The special use will not overburden the capacities of the existing streets, utilities, parks,
schools and other public facilities and services.
There will be no impact to parks or schools. All utility agencies are currently serving the property.
7. There is a history of compliance by the applicant and/or property owner with Code
requirements and prior conditions, if any, regarding the subject property.
If conditions of an approved special use are violated, the permit can be revoked. If the permit is
revoked, then the use of the property for vehicle sales and rental must cease. A review of the
department's code enforcement files has revealed that there have be no zoning code violation citations
for the property in the recent past.
8. The application is in substantial compliance with the applicable standards set forth in
the Architectural and Site Design Manual.
No physical improvements are proposed to the property therefore this criterion is not relevant.
IV. NEIGHBORHOOD MEETING
A meeting for neighborhood input was held on October 16, 2007. One neighboring property owner
was in attendance. (Exhibits 3 and 4, Neighborhood meeting recap and Sign-up sheet).
The adjacent property owner to the west submitted a letter of no objection as long as his ingress/egress
easement carrnot be used for vehicle display. (Exhibit 5, adjacent property owner letter)
V. STAFF RECOMMENDATIONIFINDINGS OF FACT
Staff reconnnends approval of Case No. SUP-07-09, a request for approval of a Special Use Permit to
allow a vehicle sales and rental lot for property located at 4949 Marshall Street with the following
findings of fact:
1. This request for an administrative special use meets all applicable conditions as required by

Existing Use/site conditions: The property is located on Marshall just north of the curve from W.
48th Avenue. There is an existing structure on the property with a 7200 s.f. footprint. A special use
permit was granted pursuant to Case No. SUP-82-5 to allow heavy automotive repair.
Applicant's Proposal: The applicant is applying for a special use permit in order to sell and rent
cars from the address above. The majority of sales will be internet based but a physical location is
needed for the business. The vehicles that are on site would also be sold to walk-in customers. The
vehicles will be displayed on the lot during business hours then moved to a fenced area after hours.
A car rental component will be added to the body shop that will allow for customers who are having
vehicles worked on to be able to rent a car at this location.
The following issues were discussed regarding the proposed Special Use permit.
The adjacent property who owns land to the west expressed concern that the proposed vehicle
display area is located on top of his access easement through the subject property. Xcel energy and
the billboard company also use this easement for maintenance of facilities on his property. Staff

indicated that the display could not occur on top of the easement. The adjacent property owner said
he would provide a copy of the easement document to staff. Otherwise, he has no problems with
the proposed special use request.

Response to City of Wheat Ridge special use criteria:
1. The addition of the used car sales to Clear Creek Collision Center will not be
detrimental. This is especially true in that solicitation of car sales will be
primarily marketed through the internet. Most sales will be by appointment only.
This will have a very minimal effect on traffic flow.
2. The sale of used cars should not be any kind of a frustration or irritation to the
surrounding neighborhood.
3. There will not be significant differences in the business appearance or operation.
This will be an added service to the community.
4. As stated previously, the traffic flow should not be impacted. Sales will be
primarily by appointment and solicited through the internet. The drive by
business is not expected to be significant to the point of influencing traffic.
5. No changes to existing landscaping, building, or other structures will be made.
Since this property has already been approved for other business use, this should
not be an issue of concern.
6. There will be no overburdening of any of the capacities listed, as the car sales will
be paired with the existing collision center and using the same resources.
7. The property is currently in compliance with all code requirements.
8. There will be no changes to the architecture or site design by adding this service
to the existing business.

Dave,
I had phone conversation with Aian, the applicant, today to learn more about their SUP proposal. Overall, the
proposal will retain the auto body shop as the main business and rental and sale as supplemental business to
enhance the service. He pians to have up to 4 vehicles for rental to customers who have their vehicles repaired
at the shop. In addition, he plans to have an inventory about 10 to 15 cars for saie thru the internet and to repair
customers. The lot will not be signed as a typical use car lots. He mentions that he may have a couple in the front
for display while the rest will be inside the fenced area. The overall plan does not fit as a typical used cars sale lot
which can generate more traffic.
The assessment above suggests that traffic generation or increase will not be significant. Therefore. the PW Dept
will retract the trip generation letter requirement as stated earlier.

