Our director is reviewing the staff report associated with the SUP and I should be able to review the building permit next week. Please provide one full size set of the site plan, printed on bond paper. Please also have it signed by MVG and your surveyor before delivering it to our office. We don't record site plans but we keep them on file. Once I get it and have it signed, I'll send you a digital copy. • In regards to CDOT, the Region 1 Director has not yet returned phone calls or emails from out Public Works Director. The Community Development Director can impose conditions or stipulations upon the approval, which may address physical design, business operations, and /or maintenance considerations to ensure compliance with the criteria for review. The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity; 2. Whether the SUP is personal to the applicant and may or may not be inherited; and/or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless renewed subject to all of the requirements of this section. II. CASE ANALYSIS The property is located at 3795 KI ling Street (Lot 3 of MVG Marketplace Subdivision) which is a corner lot with frontage on W. 38` Avenue and Kipling Street (Exhibit 2, Aerial). The site is 0.56 acres in size and is zoned Commercial -One (C -1), a zone district which provide for a wide range of commercial land uses including office, general business, and retail sales and service establishments. Land uses in the C -1 zone district are often supported by the community and/or by the entire region. Existing Conditions The surrounding properties include a variety of zoning designations and land uses (Exhibit 3, Zoning). The subject site is part of a larger 6 -acre redevelopment project, and immediately to the south and west are other properties owned by the applicant. To the south the applicant is developing a Sprouts Farmers Market (per Case No. WSP- 14 -01), and to the west is a vacant lot that is likely to be developed with a quick serve restaurant. Case No. SUP -14 -05 / Starbuc s 2 Across W. 38 Avenue to the north is dental clinic zoned PCD, vacant land zoned R-1, and a fueling station zoned C-1. Across Kipling to the east are the Applewood Caf6 restaurant and Discovery Park zoned C -1 and PCD, respectively. The most recent land uses on the subject site included a variety of businesses in two multi-tenant buildings. A Cost Cutters and Starbucks have been located in a 2,400-square foot building at the hard comer. This building is in the process of being vacated and demolished. A second building to the south was demolished earlier this fall Proposed Development The applicant is proposing to redevelop the site with a single tenant building: a 2,100- square foot Starbucks with drive through facility (A The building is rectangular in shape and is located in the northeast comer of the site. The store will include indoor and outdoor seating. The drive through can accommodate 10 vehicles and the parking lot can accommodate 20 vehicles. Six bicycles parking spaces are also provided. The site will not have direct access to t SK 38"' Avenue or Kipling but will be served by a major interior drive to the south. The drive rough wraps the south and west sides of the building, and is proposed to be screened from Kipling with a variety of evergreen shrubs and screened from W. 38 'h Avenue with a low brick wall. Pedestrian accommodations include two primary entrances into the building on the north and west facades. An outdoor patio extends along the west and south sides of the building and is buffered from the drive through by a landscaped area. Sidewalks are located along three sides of the property and extend into the site from the north and south. The building will be one-story in height with four-sided architecture including earth toned brick, hard coat stucco, and metal. An analysis of the site and building design is provided below in relation to SUP criterion #8. HL SPECIAL USE PERMIT CRITERIA I Staff uses the following criteria from Section 26-114.1 of the City Code to evaluate special use pen-nit requests. The Community Development Director shall base its decision in consideration of the extent to which the following criteria have been met. The proposed use and potential impacts are relatively compatible with surrounding land uses. The site has been designed to accommodate both motorists and pedestrians. The special use will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics. Staff finds this criterion has been met. 3. The special use will not create adverse impacts greater than allowed under existing zoning for the property. Staff has not identified any adverse impacts greater than what are allowed under the existing zoning. The drive through has been designed to provide safe access and minimize potential impacts. Staff finds this criterion has been met. 4. The special use will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. 5. The property is appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. The site design complies with the Commercial -One (C- 1) development standards and the design of the site is compatible with the surrounding areas. 'Me architecture is distinct from other buildings on the property, but the upgraded building and landscaping design will result in a cohesive development. Staff finds this criterion has been met. Parks, schools, and other public facilities will not be negatively impacted by the proposed use. The existing network of streets has the ability to handle the capacity of traffic, A traffic study for the entire development has been reviewed and approved by the Public Works Department. Utility agencies have expressed that they can serve the property, and any improvements required by the utility companies will be completed as part of the building permit process. Staff finds this criterion has been met. t 7. There is a history of comp p liance by the aplicant and/or proper . owner with Code requirements and prior conditions, if any, regarding the subject property. In recent years, the site has been the subject of several code enforcement cases related to property maintenance, but these violations occurred under previous ownership. The applicant has expressed a commitment to comply with the municipal code and to improve the site. General Comments Several sheets in the plan set show signage including wall signs, drive through signs, menu boards and an order box. Please note that several of these signs do not comply with the City's sign code, for example wall signs are not permitted on the west facade, the order box appears too tall and large, and the "drive thru" sign on the north facade may exceed the size limitations for this wall. When the Sprouts site plan was reviewed, a Master Sign Plan was recommended. Again, some