Approval of Special Use Permit
WHEREAS, an application for a special use permit was submitted for 4251 Kipling Street; and
WHEREAS, City staff found basis for approval of the special use permit, relying on criteria listed
in Section 26-114 of the Wheat Ridge Code of Laws and on information submitted in the case file;
and
WHEREAS, the Community Development Department has served proper public notice pursuant to
Section 26-109 of the Wheat Ridge Code of Laws; and
WHEREAS, there were no registered objections regarding the application;
NOW THEREFORE, be it hereby resolved that a special use permit is granted for the property
located at 4251 Kipling Street for the purpose of allowing a roof-top, commercial mobile radio
service (CMRS) facility in a C-l (Commercial One) zone district based on the following findings of
fact:
1. This request for an administrative Special Use meets all applicable conditions as
required by Section 26-114 of the City of Wheat Ridge Code of Laws.
2. There will be no detrimental effect on health, safety, welfare, or convenience to the
public in the area.
3. The special use will not create adverse impacts greater than allowed under existing
zoning for the property and is compatible with the character of the surrounding areas
and neighborhood.
4. There will be no impact on the light, air, or water to adjacent property owners.
5. There has been a history of compliance ofthe property with the provisions of the
Zoning and Development Code.
6. The special use will not create or contribute to blight in the neighborhood and will
not over burden the capacities of the existing streets, parks, schools, and other public
facilities and services.
7. There were no comments or objections received during the required posting period.
With the following conditions:
1. The special use will be granted solely to Cricket Communications.
2. The CMRS facility shall be screened or camouflaged as appropriate from view from
adjacent property lines.
3. The antennas shall extend no more than seven (7) feet above the parapet.
4. The accessory structures and cabinets shall extend no more than seven (7) feet above
any parapet.

I. REQUEST
Case No. SUP-08-03 is an application by Mike Sharlow requesting approval of an administrative Special Use
Permit to allow a low-powered, FCC regulated, roof-top Commercial Mobile Radio Service (CMRS) on
property zoned C-llocated at 4251 Kipling Street. Building-mounted CMRS facilities in the C-l zone districts
shall be reviewed by the Department of Community Development for compliance with the requirements of the
zoning code and must receive a special use permit, pursuant to City Code, Section 26-114. (Exhibit!, Letter of
Request)
Pursuant to Ordinance No. 1291, the Community Development Director has the ability to decide upon
applications for administrative special use approval, without a public hearing, provided the following conditions
have been met:
1. A completed application package has been submitted and fee paid.
2. The Community Development Department has notified adjacent property owners by letter and
the site has been posted for at least ten (10) days.
3. No written objections have been received in such ten day period.
4. The Community Development Director concludes that the criteria for approval, as set forth
below, are substantially complied with and supports the request.
The Community Development Director can impose conditions or stipulations upon the approval, which may
include physical design, operational, and maintenance considerations to ensure compliance with the criteria for
reVIew.
The Community Development Director shall also decide the following:
1. Whether the SUP runs with the land in perpetuity;
2. Whether the SUP is personal to the applicant and mayor may not be inherited; and/or,
3. Whether the SUP is granted only for a defined period, after which time the special use shall expire
unless renewed subject to all ofthe requirements of this section.
II. CASE ANALYSIS
The property is 141,134 square feet or 3.24 acres in size. The lot is very irregular in shape and abutted by the
Clear Creek Open Space to the south. There is an existing five story office building on the east side ofthe
pro]Je$'\Vit~dir~ctfr?Il~<l~eon Kipling Street with parking for the site drawing access offW. 43'd Avenue
(EXhibit2,aerialphotograpl.1). The building has a footprint of approximately 17,560 on each story and an
approximate total of 87,800 square feet on the 5 stories. This structure contains professional offices and also
serves as a major location for several cellular phone companies' antennas and accessory equipment, as the
building is a high point in an otherwise relatively low area (EXhibit3,Sit~;"I'hot(,gfaph~.
Cricket Communications is a state licensed cellular phone company and the site will be regulated by the FCC.
The building at 4251 Kipling Street is an area that is lacking coverage and is high enough to meet the coverage
requirements of the company.
An additional 3 cellular phone antennas with their accessory cabinets are being proposed to be placed on the
roof of the building. All roof-mounted CMRS facilities are required to comply with Section 26-615 of City
Code. Roof-mounted CMRS facilities are required to be screened or camouflaged as appropriate from view
from adjacent property lines. Whip antennas shall extend no more than 1 0 feet above the parapet of any flat roof

to which they are attached while the antennas and accessory structures may not extend more than 7 feet above
the parapet.
According to the plans submitted by the applicant, the antenna and their cabinets will be placed behind
screening that will match the screening already in place to screen HV AC units and other equipment located on
the roof (Exhibit 4, Screen Elevation). The equipment and antenna will also meet all height regulations as
prescribed by City Code. In addition, the antenna and accessory equipment will be constructed in such a
manner that the co-location of other cellular phone antennas and equipment can be accommodated (Exhibits 5
and 6, Building Elevations).
III. SPECIAL USE PERMIT CRITERIA
Staff has the following criteria to evaluate special use permit requests and shall determine that the majority of
the "criteria for review" listed in Section 26-114.D of the City Code have been met. The applicant has provided
their analysis of the applications compliance with the variance criteria (EXhibit 7).
Staff provides the following review and analysis of the special use criteria:
1. The special use will not have a detrimental effect upon the general health, welfare, safety
and convenience of persons residing or working in the neighborhood.
The proposed special use will not affect the health, welfare, safety, or convenience of any person
working or residing in the area. With the proposed use being screened from view and being
located on the top of a 5 story office building, the proposal will not increase the intensity of
current land use.
Staff finds this criterion has been met.
2. The special use will not create or contribute to blight in the neighborhood by virtue of
physical or operational characteristics.
The property is developed and currently does not contribute to blight in the neighborhood. The
building on site was constructed of quality materials and is well maintained. The addition of a
CMRS facility will not contribute to blighting of the area. Concerns with being able to view the
equipment from the surrounding properties have been addressed by the applicant with
appropriate screening material. The height of the building and the location of the equipment and
antenna make it even difficult to see the screening from the ground
Staff finds this criterion has been met.
3. The special use will not create adverse impacts greater than allowed under existing zoning
for the property.
Staffhas not identified any adverse impacts greater than what are allowed under existing zoning.
There will be no impact to the light, air and water to the adjacent properties as no expansions or
site modifications are being proposed. There will also be no adverse impacts as the C-l zone
district allows a wide array ofland uses, some of which are more intense than the proposed use.
This use will require very little parking and generate very little traffic.
Staff finds this criterion has been met.

4. The special use will not result in undue traffic congestion or traffic hazards, or unsafe
parking, loading, service or internal traffic conflicts to the detriment of persons whether on
or off the site.
The use will not create undue traffic congestion or hazards. All parking and loading areas are
currently existing on the property.
Staff finds this criterion has been met.
5. The property is appropriately designed, including setbacks, heights, parking, bulk,
buffering, screening and landscaping, so as to be in harmony and compatible with the
character of the surrounding areas and neighborhood, especially with adjacent properties.
The adjacent properties should experience minimal impact from the proposed special use. The
light, air or water to surrounding properties will not be affected by the request. There is no
increase in the "floorprint" and the building will have the same setbacks as it currently does.
Screening will be provided by the applicant which will match the screening that is already on the
roof for the existing HV AC units and other equipment.
Staff finds this criterion has been met.
6. The special use will not over burden the capacities of the existing streets, utilities, parks,
schools, and other public facilities and services.
Parks, schools and other public facilities will not be negatively impacted. There will be no or
minimal increases to traffic on the streets that will be generated by this use. Other utility
agencies are already serving the property. Any improvements required by the utility companies
must be completed during the building permit process.
Staff finds this criterion has been met.
7. There is a history of compliance by the applicant and/or property owner with Code
requirements and prior conditions, if any, regarding the subject property.
The applicant and the property have no history of code violations.
Staff finds this criterion has been met.
8. The application is in substantial compliance with the applicable standards set forth in the
Architectural and Site Design ManuaL
The Architectural and Site Design Manual applies to all new construction except single and two
family residential and those existing structures undergoing major additions. This building will
not see any additions or other improvements as a result of this request
Staff fmds this criterion is not applicable.
IV. NEIGHBORHOOD METING

Prior to submittal of an application for a special use, the applicant shall be required to hold a neighborhood
meeting in accordance with the requirements set in City Code, Section 26-109 A.
A meeting for neighborhood input was held on February 12,2008 in accordance with Section 26-109A. The
only attendees present were the applicant and staff.
V. AGENCY REFERRAL
All affected service agencies were contacted regarding the ability to serve the property. Their specific referral
responses follow.
City of Wheat Ridge Building Division: No comments or objections.
VI. STAFF RECOMMENDATIONSIFINDINGS OF FACT
Having found the application for Case No. SUP 08-03/Cricket Communications, a Special Use Permit to allow
a rooftop a commercial mobile radio service (CMRS) facility in a C-l zone district, to be complete and in
compliance with the majority of the applicable review criteria, therefore, staff recommends APPROVAL of the
special use request.
Staff recommends APPROVAL for the following findings of fact:
1. This request for an administrative Special Use meets all applicable conditions as required by
Section 26-114 of the City of Wheat Ridge Code of Laws.
2. There will be no detrimental effect on health, safety, welfare, or convenience to the public in the
area.

I am getting started on writing the staff report for your special use permit today. I will hopefully have it done and
to the director of community development by the end of the day. While I was looking through your file, I found
that we are missing one piece info that we should have caught up front. I know the Community Development
Director will want to see it in the staff report so if you could get responses to me from the attached form by the
end of the day so I can attach it to the staff report it would be extremely helpful and will help speed things along
rather then if we have to wait for the responses for a few days. I'll keep plugging along on the report in the

Request and Justification
Cricket Communications operates a FCC licensed cellular phone company. Pursuant to the federal licenses
Cricket purchased for coverage in the State of Colorado. The Clear Creek building rooftop is in a location
lacking coverage and is high enough to meet Cricket's technical requirements and would serve well to
collocate its antennas. This would allow Cricket to meet its Federal License as well as customer obligations
with a stealth rooftop facility as opposed to building a new antenna tower.

Summary
There are numerous Cricket subscribers living. working. and traveling through this area who depend on
adequate wireless coverage not only for personal use but also for businesses to keep in contact with their
employees and customers. The industry is seeing a new trend in wireless telecommunications usage from
morning and night commutes along major roadways to nights and weekends in residential areas. Therefore,
ensuring adequate coverage along both major roadways as well as in residential areas as mandated by our
federal license agreements is critical and will be achieved with this proposed facility. This is further
evidenced with the growing trend of residents discontinuing their land line based telephone service for
wireless service and will continue to become more of a concern in residential areas now that Local Number
Portability (LNP) is in place. There is also a significant safety factor involved in having this service in this
area for E-911 capabilities.

Existing Use/site conditions: The property is located on the southwest comer ofW. 43'd Ave. and Kipling St.
and is zoned C-1. The majority ofthe area is zoned commercially, whether it is Cl, PCD, or R-C, as the
intersection ofW. 44th Ave. and Kipling St. is a major intersection with commercial uses extending along both
W. 44th Ave and Kipling St. There are some residential uses in the general area which contain a mix of single
family, duplexes and apartments. The property also abuts the Clear Creek Greenbelt to the south.
The property has been developed and is a multi-story, multi-tenant office building housing various businesses
and offices. A RV repair shop sits directly in front of the office building at the northeast comer of the property.
Applicant's Proposal: The applicant is proposing to locate wireless phone service equipment on the Clear
Creek Office Park rooftop. A CMRS facility is allowed in the C-l zone district upon approval of a special use
permit. The equipment will consist of radio cabinets which will be placed behind fabricated screens that look
identical to the existing HV AC equipment screening. Two, single antennas will be mounted behind the screening
while a third antenna will be located on another part of the roof behind another screen.
The following issues were discussed regarding the zone change request and proposed development:
. Staff discussed the site, its zoning and future land use.
. The applicant was informed of the special use permit process and which departments and agencies the
application would be sent on referral to.

. There is the possibility the HV AC system for the building is going to be redone. The HV AC units would be
replaced and could result in the cell phone antennae and cabinets be relocated. Will this create any issues?
As long as there are no major changes to the sizes and heights of the equipment there will likely be no
concerns. Regardless of the location of the equipment, it will have to be screened
. Will an address list be prepared for the applicant for the mailing sent in conjunction with the 10 day posting
period? The Community Development Department will handle the mailing of certified letters for the posting
period to the surrounding adjacent properties. The applicant will not be required to create a letter and is
not responsible for this mailing.
. What is required for the posting of the signs? The Community Development Department will prepare the
signs to be posted on the property. Two sign will be required since it has frontage on both Kipling St.
and W 43 Ave. The signs will need to be picked up and posted on the property by the applicant. It is the
responsibility of the applicant to ensure the signs remain in place for the entire posting period If the
signs should fall down, be stolen, etc. the applicant should inform staff immediately and a new sign will
be createdfor the applicant.
Other than the applicant and staff, no one was present at the meeting. There was no response received by staff
from anyone regarding the proposal.

NOTICE OF NEIGHBORHOOD INPUT MEETING
Cricket Communications is proposing a Special Use Permit on property located
at 4251 Kipling (Clear Creek Office Park Building). A neighborhood meeting will be
held on February 12, 2008 at 6:30 pm at the City of Wheat Ridge Buildiug at 7500 W. 29th Ave.. The
purpose of the request is to allow a screened from view, low-power, and FCC regulated cellular phone
antenna facility on the roof of the Office Park building..
The City of Wheat Ridge has adopted a requirement that prior to any application Special Use Permits, an
applicant must notify all residents and property owners within 600 feet and invite them to a Neighborhood
Input Meeting. The purpose of this meeting is to allow the applicant to present his proposal to the
neighborhood and to give the neighborhood a forum to express their concerns, issues and desires.
A Staff Planner will attend the meeting to discuss City policies and regulations and the process involved,
however, the Planner will remain impartial regarding viability of the project.
Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be entered as
testimony, it is the public hearings in front of the Plalllling Commission and City Council where decisions
are rendered. Jfyou want input in the decision-making process, it is imperative that you attend the public
hearings.
The kinds of concerns residents normally have include the following:
. Is the proposal compatible with surrounding land uses and zoning?
. Are there adequate utilities and services in place or proposed to serve the project?
. What is the impact on our streets?
. How will this proposal affect my property?
. Where will the storm drainage go?
. How will the project be designed to enhance rather than detract from the neighborhood?
. What specific changes can be made in the proposal to make it more acceptable to me?

3. IT IS CRITICAL THAT THE GPS ANTENNA IS
MOUNTED SUCH THAT IT IS W!THIN 2 DEGREES
OF VERTICAL AND THE BASE OF THE ANTENNA
