Approval of Special Use Permit
WHEREAS, an application for a special use permit was submitted for the property located at 8935
West 44th Avenue; and
WHEREAS, City stafffound basis for approval of the special use permit, relying on criteria listed
in Section 26-114 of the Wheat Ridge Code of Laws and on information submitted in the case file;
and
WHEREAS, the Community Development Department has properly notified pursuant to Section
26-109 of the Wheat Ridge Code of Laws; and
WHEREAS, there were no registered objections regarding the application;
NOW THEREFORE, be it hereby resolved that a special use pennit is granted for the property
located at 8935 West 44th Avenue for the purpose of allowing automobile sales for property zoned
Commercial-Two (C-2), based on the following findings offact:
1. The proposed special use pennit will not have a detrimental effect upon the general public
health, welfare, and safety of the surrounding area.
2. The proposed use will not result in undue traffic congestion or traffic hazards, or unsafe
parking, loading, service or internal traffic conflicts.
3. The proposed use will not adversely affect the light and air to adj acent properties.
4. Adequate landscape buffers as required by the Zoning Code are being proposed, and all
parking requirements will be met.
With the following condition:
1. The grant of use shall be specific to the applicant and may not be inherited by or transferred
or assigned to another party.

All notification and posting requirements have been met; therefore, there is jurisdiction to make a determination
regarding this request.
I. REQUEST
The applicant is requesting a Special Use Permit to allow automobile sales and display on property zoned C-2
and located at 8935 W. 44th Avenue. Section 26-204 of the Code of Laws specifies that any automobile sales
and display lot in the C-2 zone district require a special use permit.
Pursuant to Section 26-114 of the Code of Laws, the Community Development Director has the ability to decide
upon applications for administrative special use approval, without requirement for a public hearing, provided
the following conditions are met:
I. A completed application package has been submitted and fee paid.
2. The Community Development Department has notified adjacent property owners by letter notice
and the site has been posted for at least ten (10) days,
3. No written objections have been received in such ten-day period;
4. The Community Development Director concludes that the criteria for approval, as set forth below,
are substantially complied with and support the request.
The Community Development Director can impose conditions or stipulations upon the approval, which may
include physical design, operational, and maintenance considerations to ensure compliance with the criteria for
review. Staff is not recommending any conditions of approval with this request.
The Community Development Director shall also decide the following:
1. Whether the SUP runs with the land in perpetuity; or,
2. Whether the SUP is personal to the applicant and mayor may not be inherited; and lor,
3. Whether the SUP is granted only for a defined period, after which time the special use shall
expire unless renewed subject to all of the requirements of this section
II. PROPERTY DESCRIPTION
The property in question is zoned Commercial-Two, and is 55,000 square feet (1.26 acres) in size. There is an
existing 11,325 square foot office building on the property (Exhibit I, Site Plan). There are two existing
accessory buildings to the east of the main building. The applicant wishes to occupy the main existing building,
therefore no major improvements are being proposed. The property is almost entirely encumbered by the 100-
year floodplain.
The applicant is not proposing any improvements to the property beyond some perimeter landscaping. The
trucks on display for sale will be parked on existing asphalt. If any new asphalt is proposed, a class I floodplain
exemption permit would be required. The applicant has removed some solid fencing on the southern property
line and replaced it with split rail fencing. A new landscape strip has been installed on the southern property
line. Section 26-628 of the Code of Laws requires that a ten-foot landscape buffer shall be installed when
adjacent to any public street.
The applicant has also indicated that some minor repair and modification of the trucks will occur inside the
building; a use which is allowed by the zone district.
The Community Development Department did receive a signed petition by property owners in the adjacent
neighborhood; however, their only request was that the fence on the northern property line should contain some
screening. It should be noted that screening is not a requirement for automobile sales and display lots. Only

