The case was presented by TravisCrane. He entered all pertinent documents into the record and advised the Board there was jurisdiction to hear the case. He reviewed the staff report and digital presentation. Staff recommended approval for reasons, and with a condition, outlined in the staff report. Board Member REINHART asked if this would be the most protruding sign on the block. Mr. Crane stated that it would be the northernmost freestanding sign on the block. rfthe sign were in a conforming location, it would interfere with parking. Board Member BELL commented that the sign would not be out of alignment with other signs down the block. Mr. Crane stated that no right-of-way was dedicated on this property for the 38th Avenue capital improvement project. In response to a question from Board Member HOWARD, the code requires that a freestanding sign not block other signs within twenty feet from an adjacent property. The size ofthe sign is in conformance with the city code. Board Member BLAIR asked if the city had received any comments from adjacent property owners. Mr. Crane stated that no comments, either positive or negative, had been received. Myron Lewis . 6140 West 38th Avenue Mr. Lewis, owner of Lewis Fine Candies; stated that if the variance is not granted, the sign would block the sign to the east. The business presently has a visibility Board of Adjustment 07-27-06 - 4- issue with customers trying to locate the store. The present sign is an eyesore and sign companies have refused to attempt to place a sign on posts built in 1958. Board Member HOVLAND expressed concern that the height to the bottom of the sign is 6.5 feet and could present a danger to a tall individual walking under the sign. Mr. Crane explained that the only time sign height comes into play is when it relates to sight distance triangles and this sign does not present an impact. Board Member LINKER also expressed concern about the height that could endanger a bicyclist. In response to a question from Board Member ABBOTT, Jerry Dahl stated that since the sign would not be on city right-of-way there would be no liability to the city. ~f1 Sherry West OR 39th Avenue Ms. West and her brother own property nearby on 39th Avenue and asked for clarification as to which sign was going to be removed and which one would be replaced. Mr. Crane explained which sign would be removed and replaced. Heidi Lewis 6140 West 38th Avenue Ms. Lewis stated that the A-frame sign would be removed. Truel West 6150 W. 39th Avenue Mr. West expressed support for the application because it would be a net improvement for the city and enhance the streetscape. There were no other individuals who wished to speak. In response to a question from Board Member HOWARD, Mr. Crane explained that the sign would have two faces. Board Member HOVLAND commented that the sign has a good design, is in keeping with the neighborhood and will present an overall improvement to the neighborhood. Board Member ABBOTT asked if the applicant could put a shed back onto the lot. Mr. Crane replied that the applicant could place a shed on the property as long as it doesn't exceed maximum lot coverage. Board Member REINHART suggested that a garage shorter than 30 feet might allow for better turning movements. William Packard 3065 Reed Street Mr. Packard 'stated that he would like to build a 30-foot garage to accommodate his vehicles that include a boat and inotorcycles. He stated that he would remove two existing storage sheds. He has considered other locations, but he found that turning would be difficult or he would have to remove landscaping. He has talked' with all of his neighbors and they are infavor of his plans. In response to a question from Board Member HOVLAND, Mr. Packard stated that he plans to use the existing garage as a garage for one car. Board Member LINKER asked if the garage door could be shifted to the left to make it more accessible. Mr. Packard replied that he wasn't sure that moving the door to the left would meet code. In response to a question from Board Member ABBOTT, Mr. Packard stated that the east face of the garage would be matching brick and the remainder of the garage would be covered with siding. It would match the house and conform to the neighborhood. REQUEST The applicant is requesting approval of a 9- foot setback variance for a freestanding sign, resulting in a freestanding sign one foot from the front property line (Exhibit 1, Letter of Request). II. CASE ANALYSIS The property is 16,476 square feet in size, has a rectangular shape, and contains an existing retail candy store. The applicant wishes to remove an existing sign and replace it with a new 15-foot tall freestanding sign (Exhibit 2, Site Plan and Exhibit 3, Sign Detail). The site contains two existing freestanding signs; neither of which meets today's setback standards. The Zoning Code allows one freestanding sign per street frontage. These signs were constructed well before incorporation of the City, and are at least 50 years old. One of the signs is located in the northeast comer of the property. The other sign is located further west near the parking area. The applicant will remove both