CITY COUNCIL MINUTES
CITY OF WHEAT RIDGE, COLORADO
May 13,1991
The City Council Meeting was called to order by the Mayor at 7 30 p m
Councilmembers ~resent Elise Brougham, Kent Davis, Don Eafanti, Phil
Edwards, Tony FIasco, Larry herkl, Ron Selstad, and Bill Shanley Also
present City Clerk, Wanda Sang, City Administrator, ~iike Smitl-J, City
Attorney, Jol-Jn Hayes, Director of Planning & Development, Glen Gidley,
staff, and interested citizens
APPROVAL OF MINUTES of April 22, 1991
Motion by Mr Eafanti for tl-Je approval of the Minutes of ~pril 22, 1991,
seconded by Mr Selstad, carried 8-0

PUBLIC HEARINGS AND ORDINANCES ON SECOND READING

Council Bill 8b - An Oroinance vacating a ~ortion of Otis
Street in tl-Je James Subdivision within the City of ~heat Ridge,
County of Jefferson, State of Colorado
(Case No WV-l-l)
Council Bill 86 was introduced on second reading by Mr FIasco, title
read by the Clerk, Ordinance No 861 assigned
Mr Gidley gave the staff report and answered Council's questions
Motion by Mr FIasco that Ordinance 8bl, a request to vacate an
unused portion of Otis Street, be approved for the following reasons
1 The remnant cul-de-sac bulb will never be used
2 All outside agencies have no problem with the vacation
3 Public Works is encouraging tl-Jis type of vacation
With the following condition
1 TI-Je application fee be refunded to the owner,
seconded by Mr Merkl, carried 8-0

Council Bill 87 - An Ordinanre ~roviding for the approval of
rezoning from Restricted Commerrial-One and Commer0ial-Gne to
Commercial-One on land lorated at 6425 W 44th Avenue, City of
Wheat hidge, County of Jefferson, State of Colorado
(Case No WZ-91-1) (Ralph Smitl-J for Arvada Draperies)
Council Bill 87 was introduced by hr Davis on secono reading, title
read by the Clerk, Ordinance No 262 assigned
hr Gidley gave the staff report and answered Council's questions
Vic Oltrogge, 11178 W 55th Place, Arvada, Director of trinity
Ministries of Denver Inc , wl-Jich owns the offi0e building east of the
subject property, also Director of tl-Je chur01-J behind the property,
Trinity Baptist Churcl-J, was sworn in by the Mayor I-.e stated that he
represented both entities, they I-Jad no objections to tl-Je rezoning, but
requested that two additional ronditions be attached to this rezoning
1 TI-Je removal of the inoperable old vehi01es that are on that property
2 Repair and maintenance of the concrete tire blocks that separate the
subject property from their property
Mr Gidley will look into the car matter and the tire blo0ks througl-J
code enforcement
Motion by Mr Davis that Ordinance 862, a request for approval of
rezoning from R-Cl and C-1 to C-l for property located at 6425 W 44th
Avenue, be approved for the following reasons
1 The property is I00ated in the City of Wheat Ridge and all
notification and posting requirements have been met, therefore there is
jurisdiction to hear this case
2 The change of zone will provide zoning unity on the pro~erty,
3 The request will not be contrary to the Comprehensive Plan, and
4 The criteria to justify rezoning su~port approval
With the following condition
1 A six-foot-high screening fence and at least a five-foot-wide
landscaped buffer be provided along the west property line,
seconded by Mr Merkl, carried 8-0
DECISIONS, RESOLUTIONS, AND MOTIONS

Resolution 1252 - amending the City of Wheat Ridge annual
budget for the fiscal year 1991
B Resolution 1253 - appropriating additional sums of money in
excess of amounts budgeted for the City of Wheat Ridge,
Colorado, for fiscal year 1991
Motion by Mr Edwards that Resolution No 1252 amending the City of
Wheat Ridge 1991 Annual Budget, and Resolution No 1253, appropriating
funds for expenditure, be approved as submitted, se0onoed by Mr
Shanley, 0arried 8-0

