Meredith,
I conclude that the 30 days runs from the date the request for rehearing was denied, as this exhausts the
applicant's administrative remedies. I notice that Code 2-61 (d)(4) contemplates the right to request a
"hearing" (probably means a rehearing), where new information was not available at the previous hearing. It might
also be good to look at the BOA's rules of procedure, which I'll bet also grant the right to request a rehearing at
the next meeting. In any event, a person does not know for sure that they want to appeal, and what that appeal is,
until the rehearing request is acted upon.
It is important to say that when the applicant does not request a rehearing, then the final date for measuring the
30 days Is the date of the BOA's action denying the application.

one vote short of the approval
In closing, one nfthe members qnestioned TllIvis if I could still appeal this to JefI'eroon Connty Court. The
Board refused my appeal on 9/28/06, therefore it is my understanding I have 30 days to now appeal to

Excerpt from the Board of Adjustment Bylaws, Article V, Disposition of Cases, paragraph 4:
"Applicants may request a rehearing in front of the Board. The request for a rehearing
must be filed in the office of the City Clerk within thirty (30) days from the date ofthe
original decision on the case. New evidence must be submitted in writing which could not
have been, with due diligence, presented at the previous hearing. At the next regularly
scheduled meeting, the Board shall decide if the new evidence warrants a rehearing upon
affirmative vote as specified under Article V, Section 2. If the request for a rehearing is
granted, the case shall be put on the next available calendar for a rehearing, and parties
appearing in the original case shall be notified of the date of rehearing."

Case No. W A-06-12: An application filed by Gary DiGiorgio for
approval of a 19-square foot variance from the 9,000 square foot minimum
lot area requirement and a 9-foot variance from the 75-foot minimum lot
width requirement to allow a two-family dwelling unit on property zoned
Residential-Three (R-3) and located at 3825 Chase Street.
The case was presented by Meredith Reckert. She entered all pertinent
documents into the record and advised the Board there was jurisdiction to hear the
case. She reviewed the staff report and digital presentation. Staff recommended
denial for reasons outlined in the staff report.

Board Member DRDA asked how the city became aware that the property was
being used as a duplex, Meredith Reckert explained that a person living in the
basement of the residence applied for high speed internet service and, upon
contact from the internet provider, the city found that there were not two
addresses for this property.
In response to a question from Board Member DRDA, Meredith Reckert stated
that she didn't see any evidence of multi-family units in the area,
In response to a question from Board Member BLAIR, Meredith Reckert stated
that the one objection to the application received by the city concemed noisy
tenants and that a duplex is inconsistent with the single family neighborhood.

9461 West 63rd Place, Arvada
Mr. Digiorgio submitted a letter signed by area residents that they were in
agreement with his application. This letter was entered into the record. . He also
submitted copies of various photographs of his property for the Board's review.
These were also entered into the record. He stated that he purchased the subj ect
property two years ago with the understanding that it was a duplex property. The
house was built in 1942 before the incorporation of Wheat Ridge. The downstairs
unit is completely separate from the upstairs unit. There is no interior connection.
The downstairs unit has an outside entrance, He stated that he would install a
large window in the downstairs portion of the dwelling to meet egress
requirements. He stated the property has adequate parking including on-street
. parking, The property is surrounded by R-3 and commercial zoning, He believed
a duplex should be allowed because the property is also zoned R-3. A duplex
would not be hamrful to the neighborhood and would provide affordable housing
for the city. A hardship exists due to loss of income and inability to rent the
property as a duplex, There is also a physical hardship due to the location of the
garage. He commented that he is within only 1 % ofrequired square footage for a
duplex.
In response to a comment from Board Member HOWARD concerning the width
of the driveway, Mr. DiGiorgio stated that he could widen the driveway to allow
another parking space. He also stated he could install a "pullout" to allow more
parking. In addition, there is about two feet of vegetation along the south side of
the driveway that could be removed.
In response to a question from Board Member LINKER, the applicant stated that
the unit was occupied as a duplex when he purchased it.
Board Member DRDA asked the applicant if he had any documentation indicating
the property was a duplex. Mr. DiGiorgio replied that he assumed it could be
used as a duplex because ofthe R-3 zoning.

Ms, Zanol spoke in opposition to the application due to the run-down condition of
the property and there are no other rental properties in the neighborhood.