existing freestanding signs. A new sign will be constructed in the exact location ofthe eastern-most sign. The Zoning Code requires that a l5-foot tall freestanding sign must have a minimum 10-foot front yard setback. The applicant wishes to construct the new sign one foot from the front property line. It is important to note the sign setback is measured from the leading edge of a sign, that is, the setback is measured from the part ofthe sign which is closest to the property line. There is no side yard setback requirement for freestanding signs adjacent to commercially zoned property. The sign will comply with all other standards outlined in Article VII of the Zoning Code. The property contains a building that is approximately 5,000 square feet in size, located approximately 30 feet from the front (northern) property line. Directly in front ofthe building is head-in parking. These parking stalls are 18 feet deep. Given a ten-foot required setback for a 15- foot tall freestanding sign, one or more of the parking spaces would be rendered useless if the sign were to meet setbacks. The site does not currently provide the minimum required parking as defined in the Zoning Code. A conforming sign will cause confusion among patrons and will be a traffic hazard for motorists trying to park and maneuver the parking lot. The applicant would like to locate the new sign in the same location as the existing sign in the northeast comer of the property. This location will not conflict with any parking spaces and will make the sign more visible from the street right-of-way. The front property line is located approximately 10 feet from the edge of existing street asphalt, so the leading edge of the sign will be 11 feet from the street. III. VARIANCE CRITERIA Staff has the following criteria to evaluate variance requests: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? Board of Adjustmeut VVA-06-10/Levns 2 Ifthe request were denied, the property can yield a return in use. The property currently contains a commercial business, and this use may remain regardless ofthe outcome of the variance request. The property currently has two freestanding signs which can remain. The applicant has expressed a desire to upgrade the current signage. However, it should be noted that it would be difficult to locate a new freestanding sign in a conforming location. If a freestanding sign cannot be located on this property, business could decline. 2. If the variance were granted, would it alter the essential character of the locality? If the request were granted, the character ofthe locality would not be altered. The sign will be located at least ten feet from the edge of existing asphalt, giving the appearance of a sign with a ten-foot setback. There are some existing freestanding signs on adjacent properties which meet the required setbacks; however, it should be noted that the Code requires an 'offset' for freestanding signs within 20 feet of each other on adjacent properties. This is to prevent sign visibility blockage. The proposed sign should not block visibility for adjacent signage. 3. Does the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular and unique hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? The existing layout of the site causes a unique hardship. The building is located approximately 30 feet from the front property line. Parking stalls are located directly in front of the building. These parking stalls are 18 feet deep, leaving no room for a freestanding sign which meets the required front yard setback. Given the site design, the applicants have extremely limited opportunity to locate a freestanding sign in the front yard. 4. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? A person who has interest in the property has not caused the hardship. The property is fairly shallow. The presence of parking in front of the building further exacerbates the problem. The shallow property depth and location ofthe parking does not leave room for a freestanding sign. A fifteen foot tall freestanding sign setback ten feet from the front property line would conflict with the parking spaces. 5. Would the granting ofthe variance be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located, by, among other things, impairing the adequate supply of light and air to adjacent property, substantially increasing the congestion in public streets or increasing the danger of fire or endangering the public safety, or substantially diminishing or impairing property values within the neighborhood? The request would not be detrimental to the public welfare. The adequate supply oflight and air would not be compromised as a result of the request. The request would not increase congestion in the streets, nor increase the danger of fire. The sign would be setback one foot from the front property line, but II feet back from the street. The sign Board of Adjustmeut WA-06-10/Lewis 3 would not cause a hazard to motorists. The request would most likely not have an effect on property values in the neighborhood. 