Item 4
Motion re Architectural Firm to be selected for space needs
study (RFP #91-003)
Motion by Nr Merkl that RECK & ASSOCIATES be awarded a contract to
conduct a space needs study for the City of Wheat Ridge Municipal
Building fJr an awount not to exceed $15,000 00 witl-J all costs to be
charged to Acct No 01-610-750 (Professional Services)
I further move that a budget transfer be made in the amount of
$15,000 00 from Acct No 01-607-795 (General Fund Unallocated) to
01-610-750 (Professional Services)
I further move that RECK & ASSOCIATES be directed to consider in the
following order of priority
1) a major remodeling of the current facility,
2) an expansion of the current facility,
3) a separate building for the Police Department
I further move that the City Administrator appoint a project manager
authorized to direct and administer the contract with Reck & Associates
in conjunction with the Committee established to select the architect,
seconded by Mr Davis, carried 8-0
Motion by Mr Davis that staff look into and have back to City Council
by the first regular meeting in June, a plan for temporary storage to
carry us over until we get back a report from our architect, seconded by
Mr FIasco, carried 8-0

Motion to approve correction Quit Claim Deed for 3511 Allison
Street
Motion by Mr Shanley tl-Jat the Correction Quit Claim Deed dated May 13,
1991, from the City of ~heat Ridge to Douglas Stanley Smith and Marie L
Smitl-J, as joint tenants, be approved, and that the Mayor and City Clerk
be authorized to execute and deliver the Correction Quit Claim Deed to
First American Heritage Title, or its designee, seconded by Mr Davis,
carried 8-0
LOCAL LIQUOR LICENSING AUTHORITY MATTERS
Item 6
Motion to set 1-mile radius for American i"iOtel, Inc
Motion by Mr Davis that the neighborhood be set at a 1-mile radius,
that a survey to establish the needs and desires of the neighborhood be
taken, and that the public hearing on this application be held on June
24, 1991, this application is for the American Motel, Inc , dba "Red
Balloon Saloon", 10101 Frontage Road North, Wheat Ridge, seconded by Mr
FIasco, carried 8-0
Item 7
Motion to set Notice of Hearing and Order to Show Cause for
WI-Jeat Ridge Liquors
Motion by that a Notice of Hearing ana Order to sl-Jow Cause be executed
by the Mayor and City Clerk and be issued to Wheat Ridge Liquors, 5808
W 38tI-J Avenue, Wheat Ridge, for June 24, 1991 at 6 30 pm, based upon
the allegations contained in the attached Offense Report, seconded by
r'lr Eafanti, carried 8-0

CITY ATTORNEY'S MATTERS
John Hayes will be late for next week's Council meeting, he will be at
the Charter Commission meeting
Mr Hayes handed out a memo informing Council that one of tl-Je Friday
court sessions will be eliminated, wl-Jich will translate into a modest
reduction to the City for prosecuting attorney's fee
He gave update on CML meeting tl-Jat he attended regarding zip code
information
Motion by Mr Merkl to I-Jold an Executive Session under Item 5 7(b)(1)(A)
after the agenda and adjourn immediately thereafter, seconded by Mr
FIasco, carried 8-0
ELECTED OFFICIALS' MATTERS
Ron Selstad moved that the City pass a Resolution in support of I-Javing
five County Commissioners After discussion, he added to the motion
that both sides of the issue come in on May 20, 1991 at 6 30 p m to
present their side and that this be televised and that American Cable be
notified, seconded by Mrs Brougham, carried 8-0
Don Eafanti asked for consensus to put on tl-Je May 20 Agenda the 41st
Avenue Safety project, seconded by Mr FIasco, carried 8-0
Kent Lavis asked that the City pursue putting some containers with
greenery on West 38th Avenue
Tony FIasco asked Council consensus that we get in our application
immediately for some zip code changes, seconded by Mrs Brougham,
carried 8-0
He asked that Councilmembers have their nominations for the swimming
pool committee in to the Mayor by 8 30 the following morning
Larry Merkl moved that we I-Jave a Special Meeting of the City Council on
Thursday, May 23, 1991 at 5 30 p m at the Municipal Building for the
purpose of awarding the bid for street construction, West 38th Avenue,
Pierce to Sheridan There will be no other official business conducted
at that meeting, seconded by Mr Selstad, carried 8-0
Motion by Mr Merkl that Mr FIasco be allowed to attend the National
League of Cities steering committee meeting in Cleveland in June,
seconded by Mr Davis, carried 8-0 (Mr FIasco was appointed to the
human development steering committee)

Bill Shanley moved that Council Bill 83 be brought off the table and be
put on the May 20, 1991 Agenda for reconsideration, seconded by hr
Merkl, carried 7-1 with Mr FIasco voting No
EXECUTIVE SESSION WAS HELD
Meeting adjourned at 9 20 P m