There were no other individuals who wished to speak at this time. Chair BELL
closed public testimony,
Board Member HOVLAND commented that he didn't believe approval of the
request would have a great impact; however, he had difficulty fmding a hardship
in the case.
Board Member BLAIR. commented that maintenance of the property should not
be a factor in the case. .
The applicant requested to address the Board, There was a consensus of the
Board to reopen public testimony to give the applicant an opportunity to make
additional statements,
Gary DiGiorgio returned to the podium. He stated that a hardship exists in that
he purchased a duplex and is not allowed to use it as such in R-3 zoning. The
location of the structure does not allow the parking it would normally have, It
would be very difficult to rent the property as a single family unit. He
commented that he is only 1 % short of the square footage requirement. He stated
that he would make every attempt to improve the maintenance of the property.
He disagreed with an earlier statement that there were no other multi-family uses
in the area because there was a nearby lot with two dwellings on it.
No one else wished to address the Board. Chair BELL closed the public
testimony.
Upon a motion by Board Member DRDA and second by Board Member
LINKER, the following resolution was stated:
Whereas, the applicant was denied permission by an administrative officer;
and
Whereas, Board of Adjustment Application Case No. W A-06-12 is an appeal
to this Board from the decision of an administrative officer; and
Whereas the property has been posted the fIfteen days required by law, and
in recognition that there were protests registered against it; and
Whereas, the relief applied for may be granted without detriment to the
public welfare and without substantially impairing the intent and purpose of
the regulations governing the City of Wheat Ridge,

Now, therefore, be it resolved that Board of Adjustment Case No. W A-06-12
be, and hereby is denied.
For the following reasons:
1. The hardships found have been self imposed.
2. Meeting the required parking capacity is highly questionable.
3. Staff recommended denial.
4. The proposed use does not conform with surrounding residential
properties.
l The motion for denial carried 4-2 with Board Members BLAIR and
LINKER voting no.
B. Case No. TUP-06-02: An application filed by L&H Auto Body & Glass
for approval of a one-year Temporary Structure Permit on property zoned
Industrial (I) and located at 4790 Independence Street.
The case was presented by Travis Crane, He entered all pertinent documents into
the record and advised the Board there was jurisdiction to hear the case. He
reviewed the staff report and digital presentation. Staff recommended approval
for reasons, and with one condition, outlined in the staff report.

Mr, Massey, the applicant, stated that he was requesting a variance to allow a
temporary structure until a permanent structure can be built. There are two
mobile structures on the property that will be removed when the temporary
structure is installed, The temporary building would be used for vehicle damage
estimation, disassembly, cleaning and washing. Even though the temporary
structure is fire-rated, there would be no painting or repairs taking place within
the structure. He ~tated that he has worked closely with the Arvada Fire
Department in planning uses for the temporary structure. The Fire Department
will also monitor uses.
In response to a question from Board Member BLAIR, Travis Crane stated that
the city has not received any feedback from neighbors conceming the application.
Board Member HOWARD asked how long it would take to erect the temporary
structure. Mr, Massey estimated it would take three to four days and would
probably be erected mid-September. Footings for the new structure would
probably not be poured before spring.
Board Member DRDA asked if it would be necessary to specifY usage restrictions
on the temporary structure. Travis Crane replied that usage and/or restrictions

