Residential Roofing Permit Application
This application is exclusively for new permits for residential roofs and for licensed
contractors only. This type of permit is ONLY being processed online --do not come
to City Hall to submit an application in person. Permits are processed and issued in
the order they are received and due to the volume of requests, time to process
varies and is subject to change. YOU WILL BE CONTACTED WHEN YOUR
PERMIT IS READY FOR PICK-UP AND WILL BE GIVEN A SPECIFIC DATE
AND TIME WINDOW TO COMPLETE THE TRANSACTION. You will be notified if
your contractor's license or insurance has expired, and you may update those
documents at the time you are issued your permit.
For all other requests:
Homeowners wishing to obtain a roofing permit must apply for the permit in person
at City Hall. Revisions to existing permits (for example, to add redecking) must be
completed in person at City Hall. All other non -roofing permits must be completed in
person at City Hall. The Building Division will be open from 7:30-10:30 a.m.,
Monday through Friday to process these types of requests.

INSURANCE ALLOWANCE AGREEMENT
Customer authorizes Carrier to pay ENERGY STAR EXTERIORS directly for all agreed upon work. �` (Initials)
Building Owner(s) (Customer) hereby retains Energy Star Exteriors (ENERGY STAR EXTERIORS) to repair/replace the roof and/or gutters upon the above stated property, contingent upon
ENERGY STAR EXTERIORS' receipt of Customer's insurance company (Carrier) approval and payment of said work. Customer understands and agrees that Energy Star Exteriors will review
said work proposal with Carrier's representative. Work will commence only after ENERGY STAR EXTERIORS and carrier agree upon the extent of damages and the cost of repairs and
replacements. This agreement is for full scope of insurance proceeds not excluding deductible,
depreciation, overhead, and profit, therefore CUSTOMER'S OUT OF POCKET EXPENSE WILL BE CUSTOMER'S INSURANCE POLICY DEDUCTIBLE AND ANY NON RECOVERABLE DEPRECIATION for
work agreed upon between Carrier and ENERGY STAR EXTERIORS. AS PER CO LAW 51338, ENERGY STAR EXTERIORS CANNOT PAY WAIVE OR REBATE THE DEDUCTIBLE IN PART OR IN WHOLE.
Customer agrees to provide all necessary documentation for the claim, and any documentation necessary to facilitate payment from the Carrier or Mortgage Company. Carrier only pays for
installed materials. All surplus material is property of ENERGY STAR EXTERIORS. Replacement of deteriorated siding, decking, fascia board, ventilators, flashing, or other materials is not
included and will be charged as extra unless otherwise stated above.
Customer may be required to supply all electricity necessary for the work. Lien waiver submitted upon final payments. ENERGY STAR EXTERIORS is not responsible for interior personal items
. All work is to be completed in a workmanlike manner according to standard practices. The Customer hereby acknowledges that ENERGY STAR EXTERIORS may be subject to delays due to
inclement weather or material shortages, which are each beyond the control of ENERGY STAR EXTERIORS and therefore accepts any delays that may occur by one or all of these

This contract and any agreement made pursuant thereto is between Energy Star Exteriors hereinafter referred to as the "Co." or "Company" and
the customer(s) named herein on the reverse side will be subject to all appropriate laws, regulations, and ordinances of the states of CO and the
terms and conditions:
1. UNDER THE RIGHT TO RESCIND, YOU HAVE UNTIL MIDNIGHT OF THE THIRD BUSINESS DAY TO CANCEL THE WORK TO BE PERFORMED, DAY ONE
BEGINS AFTER THIS CONTRACT IS SIGNED. If this contract is signed under insurance
proceeds, the homeowner has the right to cancel this contract within 72 hours after receiving notice from their insurer that the claim is denied in
part or in whole. Any monies paid by the homeowner will be refunded in full within 72 hours. 2.SHOULD DEFAULT BE MADE IN PAYMENT OF THIS
CONTRACT, CHARGES SHALL BE ADDED FROM THE DATE THEREOF AT A RATE OF ONE AND ONE HALF (11/2) PERCENT PER MONTH (18% PER
ANNUM) WITH A MINIMUM CHARGE OF $2.00 PER MONTH, AND IF PLACED IN THE HAND OF AN ATTORNEY FOR COLLECTION, ALL ATTORNEY'S
FEES AND LEGAL FILING FEES SHALL BE PAID BY CUSTOMER ACCEPTING SAID CONTRACT.
3.The Company is not responsible for unseen site conditions.
4.The Company shall have no responsibility for damages from rain, fire, tornado windstorm, or other perils, as is normally contemplated to be
covered by HOME OWNERS INSURANCE or BUSINESS RISK INSURANCE, or unless a specified written agreement be made therefore prior to
commencement of the work. S.The quotation or the face hereof does not include expenses or charges for bond insurance premiums or costs
beyond normal insu rance coverage, and any such additional expenses, premiums or costs shall be added to the amount of the contract.
6.Replacement of deteriorated decking, fascia board, roof jacks, ventilators, flashing or other materials unless otherwise STATED IN THIS
CONTRACT, are NOT INCLUDED and will be charged as an extra on a time and material basis.
7.The Company shall not be liable for failure of performances due to labor controversies, strikes, fires, weather, inability to obtain materials from
usual sources, or any other circumstances beyond the control of the company, whether of a similar or dissimilar nature.
8.If roofing and sheet metal work is involved, it is understood and agreed to that our standard roof guarantee, a copy of which is available in our
office, shall be acceptable and that all terms and provisions therein shall prevail, unless specifically agreed to in writing prior to the commencement
of the work.
9.The Company is not responsible for any damage on or below the roof due to leaks by excessive wind driven rain, ice, or hail during the period of
the warranty.
EXCESSIVE WIND IS 50 OR GREATER M.P.H. THE WARRANTY IS NONTRANSFERABLE.
10.If material has to be reordered or restocked because of a cancellation by the customer there will be a RESTOCKING FEE equal to fifteen percent
(15%) of the contract price.
11.This contract or warranty shall not be assigned except by or with the written permission of the company.
12.IF THIS CONTRACT IS CANCELED BY THE CUSTOMER, customer shall pay the company fifteen percent (15%) of the contract price as liquidated
damages, not as a penalty, and the company agrees to accept such as a reasonable and just compensation for said cancellation.
13.THIS CONTRACT CANNOT BE CANCELED ONCE WORK IS COMMENCED EXCEPT BY MUTUAL WRITTEN AGREEMENT OF THE PARTIES.
14.PAYMENTS ARE TO BE MADE PAYABLE TO ENERGY STAR EXTERIORS: 1/2 UPON EXECUTION of CONTRACT or COMMENCEMENT OF WORK AND

15.If any provision of this contract should be held to be invalid or unenforceable the validity and enforceability of the remaining provisions of the
contract shall not be affected thereby.
16.ANY REPRESENTATIONS, STATEMENTS, OR OTHER COMMUNICATIONS NOT WRITTEN ON THIS CONTRACT ARE AGREED TO BE IMMATERIAL, and
not relied on by either party, and do not survived the execution of this contract.
17.The maximum liability for the Co. shall be the original cost of labor and materials for the repair which customer agrees shall be a liquidated sum,
under any event of default of Co. herein.
18.During the duration of the work the customer's homeowner's insurance will be responsible for any interior damage as long as the Company has
taken appropriate action to protect the roof during the repair of the roof.
19.If there are any solar panels on the roof, the Co. will not be responsible for damage during the repair, so homeowner agrees to have solar panel
company take the appropriate action to protect it if necessary.
21.The Co. is not responsible for construction problems of your home. If pointed out and notified to our Co., we will try to assist you on correcting
them on a time and material basis.

Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) requires an approved inspection

