All notification and posting requirements have been met; therefore, there is jurisdiction to make a decision.
I. REQUEST
The contractor who is constructing a detached garage at 4240 Newland Street is requesting approval of
a 248 - square foot variance (25 %) from the 1,000 foot maximum building size for major accessory
buildings on behalf of the property owner. The variance will allow for the construction of a 768 -
square foot detached garage (Exhibit 1, Submittals) on a lot that already has 576- square feet of
accessary structure. The proposed construction would alleviate a lack of covered parking on the
property.
Section 26 -115.0 (Variances and Waivers) of the Wheat Ridge City Code empowers the Director of
Community Development to decide upon applications for administrative variances from the strict
application of the zoning district development standards that are not in excess of fifty (50) percent of
the standard.
II. CASE ANALYSIS
The subject property, 4240 Newland Street, is located at a bend in Newland Street extending south
from 42 " Avenue (Exhibit 2, Site Location). The property is zoned Residential -Two (R -2) and is part
of the Clarmor Homes Subdivision. The property is embedded in a low density single - family
neighborhood. All surrounding properties are zoned R -2 (Exhibit 3, Zoning).

Existing on the property is a 480 -
square foot frame building that was a
detached garage for the property. In
April 2002 the building was converted
from a garage to a non - habitable art
studio (Exhibit 4, Converted Garage).
The property also contains a 96- square
foot storage shed.
According to the Jefferson County
Assessor the property at 4240 Newland
Street is one parcel with an area of
16,258 square feet. The property is
7,258 square feet larger than the R -2
minimum single family lot area
standard. The home is positioned on
the northern section of the property
within the required setback from along
the northern property line. The lot is
an irregular trapezoidal shape, with a
large area on the southern portion of
the lot that is undeveloped (Exhibit 5,
Development Envelope).
The property contains a 1,160 square foot ranch style home. The home was built in 1950 and was
purchased by the current property owner in March 2014. Access to the property is from a 12 -foot wide

paved driveway at the bend in Newland Street 1 " AlM A branch of the driveway is gravel ,( 0
and the current property owner uses this section of the driveway to park their car outside of the home.
This existing drive would provide access to the detached garage. The proposed detached garage would
mitigate covered parking issues for the home,
10-DaY Posting Period
During the I O-day posting period, the property owner at 4210 Newland Street came in to inquire about
the variance request and discuss any impact the garage would have on his property. After discussion
with staff, the property owner had no objections to the variance.
MOMMADINUM W
In order to approve an administrative variance, the Community Development Director must determine
that the majority of the "criteria for review" listed in Section 26-115.C.4 of the City Code have been
met. Staff provides the following review and analysis of the variance criteria.
1. The property in question would not yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by regulation for the district in
which it is located.
2. The variance would not alter the essential character of the locality.
The character of the neighborhood is a homogeneous mix of single-family homes on lots that
meet the R-2 standard. Many properties in the neighborhood have accessory structures 04

Staff finds this criterion has not been inct.
3. The applicant is proposing a substantial investment in the property with this application,
which would not be possible without the variance.

4. The particular physical surrounding, shape or topographical condition of the specific
property involved results in a particular and unique hardship (upon the owner) as
distinguished from a mere inconvenience if the strict letter of the regulations were carried
out.
The lot is irregularly shaped, and there are a number of mature trees in the rear yard. Though
these site restrictions exist, the lot is relatively flat, and there is significant room on the lot to
construct additional buildings. Also, a 520 square foot garage would be built without a
variance.
Staff finds this criterion has not been met.
The alleged difficulty or hardship has not been created by any person presently having an
interest in the property.
The alleged hardship was not created by anyone having interest in the property. The
conversion of the existing garage was done in 2002, before the applicant owned or had interest
in the property.

7. The unusual circumstances or conditions necessitating the variance request are present in
the neighborhood and are not unique to the property.
The neighborhood has a mix of detached garages and carports. The property is consistent with
other parcels in size and scale and is not unique. The extensive lot coverage for existing and
proposed accessory buildings is inherent in the property and not the neighborhood as a whole.
Staff finds that this criterion has not been met.

8. Granting of the variance would result in a reasonable accommodation of a person with
disabilities.
Single- and two- family homes and their accessory buildings are not required to meet building
codes pertaining to the accommodation of persons with disabilities.
Staff finds this criterion is not applicable.
9. The application is in substantial compliance with the applicable standards set forth in the
Architectural and Site Design Manual
The Architectural and Site Design Manual does not apply to single and two family dwelling
units.
Staff finds this criterion is not qWlicable.
IV. STAFF CONCLUSIONS AND RECOMMENDATIONS
Having found the application in compliance with a majority of the review criteria, staff recommends
DENIAL of a 248-square foot variance (25%) from the 1,000 foot maximum building coverage for
major accessory buildings for the construction of a detached garage. Staff has found there are not
unique circumstances attributed to this request that would warrant approval of the variance. Therefore,
staff recommends denial for the following reasons:

Mr. Morgan,
Kathleen and I would like to let you know our intentions for the work we are
doing on our garage on the rear of our property. We would like to put in an art
studio where our garage now exists to include plumbing for gas, water and sewer.
The gas will be used for a furnace we will use to heat the area. The water and
sewer will be utilized in the future when we get the money to continue our
project. We have enclosed a drawing of the proposed studio. We were informed
by your office that we are zoned R -2, but are not at this time thinking about this as
a residence, if this ever comes up in the future we will let you know. Thank you
for your help and advice on this project, as always this is becoming quite a
learning experience for both of us.