outdoor storage must be screened from view. This signed petition has been included as Exhibit 2. The applicant
has volunteered to install screening on the northern property line.
m. SPECIAL USE PERMIT CRITERIA
Before an administrative special use is approved, the applicant shall show and the Community Development
Director shall find that the proposed special use:
1. The special use will not have a detrimental effect upon the general heaIth, welfare, safety and
convenience of persons residing or working in the neighborhood.
The proposed use will not have a detrimental effect on the general health, welfare, safety and
convenience of persons residing or working in the neighborhood. The use should not be intrusive to
persons in the neighborhood. No traffic from this business should spill into the neighborhood to the
north. The operation of the property should not have an adverse effect to the neighborhood.
2. The special use will not create or contribute to blight in the neighborhood by virtue of physical
or operational characteristics.
The request will not create or contribute to blight in the neighborhood. The applicant has made some
aesthetic improvements to the property in the form of new landscaping and updated fencing. An old
dilapidated fence was removed from the southern property line. Screening slats were removed from
the fence on the northern property line, which will be replaced with new screening material. The
access to the property is from W. 44th Avenue. No traffic from this business should spill into the
neighborhood to the north. The operation of the property should not have an adverse effect to the
neighborhood.
3. The special use will not create adverse impacts greater than allowed under existing zoning for
the property.
The request will not create adverse impacts which are greater than the existing zoning. The activity
generated by this type of use is not uncharacteristic with other allowed uses in the C-2 zone district.
4. The special use will not result in undue traffic congestion or traffic hazards, or unsafe parking,
loading, service of internal traffic conflicts to the detriment of persons whether on or off the
site.
The request should not cause undue traffic congestion or hazard. The amount of traffic derived from
this use will be minimal compared to the previous user; a lawn care company which employed many
field technicians. The property gains access through an existing curb cut on the adjacent property to
the west. There should be no internal traffic conflict as a result of this proposed operation.
5. The property is appropriately designed, including setbacks, heights, parking, bulk, buffering,
screening aud landscaping, so as to be in harmony and compatible with the character of the
surrounding areas and neighborhood, especially with adjacent properties.
Although the existing building will remain as-is, the applicant must adhere to certain landscaping
standards required for automobile sales lots. A ten-foot landscape buffer is required along the street
frontage adjacent to the display area. The site plan shows this ten-foot landscape buffer. If any storage
is proposed, it must be properly screened from the right-of-way. Adequate parking is being provided
based upon the amount of sales area devoted to the site.

6. The special use will not overburden the capacities of the existing streets, utilities, parks, schools
and other public facilities and services.
The request should have no impact on the public facilities or services.
7. There is a history of compliance by the applicant audlor property owuer with Code
requirements aud prior conditions, if any, regarding the subject property.
No history was found regarding code requirements on the subject property. There are no relevant
conditions on this property or the applicant pertaining to this proposal that were found.
8. The application is in substantial compliance with the applicable staudards set forth in the
Architectural and Site Desigu Manual.
The applicant is not proposing any changes to the existing building or major changes to the site;
therefore the requirements in the Architecture and Site Design Manual are not applicable.
IV. NEIGHBORHOOD MEETING
A meeting for neighborhood input was held on October 30, 2007. There was one neighbor who attended the
meeting. A summary of the meeting has been attached as Exhibit 3.
V. AGENCY REFERRAL
Because the building currently exists, and the proposed use should not alter the ability of any provider to serve
the property, a limited referral was sent. The agencies which were contacted offered no response to this
proposed use.
VI. STAFF RECOMMENDATION
Staff concludes that the proposed use will not have a detrimental effect on the surrounding area. The ten-day
public notice period was held and all adjacent landowners were notified by certified mail. The ten day public
notice period did not produce any relevant objections. Therefore, staff recommends approval of Case No. SUP-
07-10, a request for approval of a special use permit for property located at 8935 West 44th Avenue to allow
automobile sales and display lot, for the following reasons:
1. The proposed special use permit will not have a detrimental effect upon the general public health,
welfare, and safety of the surrounding area.
2. The proposed use will not result in undue traffic congestion or traffic hazards, or unsafe parking,
loading, service or internal traffic conflicts.
3. The proposed use will not adversely affect the light and air to adjacent properties.
4. Adequate landscape buffers as required by the Zoning Code are being proposed, and all parking
requirements will be met.
With the following condition:

Comprehensive Plan Designation: Neighborhood Serving Retail
Existing Use/site conditions: The site in question is 4.7 acres in size and is zoned
Commercial-Two, It has street frontages on three sides, with 44th Avenue on the south, field Street
on the West and W, 45th Place on the north. Abutting the site on the east is the Clear Creek trail and
greenbelt. The property is encumbered with lOO-year floodplain on the eastern half.
Several structures are located on the site including an II ,000 square foot metal building in which
the truck servicing and sales office will be located,
The surrounding properties have mix of zoning designations including several multi-family
developments zoned R - 3 to the north and a retail shoppette zoned C-l to west.
Applicant's Proposal: The applicant is applying for a special use permit in order to establish a
vehicle sales lot on the address above. Minor servicing and detailing of the vehicles will occur on
the property as well.
EXHIBIT 1
The area of proposed occupancy is generally the eastern one-third of the site,
The following issues were discussed regarding the zone change request and proposed
development:
. Are there going to be any fence improvements? The property owner is working with the City
through CSU to repair the existing fence on the north and east sides. Some of the existing
chainlink fence along W 441h Avenue will be replaced with split rail.
. The fence along the Clear Creek greenbelt has been a target of graffiti, Can the slats be taken
out so it is just chainlink and a less attractive target for graffiti? The requirement for the
screening slats was due to the outside storage for the True Green maintenance operation.
The truck sales facility does not need screening unless there is the outside storage of parts
or vehicles being worked on, The applicants may want to consider screening the northern
portion only.
. Will you be moving vehicles back and forth between this property and your current location (W,
44th Avenue/Garrison)? No, once we receive the SUP approval, all vehicles will be kept on
this property.
. What will be the traffic impact? There will be much less traffic generated than by the previous
tenant which had 40 service trucks with trailers that would leave and return to the site every
day. The majority of the traffic will be customers,
. Will any repair occur outside? No, all repair will occur inside the structure,
. Where will the office be located? There will be three offices inside the large building.

Kevin Hood declared a quorum present.
Kevin Hood announced his resignation from the Parks and Recreation Commission and noted that his
last meeting will be February. There was discussion regarding filling the Commission vacancies and
elections for a new chairperson.

Beth McBride made a motion to approve the minutes of October 17, 2007. Liz George seconded. The

ITEM 5 - NEW BUSINESS
Master Plan Administrative Action Report - Joyce Manwaring presented a power point presentation
that addressed the progress of the Parks and Recreation Master Plan administrative actions to date.
There was discussion regarding the process for fees in lieu of park land for proposed subdivisions,
property acquisition, parks needs in underserved areas as identified in the Master Plan, the challenges
of establishing school sites as neighborhood parks, intra-departmental communication and common
goal achievement, park impact fee analysis, future park site status, on-going park upgrades and facility
improvements, and the status of current projects including Anderson Park pool renovation, and the
Baugh House historic park.
Manwaring discussed the master planning process for development of the future park site at 38th and
Kipling and noted that the planning will begin in 2008. She discussed the process for capital
improvement projects, including the master planning process, public outreach, and impact of revenue
and budgets on project completion.
Manwaring discussed funding impacts, options for funding sources, city-wide economic development
issues, bicycle and trail connectivity upgrades, regular park plan inventory updates, ADA park
upgrades, semi-annual park replacements and improvements, and implementation of a GIS/GPS based
inventory and service order software. There was additional discussion regarding the Intergovernmental
Agreement with Jeffco R-l School District for field usage and targeted Open Space acquisitions.
ITEM 6 - PROJECT UPDATES
Manwaring discussed the status of the Request for Qualification for master planning of the property at
38th and Kipling. There was discussion regarding the public process, project timing, traffic planning,
and neighborhood access.
ITEM 7 - PENDING DEVELOPMENT REVIEWS
8395 W. 44th Ave./DTI Trucks - Manwaring asked for comment on the proposed property use.
There was discussion regarding the effects of a property use change on the quality of the Greenbelt
experience. The Commissioners recommend that in exchange for issuance of the special use permit, the
property owners agree not to detract from the experience on the Greenbelt by providing appropriate
screening, lighting levels that limit spillover into the Greenbelt, storm water and waste water drainage
management, and an access point from the westbound side of 44th to the Greenbelt.
10400 W. 44th Ave./Newgate - There was discussion. The Commission determined that based on the
location of the property there was no impact to Parks and Recreation for this particular case.
ITEM 8 - FUTURE AGENDA ITEMS
Open Space Management Annual Report - Joyce Manwaring advised that the Open Space Annual
Report will be presented in January.
Forestry Program Annual Report - Manwaring will advise the timing for the Forestry report.