JURISDICTION:
The property is within the City of Wheat Ridge, and all notification and posting requirements have been
met, therefore, there is jurisdiction to hear this case.
I. REQUEST
The property in question is located at 3825 Chase Street and is zoned Residential- Three (R~3). It is
currently being utilized as a two~family dwelling with tenants in both the main floor and basement. In
the R-3 zone district, a legal two-family dwelling lot requires 9000 square feet oflot area with 75' oflot
width. The property is substandard to these requirements with only 66' oflot width (resulting in a 9'
required lot width variance) and 8981 square feet of lot area (resulting in a 19 square foot required lot
size variance). An administrative variance cannot be granted because it results in an additional dwelling
unit.
The property owner purchased the property two years ago and it had two units at that time. The
house was built in 1942. It is unclear at what point it was converted into a duplex. There is no
evidence in the building department records that this was a legal conversion. The Jefferson
County Assessor's office indicates that there is only one recognized unit on the property.
Staffbecame aware of the nonconformity because the lower unit was in need of a high speed internet
connection. Comcast needs a separate address to service the lower unit as both units are currently under
the same address. The variances are needed to legitimize the two units on the property. (Exhibit 1,
applicant letter).
The property is surrounded on the north and west by R~ lA zoned single family residences. The
property to the south is zoned R~3 utilized as a single family residence. To the east is a
commercial strip center zoned C~ 1.
Because each of the variances is dependent on the other, they will be considered simultaneously.
II. SITE PLAN
The property owner has submitted an improvement location certificate which shows the location
of the structure on the property. (Exhibit 2, Improvement location certificate). It is a one~story
lap~sided home with a detached double car garage. Additional parking for the home is located in
the driveway to the east of the garage. The driveway is around 70' in length and could
accommodate an additional three cars.
Pursuant to the off-street parking regulations in the Zoning and Development code, single and
two family dwellings are required to have two spaces per dwelling unit with on-street parking
and four spaces per dwelling unit without on~street parking. The property is 66.67' wide and
could accommodate another two vehicles. A total of eight parking spaces (both on and off street
spaces) are required for the duplex where only seven spaces are available (five on the property
and two on the street).

The property is relatively flat and is consistent with the "look" of houses in the area. The first
floor tenant enters through the front door. The basement tenant enters from the south side which
goes immediately downstairs. There is no connection between the two units.
By recognizing this as a legal duplex, the building inspector has advised that the basement must
be brought up "to code". If the variance is denied, the structure must be converted to single
family dwelling.
Staff has received an objection to the variances from an adjacent property owner at 3820 Depew
Street (directly to the west ofthe subject property).
III. VARIANCE CRITERIA
Staff has the following comments regarding the criteria used to evaluate a variance request:
1. Can the property in question yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by regulation for the district
in which it is located?
If the request is denied, the property may still receive a reasonable return in use. The
property is currently approved for single~ family use.
2. If the variance were granted, would it alter the essential character of the locality?
The variance could potentially alter the essential character of the locality by legitimizing
a duplex in a neighborhood which is composed of single family residences. However, the
structure has been used as a duplex since the time of purchase two years ago.
3. Does the particular physical surrounding, shape or topographical condition of the
specific property involved result in a particular and unique hardship (upon the
owner) as distinguished from a mere inconvenience ifthe strict letter ofthe
regulations were carried out?
No, the lot is question has a typical rectangular shape and is relatively flat.
4. Has the alleged difficulty or hardship been created by any person presently having
an interest in the property?
The illegal nature of the second unit has not been created by the present owner. The
hardship stems from the conversion ofthe structure to two units by a previous owner.
The current owner relied on this rental income when he purchased the property.
5. Would the granting of the variance be detrimental to the public welfare or injurious
to other property or improvements in the neighborhood in which the property is
located, by, among other things, impairing the adequate supply of light and air to
adjacent property, substantially increasing the congestion in public streets or

increasing the danger of fire or endangering the public safety, or substantially
diminishing or impairing property values within the neighborhood?
Granting of the variance would not be detrimental to the public welfare or injurious to
other properties or improvements in the neighborhood. The current duplex does not
impact the adequate supply of light and air to adjacent properties, does not increase the
chance of fire or endanger the public safety. There could be an impact on Chase Street
because of inadequate parking available on~site.
6. If criteria 1 through 5 are found, then, would the granting of the variance result in a
benefit or contribution to the neighborhood or the community, as distinguished
from an individual benefit on the part of the applicant, or would granting of the
variance result in a reasonable accommodation of a person with disabilities?
The requested variance would result in an individual benefit for the property owner and
would not produce a benefit for the neighborhood or the community. Approval of the
variance would not result in the accommodation of a person with disabilities.
IV. STAFF CONCLUSIONS AND RECOMMENDATIONS
Upon review ofthe request, staff concludes that the above criteria are not supportive of
the variance requests. Therefore, staff recommends denial for the following reasons:
1. There are no unique circumstances.
2. The proposed duplex is out of character with the neighborhood which is
comprised of single family dwellings.
3. The property cannot meet the required parking for a two~unit dwelling.
If the variances are approved, staff recommends the following conditions:
I. The property owner must bring the basement into conformance with the
appurtenant fire and building codes.
2. The City will assign an additional address, thereby notifying the Jefferson
County Assessor's office of the second unit.
