D' ° ~ ¢ m ~ D' fD ~ N ^ S m m w ~ ~ T^ $y, ~, ras ~ ~ } M E M O R A N D U M TO: Case File FROM: Greg Moberg, Planner I RE: Case No. WA-92-21 DATE: November 18, 1992 Case No. WA-92-21 is a request for a 1.5' variance to the required 15' setback. As per Section 26.D.2.a., the request was administratively processed without the need of a public hearing. VARIANCE STANDARDS 1. The property in question cannot yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by the regulations for the district in which it is located. The property in question can yield a reasonable return in use if the variance is not granted as it has prior to the request. 2. The plight of the owner is due to unique circumstances. There are no circumstances that could be considered unique. 3. The variation, if granted, will not alter the essential character of the locality. The essential character of the neighborhood will probably not be altered i£ the variance is granted as the requested variance is less than ten (10) percent of the required setback. The required setback is 15'; the proposed setback is 13.5'. 4. The particular physical surroundings, shape or topographical condition of the specific property involved would result in a particular hardship upon the owner as distinguished from a mere inconvenience, if the strict letter of the regulations were carried out. There are no hardships relating to physical surroundings, shape or topographical condition of the subject site. However, the proposed structure is a greenhouse needing southern exposure, therefore making any other location unacceptable. 5. The conditions upon which the petition for a variation is based would not be applicable, generally, to the other property within the same zoning classification. The conditions upon which this petition is based could be applicable to other properties within the same zoning classification. 6. The purpose of the variation is not based exclusively upon a desire to make more money out of the property. The purpose of this variance is not exclusively profit motivated. 7. The alleged difficulty or hardship has not been created by any person presently having an interest in the property. A hardship could be considered due to the need of southern exposure. 8. The granting of the variation would not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located. The variance will not negatively impact public welfare and/or neighborhood property. 9. The proposed variation would not impair the adequate supply of light and air to adjacent property or substantially increase the congestion in, the public streets or increase the danger of fire or endanger the public safety and substantially diminish or impair property values within the neighborhood. The variance will not impact local streets or public safety. CONCLUSIONS Staff finds that: 1. The variance does not exceed 10$ of the minimum or maximum standard; 2. The "Findings of Fact" as set forth in subsection 26.D.2.c. support the request; 3. All adjacent property owners have been notified of the request at least 10 days prior to the rendering of this decision, and no protests have been received during the 10 day period; 4. The request will not result in the creation of any additional dwelling. units. Staff concludes that all conditions and requirements of this request have been met in regards to Section 26.D.2 Minor Variance or Waivers, therefore, a recommendation of APPROVAL is given for Case No. WA-92-21. li~3o/9"t~