Kevin Hood commented on the memo from Manwaring regarding trail opportunities as part of the
Quail Hollow development. There was discussion. Ralph Hughes will meet with Manwaring to review
maps of the area.
Manwaring distributed a list of2008 meeting dates. She updated the Commission on the success of the
Pumpkin Carving event at the Senior and Community Center. Manwaring reported that the VOA meal
site will move from the Senior and Community Center to the nearby Highlands South on January l,
2008.

I have completed my initial review of the special use permit application which was submitted to the
Community Development Department, and I have the following comments:
1. General
A, I have included all referral comments received by the Department. If you have any
questions regarding these comments, please direct them to the agency which
generated said comment.
B. A ten-day public notice period will begin on Monday, November 26, 2007 and run
through Wednesday December 5,2007. During this time, any affected neighbor may
submit written comments regarding your proposal. If the Department receives any
legitimate objections, a public hearing will be scheduled before the City Council.
Please be aware that if a City Council hearing is required, an additional fee of $440
is required. City staff will create public notice signs which must be posted on the
property notifying the public of the hearing, The applicant (or representative) must
be present at the public hearing,
C, Once the ten.day public notice period has concluded, a staff report will be forwarded
to the Community Development Director. The Director will review the request in
conjunction with the special use permit criteria listed in the Code of Laws. If the
Director feels that one or more of the special use criteria are not being met, a City
Council hearing will be scheduled and the above-listed items of l(B) will be
required.
2. Site Plan Review:
A. Please be aware that a landscape buffer of at least ten feet in width must be installed
on the southern property line. The ten foot buffer is measured from the southern
property line of the subject property. It appears that this ten-foot landscape buffer is
shown on the site plan.
B. Please be aware that the property must contain one landscape island for each 30
parking andlor display spaces. Each landscape island must include one two-inch
caliper tree,

C, The Public Works Department has indicated that water quality issues must be
addressed if any additional paving is planned. This may include the use of swales
and/or porous pavement. Additionally, a drainage letter and plan must be submitted
which detail the extent of the drainage improvements, This plan and letter must be
prepared by a licensed engineer.
D, A large portion of the property is located within the lOO-year floodplain area. If any
additional site paving is anticipated, a class I floodplain exemption permit is
required, Along with the building permit application for the paving, additional
drainage information is required, This drainage information must be prepared by a
licensed engineer.
E. Please be aware that any storage of material(s) located within the limits of the lOO-
year floodplain must receive a class I floodplain exemption permit. Additionally, this
storage must be screened from view by a six-foot fence.
F. Section 26-5OI of the Wheat Ridge Code of Laws specifies that for automobile sales
lots, one parking space must be supplied for each 1,000 square feet of display area,
Based on the area shown on the site plan, you will need II parking spaces onsite. It
appears that all required parking spaces have been provided.

