Please be advised that at its meeting of December 13, 2006, the Board of Adjustment APPROVED your request
of a fence height variance to allow a fence which is 7 feet 9 inches tall at its highest point for property zoned
Residential-One and located at 14 Twilight Drive for the following reasons:
1. The style of fence is physically less imposing than a solid fence, thereby decreasing impact to the
surrounding area by maintaining an open appearance.
2. The applicants' desire to keep cats within their yard and keep wildlife out should be enhanced by this
fence with its angled extension.
3. The request should not have negative impact on the neighborhood nor change the character of the
existing neighborhood.
4. The fence is located in the back yard and obscured by mature trees so that most of the fence is barely
visible from the street.
5. Staff recommended approval.
Enclosed are copies of the Certificates of Resolution, as well as a draft copy of the minutes, stating the Board's
decision which became effective the date of the meeting, December 13,2006. This variance shall automatically
expire within one hundred eighty (180) days of the date it was granted, June 11,2007, unless a building permit has
been obtained.

Chair BELL announced that this case had been withdrawn. Meredith Reckert
reported that the applicant needs a multiple-request approval that will include the
variance and require a hearing before city council. She informed members of the
public that this will involve a neighborhood meeting at some time in the future.

The case was presented by Travis Crane. He entered all pertinent documents into
the record and advised the Board there was jurisdiction to hear the case. He
reviewed the staffreport and digital presentation. Staff recommended approval
for reasons outlined in the staff report. One letter of objection was received from
a nearby neighbor.
Board Member LINKER referred to the applicants' letter that stated they were not
advised they could not build a fence of this height. Travis Crane stated that a
permit was granted for a 6-foot fence. The detail ofthe fence did not show any
extension nor did it show a cantilever design. It was after construction, that the
height ofthe fence was brought to staff's attention through a citizen complaint.

Ms. Leggett stated that because the fence company received a permit from the
city, they believed the fence was legal. It wasn't until after the fence was
installed that the city called and said it was not consistent with city code. She
stated that much research went into finding an attractive fence that would meet
their needs of keeping their cats inside the yard and keeping foxes and coyotes
from entering the yard. She stated that cats have the ability to jump a 6-foot
fence unless there is some type of barrier at the top of the fence. She stated that
she and Ms. Peters also take care of foster cats, but these cats are not allowed
outside the house.
Board member ABBOTT asked how much of the fence was over 6 feet. Ms.
Leggett explained that the fence was 7 feet on the west side and a portion of the
fence on the east side is 7 feet 9 inches. Board Member ABBOTT questioned the
need for a fence of this height and suggested that a 5 foot fence with a barrier
would work as well. Ms. Leggett stated that cats could easily jump a 5 or 6 foot
tall fence.
Chair BELL commented that the fence is nicely done with a very open
appearance as opposed to a solid fence. She drove by the property of the person
who wrote a letter of objection and could not see that the fence was visible from
that person's property.

Board Member BLAIR agreed that the open fence was more attractive than a
solid fence.
Board Member HOVLAND commented that the fence is very open and maintains
the integrity of the area.
Board Member HOWARD agreed that the fence was attractive, fits well into the
neighborhood, and is probably the best kind of fence to accommodate the
applicants' situation.
Dan Brennan
Mr. Brennan lives directly across the street from the applicant. While he agreed
that the fence was open, he objected to the angled extension on the fence that
gives the appearance of a compound or detention area. He stated that he was the
citizen who made a phone call to the city to find out whether or not the fence met
code. He apologized to the applicant and stated that he didn't intend for the
matter to end up before the Board of Adjustment. However he thought there
would be other creative ways to meet their needs.
Alex Tanner
Mr. Tanner's property borders the east side of the subject property. He spoke in
support of the applicant's fence. He appreciated the fact that the fence is open
and not a solid fence and he understands the need for it. He stated that he has
known Ms. Leggett and Ms. Peters for 21 years and they have been excellent
neighbors.
Board Member ABBOTT commented that he had difficulty finding a hardship.
He asked if the applicants had spoken with their neighbors regarding the fence.
Ms. Leggett stated that two adjacent neighbors (to the east and west across the
street) indicated their support ofthe fence.
In response to a question from Chair BELL, Ms. Leggett explained that
volunteering to shelter foster cats was not a function ofliving in the house. The
fence functions to keep foxes and coyotes out and also serves as a security fence.
There were no other individuals present who wished to address the case, therefore
Chair BELL closed public testimony on this case.
Upon a motion by Board Member BLAIR and second by Board Member
HOWARD the following resolution was stated:

D. Case No. WA-06-19: An application filed by Mansour Fotovat for Gas
Plus for approval of (A) a sign height variance of 7 feet and (B) sign
setback variances for up to 5 feet to allow a freestanding sign on property
zoned Commercial-One and located at 6595 West 44th Avenue.
The case was presented by Meredith Reckert. She entered all pertinent
documents into the record and advised the Board there was jurisdiction to hear the
case. She reviewed the staff report and digital presentation. Staff recommended
approval for reasons, and with conditions, as outlined in the staff report.
Board Member ABBOTT asked if the City Council sign committee decisions had
any impact on this case. Meredith Reckert replied that those decisions would not
have any impact. She further explained that a variance would override any future
city council decisions regarding signs.
In response to questions from Board Member HOWARD, Meredith Reckert
stated that staff did not believe there was a sight triangle issue at Newland and

All notification and posting requirements have been met; therefore, there is jurisdiction to hear
this case.
I. REQUEST
The applicants are requesting approval a variance to allow a fence which is 7 feet 9 inches
tall at its highest point. The variance would allow a taller fence which would prevent cats
from escaping (Exhibit 1, Letter of Request).
II. CASE ANALYSIS
The property is 13,562 square feet in size, has an abnormal shape and contains an existing
single family structure. The property is bounded by Twilight Drive on the northeast and
northwest property frontages.
The applicants would like approval for a fence which is 7 feet 9 inches at its highest point.
The R-l zone allows a maximum fence height of 6 feet in the rear and side yards. The fence
will be used to contain cats in the back yard and keep wild animals out (Exhibit 2, Site Plan).
The applicants applied for and received a building permit to construct a six foot fence in the
rear yard. The fence was constructed; however an extension was constructed on top ofthe six
foot fence which serves to contain cats. The extension is angled at approximately 45 degrees
in towards the subject property. The permit did not contain any language or evidence that an
extension would be constructed on top of the six foot fence.
The fence is constructed of metal mesh with metal posts (Exhibit 3, Applicant Pictures). The
fence is constructed in a similar fashion to a chain link fence. This style of fence makes the
fence appear less imposing. The fence would not constitute a sight distance triangle
obstruction.
There have been no variances granted for properties in the neighborhood to increase fence
height. One letter of objection has been received (Exhibit 4, Letter of Objection).
III. VARIANCE CRITERIA
Staff has the following criteria to evaluate variance requests:
1. Can the property in question yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by regulation for the district
in which it is located?
Ifthe request were denied, the property can yield a return in use. The property currently
contains an existing single-family structure, and this use may remain regardless of the
outcome of the variance request. A six foot fence is allowed in the side and rear yards. If
the request were denied, the applicants would need to remove the portions of the fence
extension which exceed the six foot height limitation.
2. If the variance were granted, would it alter the essential character of the locality?
If the request were granted, the character of the locality would not be altered. The fence is
not extremely visible from the right-of-way. Many mature trees help to obscure the fence.
There have not been any variances granted in the neighborhood which allow a fence taller

