TITLE: AN ORDINANCE AMENDING AND ADOPTING THE 2002
NATIONAL ELECTRICAL CODE AND ADOPTED IN
CHAPTER 5 OF THE CODE OF LAWS OF THE CITY OF
WHEAT RIDGE, RELATING TO BUILDINGS AND
BUILDING REGULATIONS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO,THAT:
Section 1. Section 5 -77 of the National Electrical Code, inclusive of the Code of Laws of
the City of Wheat Ridge is hereby amended as follows:
(a) Adopted. The National Electrical Code, 199-3 2002 Edition, copyright by the
National Fire Protection Association, Batterymarch Park, Quincy, Massachusetts, 02269,
is hereby adopted by reference thereto and incorporated into this chapter as though fully
set out herein as the electrical code of the city. Except as otherwise provided in this
chapter, such code is adopted in full, including the index and appendix contained therein.
One copy of said National Electrical Code shall be filed in the office of the city clerk and
may be inspected during regular business hours.
(b) Amendments. The National Electrical Code, adopted by this section is hereby
amended as follows (section numbers refer to section numbers of the National Electrical
Code):
Section 31-0 -2(b) 310.2(b)is amended by adding a new sentence to read:
"Aluminum conductors under size 8 are not allowed."
Section 336-5, 334.12, "Uses Not Permitted," is amended by the addition of the following
paragraph (e) (B):
"(e) (B) These types shall not be used in any group A, B, E, F, H, I, M, or S or R -1
occupancy (as defined in the Uniform Building Code, 1997 Edition)."
Section 2. Previous Amendments. All previous amendments to Section 5 of the Code of
Laws shall remain in effect unless otherwise amended as part of this ordinance.
Section 3. Safety Clause. The City Council hereby finds, determines, and declares that
this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it
is promulgated for the health, safety, and welfare of the public and that this ordinance is
necessary for the preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a rational relation to
the proper legislative object sought to be attained.
Section 4. Severability. If any clause, sentence, paragraph, or part of this Zoning Code
or the application thereof to any person or circumstances shall for any reason be adjusted by a
court of competent jurisdiction invalid, such judgment shall not affect application to other
persons or circumstances.
Section 5. Supersession Clause. If any provision, requirement or standard established by
this Ordinance is found to conflict with similar provisions, requirements or standards found
elsewhere in the Code of Laws of the City of Wheat Ridge, which are in existence as of the date
of adoption of this Ordinance, the provisions, requirements and standards herein shall supersede
and prevail.
Section 6. This ordinance shall take effect 15 days after final publication.

circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set

RECOMMENDED ACTION:
I move to approve Council Bill No.01 -2003, on second reading, adopting the 2002 National Electrical
Code.
EXECUTIVE SUMMARY:
This ordinance is to adopt the 2002 edition of the National Electrical Code. This code edition and its
amendments were reviewed and accepted by the Building Code Advisory Board in a recent meeting. This
edition of the NEC was recently adopted by the State of Colorado Electrical Board.
FINANCIAL IMPACT:
There will be no financial impact by the adoption of this code edition.
COMMISSIONBOARD RECOMMENDATION:
The Building Code Advisory Board has reviewed and approved the proposed code edition and
amendments.
PROJECT HISTORY:
This edition of the code is part of the traditional three year cycle of nationally recognized life safety codes.
STATEMENT OF THE ISSUES:
This code is being adopted to ensure all life safety and installation requirements related to electrical
installations are installed per the most recent safety standards and regulations. Adoption is also to keep
current and consistent with the most current adopted code enforced by the State of Colorado Electrical
Board.
ALTERNATIVES CONSIDERED:
None at this time.

I move to approve Council Bill No. , an ordinance adopting the 2002 National Electrical Code
on first reading, ordered published, and set the public hearing for February 10, 2003, at 7:00 p.m. in the
City Council Chambers.
EXECUTIVE SUMMARY:
This ordinance is to adopt the 2002 edition of the National Electrical Code. This code edition and its
amendments were reviewed and accepted by the Building Code Advisory Board in a recent meeting. This
edition of the NEC was recently adopted by the State of Colorado Electrical Board.
FINANCIAL IMPACT:
There will be no financial impact by the adoption of this code edition.