1 have reviewed the above proposal and have the following comments:
l. The submitted information offers limited descriptions to assess traffic impact. Specifically,
detail description of current and proposed used is needed for the assessment.
2. lt is unclear whether the center driveway currently in operation. This driveway will need to be
closed off if it has not been done.
3. No traffic access will be allowed on 45th Avenue,
4. The site will be required to go through the floodplain process ifthe proposal involved in site
and/or grade alteration.
5. Current ROW maps indicated the portion of the frontage along 44th Avenue Right-of-way is
designated as unclear title. Additional discussions are strongly suggested to determine whether
this can be resolved with the SUP.

Applicant/Owner Preliminary Proposal:
The applicant is applying for a special use permit in order to establish a vehicle sales lot
on the address above. Minor servicing and detailing of the vehicles will occur on the
property as well.
The area of proposed occupancy is generally the eastern one-third of the site.
Will a neighborhood meeting need to be held prior to application submittal?
A neighborhood meeting will be required for a Special Use Permit to allow for vehicle
sales. A neighborhood meeting is not required for the minor servicing and detailing.
Existing site conditions:
The site in question is 4.7 acres in size and is zoned Commercial-Two. It has street
frontages on three sides, with 44th Avenue on the south, field Street on the West and W.
45th Place on the north. Abutting the site on the east is the Clear Creek trai~ and
greenbelt. The property is encumbered with 1 OO-year floodplain on the eastern half.
Several structures are located on the site including an 11,000 square foot metal building
in which the truck servicing and sales office will be located.
The surrounding properties have mix of zoning designations including several multi-family
developments zoned R-3 to the north and a retail shopette zoned C-1 to west.
Planning comments:
The parcel on which the action is being requested is zoned Commercial Two, C-2. Under
the C-2 zone district regulations, automobile sales and rentals are allowed as special
uses. The intent of this district is to provide for areas of the city with a range of
commercial land uses which include office, general business, more intensive retail sales,
wholesale businesses, and light manufacturing.
Minimal improvements are required for use of the property; however, some portions of the
proposed display areas are not adequately paved. Any areas used for vehicle display and
customer and/or employee parking must be paved.
The storage of truck accessory parts such as beds, and trucks being worked on could be
stored outside behind a 6' high screening fence. Care must be taken regarding the
storage of items which are buoyant in the floodplain.
A paving permit will be required with the installation of a 10' wide water quality swale
along the east property line adjacent to where the new paving will occur. Public Works
suggests the use of porous landscaping with a "trough" configuration to capture and filter
storm water flow off the site.
Specific requirements for landscape installation are detailed for vehicle sales and display
lots (Section 26-628). Those improvements include the installation of a 10' wide
landscaped strip adjacent to any public street. Although there is existing landscaping
along the 44th Avenue frontage which includes grass and street trees, these
improvements were installed as part of the W. 44th Avenue implements project and are
located in city right-of-way. Ten feet of additional landscaping must be installed behind
the existing landscaping in the r-o-w.
Other required landscape improvements include one interior landscaped island for each
30 parking display spaces. Each island shall be a minimum of 8-1/2' x 18' in size and
must include one tree and five shrubs or living ground cover.
The SUP is needed only for vehicle display, not for vehicle servicing. Vehicle servicing
could occur prior to approval of the SUP. All repair must occur within a structure.
Process:
The first step in the process began with the pre-application meeting on September 27,
2007.
The second step that is required by the Code of Laws will be to conduct a neighborhood
meeting. For this meeting, the applicants must inform all property owners, via mail or
hand delivery, within a 600 foot radius of the property on which the action is being taken.
The Comrnunity Development Department will supply the applicant with a list of the all
property owners in the radius. The meeting should be coordinated with the assigned staff
member and a fee of $100 is required for staff time at the meeting. A sample of this letter
is found in the pre-application meeting packet and can be used as a template. However,
changes to the letter should be made to suit the applicant, including the letterhead. The
meeting will be run by the potential applicant and should inform those who attend what is
being proposed.
After the neighborhood meeting is held, the applicant may submit their application for a
special use permit. Upon submittal, the assigned staff will review and comment on the
project. The project will simultaneously be referred to other departments and utility
companies for their comments. The staff planner will inform the applicant if further
changes need to be made based on comments of others or their own, or if they meet all
requirements.
When all requirements are met, the applicant will be required to post a sign on the
property for ten days informing citizens of the action being proposed. Normally, if no
legitimate objections are received regarding the action on the property the Special Use
Permit could be approved administratively. Informational letter noticing of the proposed
SUP are sent to adjacent property owners. If there are objections that are received in the
ten day posting period a hearing will be set before city council.
If a is hearing required before City Council the case planner will present evidence to
support their recommendation of approval, approval with conditions, or denial. The public
will also be allowed to give testimony in support of or against the request for the special
use permit. The City Council will make the final decision on the request by making a
motion for approval, approval with conditions, or denial.
A "to-scale" site plan must be submitted with the application so the proposed parking
layout can be reviewed.

