The District does not require a particular format or wording for the FICA Agreement /Contract indicating

Agreement/Contract show that the oNviiershiplmaintenatice/f'uture repairs are the responsibility of the
developer or HOA. This contract shall also be a legal document that is recorded with the County and a

The Wheat Ridge Fire Protection District has reviewed the Community Development Referral and
has the following comments regarding our ability to serve this property:
1. Additional fire hydrants will be needed to meet the water supply requirements of the Fire
District. Two new hydrants are shown on the site plan. The applicant must verify
quantities and locations based on fire flow requirements. Available fire flow will need to
be calculated and verified based on building size and construction type. Reference
Section 508, Appendix B and C, of the fire code to ensure compliance.
2. Other than unit - specific garage parking, available off street parking has increased since
the initial development review from zero stalls to 6 stalls. The applicant should be made
aware that proposed fire lane widths as shown will prohibit on- street parking throughout
the development other than on 38` Avenue and on Depew Street. An approved plan to
mark fire lanes appropriately will be required and will likely include both signage and
striping as well as other enforcement measures as necessary to ensure compliance.
3. The site plan indicates that the 6 parking stalls off of the north access lane encroach on
the 20 foot minimum width by about 3 feet. Minimum access lane widths shall be
maintained throughout and cannot be encroached on by vehicle parking or other
obstacles.
4. Elevation drawings 6. 7, and 8 indicate that certain buildings will exceed 30 feet in
height. Buildings that exceed 30 feet in height must meet the fire access road
requirements for aerial apparatus and the existing internal access lanes do not meet this
requirement:

D105.1 Where required. Buildings or portions of buildings or facilities exceeding 30 feet (9144 mm)
in height above the lowest level of fire department vehicle access shall be provided with approved

utility and power lines shall not be located within the aerial fire apparatus access roadway.

Public Service Company of Colorado (PSCo) has determined there is a conflict with the
above captioned project. Please be aware PSCo owns and operates existing natural gas
and electric distribution facilities in the proposed project area. Of concern are the planned
trees in the vicinity of the overhead electric lines along Depew Street. Public Service
Company's "Guidelines for Planting In or Near Rights -of -Way and Utility Facilities"
has been attached for review.
Due to the unique configuration of the utility easements in relation to the proposed lots, the
property owner /developer /contractor must contact the Builder's Call Line at 1- 800 -628-
2121 as soon as possible and complete the application process for any new gas or
electric service, or modification to existing facilities. It is then the responsibility of the
developer to contact the Designer assigned to the project for approval of design details.
Additional easements may need to be acquired by separate document for new facilities.
As a safety precaution, PSCo would like to remind the developer to call the Utility

• Trees growing taller than 20 feet should not be planted within distribution line rights -of -way. However, they may
be planted at least 20 feet (horizontally) from overhead electric distribution lines.
• Trees with a maximum mature height of less than 20 feet may be planted beneath overhead electric
transmission and distribution lines except when near structures. Please see list of compatible tree species listed
below.

• Trees should be planted at least 15 feet from transmission and distribution poles and structures.
• Shrubs, ground covers, and flowerbeds can be planted up to the base of poles and structures. However, plant

UNDERGROUND ELECTRIC OR GAS LINES
• Avoid placement of shrubs and trees over underground facilities and in front of the access doors of pad -

• Trees should be planted at least 15 feet from transmission and distribution poles and structures.
• Shrubs, ground covers, and flowerbeds can be planted up to the base of poles and structures. However, plant
material may be destroyed during groundline inspection of wood structures for underground decay. Damaged or
destroyed plant material will not be replaced.
UNDERGROUND ELECTRIC OR GAS LINES
• Avoid placement of shrubs and trees over underground facilities and in front of the access doors of pad -
mounted underground equipment. This will help avoid having to move and possibly destroy plants during
maintenance and repair operations. Damaged or destroyed plant material will not be replaced.
• If planting above underground facilities cannot be avoided, plant materials with roots that extend less than 18
inches below grade at maturity should be used.

property is 1.4 acres in size and is currently vacant. .
The applicant proposes development of 26 new residential units configured as a mix of 24
rowhouses and one duplex (two units). All access will occur from Depew Street through a
looped internal drive. A prior referral was distributed relative to a subdivision of the property
(Case No. WS- 13 -02). The site plan approval process will be administrative.

