approvals for the business, including the business license, it merely allows the use on the property.
A business license through the City must be obtained, a building pennit must be approved for any
maj or interior work and all other necessary pennits must be obtained prior to opening the business.

All notification and posting requirements have been met; therefore, there is jurisdiction to make a determination
regarding this request.
I. REQUEST
The applicant requests approval of a special use permit to allow a body art establishment on property zoned
Commercial-One (C-I) and located at 10135 West 37th Place. Section 26-204 specifies that body art
establishments require a special use permit to operate on C-I zoned property.
Pursuant to Section 26-114 of the Code of Laws, the Community Development Director has the ability to decide
upon applications for administrative special use approval, without requirement for a public hearing, provided
the following conditions are met:
I. A completed application package has been submitted and fee paid;
2. A neighborhood meeting has been held in accordance with Section 26-114;
3. The Community Development Department has notified adjacent property owners by letter notice
and the site has been posted for at least ten (10) days;
4. No written objections have been received in such ten-day period;
5. The Community Development Director concludes that the criteria for approval, as set forth below,
are substantially complied with and support the request.
The Community Development Director can impose conditions or stipulations upon the approval, which may
include physical design, operational, and maintenance considerations to ensure compliance with the criteria for
reVIew.
The Community Development Director shall also decide the following:
I. Whether the SUP runs with the land in perpetuity; or,
2. Whether the SUP is personal to the applicant and mayor may not be inherited; and lor,
3. Whether the SUP is granted only for a defined period, after which time the special use shall
expire unless renewed subject to all of the requirements of this section.
II. PROPERTY DESCRIPTION
The property in question is zoned Commercial-One (C-I), and is 128,763 square feet in size, or 2.96 acres.
There is an existing multi-tenant commercial building on the property of approximately 27,000 square feet in
size. Existing tenants on the property include a dry cleaning service, bingo establishment, day care, a bar/eating
establishment, a firearms store, a fitness establishment, an adult bookstore, some miscellaneous office uses and
a pet grooming service. To the south of the subject property is a mix of multi-family housing and existing
commercial uses. To the east are existing commercial uses. To the north is a mix of single family and
nonresidential uses, including a doctor's office and the Wheat Ridge Recreation Center. There is ample parking
on the subject property which is shared by multiple tenants. There are approximately 15 parking spaces
immediately adjacent to the proposed tenant space which the applicant has stated will be utilized for the body
art establishment.
ill. SPECIAL USE PERMIT CRITERIA
Before an administrative special use is approved, the applicant shall show and the Community Development
Director shall find that the proposed special use:
1. Will not have a detrimental effect upon the general health, welfare, safety and convenience of
persons residing or workiug in the neighborhood of the proposed nse.

The proposed use will not have a detrimental effect on the general health, welfare, safety and convenience
of persons residing or working in the neighborhood of the proposed use. The proposed use is consistent
with the existing uses in the shopping center.
2. Will not create or contribute to blight in the neighborhood by virtue of physical or operational
characteristics of the proposed plan.
The request will not create or contribute to blight in the neighborhood. With the exception of possible
signage, there will be no physical changes made to the exterior of the structure or any substantial changes to
any part of the property as a result of this request. There is no evidence that this body art establishment will
create or contribute to blight in the neighborhood, nor any evidence that the clientele of the proposed use
will create or contribute to blight in the neighborhood. The proposed use is consistent with the existing uses
on the subject property.
3. Will not adversely affect the adequate light and air, nor cause significant air, water or noise
pollution.
The request will not adversely affect the adequate light and air, nor cause significant air, water or noise
pollution.
4. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service
of internal traffic conflicts to the detriment of persons whether on or off the site.
The proposed use will not substantially increase traffic in the area, and the use will have a much smaller
number of clients and users than many ofthe existing uses in the shopping center. There is ample parking
that is shared by multiple tenants on the subject property. Approval of the special use permit will not result
in any new problematic conditions related to traffic congestion or traffic hazards, unsafe parking, loading,
service or internal traffic conflicts to the detriment of persons whether on or off the site.
5. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening
and landscaping, so as to be in harmony and compatible with the character of the surrounding
areas and neighborhood, especially with adjacent properties.
All applicable development standards must be met for any physical improvements to the exterior of the
subject property, although none are proposed as part of this request.
6. Will not overburden the capacities of the existiug streets, utilities, parks, schools and other
public facilities and services.
The request is to use an existing tenant space in a multi-tenant structure. There will be no detrimental
impact to streets, utilities, parks or schools as a result of the special use.
7. History of compliance by the applicant with Code requirements and prior conditions, if any,
regarding the subject property.
No history was found regarding code requirements on the subject property. There are no relevant
conditions on this property or the applicant pertaining to this proposal that were found.

