The initial application was filed with the City Community Development Department on
December 27,2006. A comment letter was generated by city staff on January 26,2007. On
April 24, 2007, 1 met with you and your new architect to discuss resubmittal ofthe site plan.
Since that time, there has been no activity on your special use request.
Please be advised that since there has been no activity on your case for one hundred twenty days,
the case is considered closed. Subsequent action on the property will constitute a new
application with new fees required.
Please contact me at your earlier convenience to discuss status of your land use request.

This letter is in regard to your request for approval of a special use permit to allow a 24.bed
assisted living facility in an RC zone district on property located at 4415 Jay Street.
I have reviewed your application/site plan and have the following comments:
SITE PLAN
You are requesting approval of a special use with a site plan requirement. The site plan is almost
identical to the submittal of 2001 except the structure is three stories in height instead of two
stories. The site plan appears to meet the requirements for building, landscaped and hard
surfaces coverage.
It does not meet the RC side and rear yard setback requirements as it is a three.story building.
The rear and side setbacks are based on a per story requirement. The side setback requirement is
5' per story with the required setback for a three story building being 15' where both the north
and south setbacks are shown as have less than 12' setbacks. The rear setback requirement is 10'
for the first story plus 5' for each additional story resulting in a 20' rear setback requirement
where only 16' is required.
PARKING
The zoning and development code does not recognize assisted living facilities as a defined use.
The category which is closest is congregate care facility. See the attached definition. The
parking ratio for a congregate care facility is .75 space per bed or 21 spaces. The residential
apartments require 1.5 spaces for a one bedroom unit and 2 spaces for a two bedroom unit. Staff
concludes that a total of26 spaces are required (if two of the apartments are one bedroom).
Please provide a copy of the parking layout for the structured parking so a better analysis can be
performed.
BUILDING ELEVATIONS
No building elevations have been provided with this submittaL Building elevations can be a
critical component of the SUP package especially since this type of approval is discretionary.
The criteria used to evaluate a special use permit specifically addresses design and the proposals
harmony and compatibility with the character of the area and the neighborhood.

Since the previous submittal, the City of Wheat Ridge has adopted architectural standards
relating to the architectural design of the building. The standards must be incorporated into the
design. See the City of Wheat Ridge Streetscape and Architectural Design Manual.
DRAINAGE
I would concur with the request by Public Works that at a minimum, preliminary drainage
information be provided to ensure there is adequate site room to accommodate pond
improvements. The City's requirements have changed due to the requirement for water quality
measures with the result that pond sizes are larger in size than anticipated. The requirement for a
larger pond could impact the parking layout in front of the building. I believe Ed Jennings did
some drainage design for the property as part of the old case.
This concludes Staffs review comments. Also attached are referrals received from other city
departments and outside agencies.

This memo is intended to state the Wheat Ridge Police Department's ability to
serve the property, and to make recommendations about additional staffing
needs to allow the police department to serve the property.
The proposed development plan indicates the property will cover .45 acres, and
that the facility will hold up to 24 residents. Parking for the facility will be
underground.
The police department does not anticipate a significant increase in requests for
service, based on the projected number of clients, staff and visitors to the
assisted living facility site, although there could be an increase in calls for service
for the fire department and the paramedic services.

I have completed the first review ofthe preliminary site plan received on January 9, 2007 for the
Special Use Permit for the Koch assisted living facility located at 4515 Jay Street, and have the
following comment:
1. The proposed assisted living facility site layout may pose some challenges regarding the
proposed detention pond geometry and location, since the original engineered pond design did
not account for the additional volume necessary to comply with current water quality
requirements.
2. Public Works suggests the engineer re.evaluate the pond size and geometry to be sure it will
still fit the site as proposed. Without knowing how the increase in required volume will affect
the layout, it is difficult for Public Works at this point to provide further comment on the
proposed design.
3. If the site as shown may be altered subsequent to Special Use approval, then Public Works has
no comments for the SUP request, and all further technical comments will be reserved for the
Building Permit submittal.

