The Wheat Ridge Community Development Department has received a request for approval of an
easement vacation for property located at 3333 Routt Street. No response from you will constitute
having no objections or concerns regarding this vacation.
Case No.: WV -13 -01 / Mackey
Request: The applicant is requesting to vacate a 5 -foot utility easement that currently bisects the
property at 3333 Routt Street. The easement was originally dedicated by the Knight
Subdivision and was adjacent to a property line (Rec. #93161211). Subsequently, the
Mackey Subdivision adjusted the lot line between 3333 Routt Street and 3430 Simms
Street (Rec. #2010047973). At this time, easements were established along the new
property line, but the existing easements were not vacated. The applicant is seeking to
remove this encumbrance from the property. See attached exhibits.
Please respond to this referral in writing to confirm that no improvements or infrastructure are located
within the easement to be vacated. No response from you will constitute having no objections or
concerns regarding the easement vacation.

and electric distribution facilities within the area of the easement proposed to be
vacated at the above captioned location. Therefore, PSCo is able to give a conditional

I would prefer to substitute the word "remove" for "vacate", as it is really more appropriate to remove an easement.
Vacation is for ROW, as it t Fertains to title held in feE_",I 77vi
But an easement is A_Eight, granted by the underlying landowner rather being than an ownership matter. So we want to
remove the right to do whatever it is the easement allows. Does that make sense?
As far as the document I sent to you goes, that was a work in progress and again I believe it should be modified to
"remove" rather than vacate an easement, And I also don't believe that XT
before City Council. The document I based this on was from the City of Arvada, a full-service city, and therefore had to
go before City Council as the legislative body over the utilities, Since we are not a full-service city it seems that we could
remove utility easements just by receiving acknowledgement from the individual districts.

trying to convey?
I just saw your easement vacation form, I already charged $300 (plat amendment fee) and I sent the request on referral
but didn't get notarized responses from utilities. I like that your form/process puts the onus on the property owner to
obtain letters from utility companies, Maybe we clarify and adopt your process with the update of the sub regs? What do
you think?