8. Ability of the applicant or any permitted successor-in-interest to continuously meet the
conditions of the proposed permit.
If conditions of an approved special use are violated, the permit can be revoked. It is in the applicant's best
interest to follow the terms and conditions of any approval received from the city.
9. Other factors relevant to the specific application.
There were no other relevant factors found regarding this proposal.
IV. NEIGHBORHOOD MEETING
A meeting for neighborhood input was held on February 15, 2006. There were three concerned citizens in
attendance. The concerns expressed can be summarized as follows:
o The citizens in attendance questioned the location ofthe use, and felt it would be more appropriate
on Wadsworth Boulevard or Colfax.
o Those citizens in attendance also expressed that the use is inconsistent with the Neighborhood
Revitalization Study (NRS), and the goals and objectives of the newly formed Wheat Ridge 2020
organization.
o Proximity to Everitt Junior High School to the east of the subject property was of concern.
o Those citizens in attendance felt that there would be increased traffic and clients will cut through
the surrounding neighborhoods to avoid 38th Avenue and Kipling Street.
o Residents also expressed that the potential clientele are of concern and those they feel will be
frequenting this business may be detrimental to the character of the neighborhood.
o The applicants expressed that given the existing businesses in Kipling Plaza (Firearms Store, Adult
Bookstore, Dog Grooming, Bingo Parlor), the clientele their business will attract will not be a
negative change from the existing clientele. The applicants feel this location is appropriate because
of the existing conditions and tenants in the shopping center.
V. AGENCY REFERRAL
Affected service agencies were contacted regarding the ability to serve the property, which consisted of the
following.
o Wheat Ridge Police Department
o Wheat Ridge Building Division
VI. STAFF RECOMMENDATION/FINDINGS OF FACT
Staff recommends approval of Case No. SUP-06-03, a request for approval of a special use permit to allow a
body art establishment on Commercial-One (C-I) zoned property with the following findings offact:
1. Body art establishments require a special use permit on Commercial-One (C-I) zoned property.
2. A neighborhood meeting was held in which all property owners within 600 feet of the subject
property were notified, and those in attendance were informed of the special use permit process.
3. Adjacent property owners were notified by certified mail of the application, the site was posted for
a period of ten days, and no written objections were received.
4. The applicant, David Guzman, has the ability to continuously meet the conditions of the special use
permit.
5. The proposed special use permit will not have a detrimental effect upon the general public health,
welfare, and safety.

6. The proposed use will not result in undue traffic congestion or traffic hazards, or unsafe parking,
loading, service or internal traffic conflicts to the detriment of persons whether on or offthe site.
7. The proposed use will not adversely affect the light and air to adjacent properties.
Therefore, Case No. SUP-06-03 is hereby APPROVED with the following conditions:
I. The special use permit for this facility shall be issued to this applicant and may not be inherited.
2. The use shall be consistent with the definition of a "body art establishment" as specified in Section
26-123.
3. Business hours shall be between the hours of7 a.m. and 10 p.m.
4. Multiple documented complaints for this business shall be grounds for initiating the enforcement
procedures of Section 26-114 (F) of the Code of Laws.

Open tattoo shop in Kipling Plaza, located at 10129 West 37th
Place. The property is zoned Commercial One (C-l). Tattoo
shops, or "body art establishments" as defined by the Code of
Laws require a special use permit to operate in the C-l zone
district.
Issues Discussed:
. Hours of operation were stated to be approximately 12pm - 10pm. Ultimately, the applicant
would like to be open 7 days a week.
. Why locate here? It seems such a business would be more appropriate on Wadsworth or
Colfax for example.
. What direct benefit will this business provide to the City? There are no quantifiable benefits
this business will provide to the City, such as significant and recurring fees collected.
. Residents in attendance expressed their objection to this proposal for a number of reasons,
one being that it is inconsistent with the objectives of the Neighborhood Revitalization
Study (NRS) recently conducted. It is also inconsistent with the objectives of the recently
formed Wheat Ridge 2020 organization, which has the task of aiding in implementing the
recommendations ofthe NRS.
. The proximity of Everitt Junior High School to the proposed use is of concern for a number
of reasons.
. Residents expressed that such special uses should automatically go to City Council for a
public hearing.
. Increased traffic and the routes the clients of this business will take are of concem. Given
the location of the tenant space adjacent to Lee Street and 37'h Avenue, clients will cut
through the adjacent neighborhoods to avoid dealing with traffic on 38th Avenue and
Kipling Street.
. Residents also expressed that the potential clientele is of concern and those they feel will be
frequenting this business may be detrimental to the character of the neighborhood.
. The applicants expressed that given the existing businesses in Kipling Plaza (Firearms
Store, Adult Bookstore, Dog Grooming, Bingo Parlor), the clientele their business will
attract will not be a negative change from the existing clientele. The applicants feel this
location is appropriate because ofthe existing conditions and tenants in the shopping center.

