WHEREAS, the City Council of the City of Wheat Ridge, Colorado desires to amend the number of members appointed to the Wheat Ridge Urban Renewal Authority. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. Section 25 -24 of the Wheat Ridge Code of Laws is hereby repealed and reenacted to read as follows: Sec. 25 -24. Appointment of members; number. The authority shall consist of seven (7) members, one (1) of such members being from each of the existing, or hereafter altered, city council districts, and three (3) members to serve at large. The at large members may include one (1) city council member. Each appointment to the authority shall be made by the mayor subject to approval by majority vote of the entire city council. The term of office of each member shall be five (5) years. Any member who shall change his personal residence to an address outside the city or outside the district he represents shall cease to be a member of the authority and his seat shall automatically.be deemed vacant as of the date on which he ceased to be a resident of the city or of the district. A member whose term has expired shall continue to hold office until his successor has been appointed and has qualified. Terms of office shall be staggered so that the term of at least one (1) member shall expire each year. The city council may appoint any number of ex- officio nonvoting members to serve for terms at the pleasure of the city council. Section 2.Safety Clause The City Council hereby finds, determines, and decidres that this Ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the Ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severability: Conflictinq Ordinances Repealed If any section, subsection or clause of this ordinance shall be deemed to be unconstitutional or otherwise invalid, the validity of the remaining sections, subsections and clauses shall not be affected thereby. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. Effective Date This Ordinance shall take effect fifteen days after final publication, as provided by Section 5.11 of the Charter. This section of the Code currently requires that the Authority consist of eleven members; two from each Council district and three at- large. One of the at -large members shall be a member of City Council. Members are appointed by the Mayor and approved by a majority vote of City Council. Members are appointed for five -year terms. Under the proposed ordinance, the membership would be changed to eight members; one from each Council district and three at- large. One of the at -large members may be a Council member. All other provisions concerning the appointment of members would remain unchanged. COMMISSION/BOARD RECOMMENDATION: None. STATEMENT OF THE ISSUES: The appointment of eleven members has been problematic from two standpoints. One, the Mayor has had a difficult time finding people to appoint when positions become vacant. There are currently three positions vacant and the Authority is operating with eight members. Two, quorum requirements for meetings have been difficult to meet with eleven members. The Authority oftentimes needs to meet on short notice and a smaller membership increases the possibility of obtaining a quorum. ALTERNATIVES CONSIDERED: Total of five members; one from each Council district and one at large. FINANCIAL IMPACT: None. RECOMMENDED MOTION: "I move to approve Council Bill No. 43 -2003 on second reading."