TERMS AND CONDITIONS
1. This Contract is subject to final approval by K&H Roofing & Restoration ("K&H") and, in conjunction with any additional change orders
(collectively referred to as the "Contract"), represents the entire agreement and understanding of all parties. There are no verbal
representations that have not been set forth in writing on this Contract. and therefore no otherterms will be recognized.
2. Any change to the terms of the Contract shall require a written document signed by all parties.
3. Any supplemental payment from the Owner's insurance company is due to K&H, including Contractor's Management Fees, Overhead and
Profit.
4. K&H will perform all work in a professional and workmanlike manner according to current local building codes and specifications.
5. K&H shall not be liable for any structural movement, settling, damage to drywall, damage to driveway, or any damage to personal
property which occurred as a result of construction.
& No warranties cover damage caused by natural disasters (including but not limited to tornados, lightning, gale force winds, hailstorms)
impact from foreign objects, damages due to failure of the foundation of the building from any reason such as settling of the soil or
failure of the walls or any other existing structure outside the scope of K&H's work.
7, K&H is not responsible for providing any materials or the performance of any work other than what is described in the Contract.
8. Buyers will .provide, without charge, all electricity needed for the work under this Contract. Buyer agrees that materials and product may
be delivered by K&H and its suppliers to Buyer's premises. Buyer shall provide to K&H, its suppliers and subcontractors timely access to
job site. All surplus materials shall remain the property of K&H.
9. Buyer agrees that Buyer is responsible for removing all personal property from the area where the work will be performed by K&H
pursuant this this Contract. Any damage to personal property of Buyer as a result of not moving the property will not be the responsibility
of K&H. Buyer acknowledges having been advised that there is a possibility of collateral damage to items hanging from ceiling and walls.
Damage to lawn, flowers, trees, gardens, landscaping, shrubs, plants, cable TV wiring or cables, electrical wiring, piping and plumbing.
K&H shall not be liable for any incidental, consequential, or exemplary damages of any nature, however caused, whether by its own
negligence or otherwise. K&H maximum liability for any reason, including its own negligence or the negligence of its subcontractors, is
limited to the amount of this Contract.
10. If this Contract is cancelled by the Buyer after the Right to Cancel but before K&H has begun work on the Contract, Buyer and K&H agree
that it will be difficult to ascertain actual damages incurred by K&H. Buyer and K&H agree to liquidate these damages and Buyer shall pay
K&H an amount equivalent to thirty percent (30%) for approved Replacement Cost Value, and K&H agrees to accept compensation for
said cancellation and consequential loss of profits.
11. Each trade represented will be payable in full at completion of said trade.
12. All payments shall be made to K&H Roofing & Restoration. 1.5% monthly will be added in daily increments to the balance of any and all
unpaid portion of Contract, commencing upon completion date or receipt of the remaining insurance proceeds, whichever is earlier.
S3. Before any warranty, written or otherwise, is to be considered valid, the Contract must be paid in full.
14. In the event Buyer has any indication that the work or material provided in accordance with this Contract may be faulty, Buyer must
provide to K&H or its authorized representative written notice containing particulars sufficient to identify the potential problem as soon
as practicable, and in any event no later than thirty (30) days from the date of discovery. Any claim by the parties that arises out of or in
connection with this Contract shall be barred unless such notice is provided.
15. If K&H seeks to enforce its rights under this Contract (whether in contract, tort, or both) or seeks a declaration of any rights or obligations
under this Contract, it shall be entitled to its reasonable attorney fees, and costs and expenses incurred.
16. This Contract shall be interpreted in accordance with the laws of the State of Colorado without regard to any conflicts of law. All claims,
disputes, and lawsuits arising out of or in connection with this Contract shall be resolved or adjudicated in the county of Jefferson in the
State of Colorado.
17. The invalidity of unenforceability of any term or provision or any clause of this Contract shall in no way impair or affect the validity or
enforceability of any other provision of this Agreement, which shall remain in full force and effect.

required. Ice dam membrane is required from eave edge to 2' inside exterior
walls. Board sheathing with any gap greater than 1/2" requires panel sheathing
overlay on entire roof. Sheathing inspection is required prior to covering.
Contractor shall provide ladder for inspections. Scheduled inspections that
cannot be performed due to inclement weather must be cancelled prior to 6:30
a.m. on the day of inspection or a re- inspection fee will be assessed.

1. This permit was issued in accordance with the provisions set forth in your application and is subject to the laws of the
State of Colorado and to the Zoning Regulations and Building Codes of Wheat Ridge, Colorado or any other applicable
ordinances of the City.
2. This permit shall expire 180 days from the issue date. Requests for an extension must be received prior to expiration
date. An extension may be granted at the discretion of the Building Official.
3. If this permit expires, a new permit may be acquired for a fee of one -half the amount normally required, provided no
changes have been or will be made in the original plans and specifications and any suspension or abandonment has not
exceeded one (1) year. If changes have been or if suspension or abandonment exceeds one (1) year, full fees shall
be paid for a new permit.
4. No work of any manner shall be done that will change the natural flow of water causing a drainage problem.
5. Contractor shall notify the Building Inspector twenty -four (24) hours in advance for all inspections and shall receive
written approval on inspection card before proceeding with successive phases of the job.
6. The issuance of a permit or the approval of drawings and specifications shall not be construed to be a permit for, nor
an approval of, any violation of the provisions of the building codes or any other ordinance, law, rule or regulation.
