Dear Mr. and Mrs. Gioie:
This letter is in regard to your application for variances to allow an existing recreational
vehicle cover on property located at 4450 Cody Street. The RV cover is in violation of the
required side yard accessory structure setback of 10'. The structure is also of metal
construction. The R-2 zone district regulations prohibit accessory buildings over 120
square feet to be made of metal.
After further discussion with the Director of Community Development it has been
determined that there is no relief to the prohibition that accessory structures over 120
square feet in size be constructed of metal. Because there are no alternatives to allow a
metal building, the setback variance for this structure cannot be processed either.
I apologize for the inconvenience this has caused you. Your entire application fee will be
refunded to you. I would suggest that you contact the company which erected the illegal
structure to discuss removal and/or replacement of it.

Dear Mr. and Mrs, Gioie-
This letter is in regard to your building permit application for an existing recreational
vehicle cover on property located at 4450 Cody Street.
Your building permit application cannot be approved for the following reasons:
1. Your property is zoned R-2, Residential-Two, Pursuant to the R-2 zone
district development regulations, accessory structures over 8' in height must
have ten foot setbacks from both the side and rear property lines, The
cover/carport is being shown as having a 15' rear setback and a 7'-10" side
setback,
2, The cover/carport structure, which measures 12' x 26', appears to be
constructed of a metal frame with a metal roof. The R-2 zone district
regulations prohibit accessory buildings over 120 square feet to be made of
metal.
Attached is a copy ofthe R-2 zone district regulations where these development standards
have been highlighted,
It is my understanding that the structure is already in place, Because the structure is in
violation of the R-2 development standards, a permit cannot be issued. Therefore, the
structure must be removed by November 30,2007,

Variance Criteria for Review
Staff uses the set of criteria listed below to critically evaluate a variance request when they are performing
their review, Applicants must also submit a written response to each of the applicable criteria with their
application for a variance. The criteria listed below are applicable to all variance cases with the
exception of the final two criteria, which are not applicable for variances for properties with single family
and two family dwelling units, The responses must reflect why a variance should be granted. The
community development director, board of.adjustment, planning commission or city council shall base its
decision in consideration of the extentto which the applicant demonstrates a majority ofthe following
criteria have been met:
A. The property in question would not yield a reasonable return in use, service or income if permitted
to be used only under the conditions allowed by regulation for the district in which it is located.
a, This statement is correct.
B. The variance would not alter the essential character ofthe locality.
b. The variance is for a professionally made and installed RV Cover for the RV currently being
parked in the locality. The variance would not alter the essential character of the locality,
C. The applicant is proposing a substantial investment in the property with this application, which
would not be possible without the variance.
c. The investment is considered by us to be substantial at $1483.00 and is more visually
appealing than a tarp covering our RV in the winter. The RV Cover is a professional up-grade
in quality and was installed by experienced professionals,
D, The particular physical surrounding, shape or topographical condition of the specific property
results in a particular and unique hardship (upon the owner) as distinguished fTOm a mere
. '
InconvenIence.
d. The only option available if the variance is not granted would result in substantial additional
cost and require the complete renovation of the existing back yard, The substantial cost
involved would create a financial hardship and be prohibitive,
E, If there is a particular or unique hardship, the alleged diffj.Pculty or hardship bas not been created by
any person presently having an interest in the property.
e, This is a true statement.
F. The granting of the variance would not be detrimental to the public welfare or injurious to other
property or improvements in the neighhorhood in which the property is located, by, among other things,
substantially or permanently impairing the appropriate use or development of adjacent property,
impairing the adequate supply of light and air to adjacent property, suhstantially increasing the
congestion in puhlic streets or increasing the danger of frre or endangering the public safety, or
substantially diminishing or impairing property values within the neighborhood,
f, The granting of this variance does not create any detrimental changes to the neighborhood. It
actually is an improvement to the current method of covering the RV with a tarp. Less danger
of fire or accidents would result by approving this variance.
G, The unusual Clrcmnstances or conditions necessitating the variance request are present in the
neighborhood and are not unique to the property,
g. There are numerous incidents of structures, i.e., sheds located inside of setback limits in
several of the yards in this neighborhood.
H, Granting of the variance would result in a reasonable accormnodation of a person with disabilities,
h. The male resident of this residence is over 70, incurred a debilitating heart attack earty this
year and is now physically unable to perform the manual labor to cover the RV in the winter.
That is the reason we had to purchase the RV cover now located on the property for which
the variance is being requested,
I. The application is in substantial compliance with the applicable standards set forth in the
Architectural and Site Design Manual. .
i. The variance requested is for a RV cover, professionally manufactured to meet or exceed all
applicable standards set forth in the Architectural and Site Design Manual.
