Dear Mr. DiGiacomo:
On August 4, 2006, a letter was sent to your attention regarding the status of the land use
application for the property located at 3275 Quail Street (MS-06-06). The letter stated that the
application has been.in a state of suspension for a period of at least 90 days. Further, a letter of
intent was to be submitted by August 18, 2006 to continue ahead with the land use application.
To date, no letter has been received which indicates that there is still interest in pursuing the land
use application. As a result, the land use application MS-06-06, an application for a minor
subdivision for property located at 3275 Quail Street has been withdrawn. If you would like to
reapply, you wil1be subject to all applicable processes and fees.

Dear Mr. DiGiacomo:
I would like to take this opportunity to briefly recount the recent history of your proposed
subdivision at 3275 Quail Street. In December 2005, you met with City staff in a pre-application
meeting to discuss subdividing the above mentioned property. An application was filed on April 7,
2006 with this same request.
On May 5, 2006, the first round of review comments was sent back for corrections. City staff was
contacted on May 16, 2006 regarding the potential sale ofthe property to Dan and Tiffany Barnhart.
It was indicated to staffthat the public hearing schedule should continue as planned. One day later,
an email was sent to staff which hinted the new owners may not be interested in subdividing the
property. It was indicated that the project should be placed on the 'back burner' until a consensus
could be reached.
It has been approximately 90 days since review comments were returned to you, with no indication
of direction from either the new owners or you. City staff takes great pride in providing the highest
level of customer service, which includes processing land use cases in a timely manner. A land use
case in a perpetual state of suspension does not foster this environment.
Staff kindly requests that a response be submitted to the Community Development Department
which details a strategy for moving forward or which formally withdraws the application. This
response shall be in writing and received by August 18, 2006. If nothing is submitted to City staff
by August 18, 2006 I will consider your application withdrawn. If your application is withdrawn
and you would like to reapply, you will be subject to all applicable processes and fees.

Thanks for the reply. I would like to stay on top of this issue. Please advise me as to
which direction you (and the new owners) would like to go.
As far as the property to the north of the church, we have not received an application as
of yet. I would encourage you to contact Meredith (mreckert@ci.wheatridge.co.us) to check
on the status. She has been dealing with the prospective owners of that parcel.

Our property was 3275 Quail Street. We did close on the 23rd. Dan and Tiffany Barnhart
are the new owners. I'm not sure about their level of interest in sub-dividing the
property. I'll copy Dan into this email, and we can all stay informed. David and I told
Tiffany and Dan that we would be happy to share all of our info with them, but we have all
been very busy with moving, visitors, graduations, etc. Maya and I are off to the zoo
today, but 1111 check in here later.

I think that it's best to move our hearing to June 15th. I received our packet in the
mail today, and I don1t imagine that we should be in a hurry-up mode for the June 1st
hearing should our current deal with the Buyers fall through.
I just sent an email to John McGuire to stop work on this project for now, stating that
we'll keep him posted (just recrd an "out of office"
auto-reply) .
Thanks for your help. Our closing is scheduled for May 23rd, and I'll let you know what's
going on.

Dear Mr. DiGiacomo:
I have completed my initial review of the subdivision plat submitted for 3275 Quail Street (DiGiacomo
Subdivision) and I have the following comments:
1. General:
A. I have included comments from all responding agencies. If you have any questions regarding
these comments, please direct them to the agency which generated said comment.
B. Pursuant to Section 26-421 (D) of the Wheat Ridge Code of Laws, a fee in lieu of parkland
dedication is required for any residential subdivision in the City of Wheat Ridge. The fee is
based upon the number of new lots created and value of the land being subdivided. The
parkland dedication fee for this subdivision proposal is $3,208.05 and must be paid to the
Community Development Department prior to recordation of the plat.
C. A Planning Commission hearing is required, and has been scheduled for Thursday, June1stat
7 :00 in the City Council chambers. You must be present at the public hearing. On Thursday
May 18th, public hearing signs must be posted on the property. Staff will generate these
signs; however it will be your responsibility to ensure these signs are visible during the
duration of the posting period.
2. Plat Review:
A. Please reword the notary signatory block to read: "...acknowledged before me this
dayaf "
B. On the graphical representation of the property, please label all survey pins as being either
found or set.
C. Please add "MS-06-06" to the case history box.
Please make all required corrections to the plat and submit 18 full sized (24" x 36") and one reduced
(11" x 17") copies to the Community Development Department no later than Thursday, May 25,