Ridge building division regarding the above referenced case.
The WRFPD will require the following:
. The building must be sprinklered
. A standpipe will be required adjacent to the entrance to the structured parking area.
. A new fire hydrant will be required on Jay Street.
. Sidewalks a minimum of 48" in width will be required around the sides and back of the
building
. The curb cut shown on the site plan provided will be required. The curb cut is to be 35' in
width with 22' of mountable curb to the south.

The Parks and Recreation Commission reviewed the special use permit referral form for 4515 Jay Street and had
the following comments:
Landscaping on the west side to buffer the view of the building from the future park site.
Request an access through property from Jay to future park site for residents in the area. This would allow
residents to enter from a residential street versus 44th Avenue.
Is this a commercial or residential development and do Park and Recreation Development fees apply?
These comments will also be included formally in the minutes of the meeting of January 17, 2007, upon
approval at the February 21, 2007 meeting.

Existing Use/Site Conditions: The property is currently zoned R.C and is currently vacant.
Applicant's Proposal: The applicant is proposing to build an assisted living center for the elderly.
It will be a two.story, twenty four room facility with underground parking to accommodate
residents and staff. The footprint of the building will be approximately 9000 s.f. with a second
story. A special use permit is required to allow an assisted living facility in the RC zone district.
Attendance: There were two members of the neighborhood in attendance.
Issues Discussed:
· How many persons will reside on the premises? There will be 24 one,bedroom rooms with
appropriate numbers of staff with 3 .4 present in the day and one at night. They must follow
state standards for the numbers of staff per resident.
. How tall will the facility be? Around 30' in height.
· Can the residents cook in their rooms? The residents can have a small refrigerator and
microwave but are not allowed to cook in their rooms. There will be a central dining area
where they will be served meals.
· Will the residents be physically or mentally impaired? No. This is not a facility for
Alzheimer's or other mentally ill or handicapped persons. The residents must be
ambulatory.
One letter of "no objections" was submitted regarding the request.

