Tom Atkins, 1110 17" Street, Golden, member of Citizens Involved in the Northwest Quadrant,
(CINQ). They are not convinced that a beltway is the solution to the transportation problems;
solutions must be developed by a cooperative, comprehensive regional planning process; they
support the feasibility study that is being done, particularly Phase ll; Phase I is sort of a flawed
Phase and some of the assumptions in it are not well thought out.
PUBLIC HEARINGS AND ORDINANCES ON SECOND READING
Item 1. Council Bill 9 - An Ordinance amending Chapter 5 of the Code of Laws of the
City of Wheat Ridge, relating to Buildings and Building Regulations. ( (Case No.
"WAR
Council Bill 9 was introduced on second reading by Mr. DiTullio, who also read the title and
summary; Ordinance No. 1163 was assigned by the Clerk.
Darin Morgan, Codes Administrator, was sworn in by the Mayor and briefed Council on the
proposed changes.
The following speakers were sworn in by the Mayor:
Odarka Figlus, 9775 West 36" Avenue, spoke against the Ordinance and asked that Council
vote against it; asked that Council appoint a task force of selected citizenry and come up with
compromises.
Phil Plummer, 10398 West 41 Avenue, spoke in opposition; he owns rental properties and he
can't believe that he would be in violation of the code if he replaces a hot water heater in one
of his units.
Motion by Mr. DiTullio to adopt Council Bill 9 (Ordinance 1163), approving amendments to the
City of Wheat Ridge's Code of Laws, Chapter 5, regarding Buildings and Building Regulations;
seconded by Mr. Siler.
Motion by Mrs. Dalbec to make an amendment under Section 5 -34 (1) to remove the words
"and resides in "; seconded by Mr. DiTullio; carried 8 -0.
Motion by Mrs. Worth to make an amendment under Section 5-43 (d)(1) lower the 10 -plex to
"4- plex"; seconded by Mr. DiTullio; carried 8 -0.
Motion by Mrs. Shaver to make an amendment under Section 5.77 (d) to leave the currently
stricken word "electrical'; seconded by Mrs. Dalbec; carried 5 -3 with Councilmembers Siler,
Mancinelli, and DiTullio voting no.
Vote on original motion as amended carried 8 -0.

Item 1. Council Bill 9 - An Ordinance amending Chapter 5 of the Code of Laws of the
City of Wheat Ridge, relating to Buildings and Building Regulations
(WCA- 99 -01)
Council Bill 9 was introduced on second reading by Mr DiTullio, who also read the title and
summary
Darin Morgan, Codes Administrator, distributed copies of revised statutes and presented staff
report.
Motion by Mr DiTullio that Council Bill 9 be postponed until June 28, 1999 Council Meeting,
seconded by Mr Mancinelli, carried 6 -0
Motion by Mr DiTullio to reconsider his motion to postpone to allow the public to speak;
seconded by Mr Donnelly; carried 6 -0
Odarka Figlus, 9775 West 36` Avenue, was sworn in by the Mayor; she suggested that the
Ordinance be worded very clearly so that people would not need to call up and ask for an
interpretation of what it means, she also questioned the wisdom of requiring a licensed
contractor for small rental properties, addressed the cost of needing a permit to change
something on a sign, such as a telephone number This will be a burden for small businesses
Motion by Mr DiTullio to postpone Council Bill 9 until the June 28 Council Meeting, seconded
by Mr Mancinelli
Motion by Mrs Shaver to amend to change the hearing date until after Council Bill 9 has been
discussed at a Study Session, seconded by Mrs Dalbec.
Motion by Mrs Worth to amend the amendment to hold the second reading at the second
regular meeting in July; seconded by Mrs Dalbec, carried 6 -0

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO,THAT:
Section 1: Sections 5 -34 through 5 -81 of the Code of Laws of the City of Wheat Ridge
are hereby amended as follows:

ARTICLE HI. TECHNICAL CODES
Sec. 5 -34. Authorized applicants.
Only persons duly licensed under the terms and provisions of this chapter may apply for a
permit, and such licensees may apply for and be issued permits to perform only such work as
they are entitled to perform under their respective licenses. Any application for a permit filed in
derogation of this chapter shall be deemed to have been filed with fraudulent intent and shall be a
mdiity. considered null and void. Notwithstanding the foregoing and in addition thereto, the
following persons shall be deemed to be authorized applicants:
(1) Any person who owns a group I R building may make application for permit to
enlarge, remodel, alter, repair, improve, convert or demolish such building. Upon
issuance of a permit hereunder all such work authorized shall be performed
personally only by such person and shall be performed in accordance with all the
requirements of this chapter.
Sec. 5 -42. House moving permits.
(b) Each house moving permit shall be assessed a one hundred dollar ($100.00)
processing fee for issuance of the permit which shall be due and payable at time of application
for the permit. In addition to the processing fee, the permittee shall provide a five hm dred-dellar
089;999) a fifteen thousand dollar ($15,000.00) bond or insurance certificate or other suitable
security to the city as a guarantee to the city that any damages to public improvement; are
repaired to new condition.
Sec. 5 -43. Drawings and specifications
(d) Disposal after final inspection. After final inspection has been made upon completion
of the work approved in a set of drawings and specifications, the division copy of such
drawings and specifications shall be disposed of in the following manner:
(1) All drawings and specifications pertaining to commercial, residential (4 -plex or
larger), and city -owned buildings, structures or utilities shall be kept in a
permanent file.
(2) 6tIter Residential drawings and specifications may be disposed of at any time
after twe (2) years leave 180 days has elapsed from the date of issuance of the
permit Certificate of Occupancy.
Sec. 5 -77. National Electric Code
Sub - Section 336 -4 5, Uses Not Permitted
"(c) These types shall not be used in any group A, B, E, H, I, R+,, or S or p4
occupancy (as defined in the Uniform Building Code, 4994 1997 Edition."
(c) Purpose. The purpose of this section is to provide minimum standards to safeguard
life or limb, health, property, and public welfare by regulating and controlling the design,
construction, quality of materials, use and occupancy, location and maintenance of all buildings,
structures and utilities and certain equipment specifically regulated herein.
(d) Electrical permit fees. Electrical permit fees as governed by the state eleetrieal -board
shall be as follows: All fees, , ;.hall be
computed on the dollar value of the electrical installation, including time and material (total cost
to the customer) and such fees shall be computed based upon the _l f _true...__
published by the State of Gelarade Section 107 and Table 1 -A of the Uniform Building Code
at time of obtaining the permit.
Sec. 5 -81. Sign and wrecking permit fees.
(a) Sign fees shall be fifteen dollars ($15.00) per sign for ej single or
double face changes only. All new or replacement signs shall have fees based on the
valuation of the installation (total cost to the customer) and such fees shall be computed
based on Section 107 and Table 1 -A of the Uniform Building Code. Wrecking permit fees
shall be teit dellafs (S 19.90) fifty dollars (550.00) per address.
Section 2. Previous Amendments. All previous amendments to Section 5 of the Code
of Laws shall remain in effect unless otherwise amended as part of this ordinance.
Section 3. Vested Property Rights. Approval of these Amendments to the Uniform
Building Code and adoption of these into the Code of Laws of the City of Wheat Ridge by
reference, does not create a vested property right. Vested property rights may only arise and
accrue pursuant to the provisions of Section 26(c) of Appendix A and the Code of Laws of the
City of Wheat Ridge.
Section 4. Safety Clause. The City Council hereby finds, determines, and declares that
this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it
is promulgated for the health, safety, and welfare of the public and that this ordinance is
necessary for the preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a rational relation to
the proper legislative object sought to be attained.
Section 5. Severability. If any clause, sentence, paragraph, or part of this- g C
or the application thereof to any person or circumstances shall for any reason be adjusted by a
court of competent jurisdiction invalid, such judgment shall not affect application to other
persons or circumstances.
Section 6. Supersession Clause. If any provision, requirement or standard established
by this Ordinance is found to conflict with similar provisions, requirements or standards found
elsewhere in the Code of Laws of the City of Wheat Ridge, which are in existence as of the date
of adoption of this Ordinance, the provisions, requirements and standards herein shall supersede
and prevail.
Section 7. This ordinance shall take effect 15 days after final publication.

Sean McCartney was sworn in by the Mayor and presented the staff report.
Motion by Mr. Eafanti that Council Bill 2 (Ordinance 1152), Case No. WV- 99 -01, an application
for approval of a right -of -way vacation of an unused portion of West 40" Avenue -
(approximately 10000 West 40'" Avenue) be approved for the following reasons: 1. The
property has never been developed and used only to access one home which is no longer
there. 2. The Public Works Department does not see any future needs for the ROW for future
use. 3. The request will not hinder the future improvements established on the Wheat Ridge
Comprehensive Plan. 4. Staff recommends approval; seconded by Mrs. Shaver; carried 8 -0.

Buildings and Building Regulations

The attached amendment to the Code of Laws is being brought to you to correct errors,
provide clarification and to update wrecking permit fees and house moving bond requirements which
are outdated.
Section 5 -34, is being amended for clarity and to correct an error in the current code, the statement
"and resides in" is being added to prohibit landlords and owners of commercial
property from performing alterations without using licensed contractors. This is to --
assure licensed professionals are used in order to protect tenants and the general
public, who occupy, commercial and rental properties. Homeowners who live in
their homes will still be able to obtain permits to perform construction on their own
homes.
Section 5 -42, is being amended to correct a typographical error in the current code and to update
bond requirements to cover damage done to public property while a house is being
moved. You will also find a memo attached from Dave Kotecki, Sr. Project Engineer
explaining the need for the change.
Section 5 -43, is being amended clarify what building plans need to be kept permanently and what
plans can be discarded and when. Changes meet the "Guidelines for the Retention
of Municipal Records of Colorado" as put out by the Colorado Municipal League.
Section 5 -77, is being amended to correct an error in the current code and to establish that Section
107 and Table l -A of the Building Code are to be used to establish electrical permit
fees.
Section 5 -81, is being amended to clarify how fees are determined for new signs and to clarify that
the current $15.00 fee is for face changes only. This section also amends fees for
wrecking (demolition) permit fees to cover staff time to process these permits. The
$50.00 fee is consistent with neighboring jurisdictions contacted.