6. If criteria 1 through 5 are found, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? The request would not result a benefit or contribution to the neighborhood, only the property owner. The request could result in a benefit to the City. The presence of a freestanding sign could have an effect on sales and business for this property. This in turn would be a benefit to the City. The request would not result in a reasonable accommodation of a person with disabilities. IV. STAFF CONCLUSION & RECOMMENDED MOTION (S) Staff concludes that the hardship has not been created by the property owner, and that unique circumstances warrant the approval of the variance request. Upon review ofthe above request, staff concludes that the criteria are supportive of the request. Therefore, staff recommends APPROVAL for the following reasons: I. The hardship has not been caused by the applicant. The hardship arises from the site design and location of parking spaces. Board of Adjustmeut W A-06-10/Lewis 4 IRlIECCIE ~VIE/D) J U _ 1 9 2006 - -------- July 17, 2006 To Whom It May Concern: SUBJECT: SIGN LOCATION My name is Myron Lewis, and along with my wife Heidi we own and operate Lewis' Fine Candies here in Wheat Ridge. Lewis' Fine Candies has a long and honored history in the city of Wheat Ridge as well as in the surrounding cities. My father Richard Lewis founded Lewis' in 1962, and in 1964 began occupying space in our current location at 6140 W 38th in a building that was constructed by my grandfather in 1958. My grandfather built this building next to the building at 6190 W 38th, a building that he purchased in 1942. My grandfather created his own history in business by operating Lewis Auto, and then Lewis Appliance and Television in Wheat Ridge until 1960 when he began a new career in politics as a Commissioner for Jefferson County. In 1998 when my father retired, my wife and I took the reigns of the family business. With my fathers retirement he also closed the last of his 4 retail mall locations, at the Villa Italia Mall, a location in which he held a lease for 32 years. With Villa Italia's pending redevelopment and the high cost of other regional mall space, my wife and I decided to open a retail store next to our manufacturing facility. Heidi aud I have been fortunate to take over a family business with a respected reputation and a legacy of providing quality products to the people of Jefferson county for so many years. With every year since opening the store we have seen a steady increase in our sales. From the beginning, we were fortunate to be frequented by customers that in the past used to trade with my father. These loyal customers were happy see that we had a new store, although many of them repeatedly stated that they had a hard time finding our store. Some of our new customers even to this day say that they have lived in Wheat Ridge for years and drive 38th Ave all the time and never knew we were here, or that they had a hard time seeing the signage as they drove by. In to day's world of corporate branding and brand recognition of some brand names by children as young as two it is difficult to compete at such a corporate level. Most young people today don't frequent older mom and pop style business unless they're in a new strip center, or in buildings with new facades etc. For this reason I feel that it is very important for us to do what we are doing by installing new high-end signage, and planning a fa<;ade remodel for next year. With an increase in our wholesale business and our expansion into retail gift baskets, having a recognized reference point from which new customers can find us is not only essential to Lewis candies, but also to the city by bringing people into Wheat Ridge and the 38th Avenue Business District. Having the new sign in the same location as the 6140 w. 38TH AVE. \VHEAT RIDGE, CO 80033 EXHIBIT 1 -2- July 19, 2006 old sign will allow passer byes to read the new marquee and discover that we are more than just a candy store, they'll find that we bake all of our own pastries, pies, and cinnamon rolls, as well as our new gift basket line. As for our current sigoage we have two free standing pole sigos, one the middle of the parking area, and one on the East edge of the parking area. Both are being removed, with the new sigo taking the place of the old sigo on the East property line. This original sigo was installed when the building was constructed in 1958. Originally our plan was to use an oval shaped backlit sigo cabinet that I had purchased used from a local business. Unfortunately I had great difficulty in finding a sigo company that would work with us in placing the cabinet on the old sigo poles. All of the sigo companies that I contacted were more than happy to come out and give us a quote, unfortunately they would either try to sell us a cheap square light cabinet, or a new cabinet and new pole, or worse they wouldn't call us back or even return our phone calls. This problem lead us to examine the new sigo new pole option, but take it further by incorporating desigo elements to coincide with the 1950s architecture of our building. Finally I would like to say thank you to he city planning department, and the economic development department for all of their help throughout the past 5 years.