than six feet. This open style of fence will not seem overbearing nor out of place in the
neighborhood.
3. Does the particular physical surrounding, shape or topographical condition of the
specific property involved result in a particular and unique hardship (upon the
owner) as distinguished from a mere inconvenience if the strict letter of the
regulations were carried out?
The property does have a unique shape; however the shape has no bearing on the request
for a taller fence. The lot meets the required lot size for a single-family structure in the R-
1 zone district.
4. Has the alleged difficulty or hardship been created by any person presently having
an interest in the property?
A person who has interest in the property has not caused the hardship. The applicants
wish to prevent cats from escaping the property and keep wildlife out of the back yard.
The fence was specially designated to accommodate these purposes. A taller fence will
accomplish these goals.
5. Would the granting ofthe variance be detrimental to the public welfare or injurious
to other property or improvements in the neighborhood in which the property is
located, by, among other things, impairing the adequate supply of light and air to
adjacent property, substantially increasing the congestion in public streets or
increasing the danger of fire or endangering the public safety, or substantially
diminishing or impairing property values within the neighborhood?
The request would not be detrimental to the public welfare. The adequate supply oflight
and air would not be compromised as a result of the request. The request would not
increase congestion in the streets, nor increase the danger of fire. The request would most
likely not have a negative effect on property values in the neighborhood.
6. If criteria 1 through 5 are found, then, would the granting of the variance result in a
benefit or contribution to the neighborhood or the community, as distinguished
from an individual benefit on the part of the applicant, or would granting of the
variance result in a reasonable accommodation of a person with disabilities?
The request would not result a benefit or contribution to the neighborhood, only the
property owner. The request would not result in a reasonable accommodation of a person
with disabilities.

IV. STAFF CONCLUSION & RECOMMENDED MOTION (S)
Upon review of the above request, staff concludes that the criteria are supportive of the
request. Therefore, staff recommends APPROVAL for the following reasons:
1. The style of fence is physically less imposing than a solid fence, thereby decreasing
impact to the surrounding area.
2. The applicants wish to keep cats within their yard and keep wildlife out. The fence
with an angled extension should accomplish this goal.
3. The request should not have any negative impact on the neighborhood, nor change
the character of the existing neighborhood.
4. The fence is located in the back yard and obscured by mature trees.

Re: Fence Variance Request for 14 Twilight Drive
We have lived in our current residence at 14 Twilight Drive since 1985. This last
summer we replaced our back yard fence with a custom-made iron wire fence. We
researched fence designs and options for several years before choosing this particular
fence. The purposes of our fence are to provide security for us and for our cats.
When we moved into this home our cats were free roaming. It soon became apparent that
wildlife (foxes and coyotes) lived in the neighborhood and that Twilight was a busy
intersection. We added "cat proofing" chicken wire to our existing 4-foot fence to keep
our cats in our yard. The cat proofing was unsightly but effective.
In addition to our four cats, we foster cats and kittens for Cat Care Society. Cat Care
Society is a nonprofit shelter in Lakewood that serves as a rescue and adoption facility
for stray, abandoned, and abused cats. Sherri is shelter manager for CCS. Foster homes
are needed to nurture underage or sick kittens until they can be returned to the shelter for
adoption. Normally, we foster two to four kittens at a time. The kittens may stay for a
weekend or longer, depending on their needs and space availability at the shelter. If there
weren't foster homes, kittens would most likely have to be euthanized.
Over the summer we fostered more than 40 kittens for the shelter along with a number of
adult cats, several of which were transported to Colorado from Florida and Mississippi
after Hurricanes Katrina and Wilma. All the cats from the hurricanes were sick and
needed fostering before they could be adopted. Occasionally, we foster older cats or
"temporary care" cats from homeless people, elderly infirm people, people in transition,
or women who are victims of domestic violence.
Since our yard is small and protected, we feel that with a cat fence it's a safe haven for
our cats and our foster cats. Usually cat fences are constructed with mesh, or are wired
extensions to privacy fences that extend at a 45% angle. (See enclosed pictures.) We
wanted a cat fence to be more aesthetically pleasing for us and for our neighbors. The
fence we chose is 80% open, so that even with the extension it isn't the eyesore a solid
fence would be. We feel we've respected the integrity of the neighborhood with its
sweeping hills and open yards.