I have reviewed the proposed amendment to Section 5 -42 of the Uniform Building Code which changes
the security amount for a house permit from $500 to $15,000.
I believe that it is in the best interest of the City to increase the security amount to $15,000 and I agree with
the change. From my one experience with a building moving operation, an accident can result in
significant damage to public facilities. Any damage to the street pavement, traffic signal facilities or
overhead utilities will certainly exceed $500. In the case of traffic signal poles and controller equipment,
the cost could exceed $10,000.
I recommend that the change in the security amount for house moving permits be increased to $15,000.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO,THAT:

are hereby amended as follows:

ARTICLE III. TECHNICAL CODES
Sec. 5 -34. Authorized applicants.
Only persons duly licensed under the terms and provisions of this chapter may apply for a
permit, and such licensees may apply for and be issued permits to perform only such work as
they are entitled to perform under their respective licenses. Any application for a permit filed in
derogation of this chapter shall be deemed to have been filed with fraudulent intent and shall be a
nullity considered null and void. Notwithstanding the foregoing and in addition thereto, the
following persons shall be deemed to be authorized applicants: .
(1) Any person who owns and resides in a group f R building may make application
for permit to enlarge, remodel, alter, repair, improve, convert or demolish such
building. Upon issuance of a permit hereunder all such work authorized shall be
performed personally only by such person and shall be performed in accordance
with all the requirements of this chapter.
Sec. 5 -42. House moving permits.
(b) Each house moving permit shall be assessed a one hundred dollar ($100.00)
processing fee for issuance of the permit which shall be due and payable at time of application
for the permit. In addition to the processing fee, the permittee shall provide
f5500,e j a fifteen thousand dollar ($15,000.00) bond or insurance certificate or other suitable
security to the city as a guarantee to the city that any damages to public improvements are
repaired to new condition.
Sec. 5 -43. Drawings and specifications
(d) Disposal after final inspection. After final inspection has been made upon completion
of the work approved in a set of drawings and specifications, the division copy of such
drawings and specifications shall be disposed of in the following manner:
(1) All drawings and specifications pertaining to commercial and city -owned
buildings, structures or utilities shall be kept in a permanent file.
(2) Ether Residential drawings and specifications may be disposed of at any time
after twcr�a 180 days has elapsed from the date of issuance of the
permit- Certificate of Occupancy.
Sec. 5 -77. Natibnal Electric Code
Sub - Section 336 -4 S, Uses Not Permitted
"(c) These types shall not be used in any group A, B, E, H, 1, R3-, or S or U
occupancy (as defined in the Uniform Building Code, +994 1997 Edition.
(c) Purpose. The purpose of this section is to provide minimum standards to safeguard
life or limb, health, property, and public welfare by regulating and controlling the design,
construction, quality of materials, use and occupancy, location and maintenance of all buildings,
structures and utilities and certain equipment specifically regulated herein..
(d) Electrical permit fees. Electrical permit fees
shall be as follows: All fees, shall be
computed on the dollar value of the electrical installation, including time and material (total cost
to the customer) and such fees shall be computed based upon tiro clectii,mrfcc si,actvrc
published by the Statc Section 107 and Table 1 -A of the Uniform Building Code
at time of obtaining the permit.
Sec. 5 -81. Sign and wrecking permit fees.
(a) Sign fees shall be fifteen dollars ($15.00) per sign for '(single or double facc) single or
double face changes only. All new or replacement signs shall have fees based on the
valuation of the installation (total cost to the customer) and such fees shall be computed
based on Section 107 and Table 1 -A of the Uniform Building Code. Wrecking permit fees
shall be tert dollus ($10.0e) fifty dollars (550.00) per address.
Section 2. Previous Amendments. All previous amendments to Section 5 of the Code
of Laws shall remain in effect unless otherwise amended as part of this ordinance.
Section 3. Vested Property Rights. Approval of these Amendments to the Uniform
Building Code and adoption of these into the Code of Laws of the City of Wheat Ridge by
reference, does not create a vested property right. Vested property rights may only arise and
accrue pursuant to the provisions of Section 26(c) of Appendix A and the Code of Laws of the
City of Wheat Ridge.
Section 4. Safety Clause. The City Council hereby finds, determines, and declares that
this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it
is promulgated for the health, safety, and welfare of the public and that this ordinance is
necessary for the preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a rational relation to
the proper legislative object sought to be attained.
Section 5. Severability. If any clause, sentence, paragraph, or part of this Zoning Code
or the application thereof to any person or circumstances shall for any reason be adjusted by a
court of competent jurisdiction invalid, such judgment shall not affect application to other
persons or circumstances.
Section 6. Supersession Clause. If any provision, requirement or standard established
by this Ordinance is found to conflict with similar provisions, requirements or standards found
elsewhere in the Code of Laws of the City of Wheat Ridge, which are in existence as of the date
of adoption of this Ordinance, the provisions, requirements and standards herein shall supersede
and prevail.
Section 7. This ordinance shall take effect 15 days after final publication.
