a. I1iclude the zoning for the adjoining parcel to the east prior to creating the Mylar@. .
2. All other conunents have been addressed.
3. Need to include the P.L.S. seal and signature on the Mylar@ copy.

I have completed my initial review ofthe above mentioned plat and I have the following comments:
1. The case number is MS-06-02. Please provide a case history box on the plat.
2. Show zoning of subject property and adjacent properties. Zoning designation is noted on
the redlined plans.
3. Please find the enclosed comments from the Public Works Department.
Once all of the corrections have been made, you may submit a blueline (paper) copy of the
consolidation plat prior to printing the mylar. Once the paper copy of the plat has been reviewed,
you may submit a blackline photgraphic mylar for recording with Jefferson County. The fees for
recording with Jefferson County are $11 per page. You may submit a mylar without first
submitting the paper copy for review, however there may be corrections necessary.

I have completed the flIst review of the above referenced document for the parcels located at 7331-7337 West 44'"
Avenue received on March 8, 2006, and I have the following comments:
Surveying Comments
I. Show all zoning, both for the 2 lots in the Replat and also for adjoining parcels.
2. Modify the text for the current lot line to read "LOT LJNE HEREBY REMOVED BY THIS PLAT".
3. Per Section 26-407 ofthe Municipal Code of Laws, the Legal Description shall include a metes and
bounds description showing accurate dimensions, with bearings and tie(s) to section and/or Y. section
comers being consistent with the current City Datum. Based upon Code requirements, the following shall
be included on the plat:
a. The Basis of Bearing statement needs to utilize a city-based bearing. The City-based bearing for
the south line of the NE y., Section 23 is N 89041 '37"E. (And FYI - the AutoCAD shortcut for
the degree symbol is %%D).
b. Point of Conunencement (section or Y. section comers only).
c. True Point of Beginning.
4. Please modify all boundary lines to be on city-based bearings.
5. Need to show the distance to the True Point of Beginning from the 44'" Avenue "CL" of ROW as
indicated on the redlined plat.
6. Need to include a Case History Box (see redlined plat).

Applicant/Owner Preliminary Proposal:
Construct an approximately 2,700 square foot, one story addition attached to the existing
structure located at 7337 -93 West 44 Avenue. The property where the existing building
is currently has Commercial One (C -1) zoning, and the property where the proposed
expansion is to be currently has Restricted Commercial (R -C) zoning.
Will a neighborhood meeting need to be held prior to application submittal? NO
Planning comments:
The proposed expansion will result in construction across a lot line. Zero setbacks are
allowed in both the C -1 and R -C zone districts per Sec. 26 -217 and 26 -218 of the Code of
Laws. However, this is only permitted where the structures are constructed of masonry or
nonflammable material and in accordance with the 2003 International Building Code.
The option exists to file a consolidation plat to remove the lot line that would run through
the building with the proposed expansion. Consolidation plats can be approved
administratively (without a public hearing) if there is no requirement for dedication of right-
of -way to the City. If you should pursue a consolidation plat, staff would recommend that
all three parcels on this corner under the same ownership be consolidated as part of this
process.

The Code of Laws also specifies that for properties with existing development,
landscaping in addition to existing landscaping shall be required on a percentage basis
according to the proposed changes to the property.
It appears that access is gained into the property immediately to the east (7301 W. 44
Ave.) coming through the property with the proposed addition. Consideration can be
given to establishing an access easement to allow this to continue and to formally
establish access if this is of concern.
Per the Code of Laws Sec. 26 -502 (D)(3)(d) all nonresidential uses located adjacent to
residentially zoned areas shall also provide a buffer consisting of either a six foot high
solid fence or hedge within a 6' wide landscaped strip, or a strip of land at least 15 feet
wide with a variety of vegetation. The properties to the north of the property in question
are zoned Residential Two (R -2).
Per the Code of Laws Sec. 26 -501 (D)(7) vehicles are not allowed to exit directly into the
public right -of -way from parking spaces. There will not be any parking allowed in front of
the building addition which would require vehicles to exit directly onto 44 Avenue. All
other parking regulations of Sec. 26 -501 must be adhered to as well.
The property of the proposed use is within an adopted urban renewal area, specifically
the Wadsworth Boulevard Corridor Redevelopment Plan. Per the Code of Laws Sec. 26-
226, the Wheat Ridge Urban Renewal Authority will review the proposal and make a
written recommendation as to whether it is consistent with the urban renewal plan.

The application must meet the requirements of the Streetscape and Architectural Design
Manual
The Streetscape and Architectural Design Manual has specific design standards for
designated mixed use areas. This property falls within a designated mixed use area so it
is subject to these design standards. Specifically, it is stated that the build to line in these
areas for the street front shall be 15 feet from the property line for minor commercial
development. Building in line with the existing structure would be supported by staff, and
waivers may be granted to this build to line administratively (without requirement for a
public hearing).

2 Copies of the following shall be submitted for review (submit with Building Permit Application):
1. A Final Drainage Report and Plan (signed and sealed by a Professional Engineer). On -site
detention is required for all commercial developments, incorporating water quality measures.
(Please see attached Site Drainage Requirements).
2. Grading & Erosion Control Plan (signed and sealed by a Professional Engineer), including details
for all BMP's to be utilized both during and subsequent to construction. Include the type of
landscaping in and around the detention area e.g., sod or native seeding mix (and rate of
application if native seeding is utilized).
3. If applicable, Construction Plans (signed and sealed by a Professional Engineer), for any
proposed changes /additions to the public improvements along the 44" Avenue frontage. Include
any COWR standard details for all proposed constructed items (e.g., drivecut, sidewalk, etc.).
4. Final (Consolidation) Plat in a 24 "X36" format. City-based bearings /coordinates shall be used per
Section 26- 407 -D -6 of the Municipal Code of Laws.
5. Site Plan shall include the following:
a. 24" X 36" sheet format.
b. A vicinity map, scale, and north arrow.
c. The boundary of the site and existing and proposed lot lines are to be completely
described using bearings and distances.
d. A Legal Description of the site, including tie(s) to the Section.
e. A Basis of Bearing statement (using local City coordinate system -see 4. below).
f. Signed Certification from a Professional Land Surveyor licensed in the State of Colorado
for the site boundary.
g. Date of map preparation, and the name, address, and firm of who prepared the map.
h. Location of 100 -year floodplain, if applicable.
i. Existing and proposed contours at 2 -ft intervals.
j. Adjacent street(s), including Right -of -Way width(s), name(s), ROW centerline(s).
k. Location of all existing & proposed easements and rights -of -way, fences, walls,
drainageways, ditches, buildings to be developed or retained on site.

inquiring about possible expansion, in the near future. The

occupy 7331 W 44th Ave, so that Lost & Found could reopen the
