SIIBJECT: Kunz property at 8995 West 44th Avenue
The Public Works Department has reviewed the site plan for the
proposed Planned Building Group for the above referenced proper-
ty. Our comments are as follows:
1. Access along 44th Avenue does not conform with Section 26-31
of the Wheat Ridge City Code. This section of the code
requires that the minimum access spacing be 100 feet. To
bring the property access within conformance, we are re-
questing that the middle access drive on 44th Avenue be
removed. This will eliminate any conflicts between vehicles
entering the site and parking maneuvers within the lot. The
other two existingJaccess drives may remain in place.
2. Any additional lot paving, regrading or increase in impervi-
ous lot surface will require the developer to submit a
drainage report and plan for this site.

Attached is the completed City of Wheat Ridge planning response
form for Case #PB6 92-1, Kunz (8995 W. 44th Avenue).
Valley Water District has met with Lee Kunz and discussed the need
for a water mainline extension and fire hydrant to meet Arvada Fire
Protection District's requirements to serve the property. The new
water line would provide adequate service and service lines to the
development.

Dear Ms Reckert:
I am replying to your November 9, 1992 request for information
regarding your Case No. PBG-92-1/Kunz at 8995 W. 44th Avenue.
You inquired as to the possibility of water service to this
site, and we would advise you that the Wheat Ridge Water District
has no guaranteed source of supply to that location.
The Wheat Ridge Water District provides water to that area
through the Arvada system, and Arvada has reserved the right at any
time to terminate service to this area.
At this time, the District would strongly urge this
improvement to seek additional water supply through the Valley
Water District as a continued suppy could then be guaranteed upon
the same terms and conditions as all other tap owners in the Valley
area. Due to the continuing dispute with Arvada over continued
service to this area, any water service to this area would have to
be on a terminable basis by contract. Should you have any
questions about this matter, please advise. I will count on you to
advise the applicant of the qualified nature of water availability
through the Wheat Ridge Water District.

Dear Lee:
Let this letter serve as notice of approval of your submittal for
a planned building group for property located at 8995 West 44th
Avenue.
The plan is approved as submitted with the condition that the
center curb cut on West 44th Avenue be closed. New curb and
gutter should be poured with a strip of landscaping between. In
addition, the fence at the northeast corner of the property
should be made solid to buffer the adjacent residents from the
parking lot/storage yard. The bottom of the fence should start
one foot above grade to allow flood waters to pass underneath.
These items must be reflected on the mylar to be recorded.
I understand that you have applied for permits to begin work on
the interior of 8955 West 44th Avenue. A permit will be issued,
however, no Certificate of Occupancy will be issued until the
center curb cut is closed and the solid fencing put in. If you
object to the requirement for closure, you may request a variance
through the Board of Adjustment. Either way, these issues must
be resolved prior to C.O. issuance for the new building.

Three property legal descriptions for the required adjust-
ments a~~=also enclosed ._ They are as follows:
1. Property to be deeded by the ,city to the owners along
the northwest corner which completes 45th Place.
2. Property to be deeded. by the_owners to the city for
the additional right-of way of 45th_Place.
3. Property use easement along 44th Avenue, between the
right-of-way line and the sidewalk for a "right to use"
I have also submitted these plans and descriptions to the
owners and Mr. Joggers, their counsel for their review and
preparation of the deeds required by them.