The parcel on which the structure would be situated is zoned Restricted Commercial, R-
C. This district was established to accommodate various types of office uses to perform
administrative, professional and personal services, and to provide for a limited range of
retail uses which are neighborhood oriented. It is the intent that the general retail uses
that serve the community or region, wholesaling, warehousing, industrial, and uses which
require outside storage of display be prohibited. Residential group and nursing homes
and congregate care facilities for 9 are more elderly people are permitted in the district as
a special use.
The surrounding land uses are also compatible with this type of facility. The property to
the south is zoned C.1 and has a vacant building on it. The applicant did express some
interest in acquiring this parcel for expansion or another use. To the north and east the
properties are zoned R.3 and have single and multi family dwelling units. A park is
located to the west.
This application would be for a similar project that was proposed by the same applicant in
2001. Staff supported the previous special use permit for a congregate care facility but it
was denied by the city council due to concerns the council members had with the on-site
parking. The parking that is required for this type of use is .5 parking spaces per resident
with one additional space per staff member on duty during the shift with the highest
number of staff present.
It appears from the plans, descriptive paragraph, and from the meeting with the
applicants, the parking issues have been resolved. The applicant has indicated that the
parking will now be located below ground level and will have enough spaces to
accommodate all the residents and staff. The parking garage will be heated as well.
Sufficient parking will also be provided for guests of residents either under ground, in a
separate on-site lot, or both.
The applicant indicated that the building will be constructed of a mixture of brick, siding
and stucco. The architecture would be reflective of the surrounding architecture. If it did
not, it would be of high quality and would add to the neighborhood. It would also be
visually appealing.
Staff showed interest in placing the garage below ground to allow for better architecture
and landscaping for an over all more attractive building. Public works did question where
the access would be for the underground parking. It was indicated the access to the
garage would likely be from the east side of the building at the southern end.
The detention pond that is currently on site will have to be upgraded or other measures
will have to be taken to mitigate on site water drainage. Public works did mention that if
an outdoor lot was still an option that there are now parking surfaces that are impervious
and depending on the materials utilized, it could possibly act as detention pond below the
parking surface. This would mean that the detention pond would not need to be
upgraded. A drainage plan will be required, regardless of any route that is pursued.
The facility itself will be for seniors who are still independent and mobile who do not need
constant care and supervision by doctors or nurses. However, the staff will be on duty 24
hours a day and can be utilized by the residents as needed. The facility will be two
stories and have approximately 12 units on the first and second floor for a total of 24
units. Since the side yard abuts a residential property the set backs for a building in R.C
zoning would be a minimum of 5 feet per story.
The first step towards approval of this special use permit began today with the pre.
application meeting in which the applicant met with staff to talk about initial concerns,
answer questions the applicant may have had, and inform the applicant of the processes
that they are required to go through.
The second step that is required by the community development department will be to
conduct a neighborhood meeting. For this meeting, the applicants must inform all
property owners via mail within a 600 foot radius of the property on which the request is
being applied for. The community development department will supply the applicant with
a list of the all property owners within the radius. The meeting should be coordinated with
the assigned staff member at a fee of $100 required for staff time at the meeting. A
sample of this letter is found in the pre.application meeting packet and can be used as a
template. However, changes to the letter should be made to suit the applicant, including
the letterhead. The meeting will be led by the applicants and should inform those who
attend what is being proposed.
After the neighborhood meeting is held, the applicant may submit their application for the
special use permit. Upon submittal, the assigned staff member will review and make
comments on the project that need to addressed before a hearing before the city council
will be set. The project will simultaneously be reviewed by other departments and utilities
for their comments. The staff planner will then inform the applicant of further changes
that need to be made or if they meet all requirements. If all requirements are met the
applicant will be scheduled for a hearing before the City Council. If the requirements are
not met, the applicant will be required to make the changes in the plans until all
requirements are in compliance with staff comments. If the applicant feels all
requirements have been met and city staff is requiring more then what is set forth in city
codes. A hearing date can be set, but the city planner will recommend denial of such
request to the city council

Public Works Requirements:
2 Copies of the following shall be submitted for review (include with Building Permit Application):
1. Final Drainage Report: As on-site detention incorporating water quality measures is required
for all commercial and subdivision developments, a Final Drainage Report and Plan, signed and
sealed by a CO licensed Professional Engineer, shall be required. (please see Site Drainage
Requirements) .
2. Grading & Erosion Control Plan: A Grading & Erosion Control Plan signed and sealed by a
Professional Engineer, including specific details for all BMP's to be utilized both during and
subsequent to construction.
3. Trip Generation Study. A trip generation study shall be prepared by a Colorado licensed
Professional Engineer with adequate experience in transportation engineering. Based upon the
findings of the trip generation study, a full Traffic Impact Study may be required.
4. Construction Plans: Construction Plans (signed and sealed by a Professional Engineer) for the
following drainage-related items: detention pond, outlet structures, drainageways or pans, curb &
gutter. Include all COWR standard details for all proposed constructed drainage facilities.
5. Site Plan: A Site Plan to include the following:
a. 24" X 36" sheet format.
b. A Vicinity Map.
c. The boundary of the site and existing and proposed lot lines are to be completely
described using bearings and distances.
d. A Legal Description of the site, including tie(s) to the Section.
e. A Basis of Bearing statement (using local City coordinate system-see 4. below).
f. Signed Certification from a Professional Land Surveyor licensed in the State of Colorado
for the parcel boundary and topographical information on the Site Plan.
g. A scale and north arrow.
h. Date of map preparation, and the name, address, and firm of who prepared the map.
i. Location of IOO.year floodplain, if applicable.
j. Existing and proposed contours at 2.ft intervals.
k. Adjacent streets, including Right.of.Way widths, names, and ROW centerlines.
1. Location of all existing & proposed easements and rights.of.way, fences, walls,
drainageways, ditches, buildings to be developed or retained on site.