Existing Site Conditions:
The property is located at 5670 W. 38' Avenue at the southwest comer of W. 38' Avenue and Depe

The buildings will be clustered around an open space/drainage area in the middle of the site, Two
curb cuts on Depew will provide vehicular access in and out of the site. The applicant is working with
the Fire District to meet minimum standards related to access.
Will a neighborhood meeting need to be held prior to application submittal?
No, a neighborhood meeting is not required.
Planning comments:
The following items were discussed based on the applicant's proposal:
Zoning
The property was rezoned to the Mixed Use-Neighborhood (MU-N) zone district in late 2012 as part
of a city-initiated rezoning of the 38' Avenue corridor. The MU-N zone district has specific design
requirements that address building placement, materials, transparency, parking, and open space
requirements, For a code analysis of MU-N development standards, please refer to the attached
Municipal Code, Sections 26-1101 to 26-1119,
In addition, an administrative site plan review will be required. The site and building designs of all
new development in mixed use zone districts are subject to review to ensure compliance with
development standards. No public hearings are required. This review may occur concurrently with
the non-administrative review of the subdivision plat, Again, the review process is further detailed
below.

Parkland Dedication
Parkland dedication is required for all residential subdivisions, When land is not dedicated for a
public park, a fee is required in lieu. Typically, the Parks and Recreation Commission makes a
recommendation, and City Council approves the final feet in lieu.
The applicant has been asked to provide with the subdivision application a letter that outlines a
justification for the requested fee amount. The letter should include a description of on-site amenities
that may help to falfill residents' recreation needs. Ultimately, City Council decides upon the fee
amount.
Staff will work with the applicant to determine which portions of the site may and may not count
towards these requirements. Please note that storm water detention areas, such as Lot 24 (Tract A)
may be counted toward usable open space if properly designed. This area will not be dedicated as
City-owned park land, but the more usable the area is, the more residents' recreation needs may be
able to be met on-site.
Building Division comments:
The following items were discussed based on the applicant's proposal:
Fire Separation
The applicant and Building Division discussed fire separation requirements in more detail after the
pre-application meeting. Please contact Chief Building Official John Schumacher for any additional
questions.
Public Works comments:
Access & Easement
The proposed design includes a looped road with two access points off of Depew Street. The northern
curb cut will be intended for right-in/right-out turning movements, but will be able to accommodate
left-in access which has been requested by the Fire District. The southern curb cut will allow for full

turnin • movements, No curb cut is propos .E E ng W. 38 Avenue. An existing drive entrance from
W. 38 Avenue will be closed.
The internal loop roaded will not be dedicated to the City, rather it will be privately owned and
maintained. In the proposed subdivision plat, lot lines are shown overlapping the internal road.
Because each lot with include some ownershi3, of the access ro
all paved areas including the parallel parking. Easement language should clarify the permitted use of
the drive and should clarify who is responsible for maintenance.
Process
As discussed at the September 2012 pre-application meeting, this request will require this request will
require two land use applications: a major subdivision and a site plan review. The first step was a
pre-application meeting and the next steps are outlined below.

Once all comments and requirements have been met, the case manager will refer the Site Plan
application to the Community Development Director for final approval. A copy of the approved
Site Plan will be kept on file at the Community Development Department.

Re: Re-subdivision Perrin's Row — Site Plan Submittal
Ms. Reckert,
We are pleased to be submitting a Site Plan for the Perrin's Row townhouse development.
The site was rezoned as MU-N as part of the city initiated rezoning of the' ) 8th Ave. corridor.
Previously, the site was zoned "Planned Mixed Use Development" for 20 residential units and
7800 SF of retail space. We intend to build 26 units of town houses surrounding a
recreational open space. 'The proposed project is in compliance with the MU-N Zoning in that
is an allowed use and meets all the requirements of the Zone District specific to this project. A
revised plat is under separate review.
Accompanying this letter are:
