The second submittal has been reviewed and all changes requested in my August 19, 2013 letter
have been completed.
Attached are referrals received from other city departments and outside agencies regarding the plat
document.
Wheat Ridge Public Works: See attached letter from Dave Brossman dated September 3, 2013.
Once Public Works has approved the modifications from the second submittal, a blackline mylar of the
plat with signatures of the owner and surveyor in black, indelible ink can be submitted to the City for our
signatures and recording. An $11 per page filing fee for Jefferson County will be required at that time.

3. Please add the missing line in the drainage easement near the southwest corner of the subdivision.

I have completed the first review of the above referenced letter and plat received on August 5, 2 13, for
the proposed consolidation of Lots I & 2, Kaiser Perrnanente Subdivision Filing No 3 to allow

Drainage Letter:
I . It appears the runoff associated water quality component has been sufficiently analyzed for the
proposed solar array project.
2. The current design provides a larger grass buffer area than required under both the Urban
Drainage and City Site Drainage Requirements criteria the Drainage Letter is hereby approved.
A copy of the approved Letter will be returned to you along with the plat after it has also been
approved.
Final (Consolidation) Plat:
General Comment:
1. There is a significant amount of text, such as all hearings and distances for the subdivision
boundary, section ties, and also property pin information, all of which appears on the PD F copy

Existing Conditions
The property is located at 4803 Ward Rd and is part of the Kaiser Permanente Subdivision Filing No.
3. Based on the plat, Lot 1 is 4.8 acres in size (209,239 square feet) and is currently vacant land. Lot
2, which is just south of Lot 1, is 20 acres in size (871,826 square feet) and is currently used as an
medical office building (58,539 square feet) for Kaiser Permanente. The total area of the two lots is
24.8 acres (1,081,065 square feet).
The site is located in the northwest quadrant of the city and is zoned Commercial -One (C -1). The site
is located on the far eastern edge of the City, adjacent to the municipal boundary. To the north and
west of the site are properties located in unincorporated Jefferson County, including. Mt. Olivet
Cemetery to the west. To the north and northeast of Lot 1 is an mix of properties that are primarily
light industrial in use. The two properties abutting Lot Ion the north appear to be office /warehouses
and used for car maintenance and storage.
The properties to the east and south are located within City of Wheat Ridge municipal limits. To the
east of Lot 1 are a cluster of condominium style office buildings with a variety of tenants and zoned
Commercial -1 (C -1). Across Ward road to the southeast is a water reservoir owned by the City of
Arvada and zoned Agriculture -2 (A -2). To the south of the property is the RTD Ward Road Park -`n-
Ride and Interatate -70.
Applicant/Owner Preliminary Proposal;
The applicant is proposing the construction of a photovoltaic (solar) array on Lot 1 to provide power
to the existing medical office building on Lot 2. Along with the construction of the photovoltaic array,
the applicant is proposing to consolidate Lots 1 and 2 into one lot. The solar array will occupy 2 acres
(approximately 87,500 square feet). The panel design for the photovoltaic array will be a static design

with fixed panels at 30 degrees. The orientation of the array is a rectangle in the middle of Lot 1, and
it will be surrounded by a 6-foot chain-link fence.
Current ground cover on Lot I includes native vegetation. The installer, Namast6 Solar, is proposing
to disrupt the site as little as possible and to preserve natural vegetation instead of gravel under the
solar panels. A third party will own and operate the solar array and will sell power to Kaiser.
Maintenance and mowing of Lot I will continue to be the responsibility of the current property owner,
Kaiser Pennanente.
Will a neighborhood meeting need to be held prior to application submittal?
No, a neighborhood meeting is not required prior to submitting a consolidation plat applications,
Planning Division comments:
The following items were discussed based on the applicant's proposal:
Zoning & Process
The property is zoned Commercial-One (C-1). The intent and purpose of C -1 is to establish and
provide for areas with a wide range of commercial land uses which include office, general business,
and retail sales and service establishments. This district is supported by the community and/or entire
region. Development standards (setback, height, building coverage), are set forth in Section 26-218 of
the City Code.
According to Section 26-204 (zone district use schedule) of the zoning code, photovoltaic panels are
allowed in commercial zone districts as an accessory use. Acessory uses cannot be located on a lot
devoid of a primary use. In addition, accessory uses shall not be located over a platted or recorded
easement.
In order to allow the photovoltaic array, the applicant is proposing the consolidation of Lots I and 2 in
to one lot. Consolidation of two lots is an administrative process, so no public hearings will be
required. The review process is further described below.
,Fene
A 6-foot chain link fence is proposed to encircle the photovoltaic array. Chain link divisional fences
are permissible in commercial zoned districts. Fences shall not exceed 6 feet in height. Barbed wire is
not permitted in commercial zoned properties. See Section 26-603 of the zoning code for fencing
requirements.
Setbacks & Develoj)ment Standards

Section 26-218 of the zoning code establishes minimum development standards for C -1 zoning district
including maximum height, lot coverage, setbacks, landscaping requirements, fencing requirements,
etc. The minimum setbacks for the solar array are X feet, and the proposed site plan, appears to be
compliant with this standard.
Building Division comments:
The building division was not present at the meeting and has no comments at this time.
Public Works Comments:
The following items were discussed based on the applicant's proposal:
Drainage
A drainage letter and stormwater management plan will be required for the development application.
The letter will verify that construction of the photovoltaic array will strive to maintain native
vegetation and not grade the site. The applicant had discussed the potential for gravel ground cover on
the area directly under the photovoltaic panels, depending on the amount of ground cover; further
drainage requirements may be needed.

and are attached to this summary. You may also refer to the Site Drainage Requirements available on
the City's website or contact Dave Brossman in
the Public Works Department.
Utility Easentent
There is a 50-foot utility easement (Rec. #86025369) in the northeast comer of Lot I that runs
perpendicular to the western property line, then turns to the east at a 90-degree angle towards the
parking lot (See Kaiser Permanente Subdivision Filing No. 3). No permanent structure can be built on
a utility easement, however, more research is need to determine it7how the transmission lines can cross
the easement.
The transmission lines which are proposed to run from the solar array to the building may not require
an easement because they are a private utility, but staff recommends denoting the location on the plat
to ensure that no future improvements interfere/conflict with the location of utility lines.
197ITM
A lot consolidation essentially combines two or more adjacent parcels and creates a single larger lot.
In this case, a consolidation plat is the document that will remove the lot line currently separating the
two parcels that make up the property at 4803 Ward Rd. The consolidation plat must be prepared by a
surveyor who is licensed in the State of Colorado.
The first step in the process began with the pre-application meeting on July 7, 2013. The next step
will be to proceed with the consolidation plat application.