Public Works Requirements:
2 Copies of the following documents, signed and sealed by a CO licensed Professional Engineer, shall be
submitted for review with the Building Permit Application:
I. Drainage Letter and Plan: Water quality measures are required for all commercial re-developments. A
Drainage Letter shall be required stating how the required additional asphalt pavement will be placed
without impacting adjacent properties, and specifying what items are to be constructed for water quality
(Le., porous landscaping with WQ "detention" troughs or berms along the downstream property lines).
Please be advised that the minimal acceptable width for WQ landscape areas is 10 feet. The Drainage
Letter shall be accompanied by a Drainage Plan showing the existing and proposed site drainage,
including percent grades and drainage direction, and all water quality features (with details for
construction).
2. Grading & Erosion Control Plan: A Grading & Erosion Control Plan (signed and sealed by a
Professional Engineer) which includes details for all utilized BMP's both during and subsequent to
construction is required.
3. Construction Plans: Construction Plans (signed and sealed by a Professional Engineer) for all water
quality and drainage-related items, and include all applicable COWR standard details for proposed
constructed items.
4. Site Plan: A Site Plan included with the Construction Plans shall include the following:
a. 24" X 36" sheet format.
b. A vicinity map, scale, and north arrow.
c. Location of the 1 OO-year floodplain.
d. Existing (and proposed) contours at 2-ft intervals.
e. Adjacent streets.
f. Location of all existing & proposed easements and rights-of-way, fences, walls, drainageways,
ditches, buildings to be developed or retained on site.
The erosion control and drainage plans mentioned above may be combined with the Site Plan forming a
single Drainage, Grading, and Erosion Control Plan.
NOTES:
1. Information pertaining to the Public Works Development Review requirements, surveyingIROW
information, and the City's Standard Street Construction and Erosion Control Details are available
on the City of Wheat Ridge website: www.cLwheatridge.co.us .
2. A signed and sealed Drainage Certification Letter from the Engineer-of-Record (p.E. who prepared

NOTICE OF NEIGHBORHOOD INPUT MEETING
Douglas Trucks, Inc. is proposing a Special Use Permit on property located at 8995 W. 44'
Avenue, Wheat Ridge, CO. 80033. A neighborhood meeting will be held on October 30' at
6:00pm in the second floor conference room at the city of Wheat Ridge Municipal building at
7500 W. 29"' Avenue, Wheat Ridge, Colorado 80033. The purpose of the request is to allow a
vehicle sales display lot.
The City of Wheat Ridge has adopted a requirement that prior to any application for Special Use
Permits an applicant must notify all residents and property owners within 600 feet and invite
them to a Neighborhood Input Meeting. The purposes of this meeting is to allow the applicant to
present his proposal to the neighborhood and to give the neighborhood a forum to express their
concerns, issues and desires.
A Staff Planner will attend the meeting to discuss City Policies and Regulations and the process
involved, however, the Planner will remain impartial regarding viability of the project.
Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be
