On 8 May 2006, the Conununity Development Department received a fee in lieu of parkland
dedication for the property located at 4700 Parfet Street. This fee is lieu of parkland dedication is
associated with Case number MS-06-01. Pursuant to Section 26-42 I (D), a fee in lieu of parkland
dedication is required for any residential subdivision. A total of $1,181.75 was submitted by the
applicant. I have attached a copy of the receipt for your reference.

At its meeting of Apri120, 2006, Planning Commission APPROVED Case No. W A-06-
01, a request for approval of a 25,954 square foot variance to the minimum lot size of lot
1, a 32,666 square foot variance to the minimum lot size of lot 2 and 52.85 foot variance
to the minimum lot width of lot 2, for property located at 4700 Parfet Street for the
following reasons:
1. The request will not be detrimental to the public welfare or injurious to properties
in the area.
2. The request would not alter the character of the locality, the proposed lot sizes and
widths would match the lot sizes and widths of neighboring properties in the
surrounding area.
3. The property as it exists today is deficient in respect to minimum lot size and
width in the A-I zone district.
Planning Commission also APPROVED Case No. MS-06-01, a request for approval of a
two-lot subdivision plat for property located at 4700 Parfet Street, for the following
reasons:
1. All requirements of the Subdivision Regulations have been met.
2. All required utility easements are being provided.
3. Adequate infrastructure will be constructed with the development to serve the
proposed use.
Enclosed is a draft copy of the minutes stating the Commission's decision. A blackline
photographic mylar of the plat needs to be submitted for recording with Jefferson County
within 90 days of final action. Enclosed are Jefferson County's recordation requirements.
The fees for recording with Jefferson County are $11 per page. Please submit payment
along with the mylar. In addition, parkland dedication fees of $1,181.75 will be required
at the time of mylar submittal.

Case No. W A-06-01: An application filed by Park Kwang Choi for approval of a
variance to minimum lot size and lot width for property zoned Agricultural-One and
located at 4700 Parfet Street.
These cases were presented by Meredith Reckert. She entered all pertinent documents into the
record and advised the Commission there was jurisdiction to hear the case. She reviewed the
staff report and' digital presentation. She also advised that the request for variance would
require a super-majority vote to be approved. Staff reconunended approval of both applications
for reasons outlined in the staff report.

Ms. Wheatley stated that they wished to subdivide the property to create two residential lots.
They plan to build a new house on lot two and rent the present dwelling.
The possibility of a mass rezoning of this area from agricultural to residential was discussed.
Alan White informed the Commission that city code only allows for mass rezoning when it is
to a more intensive zoning.
There were no other individuals present who wished to address these cases.
It was moved by Commissioner PLUMMER and seconded by Commissioner STEWART

the minimum lot size of lot 1, a 32,666 square foot variance to the minimum lot size of lot
2 and 52.85 foot variance to the minimum lot width of lot 2, for property located at 4700
Parfet Street for the following reasons:
1. The request will not be detrimental to the public welfare or injurious to properties
in the area.
2. . The request would not alter the character of the locality, the proposed lot sizes and
widths would match the lot sizes and widths of neighboring properties in the
surrormding area.
3. The property as it exists today is deficient in respect to minimum lot size and width
in the A -1 zone district.

Prior to presentation of the cases, Commissioner STEWART disclosed that she is a neighbor of
the applicant and they have had some dealings in the past.
These cases were presented by Meredith Reckert. She entered all pertinent documents into the
record and advised the Commission there was jurisdiction to hear the case. She reviewed the
staff report and digital presentation. Staff reconunended approval of both applications for
reasons outlined in the staff report.
In response to a question from Commissioner STEW ART, Ms. Reckert explained that exiting
from the property would not be allowed from the north access due to limited sight distance.
Jim Blumenthal
4651 Tabor Street
Mr. Blumenthal, owner of Trailer Source, stated that CDOT will be taking 64% of his existing
property for a new off ramp leaving him with 2.5 acres out of 7 acres. He plans to build a
contemporary building on the remaining site to house their operations. He presented
architectural renderings of the proposed building. He stated his opposition to the city's request
for brick wainscoting which he believed would not be consistent with the overall design of the
building.
In response to a question from Commissioner PLUMMER, Alan White stated that the type of
building materials proposed to be used in this project are within the architectural code
guidelines.
In response to a question from Commissioner STEWART, Mr. Blumenthal stated that the
existing building woilld be demolished.
There were no other individuals present who wished to address these cases.