On behalf of the Northwest Lakewood Sanitation District (NWLSD). Martin/Martin Inc. acting as the District Engineer
offers the following in response to the referenced Case Number MS-06-06 dated April 11, 2006:
NWLSD has an 8-inch diameter sanitary sewer main within Quail Street (R.O.W.) along a portion of the east property
frontage and a 24-inch and 12-inch diameter sanitary sewer mains within West 32" Avenue (R.O.W) along the south
frontage of the property. Upon subdivision of the lot per the supplied Final Plat, the existing 8-inch sanitary sewer
main within Quail Street will be along the east frontage of Lots 1,2 and a portion of Lot 3 and the existing 24-inch and
12-inch sanitary sewer mains within West 32" Avenue R.O.W. will be along the south frontage of Lot 3.
The subdivided lots shall connect tot the 8-inch sanitary sewer main within Quail Street. The dead-end 8-inch
sanitary sewer main stops approximately 95 feet north of the northerly 32" Avenue R.O.W. Therefore. it appears
that Lot 3 can be serviced by this mainline without extension. However. the developer is responsible for mainline
extension if necessary. The developer is responsible for determining depths of the existing sanitary sewer main to
verify if gravity fiow sanitary sewer services are capable of servicing the proposed development or if individual
sewage ejectors (lift stations) are required. In addition, the developer shall provide NWLSD proposed peak fiows
from the proposed development to evaluate if the existing sanitary sewer infrastructure adjacent to and downstream
of the development has sufficient capacity to support the development.
Each single family house shall have a separate sanitary sewer service from building to main line. The services shall
have a minimum slope of 2 percent with a c1eanout located within 5 feet outside the building and every 100 feet along
the alignment of the service. The service line shall connect perpendicular to the main line with a wye fitting.
Current tap fees are required by the District in the amount of $1.650 per SFRE in addition to Metro Reclamation
District's tap fee of $1.820 per SFRE associated with new sanitary sewer service connections to main lines.
The NWLSD shall review the sanitary sewer construction plans as they relate to the connection to the District
main(s).

This will acknowledge receipt of your correspondence dated April 11, 2006 regarding the
above referenced property.
Please be advised that the above referenced. property is in an area served by The
Con.solig?ted Mutual Water Company by virtue of a Distributor's Contract with Denver
Water. Domestic water service may be provided to this property subject to compliance
with the Company's rules, regulations and requirements for such service as well as the
water tap allocation policies as established by Denver Water.
The Company's rules, regulations, and requirements further state that each separate
structure be served by a separate tap arid meter, and in order to receive domestic water
service; the property must also front a Company main.
Fire protection requirements should be obtained from Wheat Ridge Fire. Rescue and
those requirements forwarded to this office by the Fire District at the earlii;lst possible
time. We can then determine if agditional system improvements would be required to

Dear Mr. Crane,
On behalf of the Northwest Lakewood Sanitation District (NWLSD), Martin/Martin Inc. acting as the District Engineer
offers the following in response to the referenced Case Number MS-OS-06 dated April 11, 2006:
NWLSD has an 8-inch diameter sanitary sewer main within Quail Street (RO.W.) aiong a portion of the east property
frontage and a 24-inch and 12-inch diameter sanitary sewer mains within West 320' Avenue (ROW) along the south
frontage ofthe property. Upon subdivision of the lot per the supplied Final Plat, the existing 8-inch sanitary sewer
main within Quail Street wili be along the east frontage of Lots 1,2 and a portion of Lot 3 and the existing 24-inch and
12-inch sanitary sewer mains within West 320' Avenue ROW. will be aiong the south frontage of Lot 3.
The subdivided lots shall connect tot the 8-inch sanitary sewer main within Quail Street. The dead-end 8-inch
sanitary sewer main stops approximately 95 feet north of the northerly 32"" Avenue ROW. Therefore, it appears
that Lot 3 can be serviced by this mainline without extension. However, the deveioper is responsible for mainline
extension if necessary. The developer is responsible for determining depths of the existing sanitary sewer main to
verify if gravity flow sanitary sewer services are capable of servicing the proposed development or if individual
sewage ejectors ~ift stations) are required. In addition, the deveioper shall provide NWLSD proposed peak flows
from the proposed development to evaluate if the eXisting sanitary sewer infrastructure adjacent to and downstream
of the development has sufficient capacity to support the development.
Each single family house shall have a separate sanitary sewer service from building to main line. The services shall
have a minimum slope of 2 percent with a cleanout located within 5 feet outside the building and every 100 feet along
the alignment of the service. The service line shali connect perpendicular to the main line with a wye fitting.
Current tap fees are required by the District in the amount of $1 ,650 per SFRE in addition to Metro Reclamation
District's tap fee of $1,820 per SFRE associated with new sanitary sewer service connections to main lines.
The NWLSD shall review the sanitary sewer construction plans as they relate to the connection to the District
main(s).

Ihave completed the first review of the above referenced documents for the proposed development
located at 3295 Quail Street received on April 12, 2006, and I have the following comments:

1. Need to include the metes and bounds shown in the graphical portion in the Legal Description.
2. Show the Point of Commencement and True Point of Beginning on the graphical portion.
3. Identify all found and set pins.
4. Please include the Case History nu..1Jlber MS-06-06 in the Case History box.
5. Include a DVD or CD-ROM containing the plat in AutoCAD dwg format on the current City
datum with the next submittal. Upon receipt of the disk, the area and closure for both the
subdivision boundary and individual lots will be checked along with the fit to the section. The
plat will not be approved prior to satisfying the closure requirements of the plat as required by
City Code.

Hope this note finds you well.
I was getting ready to leave yesterday to make copies of the plans and
come over to your office --then I noticed that the south lot size was
wrong (it didn't permit a building site). John fixed it for me, but
then the day slipped from me by the time that I picked up the new set,
etc.
I have the copies, but tomorrow looks like a better time for me to get
over to your office --in the morning when one of my teenagers can stay
with Maya.
Questions:
Do you want the copies rolled or folded (with the identifying lower
right block showing)?
Do you need me to sign the application for David in addition to my
signature? He is still out of town, to return late on May 1 st, but I
do have a power of attorney. I can bring it and sign for him, but I
was thinking that, for the application, maybe you only need one
signature. .
Who should I see when I get there, and who might be available if I have
questions regarding completing the application?