NOTICE OF NEIGHBORHOOD INPUT MEETING
Clear Creek Auto Sales, Inc. dba Clear Creek Collision Center is proposing a Special Use
Permit on property located at 4949 Marshall St., Wheat Ridge, Colorado 80033. A
neighborhood meeting will be held on Tuesdav, October 16, 2007 at 6pm in the Second
Floor Conference Room at Wheat Ridge City Hall, 7500 W 29th Avenue, Wheat Ridge,
Colorado 80033. The purpose of the request is to allow auto sales and vehicle rentals in
C-I Zoning.
The City of Wheat Ridge has adopted a requirement that prior to any application for
Special Use Permits an applicant must notify all residents and property owners within
600 feet and invite them to a Neighborhood Input Meeting. The purpose of this meeting
is to allow the applicant to presrnt his proposal to the neighborhood a.t1d to give the
neighborhood a forum to express their concerns, issues and desires,
A Staff Planner will attend the meeting to discuss City policies and regulations a.nd the
process involved, however, the Planner will remain impartial regarding viability of the
project.
Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be
entered as testimony, it is the public hearing in front of City Conncil where decisions are
rendered. If you want input in the decision-making process, it is imperative that you
attend the public hearing.
The kinds of concems residents nonnally have include the following:
. Is the proposal compatible with surrounding land use and zoning?
. Are there adequate utilities and services in place or proposed to serve the project?
. What is the impact of our streets?
. How will this proposal affect my property?
. Where will the storm drainage go?

ApplicanUOwner Preliminary Proposal:
The applicant is applying for a special use permit in order to sell and rent cars from the
address above. The majority of sales will be internet based but a physical location is
needed for the business, The vehicles that are on site would also be sold to walk-in
customers, The vehicles will be displayed on the lot during business hours then moved to
a fenced area after hours,
A car rental component will be added to the body shop that will allow for customers who
are having vehicles worked on to be able to rent a car at this location,
Will a neighborhood meeting need to be held prior to application submittal?
A neighborhood meeting will be required for a Special Use Permit to allow for car sales
and rentals,
Planning comments:
The parcel on which the action is being requested is zoned Commercial One, C-1, Under
the C-1 zone district regulations, automobile sales and rentals are allowed as a special
use, The intent of this district is to provide for areas of the city with a range of commercial
land uses which include office, general business, and retail sales and service
establishments. The surrounding properties have mix of zoning designations but the
majority of uses are industrial in nature. There are some residential properties to the east
but this proposed use should have little effect on those properties.
The area surrounding the proposed site has a large amount of industrial properties, Some
are more intensive in use and other less intensive, There already is a body shop on site
which also more intensive in use then automobile sales and rentals.
Parking should be able to be accommodated on site for the vehicle sales, rentals, and
body shop, In the building there is room for parking 20-25 vehicles, The outdoor parking,
storage, and display areas are all paved and should have enough area to be able to meet
the parking requirements.
One of the previous owners was selling vehicles from this location. A search of the city's
records has shown that the approved special use permit allowed only for automotive
repair and not vehicle sales. A separate special use permit will need to be obtained by
the applicants in order to sell vehicles from this property,
If the applicants would like to begin car sales on the premises immediately while pursuing
a special use permit for the displaying of vehicles, they may advertise vehicles solely on
the internet with no onsite display of the vehicles, The vehicles would need to be kept
behind the fencing or on the interior of the building, out of site of the general public from
Marshall Street. Customers would still be allowed to come on site to view vehicles while
the special use permit for displaying the vehicles was being pursued.
Process:
The first step in the process began with the pre-application meeting on August 30th, 2007,
The second step that is required by the Code of Laws will be to conduct a neighborhood
meeting. For this meeting, the applicants must inform all property owners, via mail or
hand delivery, within a 600 foot radius of the property in which the action is being taken,
The Community Development Department will supply the applicant with a list of the all
property owners in the radius. The meeting should be coordinated with the assigned staff
member and a fee of $1 00 is required for staff time at the meeting. A sample of this letter
is found in the pre-application meeting packet and can be used as a template, However,
changes to the letter should be made to suit the applicant, including the letterhead, The
meeting will be led by the applicants and should inform those who attend what is being
proposed,
After the neighborhood meeting is held, the applicant may submit their application for a
special use permit. Upon submittal, the assigned staff will review and comment on the
project. The project will simultaneously be referred to other departments and utility
companies for their comments. The staff planner will inform the applicant if further
changes need to be made based on comments of others or their own, or if they meet all
requirements,
When all requirements are met, the applicant will be required to post a sign on the
property for ten days informing citizens of the action being proposed, Normally, if no
legitimate objections are received regarding the action on the property the Special Use
Permit could be approved administratively, If there are objections that are received in the
ten day posting period a hearing will be set before city council.
If a is hearing required before City Council the case planner will present evidence to
support their recommendation of approval, approval with conditions, or denial. The public
will also be allowed to give testimony in support of or against the request for the special
use permit The City Council will make the final decision on the request by making a
motion for approval, approval with conditions, or denial.
