I. REQUEST Case No. SUP -10 -08 is an application by Clear Wireless requesting approval of an administrative Special Use Permit to allow collocation of three 42" panel antennas and three microwave dishes (one 24" and two 36 ") on an existing nonconforming telecommunications tower located at 10019 W. 26 °i Avenue in the C -1 zone district. The freestanding monopole tower, which is 155 feet tall, is over the maximum height allowed for the zone district and is thus a legal nonconforming CMRS tower. According to Section 26 -615.K of the zoning code, collocation on a legal nonconforming tower requires a special use permit. Pursuant to Ordinance No. 1291, the Community Development Director has the ability to decide upon applications for administrative special use approval, without a public hearing, provided the following conditions have been met: 1. A completed application package has been submitted and fee paid. 2. The Community Development Department has notified adjacent property owners by letter and the site has been posted for at least ten (10) days. 3. No written objections have been received in such ten day period. 4. The Community Development Director concludes that the criteria for approval, as set forth below, are substantially complied with and support the request. The Community Development Director can impose conditions or stipulations upon the approval, which may include physical design, operational, and maintenance considerations to ensure compliance with the criteria for review. The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity; 2. Whether the SUP is personal to the applicant and may or may not be inherited; and /or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless renewed subject to all of the requirements of this section. II. CASE ANALYSIS The applicant Clear Wireless is requesting the Special Use Permit to allow a collocation on an existing nonconforming telecommunications tower at 10019 W. 26 °i Avenue (Exhibit 1, Letter of Request). The property is zoned C -1, a commercial district established to provide for areas with a wide range of commercial land uses which include office, general business, and retail sales and service establishments. The tower is over the maximum height of 50 feet allowed by the C -1 zone district and is nonconforming. According to Section 26 -615.K of the zoning code, collocation on a legal nonconforming tower requires a special use permit. Case No. SUP -10 -08 /Clear Wireless 2 The properties immediately to the north of the site are zoned commercially and adjacent to Kipling Street, a major commercial corridor through the City of Wheat Ridge. The property northwest of the site is zoned R -3 and the property immediately west, across Paramount Parkway, is zoned R -2 (Exhibit 2, ZoningLlap). Properties to the south are located in the City of Lakewood. The property contains a single -story commercial shopping center with multiple tenants. The property is 71,900 SF (1.65 acres) in size and the building, built in 1959, is approximately 30,000 SF. The building is surrounded by paved parking and circulation areas on the south, north, east and west. There are no landscape improvements on site. The freestanding telecommunications tower was constructed in 1983 subject to a Public Utilities Use Permit approved by the Board of Adjustment. The tower is 155 feet tall and is located behind the shopping center structure (Exhibit 3, Site Plan). There is an at -grade utility area, enclosed by a chainlink fence, that contains the equipment associated with the tower, also located behind the building near the base of the tower (Exhibit 4, Site Photos). The applicant is requesting permission to add three 42" panel antennas and 3 microwave dishes at a height of 120 feet on the existing tower (Exhibit 5, Photo Rendering of Proposal). The purpose of the antennas and microwave dishes is to provide new high -speed wireless internet service for the area. The proposal also includes a new 5 foot by 5 foot steel platform that would be installed within the existing fenced -in utility area to accommodate a new equipment cabinet that is 2 feet by 3 feet large. A Special Use Permit application to collocate on the tower was submitted in 2001 (SUP- 01 -02) but was withdrawn prior to approval or denial. III. SPECIAL USE PERMIT CRITERIA Staff has the following criteria to evaluate special use permit requests and shall determine that the majority of the "criteria for review" listed in Section 26 -114.D of the City Code have been met. The applicant has provided their analysis of the applications compliance with the Special Use criteria (Exhibit 6). Staff provides the following review and analysis of the special use criteria: 1. The special use will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood. The proposed special use will not affect the health or welfare of any person working or residing in the area. The proposed use also will not negatively affect the safety and convenience of people living and working in the area. The telecommunications tower is existing and the additional antennas, microwave dishes, and utility cabinet should not have a negative impact on the area. Staff finds this criterion has been met. Case No. SUP -10 -08 /Clear Wireless 2. The special use will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics. The existing tower, which is 155 tall, does create visual blight, especially for the residential neighborhood to the northwest of the site. However, the proposed collocation will not increase the height of the tower. It would have a minimal visual impact, as depicted in the photo rendering attached in Exhibit 5. The proposed cabinet at the base of the tower is located behind the building and at the center of a very large lot. It would not be visible from any public right -of -way or adjacent properties, especially since it is an enclosed cabinet. Thus, although the existing tower may have a negative impact on the area, the physical characteristics