Section 5 -76 of the Uniform Building Code, inclusive of the Code of Laws of the City of Wheat Ridge is hereby amended as follows: Article III. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severability. If any clause, sentence, paragraph, or part of this Zoning Code or the application thereof to any person or circumstances shall for any reason be adjusted by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section 4. Supersession Clause. If any provision, requirement or standard established by this Ordinance is found to conflict with similar provisions, requirements or standards found elsewhere in the Code of Laws of the City of Wheat Ridge, which are in existence as of the date of adoption of this Ordinance, the provisions, requirements and standards herein shall supersede and prevail. Section 5. This ordinance shall take effect 15 days after final publication. EXECUTIVE SUMMARY: This ordinance is to amend Table 1 -A, 'Building Permit Fees” as adopted in the 1997 edition of the Uniform Building Code. This table is typically adjusted every three years as part of the three year building code cycle. 1997 was the last year of the Uniform Building Code and in 2000 all of the model code organizations joined to create the 2000 International Codes. This code edition no longer has a building permit fee table, leaving all fee tables to be determined by the jurisdiction. FINANCIAL IMPACT: As proposed, the dollar figures indicated in the 1997 Edition of Table 1 -A will increase by thirty (30) percent. Actual fees collected including plan review fee and use tax will increase between 13% for a one million dollar building project and 23% for a five thousand dollar building project. Based on historic revenues and possible building projects proposed for 2003, this would increase building permit revenues approximately 15 percent or $142,000 in 2003. COMMISSION/BOARD RECOMMENDATION: None. PROJECT HISTORY: None. STATEMENT OF THE ISSUES: Since 1979, Tablet -A has increased every seven year cycle except one. For example, 1979 UBC Edition to 1985 UBC Edition (7 year cycle), fee table increased 44 %; 1985 UBC Edition to 1991 UBC Edition (7 year cycle), fee table increased 0 %; 1991 UBC Edition to 1997 UBC Edition (7 year cycle), fee table increased 57 %. This ordinance would increase the 1997 UBC Edition to 2003 proposed fee schedule (7 year cycle) 30% with actual revenues being increased 13 - 25% including use tax and plan review fees if applicable. This ordinance is also being proposed to offset personnel costs associated with building permit review, issuance, and inspections which have increased approximately 35% since 1998. After the flat rate alternate was considered, staff has found the existing Table 1 -A format reflects a more realistic building permit fee versus construction valuation ratio based on actual time spent by city staff to review building projects. Staff recommends this fee schedule. ALTERNATIVES CONSIDERED: Staff has performed calculations on a flat rate percentage based on the current Table 1 -A and has found that if a flat rate of 1.89% of construction valuation is used to determine permit fees, the city would lose revenue on permits with a valuation of $10,000 and less. Building permit fees for a $100,000 project would double and projects of $500,000 and greater would triple current fees being assessed. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severability. If any clause, sentence, paragraph, or part of this Zoning Code or the application thereof to any person or circumstances shall for any reason be adjusted by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section 4. Supersession Clause. If any provision, requirement or standard established by this Ordinance is found to conflict with similar provisions, requirements or standards found elsewhere in the Code of Laws of the City of Wheat Ridge, which are in existence as of the date of adoption of this Ordinance, the provisions, requirements and standards herein shall supersede and prevail. Section 5. This ordinance shall take effect 15 days after final publication.