NOTICE OF NEIGHBORHOOD INPUT MEETING
Black Diamond Tattoo is proposing a Special Use Permit on property located at 10129
West 37'h Place. A neighborhood meeting will be held on February 15, 2006 at 6 pm at
7500 West 29th Avenue (city building). The purpose of this request is to allow a tattoo
shop at this location.
The City of Wheat Ridge has adopted a requirement that prior to any application for
Rezoning of property and for Special Use Permits an applicant must notifY all residents
and property owners within 600 feet and invite them to a Neighborhood Input Meeting.
The purpose ofthis meeting is to allow the applicant to present his proposal to the
neighborhood and to give the neighborhood a forum to express their concerns, issues and
desires.
A Staff Planner will attend the meeting to discuss City policies and regulations and the
process involved, however, the Planner will remain impartial regarding viability ofthe
proj ect.
Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be
entered as testimony, it is the public hearings in front of the Planning Commission and
City Council where decisions are rendered. rfyou want input in the decision-making
process, it is imperative that you attend the public hearings.
The kinds of concerns residents normally have include the following:
. Is the proposal compatible with surrounding land uses and zoning?
. Are there adequate utilities and services in place or proposed to serve the project?
. What is the impact on our streets?
. How will this proposal affect my property?
. Where will the storm drainage go?
. How will the project be designed to enhance rather than detract from the
neighborhood?
. What specific changes can be made in the proposal to make it more acceptable to
me?

Open tattoo shop in Kipling Plaza, located at 10129 West 37th Place. The property is
zoned Commercial One (C-1). Body art establishments require a special use permit to
operate in the C-1 zone district.
Will a neighborhood meeting need to be held prior to application submittal? YES
Planning comments:
A special use permit will be required for the proposed use. Tattoo shops fall under the
category of body art establishments. Body art establishments require a special use
permit in the C-1 zone district. The process for special use permit applications is
discussed later.
All applicable code regulations for the City, State and County must be adhered to. It is
advisable that the applicant contact the City's Chief Building Official regarding building
code requirements. For example, it is likely that a handicapped accessible restroom must
be provided.

written approval must be obtained from the property owner.
The proposed use cannot have an adverse effect on the parking for the shopping center.
All signage must meet the city's sign code.

A special use permit will be required to allow for the proposed use on the property. Body
art establishments require a special use permit. The special use permit can be approved
administratively (without a public hearing) if there are no written objections directly related
to the special use request during the 10-day public notice period and if the plan meets all
applicable standards.
Now that a pre-application meeting has been held, the applicant can work with staff to
schedule the required neighborhood meeting. The Community Development Department
will initiate the 600' radius property owner search for the neighborhood meeting notice.
There is a $100 fee for the neiqhborhood meetina that needs to be received on or before
the date of the meetina. Once the neighborhood meeting is held, a formal application for
a special use permit may be submitted. Upon receipt of the application the proposal will
be referred to the necessary outside agencies for a period of 15 days review and
comment.
After the review process is complete, the Community Development Department shall
notify adjacent property owners by certified letter and posting of the site for 10 days. If no
written objections directly related to the special use request are received within this 10-
day period, the Community Development Director can approve, approve with conditions
or deny the special use. Upon receipt of any written objections by an adjacent property
owner or upon appeal by an applicant of a decision by the Community Development
Director, the special use request will be heard by the City Council through a public
hearing process. If approved, either by the Community Development Director or by the
City Council at a public hearing, the special use becomes effective immediately.

This is a proposal for a tattoo shop to be located at
10129 W. 37th PI. Co 80030. The space in question is
located in the Kipling Plaza. We will be using 640 sq. ft. It is
on the south side of the building. There are no other
business entrances on this side. Located across from the
building is twenty parking spaces. At the most we may be
using haJf of these spaces at any one time.
At this business we will be offering tattoo's and body
piercing with the option of retail in the future. To start
there will be two tattoo artist's and one body piercer. All
that will be performing services have been professionally
trained in their area of expertise.
We have chosen this property because it fits are
needs tb the tee. Also in Kipling Plaza is a gun shop, bar
and grill, and an adult book store. Many places that I think
would not have problem with a tattoo shop close to their
businesses.
If this proposal is accepted we would like to start
remodeling the site on the first of February, and wouid be
open for business by the third or fourth week of February.
As for operation days and hours we would like to start with
five days a week, eventually going to seven days. Opening
time will be noon and will be closing at 10 pm.

This is the site plan for 10129 W. 37th Pl. I will be

building. (You can see the site on picture # 1) There is no

the east side of the space is the side door to the Hollywood
bingo (Picture #2). Across from building is aprocemently
20 parking spaces (Picture #3). At the most we will be
using 10 of these spaces at anyone time. On the west and
north side of the building (Picture #4 Be 5) there are many
other businesses.
I will be remodeling to fit three tattoo stations and
one private piercing room. Also, I will be adding an office
space. Each tattoo and piercing space will have one clean
and one dirty sink. This business will be built using all of
state regulations required for the use of a tatoo shop.
