(Case No. W A-06-13) have been approved. Please see the attached staff report for the discussion
and fmdings. You should be aware that pursuant to Section 26-115 (C)(4), the variance will expire
in 180 days. If building plans are not submitted within the 180 day period, the variance will become
invalid. You do have the option of requesting an extension to this 180 day period. The request must
be submitted in writing prior to the expiration of the 180 day timeframe. The 180 day period starts

I. REQUEST
The applicant is requesting approval of two variance requests: request for a 125 square foot
lot size variance and a one foot lot width variance for an existing duplex in the R-2 zone
district (Exhibit 1, Letter of Request).
II. CASE ANALYSIS
The property is 12,375 square feet in size, has a rectangular shape, and contains an existing
two family structure. The applicant wishes to reconstruct the existing duplex (Exhibit 2, Site
Plan). The R-2 zone district requires a minimum lot size of 12,500 square feet and a
minimum lot width of 100 feet for a two-family dwelling. The lot is 12,375 square feet in
size and 99 feet wide. The site contains an existing 1,479 square foot house. The rebuilt
duplex has not been designed to date; however, it must meet all applicable development
standards in the R - 2 zone district.
The existing structure was constructed in 1919 and modified in 1936. The applicant has
indicated that the second unit was added in 1956, prior to the City's incorporation.
In consultation with the City Attorney, he has opined that the Community Development
Director does have the authority to grant these variances because a duplex currently exists on
the property and the result of these requests will not add a residential unit.
III. VARIANCE CRITERIA
Staff has the following criteria to evaluate variance requests. Because these variance requests are
mutually exclusive, the requests have been evaluated together.
1. Can the property in question yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by regulation for the district
in which it is located?
If the requests were denied, the property can yield a return in use. The property currently
contains an existing two-family structure, and this use may remain regardless ofthe
outcome of the variance request. The applicant would not be able to reconstruct the two-
family dwelling if the requests were denied. A one family dwelling could be constructed
regardless of the outcome of this request.
2. If the variance were granted, would it alter the essential character of the locality?
If the request were granted, the character of the locality would not be altered. The entire
neighborhood has R-2 zoning, and a handful of these properties contain two-family
dwellings. Further, the applicant will not be changing conditions on this property; rather
he will simply be improving a dilapidated structure.
3. Does the particular physical surrounding, shape or topographical condition of the
specific property involved resnlt in a particular and unique hardship (upon the
owner) as distinguished from a mere inconvenience if the strict letter ofthe
regulations were carried out?

The property has a typical rectangular shape and is relatively flat. The hardship in this
case arises from the age of the existing structure. The structure was originally constructed
in 1919, and modified in 1936. In 1956, a basement unit was created legally under
Jefferson County jurisdiction. When the City of Wheat Ridge incorporated in 1969, the
second unit was made non-conforming due to increased lot size requirements established
in the City Code of Laws.
4. Has the alleged difficulty or hardship been created by any person presently having
an interest in the property?
A person who has interest in the property has not caused the hardship. The two-family
dwelling was constructed prior to incorporation ofthe City. The applicant wishes to
simply reconstruct a dilapidated two-family dwelling.
5. Would the granting ofthe variance be detrimental to the public welfare or injurious
to other property or improvements in the neighborhood in which the property is
located, by, among other things, impairing the adequate supply of light and air to
adjacent property, substantially increasing the congestion in public streets or
increasing the danger of fire or endangering the public safety, or substantially
diminishing or impairing property values within the neighborhood?
The request would not be detrimental to the public welfare. The adequate supply oflight
and air would not be compromised as a result of the request. The request would not
increase congestion in the streets, nor increase the danger of fire. The request would most
likely not have an effect on property values in the neighborhood.
6. If criteria 1 through 5 are found, then, would the granting of the variance result in a
benefit or contribution to the neighborhood or the community, as distinguished
from an individual benefit on the part of the applicant, or would granting of the
variance result in a reasonable accommodation of a person with disabilities?
The request would not result a benefit or contribution to the neighborhood, only the
property owner. The request would not result in a reasonable accommodation of a person
with disabilities.
IV. STAFF CONCLUSION & RECOMMENDED MOTION (S)
Staff concludes that the hardship has not been created by the property owner, and that
unique circumstances warrant the approval of the variance requests. Upon review ofthe
above requests, staff concludes that the criteria are supportive of the requests. Therefore,
staff recommends APPROVAL for the following reasons:
1. The structure was constructed prior to incorporation of the City of Wheat Ridge.
As a result of incorporation of the City, in tandem with the adoption of lot size
requirements in the R-2 zone district, the structure became non-conforming.
2. The hardship has not been caused by the applicant.
3. The character of the neighborhood should not be altered, as the two-family
dwelling has existed since 1956.
4. The adequate supply oflight and air will not be compromised as a result of these
requests.

5. There have been no protests submitted during the ten-day public notification
period.
Pursuant to Section 26-115 of the Wheat Ridge Code of Laws, and in consultation with
the City Attorney, the Community Development Director has the authority to make a
decision on the variance requests. The property has been properly posted and mailing
notices have been distributed. In recognition that there have been no protests registered
within the ten-day comment period, and based upon the above conclusions and evidence