of the proposed antennas, dishes, and utility cabinet should not contribute to the existing blight. Staff finds this criterion has been met. 3. The special use will not create adverse impacts greater than allowed under existing zoning for the property. Staff has not identified any adverse impacts greater than are allowed under existing zoning, especially because there is no proposed new development or land uses. There should be no impact to the light, air and water to the adjacent properties nor any additional traffic generated by the proposal. Staff finds this criterion has been met. 4. The special use will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. The use will not create undue traffic congestion or hazards. There will be little to no increased traffic since the only vehicular traffic associated with the proposal is for occasional maintenance. Staff finds this criterion has been met. 5. The property is appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. The property is already developed. No changes to the site layout, parking, or the building are proposed. As a result, all setbacks from surrounding structures will remain the same and the height will remain unchanged. Should changes to the site or building be proposed, improvements to landscaping, parking, and stormwater quality would likely be required. This application, however, only entails an addition to an existing telecommunications tower. Staff finds this criterion has been met. Case No. SUP -10 -08 /Clear Wireless 4 6. The special use will not overburden the capacities of the existing streets, utilities, parks, schools, and other public facilities and services. Parks, schools and other public facilities will not be negatively impacted since the proposed use will not have an effect on the number of residents, workers, or cars in the area. Any improvements required by utilities must be completed during the building permit process, if applicable. Staff finds this criterion has been met. 7. There is a history of compliance by the applicant and /or property owner with Code requirements and prior conditions, if any, regarding the subject property. Neither the applicant nor the property in question has a history of code violations related to the telecommunications tower. Staff finds this criterion has been met. 8. The application is in substantial compliance with the applicable standards set forth in the Architectural and Site Design Maruual. The Architectural anal Site Design Manual applies to all new construction except single and two family residential structures and those existing structures undergoing major additions. No new buildings or additions are being proposed for this site. Staff finds this criterion is not applicable. IV. NEIGHBORHOOD MEETING Prior to submittal of an application for a special use, the applicant is required to hold a neighborhood meeting in accordance with the requirements set in City Code, Section 26 -109A. A meeting for neighborhood input was held on July 7, 2010 in accordance with Section 26- 109A. Other than the applicant and staff member, there were no residents of the area present. No formal objections were filed during the 10 -day noticing /comment period. V. AGENCY REFERRAL All affected service agencies were contacted regarding the ability to serve the properly. All agencies to which the referral was sent either did not respond or have indicated they have no issues with the proposed use and that they have the ability to serve the property. Existing Conditions: The property is zoned Commercial One (C -1), a commercial district established to provide for areas with a wide range of commercial land uses which include office, general business, and retail sales and service establishments. The site, which is approximately 71,900 SF in area, contains a commercial shopping complex, with the existing CMRS tower located behind the shopping center building. Planning comments: The existing tower, which is 155 feet tall, exceeds the height restrictions in the current code and is considered a nonconforming tower. Collocation on an existing nonconforming tower is allowed only after a Special Use Permit (SUP) is obtained. The required SUP process is outlined below. As part of the SUP application, the applicant should include a proposed site plan, elevations, and a photo - visualization of what the tower will look like after the proposed collocation. The Community Development Department will supply the applicant with a list of the all property owners within the 600 foot radius. A sample of this letter is attached and can be used as a template. Please make changes to the template to fit your specific project. The letter will need to be approved by a planner before it is mailed. The meeting should be coordinated with the assigned staff member. A fee of $100 is required for staff to be present at this meeting. Meetings can be held at city hall or any location the applicant desires. All costs associated with meeting, its location, and mailings will be paid by the applicant. The meeting will be led by the applicant and should inform those who are in attendance what is being proposed. After the neighborhood meeting is held, the applicant may submit their application for the request. If a complaint is received by the Community Development Department, then the request for the Special Use Permit will be decided upon at a public hearing before the City Council. If the application is reviewed administratively and denied, the applicant can be appeal the decision to the City Council. If a hearing before City Council is required for any reason, staff will present evidence to recommend the approval, approval with conditions, or denial of the Special Use Permit. The public will also be allowed to present evidence or give testimony in support or in opposition of the project. The City Council will approve, approve with conditions, or deny the project based on the testimonies given by staff, applicant and the public.