All notification and posting requirements have been met; therefore, there is jurisdiction to hear
this case.

width which will not be altered as a result ofthe subdivision plat, no variance is required. Lot 2
will require a variance to minimum lot width. The A-I zone district requires that each lot shall be
a minimum width of 140 feet. Lot 2 would be 87.15 feet wide, which is 52.85 feet short of the
minimum standard. This deficient lot width for lot 2 is created by the subdivision request, so a
variance must be processed for the width of lot 2.
Because the request is for a two-lot minor subdivision, Planning Conunission will take final
action on both the subdivision plat and the variance requests. If the variances are not approved,
the subdivision plat cannot be approved.
Al!encv Referral
All responding agencies have indicated that they can serve the property, and the applicant will
bear the cost of upgrading any service to the property. Typical utility easements are being
established around the perimeter of each lot.
Access
There is an existing access point located on Parfet Street which serves the single family structure
on lot 1. This access point will remain. Lot 2 will gain access from W. 47th Avenue.
III. VARIANCE CRITERIA
Because the variance requests are inter-related and all variances must be approved as a package,
the variance requests will be discussed together as one discussion item. In other words, Planning
Conunission can not approve the lot size variances and deny the lot width variances.
Staff has the following conunents regarding the criteria used to evaluate a variance requests:
1. Can the property in question yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by regulation for the district in
which it is located?
Ifthe request is denied, the property may still receive a reasonable retum in use. The existing
single family residence may remain. Redevelopment may occur on the parcel in conformance
with the A-I standards and guidelines. If the variances are not granted, the subdivision may not
be approved.
2. If the variance were granted, would it alter the essential character of the locality?
If the requests were granted, the character of the locality would not be altered. Lot 1 would be
17,606 square feet in size and lot 2 would be 10,894 square feet in size. This lot size is consistent
with surrounding properties on the north and south side of West 4 7th Avenue. The properties on
W. 47th Avenue are all between 12,200 square feet and 13,900 square feet, far below the one acre
minimum lot size. Additionally, the surrounding properties are all approximately 100 feet in
width, less than the 140 foot standard. While the lot sizes will be much less than the one acre
standard, the lots will match the conditions of the surrounding neighborhood.
3. Does the particular physical surrounding, shape or topographical condition of the specific
property involved result in a particular and unique hardship (upon the owner) as
distinguished from a mere inconvenience ifthe strict letter ofthe regulations were carried
out?

The property does not have a unique shape. The propert~ is rectangular in shape and is relatively
flat. The property has frontage on two streets - West 4 7' Avenue and Parfet Street.
4. Has the alleged difficulty or hardship been created by any person presently having an
interest in the property?
A person having interest in the property has caused the hardship. The lot is currently 28,500
square feet in size, which is 15,060 square feet short ofthe one acre minimum lot size standard.
However, the applicant wishes to subdivide and further increase the non-conformity, creating two
substandard lots.
5. Would the granting ofthe variance be detrimental to the public welfare or injurious to
other property or improvements in the neighborhood in which the property is located, by,
among other things, impairing the adequate supply of light and air to adjacent property,
substantially increasing the congestion in public streets or increasing the danger of fire or
endangering the public safety, or substantially diminishing or impairing property values
within the neighborhood?
The request would not be detrimental to the public welfare. The adequate supply oflight and air
would not be compromised as a result of the request. The request would not increase congestion
in the streets, nor increase the danger of fire. The request would most likely not have an effect on
property values in the neighborhood.
6. If criteria 1 through 5 are found, then, would the granting of the variance result in a
benefit or contribution to the neighborhood or the community, as distinguished from an
individual benefit on the part of the applicant, or would granting of the variance result in a
reasonable accommodation of a person with disabilities?
The granting of the variance will not result in a benefit to the neighborhood. The request would
not result in a reasonable acconunodation of a person with disabilities.
VI. STAFF CONCLUSION & RECOMMENDED MOTION (S):
Each request will require a separate motion. The subdivision plat cannot be approved if
the variance requests are denied.
Variance
Upon review of the above request, staff concludes that the criteria are supportive of the request.
While the hardship may be self-created, the end result of the variances will match the existing
character of the neighborhood. Therefore, staffreconunends APPROVAL ofthe variance
request.

