All notification and posting requirements have been met; therefore, there is jurisdiction to hear this
case.

The 2.86 acre property is located at 8955 W.44 Avenue and is zoned C-2. The applicant is
requesting approval of a Class 11 Special Exception Floodplain permit to allow the construction of a
commercial structure roughly 4900 square feet in size.
Section 26-808(D) (Floodplain Control) of the Wheat Ridge zoning and development code empowers
the Board of Adjustment to hear and decide appeals of Class I special exception permits which have
been denied by the floodplain administrator and requests for Class 11 special exception permits as
provided within these regulations.
Prior to construction of the new building, a Planned Building Group plan to allow multiple structures
on the property and a building permit must be obtained. These are both administrative approvals.
The subject property is currently occupied by DTI Trucks, which sells light-, medium- and heavy-duty
work trucks. The site includes a 10,500 square foot main building that has a north-south orientation.
The building contains offices and a garage in which vehicles are reconditioned. Two smaller
accessory structures have an cast-west orientation in the middle of the site. The remainder of the
property is paved parking for display of vehicles.
The majority of the site lies within the Clear Creek 100 -year floodplain. (Exhibit 2, aerial photo with

M. CASE ANALYSIS
On Exhibit 2, the flood storage area is designated in turquoise. The flood ay is shown as being purple.
The applicant is proposing to demolish the two ancillary structures located east of the primary
structure and replace them with a new building approximately 4900 square feet in size. Location of

The purpose of this analysis is to determine the effects that the proposed project of the
property will have on the I 00-year floodplain in support of a Class H Floodplain permit
application to the City of Wheat Ridge.
The eastern and northern portions of the site are in Zone AE as depicted on Flood
Insurance Rate Map (FIRM) Number 080590215E (See Appendix). The remainder of
the site is in Zone X. The elevations in the FIRM are in NGVD 29 Datum.
The 100-year flood plain is more accurately depicted in the April 2007 Flood Hazard
Delineation Study (FHAD) for Clear Creek prepared by ICON Engineering, Inc. and
adopted by the City of Wheat Ridge on March 24, 2008. The elevations in , the FHAD
are in NAVD 88 Datum, which is the datum currently used by the City of Wheat Ridge
for control and is the datum used for the elevations on the Flood Permit Drawing. Sheet
16 and a portion of J'able 3 from this study are included in the Appendix,
A Letter of Map Amendment (LOMA) was issued by FEMA removing all of the main I
building from the floodplain. A copy of the LOMA Determination Document (Case NII
09-08-0798A) is included in the Appendix.

bounded to the south by W. 44 Avenue and to the east by Clear Creek and the Clear Creek bike path.
The surrounding area is primarily a rnix, of commercial and residential zone districts. The residential
areas are to the north and cast. The properties to the west are zoned Commerciat-One (C-1). Across
W. 44 Ave is Anderson Park which includes sports fields, basketball courts, a skate park, outdoor
pool, and indoor faciliti

Staff encourages the applicant to pursue a north-south orientation for the new building, assuming that
functional ramps can be built to accommodate DTI trucks and the floodway. An east-west orientation
is discouraged for aesthetic reasons associated with garage doors facing W. 44"' Avenue.
The new structure is subject to requirements of the ASDM. Due to the unique nature of the building
and site plan, staff would like to meet with the applicant and architect prior to accepting the proposed
SUP and PBG applications. Once a revised site plan and building elevations are acceptable to Staff,
the applicant may proceed with the SUP process.
Upon submittal, the assigned staff will review and comment on the project. The project will
simultaneously be referred to other departments and utility companies for their comments. A 15 day
time period is given for the agencies to respond. The staff planner will inform the applicant if further
changes need to be made based on their own review or others' comments.
Once the review of the application is complete, the property must be posted for a minimum of 10
consecutive days. If no legitimate complaints are received regarding the request within the 10 day
period, the application for a Special Use Pen may be reviewed administratively. If a complaint is
received by the Community Development Department, then the request for the Special Use Permit will
automatically require a public hearing before the City Council.
If a hearing before City Council is required for any reason, staff will present evidence to recommend
the approval, approval with conditions, or denial of the Special Use Permit. The public will also be
allowed to present evidence or give testimony in support or in opposition of the project. The City
Council will approve, approve with conditions, or deny the project based on the testimonies given by
staff, applicant and the public.

The PBG application is an administrative process that may be processed simultaneously with the SUP.
Once approved, the PBG must be photographically reproduced on mylar film in a plat format with all
the required signatures so that it may be recorded with the Jefferson County Clerk and Recorder. If the
PBG is denied the applicant may appeal the decision to the Planning Commission, for which a public
hearing would be required.
The ASDM discourages garage doors from facing the primary street, which is W. 44"' Avenue. It is
for this reason that Staff is encouraging a north-south orientation for the proposed building.
The applicant's first priority should be to confinn that the proposed building is feasible in relation to
the floodplain. After this is deters - pined, the applicant and staff may have a more detailed discussion
related to architectural requirements and elevations.