of these signage issues may be addressed through a Master Sign Plan. For the purpose of this site plan, the signs either need to comply with Article VII of the zoning code or should be removed from sheet 7 (building elevations). We understand your comment and a Master Sign Plan is currently being prepared for submittal to the City in order to address the deviations from code. Will a neighborhood meeting need to be held prior to application submittal? Yes, the proposed drive-through will require a Special Use Peirnit (SUP) which includes the requirement for a neighborhood meeting. Planning Comments: The following items were discussed based on the applicant's proposal: Based on the site plans provided, it is unclear where the new property lines are located after right-of- way dedications. It was indicated that the property lines along 38"' Avenue and Kipling are located behind the back of sidewalk. All final submittals need to represent accurate property lines in order to confirm that build-to requirements are being met. Setbacks and Development Standards Section 26-218 establishes development standards for the C- I zone district. The following is a summary of those requirements: Paving, Parking and Circulation In the City of Wheat Ridge, any area subject to wheeled traffic for access or parking is required to be hard surfaced with concrete or asphalt. This means that all access drives and parking areas will need to be paved. 9 * Build-to requirement as spec4ied ?y the ASDIV; see beloiv. Minimum size standards for parking spaces and drive aisles are outlined in section 26-50I .E. I I of the zoning code, Handicapped parking spaces will need to be provided based on the total number of required parking spaces (see Sec. 2h -5 1.E.9). The property will be required to have bicycle parking at a rate specified by Section 26-501 EA. It appears that the proposed site design is compliant with the amount of off-street parking required however; the applicant is encouraged to work- with Staff to determine: final requirements. It was indicated that there may be room to shift the entire building to the north to accommodate improved radius geometry into the drive-through lane. The overflow stacking could occur in the drive aisle west of the building instead of the major interior drive. Staff expressed concern with a potential conflict between the ADA access from W. 38"' Avenue and vehicles exiting the drive-through lane. Mechanical equipment must be screened from public streets and internal drives. Screening can include parapets, wing walls, or other building features. El The on-site landscaping for Lot 3 is subject to the requirements outlined in section 26-502 of the zoning code which will include the following: The location, dimensions, and square footage of all landscaped areas should be provided on the landscape plan in addition to species and size of all plant material. • The building design will need to comply with the transparency standards for retail development. The primary facade will need to have 60% transparency in the wall area between 3 and 8 feet in height. The secondary faVade should be 30% transparent, For facades visible from West 38 Avenue and Kipling Street, a level of finished architectural quality shall be designed to the human scale. Each facade that faces a street or public spaces will need to have at least one variation in plane depth, a minimum of one foot for 50 linear feet of the length of the fagade. • Please note that a build-to requirement for the Contemporary Overlay will apply. It was indicated that proposed architectural materials will be consistent with those used on the Sprouts building and will include brick, stucco and metal canopies. Material requirements in the ASDM allow only 25% of a facade to be comprised of EIFS. Please refer to the ASDM for all applicable requirements. The ASDM can be downloaded from the City's website: nients W Given the current configuration of the site, wall signs would be allowed on the north and east facades as they are appurtenant to public streets (W. 38"' Avenue and Kipling, respectively). A wall sign would also be allowed on the south faqade because of the major interior drive running between the subject site and the property to the south. The applicant stressed the importance of a wall sign on the west facade which would not be allowed under current conditions. Staff suggested the developer submit a Master Sign Plan application for the entire Kipling Ridge development. This could address shared off-premises signs and additional wall signs. This had previously been discussed with MVG because the Sprouts Farmers Market was seeking signage on the 38 Avenue frontage. No master sign plan has been submitted to date. Public Works Comments: Public Works was present and the following items were discussed based on the applicant's proposal: Drainage A drainage compliance letter will be required to ensure that gi and development of the site will be in compliance with the master drainage report for the Kipling Ridge development. For more information, please refer to the Public Works comments that were distributed at the meeting. Special Use Permit (SUP) and Site Plan Review Process: This request will require a Special Use Pennit and Site Plan review, and the first step in the process was the pre-application meeting held on July 27, 2014. 0 For a Special Use Permit, the next step required by the Community Development Department will be to conduct a neighborhood meeting. This meeting is scheduled for August 6, 2014. After the neighborhood meeting is held, the applicant may submit their application for the Special Use Permit. This application will need to include a complete Site Plan including landscape plans, building elevations, and any required civil documents. The application should also include a written narrative that addresses the SUP criteria, If it is not already clear from the site plan, the narrative may also include an explanation of how the ASDM design requirements are being met. Upon the submittal, the Special Use Permit application will be reviewed by the case manager and sent to outside agencies for review. This referral period is 15 days long and allows time for agencies to comment on the application. Modifications to the application may be required as a result of these comments. This cycle of review may occur several times until all comments are addressed. If the application is reviewed administratively and denied, the applicant can be appeal the decision to the City Council. Building Permit Approval of an SUP and site plan application does not mean that a building permit has been issued. Once site plan approval is attained, the applicant may submit a building permit application to the Building Division.