Dear Mrs. Wheatley:
I have completed my second review of the subdivision plat submitted for 4700 Parfet Street, and I
have the following comments:
1. One correction is needed to the plat. Please see the attached letter from David Brossman.
Once the correction has been made, please submit 18 full sized (24" x 36") paper folded
copies of the plat. Additionally, one reduced (11" x 17") copy is required.
2. A Planning Commission hearing has been scheduled for Thursday April 6, 2006. You
must be in attendance at the hearing. Please submit the aforementioned copies of the plat
no later than Thursday, March 30, 2006. Public hearing signs must be posted on the
property (created by City staff) by Thursday March 23, 2006. You will be required to
maintain the public hearing sign a full fifteen days prior to the hearing, and ensure the
sign is visible at all times.

I have completed my initial review of the subdivision plat submitted for 4700 Parfet Street, and I
have the following comments:
1. General:
A. I have included all referral comments received for your review. Please direct any
questions regarding these comments to the appropriate agency which generated said
comment.
B. The submitted application contained a subdivision plat and all pertinent documents
for review. After the initial review, it was discovered that three variances must be
processed with the subdivision plat: a variance to lot size for lots I and 2, and a lot
width variance for Lot 2. These variances will be discussed concurrently with the
subdivision plat at public hearing,
C. After all required corrections have been made; a public hearing will be scheduled
before the Planning Commission. Prior to the hearing, the applicant will be required
to post public hearing signs on the property (created by City staff). The applicant
will be required to maintain the public hearing sign a full fifteen days prior to the
hearing, and ensure the sign is visible at all times.
D. The Code of Laws dictates that for all residential subdivisions, a fee in lieu of
parkland dedication is required, This fee is based on size of subdivision, value of
subdivision and number of dwelling units. The total fee in lieu of parkland
dedication is $1,181.75. This fee should be paid after the Planning Commission
hearing, prior to recordation of the mylar.
2. Subdivision Plat:
A. Please correct the typographical error in line 6 of the Dedication statement (,., west a
distance of...).
B. Please correct the typographical error in line 7 of the Dedication statement (,., west
227.9 feet to...).
C. Please correct the spelling of "foregoing" in the Owner's Certification in the
Dedication statement.
D. Please add the following case numbers to the Case History box: MS-06-01 and W A-
06-01.
E. Please reword the Planning Commission Certification to read: "Approved this _

1. The Legal Description does not match the graphical portion of the Plat. Please revise the Legal to
correspond to the graphical portion (what was set).
2. All platted bearings need to be revised and shall be on City-Based Datum per Section 26-407D
of the Municipal Code of Laws.
3. The Basis of Bearing statement needs to be revised and on the City-Based Datum, The city-based'
bearing for the east line of the NW Y. of Section 21: SOoo18'35"E.
4. The 5' utility easement shown along the southerly line of Lot I needs to be changed to a 10'
utility easement (see General Note 2).
5. Please include the following:
a. True Point of Beginning.
b, Point of Commencement.
c. Dates of preparation and revision.
d. All street centerlines, and the perpendicular distances from those centerlines to the
subdivision boundary.
e. All zoning, both on-site and off-site.
f. Case History numbers: MS-06-01/W A-06-01.
6. Please correct the typographical errors in the Legal Description, and the dates for the Planning

The following are our site plan review comments;
1) Fire protection to this location is provided by the Arvada Fire Department
Station # 210cated at 12195 W 52nd Ave. and Station #1 located at 7900 W
57th Ave.
2) Fire apparatus access roads shall be required for every building constructed
.when any portion of an exterior wall of the first story is located more than 150
feet from fire department vehicle access.
3) All-weatherfire department access roadways shall be capable of supporting
the imposed loads of 57,000 Ib fire apparatus and shall be installed prior to
above grade construction.
4) Water lines and fire hydrants shall be capable of providing the minimum fire
flow prior to above grade construction. Additional fire hydrants may be
required.