There are still a number of free roaming cats in our neighborhood that, unsupervised, are
a potential nuisance. They tend to fight, create traffic hazards, and make dogs bark.
Most shelters these days require cats be kept indoors or in a cat-proof enclosure.
It was our understanding that the design and dimensions of the fence were approved by
the city as part of the work permit (see attached). The city planner never suggested that
we might need a variance. A city inspector actually stopped by the site on the day the
fence was being installed and didn't mention anything about a variance. We certainly
never intended to violate city code for our cat fence.
Enclosed are pictures of our new Deacero fence. It was custom-built and imported from
Mexico. We think the construction is solid and secure, and open enough to blend
beautifully with the landscape. After we plant shrubs or climbing foliage near the gate,
the front should be as camouflaged as the back.
The height of the fence and the angled extension was an important part of our decision in
choosing this particular design to insure that the cats could not climb or jump over it.
Our property sits on an incline from west to east and is lower in the back yard than front.
The fence panels are 6 feet high from ground to tip, and the cat extension rises
approximately a foot and a half into the back yard. The fence is highest on the east side
at 7 feet 9 inches and lowest in the back at 7 feet 1 inch. The posts had to be installed at
different heights to accommodate for the variation in ground levels.
We do hope the fence increases property value and enriches the unique flavor and
integrity of our lovely neighborhood.

Notice is hereby given that a Public Hearing is to be held before the City of Wheat Ridge
BOARD OF ADJUSTMENT on Wednesday, December 13, 2006, at 7:00 p.m. in the Council
Chambers of the Municipal Building at 7500 West 29th Avenue, Wheat Ridge, Colorado. All
interested citizens are invited to speak at the Public Hearing or submit written comments. The
following petitions shall be heard:
Case No. W A-06-16: An application filed by Jason Timmes for approval of a IS'!" front
yard setback variance from the 30 foot front yard setback requirement when adjacent to a
public street resulting in a 14'11" front yard setback for property zoned Residential-Two

CAT FENCE-IN'" Patented cat Containment System
Keeps Your Cat Safe in Your Fenced Yard and Stray Cats Out!
Scissors and a drill motor with a 1/4 inch and 5/16 inch socket do
most of the work. Self-drilling screws (included in each kit) re ce drill
bits.
After the brackets are screwed to the fence, the net banding
is secured to the fence from comer to corner. This makes tight fit so cats
can't get between the netting and fence. The banding and etting wrap easily
around corners without cutting.
If two or more kits are needed, they can be easily fasten
netting is then brought up and connected to the brackets .th heavy duty,
weather proof twist ties. These eliminate sag and keep the ne
tlght on the brackets.

Installation Basics
A. Screw the 16 inch brackets 8 to
12 feet apart below the top of
fence. Then bolt the 20" rods
to bracket ends.
B. Start at one end of fence and
screw netting attachment edge
along a horizontal line below
brackets.
C. Bring netting up and secure to
bracket and rod ends with twist
ties.

Barrier Kit
Keeps your cat in your yard only. Works on any fence taller than 5 ft.
The STRATQ barrier extends out 16 inches and the netting hangs down 20 inches.
The hanging netting is secured to the fence every 8 ft with twist tie to keep it
stationary.
If you have high obstacles close to your fence such as planters, wood piles, air
conditiong units, hot tubs, etc., use the COMBINATION barrier In that area,
COMBINATION and STRATa barriers can be joined together.
A cat can jump 5 fl.. If you wish to keep stray cats out or your fence is 5 ft. or shorter, order the

GATE
Hardware Kit
One is needed for each gate.
The gate kit is used on any swinging gate to close the gap at the gate opening. One is needed for any gate that swings either
into or out of your yard. For double gates, order one kit for an inS\.-ving gate and two kits for an outswing gate.
The gate kit contains special hardware and three offset brackets that can be used on any gate situation. Rods are included for
the COMBINATION system. The hardware makes the brackets rigid for easy bypass of brackets and netting when the gate is
opened and closed.
Illustrated instructions in each kit show the placement of brackets on all gate configurations.
GATE KITS do not include netting. When measuring a fence for netting barrier kits, include gates in measurement (see
order example on page 4).
